The January 6 committee has concluded for the day, but before they finished, they revealed a key piece of information about the conduct of John Eastman, the lawyer who crafted former president Donald Trump’s strategy to overturn the election in 2020.
Eastman sought a pardon from Trump in the closing days of his presidency, writing to Rudy Giuliani, another lawyer for the president, “I’ve decided that I should be on the pardoned list, if that is still in the works.” The committee added that he did not receive one.
Eastman’s actions were covered in detail at today’s hearing, particularly his efforts to convince Mike Pence that his position as vice-president gave him the authority to hand the election to Trump when Congress met to certify on January 6, 2021. Pence declined to do that.

There was much focus on the intensity of the effort by President Trump to pressure Vice President Pence to block the electoral count, including a heated phone call between the two. Also evidence linking a Jan. 6 tweet by the president castigating Pence for failing to act to a surge in intensity from the mob at the Capitol. And a steady stream of debunking of the theory that the vice president had any authority in the first place.

There is that Federal law what states that any President whose Vice President is within 100 feet of rioters can be charged with whatever crimes that the opposing Party wants to charge him with.
Eastman is the Trump ally and lawyer who penned what had been dubbed the “coup memo,” a six-step plan to overturn Joe Biden‘s win in the 2020 presidential election. As the committee hearings have revealed, several people close to Trump told him that Eastman’s theory was not supported by law. Eastman himself acknowledged that he would lose 9-0 before the Supreme Court, Mike Pence’s lawyer Greg Jacob told the Committee.
Herschmann testified that he gave Eastman unprompted legal advice.
“Get a great effing criminal defense lawyer,” Herschmann recounted. “‘You’re going to need it.’ And then I hung up on him.”
Eastman emailed Giuliani days later, Rep. Pete Aguilar (D-Calif.) said at Thursday’s committee hearing.
“Dr. Eastman did not receive his presidential pardon,” Aguilar noted. He then ran a compilation tape from Eastman’s deposition before the Jan. 6 committee, in which Eastman apparently invoked his Fifth Amendment right against self-incrimination more than 100 times.
“A Coup in Search of a Legal Theory”
While it’s unclear whether Herschmann’s advice spurred Eastman to hire a lawyer, his decision to refuse to answer questions from the Jan. 6 committee may stem from a ruling in the very lawsuit he filed against the committee in an effort to avoid testifying.
In that ruling, which allowed the committee to access more than 100 communications Eastman claimed were privileged, U.S. District Judge David O. Carter said that it was “more likely than not” that Trump tried to “corruptly” overturn the results of the 2020 presidential election. Carter found that Trump and Eastman “likely” violated two federal statutes: obstruction of an official proceeding and conspiracy to defraud the United States.
The illegality of the plan was obvious,” Carter, a Bill Clinton appointee, wrote in a scathing 44-page order. “Our nation was founded on the peaceful transition of power, epitomized by George Washington laying down his sword to make way for democratic elections. Ignoring this history, President Trump vigorously campaigned for the Vice President to single-handedly determine the results of the 2020 election. As Vice President Pence stated, ‘no Vice President in American history has ever asserted such authority.’ Every American—and certainly the President of the United States—knows that in a democracy, leaders are elected, not installed. With a plan this ‘BOLD,’ President Trump knowingly tried to subvert this fundamental principle.”
Carter zeroed in on Eastman’s efforts as well, linking them directly to the former president.
“Dr. Eastman and President Trump launched a campaign to overturn a democratic election, an action unprecedented in American history,” Carter wrote. “Their campaign was not confined to the ivory tower—it was a coup in search of a legal theory. The plan spurred violent attacks on the seat of our nation’s government, led to the deaths of several law enforcement officers, and deepened public distrust in our political process.”

USA Today removes 23 articles after reporter Gabriela Miranda fabricated sources
USA Today said it has deleted 23 articles from its website after an investigation found that the reporter who wrote them used fabricated sources.
The journalist who is said to have used the fabricated sources was identified as Gabriela Miranda, a breaking news reporter who resigned from the Virginia-based newspaper weeks ago, the paper confirmed Thursday.
Miranda’s most recent news story for USA Today is dated April 17.
According to the bio on her website, Miranda was assigned to cover “trending news nationwide” while at USA Today.

Appointed to the federal bench by George W. Bush, Luttig spent 15 years as a federal appellate court judge and was shortlisted—but never tapped—for the U.S. Supreme Court. He was known as a “feeder judge” because his clerks typically went on to serve conservative justices, and he personally clerked for the late Antonin Scalia.
With his lacerating testimony on Thursday, Luttig cements his place one of Trump’s harshest critics among the legal luminaries of the right. The speech does not mention the 45th president by name but makes unmistakable his belief that Trump “instigated and prosecuted” no less than an assault on U.S. democracy.
“In fact, January 6 was a separate war unto itself, a war for America’s democracy, a war irresponsibly instigated and prosecuted by the former president, his political party allies, and his supporters,” Luttig wrote. “Both wars are raging to this day
Trump's lawyer John Eastman, the author of the so-called “coup memo,” had been a point person in the plot to pressure Pence to purport to block certification of the election. Jacob’s resistance to that plan came into focus in an email correspondence with Eastman on the day of the attack.
“[T]hanks to your bullshit, we’re now under siege,” Jacob fired off in a blistering email on Jan. 6 at 12:14 p.m.
Jacob did not hold back in his prepared remarks, either.
“The law is not a plaything for Presidents or judges to remake the world in their preferred image,” he wrote.
Though a group of conservative attorneys reportedly advised him—so-called “torture memo” author and University of California at Berkeley Professor John Yoo was one—Pence credited the father of the U.S. Constitution with the most profound advice, according to Jacob.
“When asked last year by a student at an event at the University of Iowa to name the person who told him he was required to certify the 2020 election, the Vice President accurately answered: James Madison,” Jacob noted.
Quoting another icon of U.S. history, Jacob turned to Alexander Hamilton’s statement that the Constitution does not make the “appointment of the President to depend on any preexisting bodies of men,” whom he warned might be subject to “cabal, intrigue or corruption.”
He emphasized that sentiment in his oral testimony to the committee.
Aguilar said that the committee’s investigation found that the crowd of rioters were within 40 feet of Pence inside the Capitol at one point.
“Approximately 40 feet. That’s all there was. Forty feet between the vice president and the mob,” he said. “Make no mistake about the fact that the vice president’s life was in danger.”
The committee also played videos of the mob chanting, “Hang Mike Pence.”
The crowd surged when Trump tweeted his anger at Pence.
Aguilar also said they found evidence that the mob got more out of control when Trump tweeted mid-riot: “Mike Pence didn’t have the courage to do what should have been done,” referring to his refusal to throw out the election results.
“Our investigation found that immediately after the president’s 2:24 p.m. tweet, the crowds both outside the Capitol and inside the Capitol surged,” Aguilar said, adding that Pence then had to be moved to a secure location.
The committee aired testimony from White House staffers who said that was exactly what they feared might happen. Deputy press secretary Sarah Matthews said that after staff urged Trump to tweet something that would calm the crowd, he instead tweeted his attack on Pence.
“The situation was already bad, so it felt like he was pouring gasoline on the fire by tweeting that,” she said.
The Jan. 6 select committee on Thursday presented evidence that top Trump allies in the administration, the campaign and the media were well aware his plans to overturn the election had no legal basis.
Why it matters: The committee is using the hearings to make a comprehensive case for Trump's culpability in the attack on the Capitol as the Justice Department watches closely.
Driving the news: In both live and pre-recorded testimony, onetime aides to former President Trump and former Vice President Mike Pence described the pressure campaign on Pence and how Trump's closest allies raised doubts there was any legal or historical justification.
Specifically they doubted a theory, championed by conservative legal scholar John Eastman and embraced by Trump, that Pence had the authority to unilaterally reject electors.

Section 4 provides that “whenever the Vice President and a majority of … the principal officers of the executive departments” declare that the president is unable to discharge the duties of his office, “the Vice President shall immediately assume the powers and duties of the office as Acting President.” We already know from published reports that Trump’s Cabinet considered invoking this provision in the aftermath of the Jan. 6 attack. Treasury Secretary Steven Mnuchin and Secretary of State Mike Pompeo discussed it. Labor Secretary Eugene Scalia called an aide to Pence to say that the Cabinet had to do something to keep the president in check. Just last week, Trump’s education secretary, Betsy DeVos, said she raised with Pence the possibility of triggering the 25th Amendment — but Pence said he’d have nothing of it. She then resigned.

During Monday’s House select committee hearing on the Jan. 6 attack on the U.S. Capitol, former Trump administration Attorney General William Barr discredited a conspiracy-driven film that makes dubious claims about widespread fraud in the 2020 election. Barr’s rebuke of the “2000 Mules” comes only days after Sen. Mike Lee gave a tacit endorsement of the film, which other Utah Republicans have shown at campaign events.
In the film “2000 Mules,” conservative pundit Dinesh D’Souza theorizes that non-profit groups paid volunteers — who are compared to drug “mules” — in five states to “harvest” hundreds or even thousands of ballots in 2020 and deposit them into ballot boxes. The film uses anonymized cell phone data to track when people came near those drop-off points, which allegedly backs up D’Souza’s claim.
The film claims “ballot trafficking” was widespread enough to rig the 2020 election for Joe Biden.
In taped testimony, Barr says he watched the film with an open mind, but it failed to deliver on those claims, even chuckling when he brought up the movie.
“My opinion is that the election was not stolen by fraud, and I haven’t seen anything since the election that changes my mind on that, including the ‘2000 Mules’ movie,” the former attorney general said during his testimony.
Barr called the analysis of the data in the film “singularly unimpressive.”
“The premise, if you go by five boxes or whatever it was, that that’s a mule is just indefensible. The photographic evidence was lacking. It didn’t establish widespread harvesting,” Barr said.
“If you take two million cell phones and figure out where they are physically in a big city like Atlanta or wherever, just by definition, you’re going to find many hundreds of them have passed by and spent time in the vicinity of these boxes. The premise that’s a ‘mule’ is just indefensible,” Barr added.
“2000 Mules” has been thoroughly debunked, with experts casting doubt on several claims.
Barr added even if it were to prove allegations of ballot harvesting, there’s no proof it would have changed the election results.
“People don’t understand that even if you show harvesting, that it doesn’t change the results of the election. The courts are not going to throw out votes and then figure out what votes were harvested,” Barr said.
During his testimony, Barr said he told former President Trump that his election fraud claims were false, but Trump wasn’t interested in hearing that.
“I thought, boy, if he really believes this stuff, he has lost contact with — he’s become detached from reality,” Barr said.

The hearing concluded ominously, with a warning from Luttig that the same forces continue to threaten American democracy.
Trump and his allies remain “clear and present danger to American democracy,” Luttig told the panel, not because of what happened on January 6 but because of their determination to “succeed in 2024 where they failed in 2020”.
WASHINGTON — Justice Department officials have renewed their request for the House select committee investigating the Jan. 6 attack on the U.S. Capitol to turn over transcripts of witness depositions, saying that the documents are "critical" to its sprawling investigation.
“It is now readily apparent that the interviews the Select Committee conducted are not just potentially relevant to our overall criminal investigations, but are likely relevant to specific prosecutions that have already commenced,” read a letter sent to the committee on Wednesday.
“Given this overlap, it is critical that the Select Committee provide us with copies of the transcripts of all its witness interviews."
The letter was signed by Matthew Graves, U.S. attorney for Washington, D.C., Kenneth Polite, assistant attorney general of the DOJ's Criminal Division, and Matthew Olsen, assistant attorney general for department's National Security Division.
Grand jury investigations are not public, the officials wrote, which means the committee "does not and will not know the identity of all the witnesses who have information relevant to the Department's ongoing criminal investigations."
It is "critical that the Department be able to evaluate the credibility of witnesses who have provided statements to the multiple governmental entities in assessing the strength of any potential criminal prosecutions," they wrote, adding that failure to grant the DOJ access to these transcripts would complicate its ability to investigate and prosecute rioters.

Pence, and his refusal to use his ministerial role in certifying the election to overturn it, was central to Thursday’s hearing. Obviously, that campaign failed. But the likelihood of a “paralyzing constitutional crisis” and fighting in the streets was discussed soberly during the hearings. That the US managed to avoid both, the committee argued, was thanks to “Pence’s courage.
Trump and Eastman were co-conspirators. Recall that when a federal judge recently posited that laws were broken in connection with Jan. 6, he asserted that both Trump and Eastman may have committed crimes.
In those court papers, the judge wrote that they may have committed “conspiracy to defraud the United States.” He suggested they enter into an agreement to obstruct a lawful function of government — Congress’s counting of electoral votes — and that both “likely knew” the plan was an illegal violation of the Electoral Count Act of 1887. Corrupt pressure on Pence may have constituted the requisite “act” in furtherance of that conspiracy.

Eastman is the Trump ally and lawyer who penned what had been dubbed the “coup memo,” a six-step plan to overturn Joe Biden‘s win in the 2020 presidential election. As the committee hearings have revealed, several people close to Trump told him that Eastman’s theory was not supported by law. Eastman himself acknowledged that he would lose 9-0 before the Supreme Court, Mike Pence’s lawyer Greg Jacob told the Committee.
Herschmann testified that he gave Eastman unprompted legal advice.

Carter said that it was “more likely than not” that Trump tried to “corruptly” overturn the results of the 2020 presidential election. USA Today said it has deleted 23 articles from its website after an investigation found that the reporter who wrote them used fabricated sources.
The journalist who is said to have used the fabricated sources was identified as Gabriela Miranda, a breaking news reporter who resigned from the Virginia-based newspaper weeks ago, the paper confirmed Thursday.
Miranda’s most recent news story for USA Today is dated April 17.

A stake was driven through the heart of American democracy on Jan. 6, 2021, and our democracy today is on a knife’s edge,” retired Judge J. Michael Luttig’s excoriating prepared remarks began.
Appointed to the federal bench by George W. Bush, Luttig spent 15 years as a federal appellate court judge and was shortlisted—but never tapped—for the U.S. Supreme Court. He was known as a “feeder judge” because his clerks typically went on to serve conservative justices, and he personally clerked for the late Antonin Scalia.
With his lacerating testimony on Thursday, Luttig cements his place one of Trump’s harshest critics among the legal luminaries of the right. The speech does not mention the 45th president by name but makes unmistakable his belief that Trump “instigated and prosecuted” no less than an assault on U.S. democracy.
“In fact, January 6 was a separate war unto itself, a war for America’s democracy, a war irresponsibly instigated and prosecuted by the former president, his political party allies, and his supporters,” Luttig wrote. “Both wars are raging to this day
Trump's lawyer John Eastman, the author of the so-called “coup memo,” had been a point person in the plot to pressure Pence to purport to block certification of the election. Jacob’s resistance to that plan came into focus in an email correspondence with Eastman on the day of the attack.
“[T]hanks to your bullshit, we’re now under siege,” Jacob fired off in a blistering email on Jan. 6 at 12:14 p.m.
Jacob did not hold back in his prepared remarks, either.
“The law is not a plaything for Presidents or judges to remake the world in their preferred image,” he wrote.
Though a group of conservative attorneys reportedly advised him—so-called “torture memo” author and University of California at Berkeley Professor John Yoo was one—Pence credited the father of the U.S. Constitution with the most profound advice, according to Jacob.
“When asked last year by a student at an event at the University of Iowa to name the person who told him he was required to certify the 2020 election, the Vice President accurately answered: James Madison,” Jacob noted.
Quoting another icon of U.S. history, Jacob turned to Alexander Hamilton’s statement that the Constitution does not make the “appointment of the President to depend on any preexisting bodies of men,” whom he warned might be subject to “cabal, intrigue or corruption.”

Aguilar said that the committee’s investigation found that the crowd of rioters were within 40 feet of Pence inside the Capitol at one point.
“Approximately 40 feet. That’s all there was. Forty feet between the vice president and the mob,” he said. “Make no mistake about the fact that the vice president’s life was in danger.”
The committee also played videos of the mob chanting, “Hang Mike Pence.”
The crowd surged when Trump tweeted his anger at Pence.
Aguilar also said they found evidence that the mob got more out of control when Trump tweeted mid-riot: “Mike Pence didn’t have the courage to do what should have been done,” referring to his refusal to throw out the election results.
“Our investigation found that immediately after the president’s 2:24 p.m. tweet, the crowds both outside the Capitol and inside the Capitol surged,” Aguilar said, adding that Pence then had to be moved to a secure location.
The committee aired testimony from White House staffers who said that was exactly what they feared might happen. Deputy press secretary Sarah Matthews said that after staff urged Trump to tweet something that would calm the crowd, he instead tweeted his attack on Pence.
“The situation was already bad, so it felt like he was pouring gasoline on the fire by tweeting that,” she said.
The Jan. 6 select committee on Thursday presented evidence that top Trump allies in the administration, the campaign and the media were well aware his plans to overturn the election had no legal basis.
Why it matters: The committee is using the hearings to make a comprehensive case for Trump's culpability in the attack on the Capitol as the Justice Department watches closely.
Driving the news: In both live and pre-recorded testimony, onetime aides to former President Trump and former Vice President Mike Pence described the pressure campaign on Pence and how Trump's closest allies raised doubts there was any legal or historical justification.

We already know from published reports that Trump’s Cabinet considered invoking this provision in the aftermath of the Jan. 6 attack. Treasury Secretary Steven Mnuchin and Secretary of State Mike Pompeo discussed it. During Monday’s House select committee hearing on the Jan. 6 attack on the U.S. Capitol, former Trump administration Attorney General William Barr discredited a conspiracy-driven film that makes dubious claims about widespread fraud in the 2020 election. Barr’s rebuke of the “2000 Mules” comes only days after Sen. Mike Lee gave a tacit endorsement of the film, which other Utah Republicans have shown at campaign events.
In the film “2000 Mules,” conservative pundit Dinesh D’Souza theorizes that non-profit groups paid volunteers — who are compared to drug “mules” — in five states to “harvest” hundreds or even thousands of ballots in 2020 and deposit them into ballot boxes. The film uses anonymized cell phone data to track when people came near those drop-off points, which allegedly backs up D’Souza’s claim.
The film claims “ballot trafficking” was widespread enough to rig the 2020 election for Joe Biden.
In taped testimony, Barr says he watched the film with an open mind, but it failed to deliver on those claims, even chuckling when he brought up the movie.
“My opinion is that the election was not stolen by fraud, and I haven’t seen anything since the election that changes my mind on that, including the ‘2000 Mules’ movie,” the former attorney general said during his testimony.
Barr called the analysis of the data in the film “singularly unimpressive.”
“The premise, if you go by five boxes or whatever it was, that that’s a mule is just indefensible. The photographic evidence was lacking. It didn’t establish widespread harvesting,” Barr said.
“If you take two million cell phones and figure out where they are physically in a big city like Atlanta or wherever, just by definition, you’re going to find many hundreds of them have passed by and spent time in the vicinity of these boxes. The premise that’s a ‘mule’ is just indefensible,” Barr added.
“2000 Mules” has been thoroughly debunked, with experts casting doubt on several claims.
Barr added even if it were to prove allegations of ballot harvesting, there’s no proof it would have changed the election results.
“People don’t understand that even if you show harvesting, that it doesn’t change the results of the election. The courts are not going to throw out votes and then figure out what votes were harvested,” Barr said.
During his testimony, Barr said he told former President Trump that his election fraud claims were false, but Trump wasn’t interested in hearing that.
“I thought, boy, if he really believes this stuff, he has lost contact with — he’s become detached from reality,” Barr said.

WASHINGTON — Justice Department officials have renewed their request for the House select committee investigating the Jan. 6 attack on the U.S. Capitol to turn over transcripts of witness depositions, saying that the documents are "critical" to its sprawling investigation.
“It is now readily apparent that the interviews the Select Committee conducted are not just potentially relevant to our overall criminal investigations, but are likely relevant to specific prosecutions that have already commenced,” read a letter sent to the committee on Wednesday.
“Given this overlap, it is critical that the Select Committee provide us with copies of the transcripts of all its witness interviews."
The letter was signed by Matthew Graves, U.S. attorney for Washington, D.C., Kenneth Polite, assistant attorney general of the DOJ's Criminal Division, and Matthew Olsen, assistant attorney general for department's National Security Division.
Grand jury investigations are not public, the officials wrote, which means the committee "does not and will not know the identity of all the witnesses who have information relevant to the Department's ongoing criminal investigations."
It is "critical that the Department be able to evaluate the credibility of witnesses who have provided statements to the multiple governmental entities in assessing the strength of any potential criminal prosecutions," they wrote, adding that failure to grant the DOJ access to these transcripts would complicate its ability to investigate and prosecute rioters.

In those court papers, the judge wrote that they may have committed “conspiracy to defraud the United States.” He suggested they enter into an agreement to obstruct a lawful function of government — Congress’s counting of electoral votes — and that both “likely knew” the plan was an illegal violation of the Electoral Count Act of 1887. Corrupt pressure on Pence may have constituted the requisite “act” in furtherance of that conspiracy.
