The House select committee investigating the Jan. 6 attack on the U.S. Capitol is in active discussions with former White House counsel Pat Cipollone regarding a potential public appearance in one of their upcoming hearings, according to sources familiar with the matter.
Cipollone and former deputy White House counsel Pat Philbin previously met with committee investigators for an informal interview in April.
Cipollone was one of the few aides who was with then-President Donald Trump in the West Wing on Jan. 6. ABC News previously reported that in the days following the attack on the Capitol, he advised Trump that Trump could potentially face civil liability in connection with his role encouraging supporters to march on the Capitol.
The committee hopes to secure Cipollone's public testimony on a panel with former acting Attorney General Jeffrey Rosen and his then-deputy Richard Donoghue, along with one of DOJ's former top attowhrneys, Steve Engel, sources said. Both Rosen and Donoghue have received formal invitations from the committee to appear.
Both Cipollone and Philbin were part of a Jan. 3 Oval Office meeting where Trump insisted on replacing Rosen with Clark, a Trump loyalist who had vowed to use the Department of Justice to investigate the election.
The officials in that meeting also debated a proposal by Clark to send a letter to state officials in Georgia urging officials in the state to investigate unfounded claims of fraud with an eye toward overturning President Joe Biden's victory in the state.
According to Donoghue, Cipollone and Philbin made it clear to Trump that they would resign if Clark were installed, with Cipollone describing the Georgia letter as a "murder-suicide pact" that would "damage anyone and anything that it touches," according to a Senate committee report released last year that detailed instances where Trump and his allies sought to use the DOJ to overturn the election.

They’d previously been charged with conspiring to obstruct Congress’s certification of the Electoral College vote. The latest set of charges widened the scope of the alleged criminal conduct, accusing them of conspiring to “oppose the lawful transfer of presidential power by force.”

Secret Service agents usually provide security but rarely talk to politicians about anything.
Ultimately, Trump famously said during the Jan. 6 rally that he planned to go to the Capitol. “[W]e are going to — we are going to walk down Pennsylvania Avenue, I love Pennsylvania Avenue, and we are going to the Capitol.”
After making that remark, Secret Service personnel reached out to other law enforcement partners to figure out if this move was feasible, a detail first reported by the Washington Post. Engel himself, meanwhile, conveyed to the relevant parties that transporting Trump to the Capitol would be unfeasible.
Guglielmi, the Secret Service spokesperson, said agency personnel inquired into the feasibility of transporting Trump to the Capitol after he made his rally remarks. But the agency never made “an operational plan” to do so, he added.
Trump himself told The Washington Post in April that his Secret Service detail blocked him from going to the Capitol.
“Secret Service said I couldn’t go,” he told the paper. “I would have gone there in a minute.”
Engel isn’t the only Secret Service employee to speak with committee investigators. Two people who spoke with POLITICO about Engel’s interview said the panel has interviewed multiple agency personnel, in sessions that have taken hours. Some of those interviewed have been called back in for repeat questioning.

WASHINGTON (AP) — Rep. Liz Cheney has been thinking lately about her great-great-grandfather, a man who fought for the Union in the Civil War, as the House committee investigating the Jan. 6, 2021, U.S. Capitol insurrection prepares to launch a prime-time hearing of its work.
The Wyoming congresswoman, a member of one of America’s famous political families, is one of just two Republicans on the 1/6 panel, and its vice chair. Cheney helped drive the committee’s investigation into Donald Trump’s relentless efforts to overturn the 2020 presidential election, and has become one of the former president’s fiercest critics after a mob of his supporters laid siege to the Capitol to try to stop Congress from certifying Joe Biden’s victory.
Thursday’s televised hearing could be a pivotal moment in her political legacy — elevating her ambitions as a post-Trump party leader or possibly costing Cheney her job.

“I have found myself, especially since January 6th, thinking often of my great-great-grandfather and of the Union he fought to defend,” Cheney said in a recent speech.

After the long assault on the Capitol on Jan. 6, Congress reconvened that night to pick up where it had left off — certifying the election results submitted by the states.
Cheney said she walked through the building, into Statuary Hall, the historic space filled with law enforcement officers in tactical gear “sitting on the floor, leaning up against the statues, exhausted from the brutal hand-to-hand combat in which they had been engaged for hours.”
She made her way to the next room, the Capitol Rotunda, “watched over by statues of Washington and Jefferson, and Lincoln and Grant, and Eisenhower, and Ford and Reagan.”
Its giant paintings, she noted, included one that depicts George Washington resigning his military commission after the Revolutionary War — voluntarily relinquishing his command in a stunning act that set the stage for the future presidential tradition.
“And this sacred obligation to defend the peaceful transfer of power has been honored by every American president — except one,” she said.
Thinking about her great-great-grandfather Samuel Fletcher Cheney, she said it’s time for this generation to “set aside partisan battles and stand together to perpetuate and preserve our great republic.”

Previously, Trump had called for his ally Gov. Kristi Noem to primary Thune, since he’d criticized efforts to challenge the 2020 election results. At the time, Trump had dubbed Thune a “RINO” and “Mitch’s Boy,” promising that his political career would soon be over.
Noem, however, declined to pursue a primary; instead, she’s running for another term in the governor’s house. She won her primary easily, and a serious challenger to Thune never really materialized. His win is a reminder that it’s still possible for Republicans to buck Trump — and succeed.

The left has a tendency to claim to have (or have seen) evidence of something when they have not. Remember how Adam Schiff claimed he saw evidence of Trump/Russia collusion? But, aside from that, the January 6 Committee has a credibility problem that cannot be ignored here. First of all, various text messages released by the committee have actually exonerated Trump, but have been falsely characterized as incriminating. In fact, they even doctored text messages to make them look incriminating when they weren’t.
Further, Raskin seemed a little less confident about Trump’s role. When he was asked if Trump was involved in the so-called, conspiracy, he was curiously less absolute. “I think that Donald Trump and the White House were at the center of these events,” he said. “That’s the only way really of making sense of them all.”
Then Raskin added that “people are going to have to make judgments themselves about the relative role that different people played.”
Gee, this sounds like the absolute opposite of the narrative we’ve been hearing from the committee since its inception: that there was a conspiracy to overthrow the government and Trump was behind it all. Raskin has essentially admitted they have nothing on Trump, and that the committee is basically crossing its fingers, hoping that people will just blame him for it anyway.
Raskin clearly shows no confidence that the committee can prove Trump incited the riot or was in any way involved in a conspiracy. Which just goes to show you this whole thing is political theatre.

Police arrested a man with a weapon near Supreme Court Justice Brett Kavanaugh's Maryland home early Wednesday morning for making threats against the justice, according to a spokesperson for the court.
Why it matters: The man was carrying at least one weapon and burglary tools and told police he wanted to kill Kavanaugh, according to the Washington Post, citing anonymous sources familiar with the investigation.
What they're saying: "At approximately 1:50 a.m. today, a man was arrested near Justice Kavanaugh's residence," Supreme Court spokesperson Patricia McCabe said.
"The man was armed and made threats against Justice Kavanaugh. He was transported to Montgomery County Police 2nd District," she added.
The big picture: Congress has been considering legislation that would increase security for federal judges and their families after protests outside the homes of Supreme Court justices over the leak of a draft decision that would overturn Roe v. Wade, Axios' Andrew Solender reports.
The legislation was also in response to a shooting at the New Jersey home of a federal judge in 2020 that killed her son and wounded her husband.

Earlier this year, a federal judge concluded in a ruling in the probe of the January 6 insurrection at the U.S. Capitol that Donald Trump probably broke the law with his plot that day to overturn the election.
As U.S. District Judge David Carter wrote in March:
Dr. John Eastman and President Trump launched a campaign to overturn a democratic election, an action unprecedented in American history. Their campaign was not confined to the ivory tower — it was a coup in search of a legal theory.
In a ruling last night allowing more of Eastman’s emails to be sent to the House Select Committee investigating the insurrection, Carter said the crime “was fully formed and actionable as early as December 7, 2020.”

An armed man was arrested near Supreme Court Justice Brett Kavanaugh's Maryland home after allegedly making threats against Kavanaugh, according to a Supreme Court spokesperson.
The man was arrested at about 1:50 a.m. Wednesday and taken into custody in Montgomery County.
The Department of Homeland Security warned in May that there could be threats against Supreme Court justices over the leaked draft of the Roe v. Wade decision.
A bulletin obtained by ABC News in May said the draft leak "prompted a significant increase in violent threats -- many made online via social media and some of which are under investigation --directed toward some U.S. Supreme Court Justices and the Supreme Court building."
The National Capital Threat Intelligence Consortium identified at least 25 violent threats on social media that were referred to partner agencies for further investigation, the bulletin said.
"Some of these threats discussed burning down or storming the U.S. Supreme Court and murdering Justices and their clerks, members of Congress, and lawful demonstrators," the bulletin said.
Senate Minority Leader Mitch McConnell said Wednesday, "This is exactly, exactly the kind of event that many feared the terrible breach of the court's rules and norms could fuel."
McConnell used the incident to call on the House to pass legislation increasing protection for Supreme Court Justices and their families.
Sen. Ben Sasse, R-Nebraska, a member of the Judiciary Committee, called on President Joe Biden to condemn those who target justices.
"Political violence is un-American. President Biden needs to personally and forcefully condemn violence and threats against Supreme Court justices .

A federal judge ordered former President Trump’s legal adviser, John Eastman, to turn over another batch of 159 documents subpoenaed by the House Jan. 6 select committee, including a single email he found to likely be part of a criminal effort to overturn the 2020 election.
The late Tuesday ruling adds to a decision earlier this year finding that Eastman, who crafted two memos outlining the Trump campaign strategy to block the Jan. 6, 2021, Electoral College certification, cannot shield some of his work from the committee by claiming attorney-client privilege because he participated in a project to undermine the election that was likely criminal.
Judge David Carter, a California-based federal judge who has been reviewing Eastman’s correspondence, found that Trump and his team may have engaged in criminal activity in early December 2020, writing that his emails “confirm that the plan was established well before January 6, 2021.”
“Dr. Eastman and President Trump’s plan to stop the count was not only established by early December, it was the ultimate goal that the legal team was working to protect from that point forward,” Carter wrote.
The judge gave Eastman until 5 p.m. Wednesday to turn over the latest batch of records.
Eastman detailed two strategies for the Trump campaign: one encouraging former Vice President Mike Pence’s availability to buck his ceremonial duty to certify the election results on Jan. 6, 2021, and the other advising sending “alternate electors” from states that Trump had lost.
In a March ruling, Carter wrote that “the illegality of the plan was obvious” and deemed it “a coup in search of a legal theory.”
