McCarthy makes another good point

The Mar-a-Lago Affidavit Circus
One of the many oddities of the Mar-a-Lago search is that it comes in the middle of a criminal investigation (I would say, a number of criminal investigations) to which it may be relevant. In a normal criminal case, the government will wait to execute search warrants until it is ready to end the investigative phase by arresting and charging people. If it has probable cause to get a search warrant, the government nearly always has probable cause for an arrest warrant, too. In fact, quite often the same affidavit is filed to support arrest warrants and search warrants. Investigators would rather wait until the end of their probe to seek both, because investigations are best done in secrecy, without tipping off suspects while evidence is still being covertly gathered. Once suspects know they are under investigation, police and prosecutors worry, they might destroy evidence, work on getting their story straight (which could undermine later interviews), and perhaps even flee.

So one of two things exist here.

  • The DOJ had an arrest warrant on Trump but have not executed it as of yet.
  • The DOJ has no arrest warrant and again are doing things spectacularity outside of the norms.

The former would sort of surprise me. the DOJ has a policy to make any sort of move that could be seen as political within 90 days of an election. The raid in question came 91 days before the election. Why would they decide that the raid was so important as to not wait, but the fact that they had evidence to arrest Trump was not? An arrest 91 days before an election would be a shock, but it would be within their policy.

But not arresting him (if they had a warrant to do so) would almost seem like they would be bending over backwards to go out of their way to not follow normal procedure in order to not appear political. Would the Biden/Garland DOJ go to an extra length not to follow normal protocol on something this important? Would they do this to cover for Trump and the GOP?

Moreover I find it utterly unbelievable that the DOJ could sit on an arrest warrant against the former President and not have that information leaked. More likely than not there was just a search warrant with no arrest warrant... and the DOJ just undercut their own protocol to make a massive raid on the last day that they are allowed to (under their policy).

It's still going well and fast enough

Weisselberg will have to testify at the Oct. 24th trial of the Trump Organization.

"It seems very, very hard to testify truthfully in that case and not implicate Donald Trump

This could be the Al Capon moment in time.

Yep.

I've raised my share of capons many years ago on our "milk cattle ranch*". Never named one 'Al' but I'll keep it in mind for the future.

A capon is a male chicken that is gelded, or castrated, at a young age, and then fed a rich diet of milk or porridge. Larger than a chicken, a bit smaller than a turkey, but more flavorful than either, capons are full breasted with tender, juicy, flavorful meat that is well suited to roasting.

Dee-lish.

*milk cattle ranch. commonly known as a dairy farm.

And while they're over there at politicalwire.com, they might want to note that there are 18 former Trump officials who are telling CNN that they never, ever heard anything about Trump having a "standing order" to delassify documents he took from the Oval Office to the White House residence.

They believe that report to be a lie, and some even laughed at it.

Roger

As explained in the National Review today (you can find the story). There are people acting as if the Trump Organization is Trump rather than a Company.

The only mention of the President is in regards to how the apartments and such were leased. There is no suggestion that Trump or anyone else had anything to do with Weissenberg's taxes.

Technically speaking my company cannot tell me what perks should or should not be taxed. They can decide to withhold taxes or not. Certain types of employment situations have different withholding. But just because an employer doesn't withhold a tax, doesn't mean it's not due. My wife had worked as a contractor for years (received almost no withholding) and was responsible (with a tax accountant) to file tax returns based on her income.

Had she not reported certain types of income... that would not be on her employer, but rather on her tax attorney.

At best... I suppose a company might tell someone that they are giving them a cheap apartment and that there is little chance that they would be audited if they do not claim it. But that would just be someone telling you that you can turn right (when the sign says you cannot) because nobody is ever there to enforce it. If you get caught, it is on you... not the person who told you do to something.

If there is a conspiracy... it would involve people who file or prepare taxes... NOT the person who leased them the apartment.

Are they like the 51 former officials who stated that Hunter Biden's laptop was Russian disinformation?

I will stick with the USSC precedents about the CIC authority to classify and declassify...

That is... if that is okay with you?

Well lookee here:

"Under the statutory scheme established by the PRA, the decision to segregate personal materials from Presidential records is made by the President, during the President's term and in his sole discretion," Jackson wrote in her March 2012 decision, which was never appealed.

"Since the President is completely entrusted with the management and even the disposal of Presidential records during his time in office, it would be difficult for this Court to conclude that Congress intended that he would have less authority to do what he pleases with what he considers to be his personal records," she added.

and this over here -

Jackson also concluded that a decision to challenge a president's decision lies solely with the National Archives and can't be reviewed by a court. If the Archives wants to challenge a decision, that agency and the attorney general can initiate an enforcement mechanism under the law, but it is a civil procedure and has no criminal penalty, she noted.

Scott the FBI has begun asking former Trump administration officials whether they’ve heard of the so-called ‘standing order’ Trump claims to have given.”

Key takeaway: “It’s unclear why a sitting president, who as commander-in-chief was privy to any classified information, would need to declassify work brought to the White House private residence.”

C.H. Truth said...

Sure, Ch.

This is one of those things where we use two different issues and sort of toss them together.

You will hear that "it doesn't matter" if the records are classified or declassified, because he is not allowed to have them. They need to be with the Archives...

But then they will ignore the fact that the President/Archive is a civil dispute and not a criminal issue and then transpose the penalties.

Honest, decent, truthful Rev. said...

Ch, why would a CIC who would be privy to all classified information -- why would he need to declassify work he brought to the White House private residence, which is govenment property?

Could you explain that with a few simple words?

Coldheartedtruth Teller said...

Bottom line is that he is facing the Georgia issue and the top secret documents are in New York.

His odds are not good for him.

Plus the Democrats will keep the Senate majority.

And if people like Jim Jordan become the face of the Republican Party.

And by 2024 the economy will have changed the way things happen.

I believe that FBI because Wray was appointed by President Donald Trump.

He wouldn't....

He would, however, need to declassify information to take it out of the White House and work on at Mar-a-Lago. Just as Reagan would have had to declassify information to view it at his ranch, Clinton if he was at Epstein's sex island. Bush to see it on his Texas Ranch, Obama if he was in Chicago...

I know this might sound strange.

But Presidents don't really get time off from having to deal with serious things.. and might need to view classified data "outside" of the White House or other secured Government facilities.

What has an emboldened DOJ done since Bill Barr handed it off to the Biden administration?

Merrick Garland cleared Andrew McCabe, reinstated his pension, and gave him a half a million bucks for his trouble. The DOJ has targeted and tracked protesting parents as domestic terrorists.Merrick Garland has challenged redistricting and voter integrity laws — in red states only. The FBI raided the home of a journalist, seized confidential legal papers, and leaked them to the press. The DOJ has threatened to sue any state that attempts to protect children from sexual grooming. The FBI has raided the home of a former president for no reason that makes any sense.

That is the level of rot that has resulted from Barr's failure to take action.

Now, when he's not supporting the Democrat's "big lie" narrative, Bill Barr is calling for Merrick Garland to appoint a special counsel.  He's asking an attorney general who is uninterested in justice to pursue justice.  Does he not see the flaw in that reasoning?  Has it occurred to him that politely asking evil to be righteous is an exercise in silliness?

I have some advice for Bill Barr.  If he really cares about justice, stop asking Merrick Garland to do the right thing, and start calling for his resignation.  Lacking that, perhaps he should spend a bit less time criticizing Donald Trump and bit more brainpower reflecting on his own failures.

Another example of the GOP making an issue out of nothing as DeSantis proudly announces that 20 will be arrested for voter fraud in Floriduh!!!!! These 20 are allegedly rapists and murderers who were not included in the amnesty program but voted any way.... I for one will certainly sleep better knowing the millions spent protected the integrity of the 20 million voters in the state...WHAT A FUCKING WASTE OF TIME AND MONEY!!!!!

“It’s 20 people out of millions of voters,” Michael McDonald, an expert on voting and a professor of political science at the University of Florida. “These arrests are inconsequential to the integrity of the electoral system.”

Happy Friday 😊

Nevertheless, the sheer diversity of the state and federal statutes that Trump may have violated is astounding. All told, it’s four criminal investigations — two federal and two state-based — which together scrutinize Trump’s conduct before, during, and after his presidency. Even if only one of these investigations leads to a conviction, the elderly Trump could potentially spend the rest of his life behind bars. While some of the criminal statutes Trump may have violated carry penalties of only a few years in prison, others carry maximum sentences of up to 20 years.

the second recovery plan pushed climate change initiatives while taxing the middle class and adding 87,000 new IRS agents to pay for it.
