Who gets to determine what the motivations for the Jan 6 Capitol protest? When we asked the actual participants they told us their motivation. 88% of them had no interest in any "insurrection".
Seems that a third Party (such as the DOJ) demanding that the motivation was different is a pretty crappy and unconstitutional manner to make charging decisions. In fact it seems corrupt.

Former White House counsel Pat Cipollone has received a subpoena from a federal grand jury, as the Justice Department looks into potential crimes related to the Jan. 6, 2021 Capitol riot, Fox News has confirmed.
Cipollone was working in the administration of former President Trump at the time of the protests and breach of the Capitol building. He previously appeared before the House Jan. 6 committee, which had said Cipollone could have information about several supposed efforts by Trump allies to subvert the Electoral College.
During his appearance, Cipollone was asked whether he agreed that there was "no evidence of election fraud sufficient to undermine the outcome of the election."
But under a grand jury investigating executive privilege does not apply

And it does not matter if 88% of the protesters say they were not interested in an insurrection. They certainly were interested in illegally keeping the certification of the votes from happening, some even to the extent of commiting murder. They said so and say so.
What really matters is whether it was TRUMP who wanted illegally to overthrow what he had to know was an election he could not effectively challenge or change by legal means.

Researchers at the Shorenstein Center on Media, Politics and Public Policy manually went through 469 pages of federal court documents to reach this conclusion.

On what this study found motivated the rioters
"There was a lot of people who said, 'You heard it from him. The don is calling us to go to the Capitol.' People commenting, 'He said, it will be wild. It's up to us to make it wild.' And when Trump called for help, that's when we saw the most violent protests in a series of protests that we had seen at other capitals after Nov. 3 and before Jan. 6. So this wasn't completely unprecedented either, that there would be some violence in a capitol and that people would be trying to break in.
"It was essentially to, in any way, shape or form, prevent the certification of the election. And the people that were charged felt as if this was the last step or the last occasion that they would have to intervene. If you also look at the trajectory of all of the different lies that had been told — there was 'sharpie-gate,' there was 'dead people voted,' there were 'ballots were destroyed,' there were 'ballots were forged,' — here were so many different little lies along the way. So a lot of the rationale was backed up by this desperate attempt to save what they believe was a stolen election. We're talking about a very fissured and split, polarized society, in which there are different facts for different sets of motivations.

In this qualitative study, we analyze federal court documents related to the January 6, 2021 attack on the US Capitol, in an effort to identify, categorize, and quantify the most frequently cited reasons for participating in the breach of the Capitol Building. We describe the beliefs, ideologies, fears, conspiratorial narratives, and other themes that most often contributed to the decision to participate in the attack, and present representative excerpts from court documents. In order to estimate the relative popularity of each motivation, researchers coded the contents of 469 charging and sentencing documents, representing 417 defendants. These excerpts provide a unique window into the defendants’ thinking and plans in the weeks and days before the attack, as well as in its aftermath. Our analysis reveals that the members of the Capitol riot were far from consistent in their reasons and goals, although most seemed to share a fear of sociocultural status loss. Some defendants describe a desire for “revolution” or “civil war,” while others describe the attack as a simple “flexing of muscles,” or a demonstration of their frustration with the status quo. We find that the largest fraction of defendants were motivated to come to Washington DC on January 6 by either their desire to support President Trump, their concerns about the integrity of the 2020 election, or some combination of both.

Harvard Study: J6 Rioters Were Motivated by Loyalty to Trump, Not Insurrection

According to The Crimson, Harvard has completed what it calls the most comprehensive study of the motivations of those involved in the January 6, 2021 Capitol riot. Many will not be surprised to learn that most participated out of loyalty to former President Donald Trump. However, the study also found that only eight percent harbored “a desire to start a civil war.” That is inconsistent with the virtual mantra out of the J6 Committee and many in Congress that this was an insurrection rather than a riot. Some of us (including many in the public) have previously questioned that characterization. Yet, it reflects the relatively small number of seditious conspiracy charges brought by the Justice Department.
The study found that a plurality of the 417 federally charged defendants were motivated by the “lies about election fraud and enthusiasm for his re-election.” It concluded that “[t]he documents show that Trump and his allies convinced an unquantifiable number of Americans that representative democracy in the United States was not only in decline, but in imminent, existential danger.”
The study also found that belief in QAnon “was one of the [defendants’] lesser motives.” The study was hardly pro-Trump and one author even expressed surprise with the results since conspiracy theories “were so prominently displayed in much of the [riot’s] visual imagery.”
Once again, none of this exonerates or excuses those who rioted on January 6th or those who fueled the riot. However, the use of “insurrection” by the politicians, pundits, and the press is not an accurate characterization of the motivation of most of the people who went to the Capitol on that day. It was clear that this was a protest that became a riot.
There is no question that there were people who came prepared for such a riot, including some who are extremists who likely would have welcomed a civil war. Yet, the vast majority of people on that day were clearly present to protest the certification and wanted Republicans to join those planning to challenge the election.

However, the use of “insurrection” by the politicians, pundits, and the press is not an accurate characterization of the motivation of most of the people who went to the Capitol on that day. It was clear that this was a protest that became a riot.

In fact, you can argue that about 88% of those who were "charged" with storming the capital that day had nothing to do with wanting an insurrection or were drawn by QAnon. But you were to listen to the liberal idiots in the media explain it (in their feeble minds) they seem to believe that at least 88% were there because they wanted an insurrection and were drawn in by QAnon. This also does not reflect the tens of thousands of peaceful protesters who never marched to the capitol or did not participate in the storming of the building.
So if you really really do the math, here is what you would find. This was a study of the 417 people charged with a federal crime in the DC court. By simple math, this leaves us with 50 people who were there to actually commit the crime that hundreds (if not thousands) are falsely being accused of.
