McCarthy seems to believe that the underlying tone of the latest court filing suggest that they may very well be looking at an indictment. Not for mishandling secured documents or espionage, but for what would amount to "process crimes" of obstruction and misleading the FBI.
There are many who feel that this is the only real case that they could make. Charging mishandling of document or espionage would be a much trickier legal endeavor and may require more than just the idea that these documents were there. There may not be any real evidence that Trump was doing anything more than sitting on the documents in question. To some degree they can argue that the classification does not matter if he refused to "cooperate" with the FBI and had lawyers send a letter that is seen to be untruthful.
Now I would like to put this into perspective. Donald Trump is not just an average everyday American. He is a former President of the United States and still very possibly the 2024 GOP nominee again. Whether or not a former President "could" be indicted for something is rarely the question. Richard Nixon could have been, but was Pardoned. Bill Clinton admitted to his crimes, apologized, and came out not only indictment free, but even more popular. Other high profile politicians (Hillary Clinton) have gotten away with obvious crimes and were never charged.
The question is simple. You are going to be the first DOJ to charge an ex-President and obvious political opponent with a Federal crime. A federal crime that will ultimately be a "process crime" having to do with disputes over documents and legal documents penned to the DOJ. Even that sort of process crime will likely tear the country apart and no doubt the legal battle will go all the way to the USSC (it would almost have to).
As much as some people believe that the case is a slam dunk. I suspect that convincing a DC Jury would be much easier than winning a lengthy legal appeal battle that will bring forth opposing laws, constitutional questions, and everything in-between. Moreover, if Trump could win an appeal up front to move the case out of DC to literally anywhere else in the country, then even a jury win would be suspect.

If the process crimes prohibit Trump from running again and serving if he were to win, then the process crimes will be pursued with indictments and convictions will be secured thanks to the inevitable DC jury eager and willing to convict him.
Process crimes such as 'obstruction' (LOL) may be as pedestrian as hell, but they serve the purpose: stopping Trump.

Recently, former CIA director Michael Hayden implied on Twitter that former President Donald Trump should be executed for violating the Espionage Act. After MSNBC contributor Michael Beschloss suggested in a tweet that Trump should be executed like the Rosenbergs for giving U.S. nuclear secrets to Moscow in 1953, Hayden retweeted: "Sounds about right."
It was a year ago almost to the day that Hayden retweeted a meme comparing Trump-supporters to the Taliban in Afghanistan. The retweet occurred at the same time the Taliban were overrunning Kabul in August 2021. This helps to explain a lot in terms of Hayden's total lack of self-awareness on Twitter, but it fails to help us understand exactly what's behind the retweet that suggested that Trump should be executed.
Beschloss and Hayden were both responding to a Washington Post report that claimed that the purpose of the raid at Mar-a-Lago was to retrieve nuclear documents. To be sure, the question about whether or not Trump was in possession of said documents, and the question about the lawfulness of the FBI's raid, are legitimate. Yet there is a greater question looming high above these inquiries: "How did we get to the place in this country where a former CIA director thinks it's okay to publicly imply that a former president should be executed?"
There is much irony here when you consider that a congressional select committee is currently investigating whether or not the words of President Trump instigated the "insurrection" that followed his speech at the "Stop the Steal" rally on January 6.
