My final word on Trump Jr...

So many legal (sic) experts on the left have determined that Donald Trump Jr committed a criminal act by agreeing to meet with an unknown person (said to be a Russian Government attorney) who supposedly had some dirt on Hillary Clinton. This argument relies on two specific premises:
  • That under the definition of criminal campaign finance statutes preventing solicitation of any contributions from foreign government... certain "information" could be seen as a contribution because it provides "something of value". 
  • In spite of the fact that the person in question was not a party to the Russian Government and that this person actually provided no information of value, the argument is that Trump Jr could still be charged with "conspiracy" to commit campaign finance fraud for simply agreeing to the meeting with someone he might have believed was a representative of the Russian government.
I would offer several major problems with this logic. First is that in the history of our campaign finance laws, nobody has ever been charged with a crime for receiving information from a foreign agent or foreign government. In spite of plenty of evidence that this has happened before, no prosecutor has ever tried to argue such a case. The decision for a prosecutor to expand the campaign finance law reach to include "information" as a campaign contribution could only be seen as a blatant attempt to create a new standard of legal jeopardy for Trump that never existed before. The political fallout would be enormous, and rightfully so. 

Secondly, the entire concept of "conspiracy to commit" seems a little bit premature, given what little is known.  Logically the actual crime would not be "receiving" the information, but actually "using" the information, as the information would be of "no value" unless it could be used (otherwise you undermine the first argument). The Conspiracy to commit also requires that one of the Parties makes an overt act to initiate the crime (actus reus).  So the conspiracy to commit would require evidence that Trump intended to do more than just meet, but would likely require some specific proof that Trump had a concrete plan to use the information, and that he made some overt act in relation to that action. Ultimately, conspiracy to commit would be another very rare charge to make in regards to campaign finance violations. To have an unprecedented charge being piggybacked onto an extremely rare "conspiracy to commit" charge, seems even a more blatant attempt to simply expand criminal liability in order to "get Trump". 

Lastly, we would still need to use the Comey/Clinton standard of "mens rea". How could you suggest that Donald Trump Jr had intent or knew he was committing a crime, when such actions had never been prosecuted before?  This is a large reason why prosecutors rarely charge people with crimes that are not generally used, and why prosecutors rarely take it upon themselves to loosely interpret a statute to prosecute someone for something outside of what is generally prosecuted. It's difficult to prove intent, when you are carving out new legal ground on the fly.

Amy Walter notes the forces opposed to the GOP’s health care legislation are outspending those supporting the bill $5.8 million to $354,000.

Nathaniel Persily at Stanford University Law School said one relevant statute is the Bipartisan Campaign Reform Act of 2002. "A foreign national spending money to influence a federal election can be a crime" ..... "And if a U.S. citizen coordinates, conspires or assists in that spending, then it could be a crime." (See Coates' definition of expenditure, below)

Persily pointed to a 2011 U.S. District Court ruling based on the 2002 law. The judges said that the law bans foreign nationals "from making expenditures to expressly advocate the election or defeat of a political candidate."

John Coates at Harvard University Law School, said if Russians aimed to shape the outcome of the presidential election, that would meet the definition of an expenditure.

"The [expenditure] could also be viewed as an illegal contribution to any candidate who coordinates (colludes) with the foreign speaker," Coates said.

To be sure, no one is saying that coordination took place. What’s in doubt is whether the word "collusion" is as pivotal as Jarrett makes it out to be.

In your example... The court ruled that making "making expenditure" is banned. That hardly qualifies as the Court ruling that providing information is banned.

In fact, it further solidifies the opposite... as the legal definition of expenditures is limited to some form of payment or something of transferable value.

(what you actually offered is the opinion of a law professor - not a court case)

A closer legal ruling was the one Rat offered, where the law specifically allows that a foreigner could volunteer time (as long as they were not paid for that time)... and makes clear that the law does not consider "voluntary activity or services" a contribution. But rather limits the definition of contribution to money or a transferable equivalent.

Both cases use the concept of money or the transferable equivalent as the definition of "expenditures" - which is not unusual, since expenditures is a well defined legal term.

So try again. When you find an actual court case (not an opinion) that define expenditure as "providing information" then we will be happy to review it.

In MUR 5409 (2004), the Federal Election Commission voted 5-1 to accept the general counsel’s finding that Grover Norquist’s Americans for Tax Reform (a corporation) provided a “thing of value” to the Bush-Cheney reelection campaign. It was a list of conservative activists in 37 states. Some of the information may have been publicly available when Norquist gave it to Ken Mehlman of the campaign. The General Counsel found that this was a prohibited corporate contribution and that Bush-Cheney violated the law by failing to report it. But it found the list had so little value that the General Counsel did not recommend pursuing the matter further.

Two points on that one, Opie...

If you read the General Counsel's report... it was found that the "list of activists (potential donors, etc)" provided had "substantial market value" because others would find the list valuable and be willing to pay for it. He pointed out that they spend five years creating the list.

So technically the "market value" of the list of activists would be a something of "transferable value". It was tangible marketing research with tangible value to other politicians in future elections.

That was the argument of the General Council - so make this fit, you would have to argue that the information provided to the Trump team (which was nothing) would have transferable market value to another candidate in another race.. and could be technically sold.

Secondly, the General Counsel ultimately suggested that the case be dropped, because it was not of "enough" value to pursue legally. So the Bush campaign (in spite of actually taking the information) was not charged with an FEC violation.

So if your really want to use this as precedent... you would have to accept that this sort of "transferable value" is still not considered valuable enough to pursue.

So by your own argument, there would be no case against Trump because there was no information of value provided (much less transferable value)

Actually the "list" was a five year research project of potential Republican donors and volunteers. The General Counsel did not find (as Opie and the blogger suggests) that "generic information has value".

In fact the General Counsel made the argument that this particular market research was not just "information" but rather had tangible market and tangible transferable value. Botton line: The market research could be sold to other people, therefor had value.

So it actually fell (in his opinion) within the boundaries of transferable market value... and it was not an argument that information alone was a violation.

If you read the General Counsel's report... it was found that the "list of activists (potential donors, etc)" provided had "substantial market value" because others would find the list valuable and be willing to pay for it. He pointed out that they spend five years creating the list.

This is why, in the other thread, I said that "damaging information" wouldn't be a "thing of value" in the statute's context. I know as well as anyone, better than most given the company I work for, that data about people does have market value. Data about one person, damaging data, not so much.

It's a reach too far, and isn't going anywhere. If any crime is alleged, it won't be based on campaign finance laws, as far as Jr's meeting goes.

Earlier today, NBC reported that there was an unknown fifth person who attended the discussion where Trump Jr. and his father’s campaign staff would supposedly learn sensitive Russian information that could damage Hillary Clinton.
