Travel Ban USSC

So the final arguments were heard on the Trump travel ban (which is currently in effect due to the USSC earlier stay). A decision is supposedly due early this summer. By all accounts it was a good day for the Administration and those supporters of the ban.

Obviously you can only pick up so much from the hearing, but many legal observers make a living out of making these sorts of predictions. From what I have read, there is an indication that support for upholding the ban could see as many as seven Justices, rather than just the expected five member conservative bloc. That being said, the majority of observers are expecting another five-four split (with liberals hoping for a defector to side with the liberals).

My favorite tweet of the day came from an obscure liberal who goes by C.F.


I think that probably sums it up for the left. They simply believe that the entire constitution and rule of law should be suspended while Trump is President. But the truth of the matter is that the President of the United States has the absolute right under both the Constitution and Federal law to enact a travel ban such as he did. Furthermore, there is nothing in either the Constitution or Federal law that suggests that the executive needs to run it by a "judge" before making his decision. The President has 17 intelligence agencies who answer to him and feed him national security information. Our court system is made up of Judges who don't have security clearance (much less the time) to second guess them.

Let's hope that at least one (or more) of the liberal bloc decides to side with the conservatives in order to make this a more consistent, credible, and non-partisan ruling. Assuming of course, that the vast majority of observers are correct and the ruling comes back in favor of the Administration.

UPDATE: It's probably worth noting that when the USSC issued their original stay of the lower court order (which allowed the ban to take effect) that only two Justices (Ginsburg and Sotomayor) dissented with the stay order. The other two liberals (Kagan and Breyer) appear to have left the door open to siding with the Administration based on the transcripts of today's oral arguments.

If the government does prevail, the only question will be if and how strong the opinion will be in rebuking the lower court's interference with executive power.

IMO it needs to be a very clear and strong rebuke or these cases will keep returning to the court.

New allegations of misconduct emerged Wednesday afternoon against Rear Adm. Ronny Jackson, the White House physician nominated to be the next secretary of Veterans Affairs.
Jackson has been accused of providing "a large supply" of prescription opioids to a White House military office staffer and "wreck[ing] a government vehicle" while intoxicated at a Secret Service event, according to a new report compiled by Democratic Senate staffers.
The White House is continuing to stand by Jackson, who said Wednesday that he would not withdraw from the nomination process.

Jackson, the White House physician, to lead the Veterans Affairs Department on Thursday after lawmakers went public with a torrent of accusations leveled against him by nearly two dozen current and former colleagues from the White House medical staff.

In a statement released Thursday morning, Dr. Jackson announced that he was withdrawing his name for consideration to be the secretary of Veteran Affairs.

“Unfortunately, because of how Washington works, these false allegations have become a distraction for this president and the important issue we must be addressing — how we give the best care to our nation’s heroes,” Dr. Jackson said in a statement provided by the White House press office.

The concerns raised on Capitol Hill over Dr. Jackson’s nomination were bipartisan and emerged after the Senate Veterans’ Affairs Committee interviewed more than 23 people, including current and former military personnel were not anonymous, who had worked alongside him. The accusations included a hostile work environment, the improper dispensing of prescription drugs to White House staff and reporters during official travel, and intoxication while traveling with the president.

all the news reports say "more than 20" and none address anonymity.

Later Tuesday, Tester said during an interview with NPR that the committee had heard complaints from more than 20 current and former military members that Jackson had improperly dispensed drugs, become intoxicated on professional trips and belittled staff members.

I heard the interview. He's a rambling man, unable to keep on a subject for more than one sentence. He did admit thtg Cohen represented him on the Stormy Daniels affair. He has denied knowledge previously when questioned, he said on Air Force One "talk to Cohen" . This is unbelievable.

The president denied on "Fox and Friends" having anything to do with Cohen's business after the attorney's office and hotel room were raided this month by the FBI.

But it's Cohen's $130,000 payment to Daniels shortly before Election Day in 2016 that may be of interest in the investigation. No shit Sherlock, if it ame from campaign funds, it could be a violation of the campaign law and his knowledge of it could be a crime.
