Texas Federal Judge Declares Border Wall Funding ‘Unlawful’

Another federal judge ruled against President Trump’s use of a “national emergency” declaration to divert funds for the construction of a border wall on Friday, finding the use of an emergency proclamation “unlawful” because it violated a Congressional budgeting measure from January.

“The Congressional language in the [bill] reveals Congress’s intent to limit the border barrier funding,” wrote Judge David Briones, who was appointed to the federal District Court for the Western District of Texas by former President Bill Clinton.

To be clear, this "IS" exactly the same case that is currently making it's way through the courts. Another "resistance" Judge ruled against the Administration and ordered an injunction to stop the President from diverting funds. The Administration made an appeal straight to the Supreme Court and was granted relief from the injunction by the USSC.

The Judge is now looking at the "injunction" phase of his ruling, providing ten days for the plaintiffs and five days for the Administration to reply. The problem is that the USSC has already stayed injunctions against the Administration on the subject. It's as if Judge Briones is "pretending" that there is no such ruling out there.

So the question becomes, what does the Administration do if the Judge ignores the higher court rulings and just issues another injunction? Do they wallow through the entire process of creating "another" appeal back to the USSC on the same issue, or do they simply tell the Judge that they will be following the USSC ruling rather than the ruling of a lowly District Judge.
