FBI reopens investigation regarding Clinton Email...

Bad timing for Clinton?
Or will nobody care?

The buzz is that Anthony Weiner may have turned over a device (willingly or otherwise) used by Huma Abedin to the FBI, which apparently contained some information relevant to the case. Now, quite obviously if this was (as some are suggesting) much ado about nothing, there would have been no reason for the FBI to take a second look at everything, much less send a letter to Congress letting them know.

Since we already know that classified material was sent from and stored on the server. My personal thought process is that this device may have held private conversations between Clinton and Abedin that would offer some proof as to her "intent" to skirt the laws. Everyone knows she did it on purpose and knew it was illegal (except of course James Comey). Perhaps this new information provides that particular smoking gun.

I certainly understand the anger from partisans on the left who are considering this a possible "dirty October surprise" on the Part of the FBI Director. Providing a generic message such as this leaves open the possibility of much speculation, much discussion, much accusation, and pretty much nothing positive for Clinton. Comey has suggested that there is no time-table, meaning there will almost certainly not be another "exoneration" speech prior to the election. This would leave open the possibility that we could elect someone who "still" could be indicted. Something that could certainly sway a few voters otherwise on the fence.  

Rebuttal update: To those who suggest that these are not relevant because they were not found from Clinton's email server sort of both miss and prove the point at the same time. If there are hundreds (as being reported) emails on this "device" that were otherwise not deleted... it could provide insight to some of the 30,000 emails that "were" deleted. This is another "possible" reason that this information is important. If they cannot cross reference these emails with what they already found from the Clinton server, it would suggest more cover up.

Btw... no way do "reporters" have information on this at this point. Anything you hear in defense of Clinton is more cover-up (you can gather this from the semantic word play being used). The letter states that the FBI will need time to go through all of this. Certainly Pete Williams does not have the "scoop" at this point. His is pure speculation.

It's also possible that this is a bigger "legal" problem for Abedin than it would be for Clinton. Remember, the investigation into Clinton's email server was not "just" about Clinton and her actions. The actions of her leading advisers and aides is also under scrutiny. All of it, however, provides a political problem for Clinton.

Aside from the letter and Chaffetz's tweet, little was known about the impetus for the reinvestigation. There was some quibbling over whether the investigation was being "reopened" or started anew:

Irrespective of that circumstance, the only information available about Comey's stated intent to reinvestigate came from Chaffetz's tweets and the letter published to Twitter. Information about the scope, impetus, and timeline for the investigation were not immediately available.

Comey and the FBI are in a terrible position here, one in which they would be accused of playing politics whatever they ended up doing.

The interesting question here is whether the FBI's predicament is Comey's own fault. It's certainly not his fault that the email mess fell into his lap and had to be investigated in the year of an election. Nor is it his fault that the the FBI ended up investigating the DNC hack and whatever trouble Weiner has gotten himself into of late. Reasonable minds will differ about whether Comey leaned too far foreward in publicly disclosing information about his thinking on the email case. He can be criticized for having said and disclosed too much and thereby made his problem worse.

But what you can't reasonably say here is that Comey has been anyone's political lackey. Over the howling objections of many Republicans, he ended the Clinton email investigation, concluding that "no reasonable prosecutor" would go forward with a case. Over the snarls of the Clinton forces, at the same time, he commented quite disparagingly about the behavior of the woman who is likely to become his boss. And now, with the election only days away, he has amended his prior resolution of the case to deal with new information.

Say what you will about the FBI, but it's surely been independent.

The campaign's just-released statement, from chairman John Podesta, is remarkable. It begins by not-so-subtly suggesting that this is at least partially a political response to Republicans' continued second-guessing of how the FBI handled its investigation, along with FBI Director James B. Comey's July conclusion that no "reasonable prosecutor" would bring charges against Clinton.

She misspoke in saying the letter only went to the Republicans. According to the reports that it went to the ranking Democrats too.

It was a no win situation for the FBI so they decided to open this because it opened new emails. There are thousands of emails, they don't know if there is anything new. That's to be determined. If there are NEW National Security emails are on the server, if not, it's no big deal.

I have seen some experienced comments saying that Clinton should for now, let her advocates say it's meaningless, and she is. As usual, they are playing it right, considering how difficult it could be.

I have to agree. It was necessary, but unfortunate for Clinton, since some of the swing states were going both ways, depending on who's poll you believe. IF, they don't come up with something damaging, despite I'm sure they have a lot o people working on it. People will move on in the decision making.

It might cost her a point of so, by Monday, but if thee is nothing, by the end of the week, will resume the move away from Trump, outside his core.

The big IF is something damaging. They appeared non concerned. That could just be politics. We have to wait and see. If nothing new by this time next week, it won't be the "October Surprise". If it is, oh shit. President Trump scares the shit out of me.

Roger - Much of the legal speculation is around possible perjury charges against Abedin, as well as possible emails that would show mens rea between the two of them.

What we can be fairly certain of... is that the FBI director does not just restart/reopen/continue a legal probe into a Presidential candidate 11 days before the election without any just reason.

As much as you would like to sweep this under the rug, it's a big deal. If for no other reason than it will motivate Republicans at this point to turn out. Considering Hillary's poll advantages are pretty much built on an "assumption" of depressed Republican turnout... this could be more important than just swinging some undecideds.

Both camps demanded that FBI Director James Comey disclose more details about the emails and the bureau’s investigation, which he made known in a letter to Congress just 11 days before the election.

“FBI Director Comey should immediately provide the American public more information than is contained in the letter he sent to eight Republican committee chairmen,” Clinton campaign chair John Podesta said in a statement that called Comey’s move “extraordinary.”

Trump campaign manager Kellyanne Conway said she agreed with Podesta’s demand. Voters, she told MSNBC’s Steve Kornacki, “have a right to know who this woman is, because you look at the polling and it’s exactly who they suspect she is.”

Comey’s letter prompted cheers from Trump supporters, who would like to see Clinton in trouble. But it also sparked a wave of complaint from Democrats, and even some former Department of Justice officials, questioning the timing of Comey’s letter and its scant details likely to leave many voters bewildered. Many challenged the FBI director’s motives, increasing the pressure on him to comply with calls from both campaigns for more information.

Matthew Miller, a former Department of Justice spokesman, turned to Twitter to question Comey’s judgment.

Sen. Dianne Feinstein (D-Calif.) said Comey’s statement “is particularly troubling since so many questions are unanswered.”

During the third debate, he said that the country is dying at 1% GDP growth. Now that actual measurements show it growing much faster, that argument is dead in the water. Philadelphia Suburbs Are Going Strongly to Clinton

Donald Trump's path to the White House goes through the Rust Belt; the key to the Rust Belt is Pennsylvania, and the key to Pennsylvania lies in the Philadelphia suburbs. The Washington Post's James Hohmann did some reporting there, and this is what he found. The "collar counties" around Philadelphia (Bucks, Montgomery, Chester, and Delaware) are going to be a big problem for Trump. A Bloomberg poll showed Clinton running 18 points ahead of Obama's 2012 performance. Republicans need to hold these counties to win statewide, and that simply isn't happening. In a day of searching, Hohmann couldn't find even a single Trump voter, although he found plenty of split-ticket voters who were going to vote for Hillary Clinton and Sen. Pat Toomey (R-PA). He asked at bars and elsewhere for suggestions on where to find a Trump supporter, and no one said they knew any. A number of voters couldn't understand why Trump kept coming back to campaign in extremely hostile territory. Some of the people interviewed said that they would have happily voted for Gov. “Assuming there is nothing literally incriminating in the emails (or nothing that will come out before election day, anyway), the scariest thing for the Clinton campaign involves the conventional wisdom that the candidate who can best avoid media attention down the stretch is likeliest to win. In a contest where both candidates are unpopular, the reasoning goes, you don’t want voters to head to the polls freshly reminded of what they most dislike about you.

“The final week or so of the campaign looked like it would be dominated by ever-more-shrill statements by Donald Trump about rigged elections and the women peddling ‘fake’ accusations of sexual misconduct against him. The spotlight had largely focused away from Clinton, aside from thoughts about the prospect of her breaking the glass ceiling, which even a fair number of the people intending to vote against her might appreciate. That’s now changed, for the moment at least.

Why is this such a stunning development? I recall writing more than a year ago that the scandal arising from her emails was a bottomless well, and that even if she could stem the flood from her own store of emails there would always be more, from other recipients.

A few of us vehemently disagreed with me then, but at least you can recall the warning I'm sure. Anything that clear to a reasonable person, that long ago, should not be a surprise now. I honestly don't understand the shock and dismay.

I also don't understand the scramble that Clinton's campaign is going through to figure out just what the FBI has. Don't they know? If all of what they have claimed is true, hell if ANY of the claims are true, then why do they expect any problems at all?

I don't see how you can support a candidate like this, without abandoning your own integrity. One that half of the country knows should be prosecuted, and is still being investigated for crimes against our national security even after the whitewash. Maybe the vocal supporter who told me he'd support her unless she was the most corrupt candidate in history was actually being honest, hard as that is to fathom.

Reporters have been saying that people inside the FBI thought Comey made a huge mistake. It was a reaction and he shouldn't have made it.

The FBI intervention into the election process is incorrect and bad judgement.

As of yet they haven't found a SINGLE pertinent Email. That's why this might narrow the election, but she's going to win. If she keeps Trump from winning Florida, N. Carolina or Colorado and he can't win.

You can see the same dilemma here. If Comey didn’t say anything about the new emails and it was revealed after the election that he knew about them and stayed silent, he would be accused of aiding Hillary. If, on the other hand, his announcement today ends up flipping the race to Trump and there is nothing significant in the new emails, he will be forever remember for torpedoing Hillary. Anything he says, or even doesn’t say, from now until Election Day is going to make someone very unhappy. I think Comey should err on the side of maximum disclosure consistent with the integrity of the investigation, but the entire episode goes to show what a bad idea it is for a political party to knowingly nominate someone who is likely guilty of criminal offenses.

If the FBI plays this like they did in the past, they'll be keeping this hand close to the vest. While that was largely in Clinton's favor the first go-round, I think it sinks her this time. With NO further information forthcoming (and why should the FBI say anything, when they're damned if they do?) speculation has free rein. That can only hurt Clinton.

At this point, the big question is the other shoe dropping, because you know there is one. Will it be a wikileaks release, some Russian hacker, a bribery allegation from a shafted Clinton Foundation donor? Who knows, but one thing is always certain with the Clintons: there's always more.
