Niger ambush came after 'massive intelligence failure,' source says

WASHINGTON — A senior congressional aide who has been briefed on the deaths of four U.S. servicemen in Niger says the ambush by militants stemmed in part from a "massive intelligence failure."

The Pentagon has said that 40 to 50 militants ambushed a 12-man U.S. force in Niger on Oct. 4, killing four and wounding two. The U.S. patrol was seen as routine and had been carried out nearly 30 times in the six months before the attack, the Pentagon has reported.

The aide, who spoke on condition of anonymity because he is not authorized to speak publicly, said the House and Senate armed services committees have questions about the scope of the U.S. mission in Niger, and whether the Pentagon is properly supporting the troops on the ground there.

There was no U.S. overhead surveillance of the mission, he said, and no American quick-reaction force available to rescue the troops if things went wrong. If it weren't for the arrival of French fighter jets, he said, things could have been much worse for the Americans.

Congress also has many unanswered questions about what happened, he said, including about the specifics of the mission that day and the accounts lawmakers have been given about the timeline of the attack and rescue.

The aide said questions are being asked about whether the U.S. soldiers were intentionally delayed in the village they were visiting. He said they began pursuing some men on motorcycles, who lured them into a complex ambush. The enemy force had "technical" vehicles — light, improvised military vehicles — and rocket-propelled grenades, the official said.

After the rescue when it became clear that one soldier was missing, "movements and actions to try and find him and bring him back were considered. They just were not postured properly [to get him]." The body of Sgt. La David Johnson was not recovered until nearly 48 hours after the Oct. 4 attack.

The Pentagon said that conclusions about an intelligence failure were premature.

On Friday afternoon, Defense Secretary James Mattis met with Sen. John McCain, R-Ariz., chairman of the Senate Armed Services Committee, to discuss the Niger raid.

Earlier this week, McCain said the committee had not been provided with the information about the Niger mission that it "deserves."

Sen. Lindsay Graham, R-S.C., said Congress will require more information from a Trump administration that is expanding counter terrorism operations across the globe.

Trump is loosening the rules of engagement when it comes to lethal action against terrorists, and expanding the counterterrorism fight to different parts of the world, including across Africa, Graham said.

"The war is morphing," he said. "You're going to see more actions in Africa, not less."

In that context, Graham said, "I will insist that Congress is informed more often and in more detail," about military operations.

He added, "As the war expands, as the military had more authority, Congress is going to require more information."

Frederica Wilson had boasted about procuring funding for an FBI field office in 2015 was proven wrong by a video released by The Sun Sentinel on Friday, backing up Wilson's claim that she had only taken credit for working across the aisle to name the building after two FBI agents who were killed in the line of duty.

Kelly called Wilson an "empty barrel" on Thursday and rebuked her for taking credit for securing funding for the future FBI building. Wilson, however, shot back and denied the claim, which was corroborated by the video of her speech.

In an interview with the Associated Press this week, Fox News Sunday anchor Chris Wallace put his colleagues on blast over their penchant for discrediting the press. As he puts it, whenever these media attacks are uttered on the air by an opinion host or commentator, that person should realize they are also essentially slamming Fox News reporters and journalists.

My Uncle was killed in combat in 1944. He was 34 years old, and not subject to the draft. He, like millions of Americans volunteered to serve their country. I met his wife and daughter as I was growing up. I even went deer hunting with his grandson in the Black Hills of South Dakota. He was a lousy shot. I got his deer. But we kept that a secret.

I didn't say anything like he is claiming. In this case, our host should remove them. He can't be sued, but in this case it sure would be allowed.

First Trump lied and said Obama didn't give his condolences to the families of soldiers killed in action.

Then he tried to double down by claiming that was true for his chief of staff, John Kelly (whose son was killed in Afghanistan,) but in fact the record shows that in May 2011 Kelly and his family attended in person a breakfast with President Obama with other gold star families (Kelly has prudently said nothing about Trump's claim that Obama ignored him.)

Finally, Trump did call the widow of a soldier who was killed in action this week-- and rubbed it in her face by telling her 'he knew what he signed up for.' Well, of course he did, but that's the LAST thing he should tell a grieving widow.

And she spent most of her nine-minute speech praising the FBI agents killed in a gunfight with drug dealers: “Today it is our patriotic duty to lift up Special Agent Benjamin Grogan and Special Agent Jerry Dove from the streets of South Florida and place their names and pictures high, where the world will know that we are proud of their sacrifice, sacrifice for our nation.”

It is unfortunate that the sacrifice of brave people such as these two agents or the four soldiers killed in Niger can get overwhelmed by the petty name-calling of politics. That is a point Mr. Kelly was trying to make Thursday, and that he undercut with his misrepresentation of Ms. Wilson. He needs to set the record straight.

Kelly made the same mistake Trump so often makes.

Although Kelly's defense of Trump's call to the wife of the fallen serviceman was heartfelt and well delivered, he made the mistake of lodging an unnecessary attack against Rep. Wilson, an attack in which he made an accusation that simply was not true as a video of her short speech clearly shows.

Contrary to what Kelly alleged, the video shows that she did NOT take credit for getting the money for the building, only for helping pass legislation naming the building after two fallen federal agents.

In making the unnecessary accusation, Kelly lowered himself in the eyes of everyone.

Far too much of that has been going on.

I covered similar matters in my column in The Hill this week. The speech by former President Bush lifted the debate to a presidential level of patriotism. It followed an equally profound speech by Sen. John McCain (R-Ariz.) warning about a "half-baked, spurious nationalism" that reminds him of conditions in the 1930s that preceded World War II.

During his vital and historically important speech, Bush condemned a political discourse that sets a negative national tone and provides permission for cruelty and bigotry.

In his call for national unity and racial justice, Bush said bigotry and white supremacy in any form are blasphemy against the American creed and warned against politics that are polluted by conspiracy theories and outright fabrication. He warned of a democratic vision that is under attack from foreign enemies.

While former President Bush was making his case, former President Barack Obama was making almost exactly the same points in speeches in New Jersey and Virginia with his call for national unity, mutual respect and social progress.

Not long ago, Newton Minow, the FCC commissioner under President Kennedy, called on all living former presidents from both political parties to speak out together against the dangers of the Trump presidency. Slowly but surely, this is now coming to pass, with two former presidents representing both major parties making powerful and compelling statements on the same day, driving home the same point.

Consider the scope and magnitude of the warnings about the dangers of the Trump presidency that have been offered in recent days — and by whom.

The previous Republican president and the last Democratic president followed the warning from the 2008 Republican nominee and chairman of the Senate Armed Services Committee, Sen. McCain, and the warning from the chairman of the Senate Foreign Relations Committee, Sen. Bob Corker (R-Tenn.), who sounded an alarm about the increasing odds of World War III.

President Bush's speech was a landmark event that will ultimately be seen by historians as a major inflection point in which the dangers of the Trump presidency were seen as so severe and ominous that speaking out became a responsibility for those who have led our nation before.

It is unprecedented for a sitting president to falsely criticize his presidential predecessors — as Trump recently did — for not caring enough about troops who gave their lives in service to our country.

It is equally unprecedented, and far more historically profound, when former presidents feel patriotically compelled to speak out against the dangers created by a successor president.

Until this week, President Bush made it a defining habit to not criticize the presidents who followed them. This week, George W. Bush felt morally and patriotically compelled to speak out with clarity at a critical and dangerous moment. It was his finest hour.

General Kelly did not go up and give his press conference because he was told to. Anyone who actually watched it, knows that General Kelly was speaking from his heart and from what he felt was right. No General like Kelly is going to be "told" to go do something he didn't want to do or defend something military related that he didn't want to defend. This was clearly personal to him... and he was mad at the Congresswoman, not the President.

Donald Trump won because he concentrated on doing what it was that was necessary to win... which was win the majority of Electoral College Votes. Hillary Clinton lost because she concentrated on doing what she thought was politically expedient and did things like spend tens of millions running Spanish speaking ads in states like California and Texas (so she could brag up her Hispanic support).

Wouldn't you rather have the person who actually understood what it took to win, did it on half the budget... than the person who spent twice as much on things that didn't matter?

But these health plans, created for small businesses, have a darker side: They have a long history of fraud and abuse that have left employers and employees with hundreds of millions of dollars in unpaid medical bills.

In many cases, the Labor Department said, it has targeted “unscrupulous promoters who sell the promise of inexpensive health benefit insurance, but default on their obligations.” In several cases, it has found that people managing these health plans diverted premiums to their personal use.

The department filed suit this year against an association health plan for 300 small employers in Washington State, asserting that its officers had mismanaged the plan’s assets and charged employers more than $3 million in excessive “administrative fees.”

Operators of the health plan violated their fiduciary duty by using its assets “in their own interest,” rather than for the benefit of workers, the government said.
Marc I. Machiz, who investigated insurance fraud as a Labor Department lawyer for more than 20 years, said the executive order was “summoning back demons from the deep.”
