Big news regarding Flynn... or not?

The N.Y. Times reported that sources have  revealed that Michael Flynn's attorneys are no longer sharing certain information with "Trump attorneys". The headline screams that Flynn is moving to cooperate.

I garnered the opinion of someone familiar with these sort of cooperating or shared defense situations and it was suggested this typically will happen when an investigation moves into areas where one or some of the clients are no longet involved. It could involve one person turning on the other, but it is not as common as the other reason.

The N.Y. Times article acknowledged this possibility when they suggested that Flynn could be negotiating a plea. Since the potential charges would involve actions that took place prior to Flynn's involvement with the Trump campaign they would not only have no reason to share, there would probably be privilege reasons not to.

Occam's razor. We already know that the rumored Flynn charges are unrelated to anything that involves Trump or collusion. Unless there are other potential charges that we do not know about, the privacy issues are best explained by what we do know.

Does this mean that Flynn couldn't potentially have information to provide? Of course not.  But nearly every charge to every potential dependant  comes with some attempt to come to a plea agreement. Very few actually are 'turning" on anyone.

Go back to Watergate. This is following the Senate hearings, others who were involved, opened up. John Dean comes to mind. He was deeply involved at every level. Trump had kept in touch. He usually cut off all contact. But not with him.

I think that the noose around his neck is getting tighter.

Flynn's lawyer and a spokesman for Mueller declined to comment on Thursday.

Jay Sekulow, an attorney for Trump, said: "No one should draw the conclusion that this means anything about General Flynn cooperating against the president."

The Times reported that Flynn's lawyers had been sharing information with Trump's legal team about the Mueller investigation. Citing four unnamed people involved in the case, the newspaper reported the cooperation agreement had ended.

Due to rules that aim to prevent conflicts of interest when lawyers represent clients, the move by Flynn's lawyers to stop communicating with Trump's lawyers indicated Flynn was now cooperating with Mueller, the Times said, although adding that in itself was not proof.

But the development has led Trump's lawyers to believe that Flynn has begun discussions with Mueller about cooperating, according to the Times.

Flynn served 24 days as Trump's national security adviser but was fired after it was discovered he had misrepresented his contacts with a Russian diplomat to Vice President Mike Pence.

Mueller's inquiry is looking into Flynn's paid work as a lobbyist for a Turkish businessman in 2016, in addition to contacts between Russian officials and Flynn and other Trump associates during and after the Nov. 8 presidential election, Reuters reported in June.

A lawyer for Flynn's son, Michael Flynn Jr., who worked with his father and is also being investigated by Mueller, according to a person familiar with the matter, declined to comment.

Washington Post
The Plum Line Opinion

Michael Flynn is the key to the Russia scandal — and he may have just flipped on Trump

By Paul Waldmn November 24

Flynn’s lawyer ends communications with Trump’s team

A lawyer for Michael Flynn has ended communications with President Trump’s legal team, a sign that Flynn may be preparing to cooperate in the Russia probe.

Michael Flynn, who served as President Trump’s national security adviser for just 24 days before being cut loose, may be the KEY FIGURE to unraveling the entire Russia scandal. If that’s true, THE PRESIDENT JUST GOT SOME VERY, VERY BAD NEWS in the form of a New York Times report:

Lawyers for Michael T. Flynn, President Trump’s former national security adviser, notified the president’s legal team in recent days that they could no longer discuss the special counsel’s investigation, according to four people involved in the case — an indication that Mr. Flynn is cooperating with prosecutors or negotiating a deal.

Mr. Flynn’s lawyers had been sharing information with Mr. Trump’s lawyers about the investigation by the special counsel, Robert S. Mueller III, who is examining whether anyone around Mr. Trump was involved in Russian efforts to undermine Hillary Clinton’s presidential campaign.

That agreement has been terminated, the four people said.

Defense lawyers frequently share information during investigations, but they must stop when doing so would pose a conflict of interest. It is unethical for lawyers to work together when one client is cooperating with prosecutors and another is still under investigation.

We should be clear that this news is not definitive proof that Flynn is cooperating with Mueller. It may mean only that he is in the process of negotiating a deal to avoid prosecution, and that deal might or might not involve giving information on other figures in the investigation.

But if Flynn is indeed cooperating, Trump is in BIG TROULE.

That’s because if Flynn is cooperating, it can only be because he has information to offer Mueller ON SOMEONE MORE IMPORTANT THAN HIMSELF. THAT'S HOW IT WORKS. And who is more important than Flynn? Only a very small number of people. Among those implicated in this whole affair, that group may consist of JARED KUSHER and TRUMP, and that’s about it.

James said...

The article at 6:04 continues:

Which means we may be getting closer to answering a question I’ve been asking for a long time: Why was President Trump so intensely focused on protecting Michael Flynn?

You’ll recall that Flynn was supposedly fired because he lied to Vice President Mike Pence about his contacts with Russian officials during the campaign and the transition, claiming he had only exchanged pleasantries with them when in fact they had discussed substantive policy matters, something Pence then repeated to the media. This was always an odd explanation for the firing. Even more odd was the fact that immediately, Trump began telling anyone who would listen what a great guy Michael Flynn is and how unfair the whole mess was to him.

Given that Trump is not known for being loyal to those who work for him, that was rather curious. Donald Trump looks out for Donald Trump, and if you become a liability to him, he’ll very quickly start acting as though he barely knew you. Now consider what Trump proceeded to do with regard to Flynn:

The day after Flynn resigned, Trump asked then-FBI Director James Comey to stop investigating the former national security adviser. “I hope you can let this go,” Comey reported Trump saying in a memo he wrote immediately after their meeting.

Trump asked Director of National Intelligence Daniel Coats to intervene with Comey to get him to back off his investigation of Flynn.

Unlike with previous aides who have displeased him, after he fired Flynn, Trump made a very public show of praising him to the media.

Months after Flynn was fired and as the investigation was accelerating, Trump kept in contact with Flynn. “I just got a message from the president to stay strong,” Flynn told friends at a dinner in April.

In May, Trump scolded his staff for criticizing Flynn to the media and had his spokesmen issued statements lavishly praising Flynn.

It’s almost as though Trump wanted to make sure Flynn didn’t turn on him.

:) said...

But if Flynn is turning on Trump, it’s because he is in a whole lot of legal trouble, probably more than anyone involved in this scandal with the exception of former Trump campaign manager Paul Manafort. Let’s remember that shortly after the Trump administration began, acting attorney general Sally Yates went to the White House and informed officials that Flynn had lied to the FBI about his contacts with Russian officials (which they knew because they were monitoring the Russian ambassador’s communications) and that because of those lies, he was susceptible to blackmail. For some reason, Flynn spent 18 more days in the White House before being fired.

By taking a large fee from Russia for giving a speech in late 2015, Flynn appears to have violated a law that requires retired generals getting such payments to receive prior approval. He also was hiding the fact that he was paid more than half a million dollars by allies of the Turkish government to promote Turkey’s interests while advising the Trump campaign (he later registered retroactively as an agent of a foreign government; failing to register is a felony). He failed to include payments from Russia on his financial disclosure forms and may have lied about it to investigators. During the transition, he managed to delay a military operation against the Islamic State that Turkey objected to while he was secretly receiving those Turkish payments, a story that has gotten strangely little attention. He was even reportedly involved in planning for a bizarre plot to kidnap the exiled Turkish cleric Fethullah Gulen in Pennsylvania and return him to Turkey, for which Flynn and his son were allegedly to be paid $15 million.

In short, Flynn appears to have violated multiple laws in multiple ways and could be looking at the possibility of serious time behind bars. He may have information Mueller could use in a case against Kushner, Trump or others, relating to multiple strands of the investigation. He may know things about the campaign’s relationship with the Russian government or about an obstruction of justice case related to Comey’s firing. Don’t forget that Trump admitted on national television that he fired Comey to shut down the Russia investigation, then shortly thereafter told the Russian foreign minister and ambassador that with his firing of Comey, “I faced great pressure because of Russia. That’s taken off.”

Here’s what we should watch for now:
If the White House suddenly changes how it talks about Flynn, disparaging him instead of saying what an admirable fellow he is, that’ll be a good indication of a change in Trump’s feelings. And it looks as though he has a lot to be nervous about.

hey alky -

deroy murdock just penned a column that lays it out in a way that even you can understand:

This Thanksgiving, Thank Donald J. Trump

• The Dow Jones Industrial Average, NASDAQ, and S&P 500 all hit record highs on Tuesday. The Wilshire 5000 Index calculates that some $3.4 trillion in new wealth has been created since President Trump’s inauguration and $5.4 trillion since his election. Fueled by the reality of deregulation, expectations of lower taxes, and a new tone in Washington that applauds free enterprise rather than excoriate it, the economy is on fire.

• Atop the second quarter’s 3.1 percent increase in real GDP, and 3.0 in 3Q, the New York Federal Reserve Bank predicts that 4Q output will expand by 3.8 percent. This far outpaces the feeble average-annual GDP growth rate of 1.5 percent on President Obama’s watch. Meanwhile, the IMF expects global GDP to rise by 3.5 percent this year. So much for a Trump-inspired “global recession.”

• Unemployment is at 4.1 percent, a 17-year low. New unemployment claims in September were at their most modest since 1974. Goldman Sachs on November 20 “lowered our unemployment rate forecast to 3.7 percent by end-2018 and 3.5 percent by end-2019.” According to the Wall Street powerhouse’s chief economist Jan Hatzius, “Such a scenario would take the U.S. labor market into territory almost never seen outside of a major wartime mobilization.”

• American companies have been expanding operations here rather than shipping jobs overseas. Corning, for instance, announced a $500 million investment in new U.S. production, launching 1,000 positions.

Yeah, because it never happened.

The economy grew at just a 1.5 percent pace during President Barack Obama's two terms that began in 2009 as the Great Recession was ending. His second term in office saw GDP average 2.1 percent a year, but overall Obama presided over the worst recovery since the Great Depression.

it's ANNUAL GDP growth that matters, d0pie.

One of the biggest criticisms of Obama's economy is that growth has been sluggish. Historically, the U.S. economy has expanded 3% or more a year, on average.

The Great Recession was a meat-cleaver on the economy. Since then, the U.S. has struggled to grow at much more than 2% a year under President Obama.

For some perspective, here's how big that job growth was: Obama averaged 109,000 jobs per month. That's far better than either President Bush experienced, but it's well below the 242,000 that Bill Clinton presided over in the roaring 1990s. For Reagan,

Federal Reserve Bank of St. Louis
Of course, President Obama came into office as the economy was plunging into a recession (a plunge that also drags down George W. Bush's number). But even if you average out Obama's 75 straight months of job growth, you get 199,000 jobs per month, still shy of Clinton's economy.

In other words, the Obama recovery has been moderate, but remarkably steady. The question is how long that steady climb can continue uninterrupted. The unemployment rate is already near a nine-year low, as Steven Russolillo at the Wall Street Journal pointed out this week, and there is some question among economists how low it can go.

Wages finally climbing

Having a job is one thing. Having a job that pays well is another. And slowly through Obama's tenure, those wages have inched upward. In fact, wages were one bright spot of Friday's jobs report. Average hourly wages were up by 2.9 percent in December. After several years of hovering around 2 percent, that's welcome growth.

Aside from meaning more money in workers' pockets, wage growth serves as yet another sign of a tightening labor market, signaling that employers are willing to pay more to attract workers.

This was published at the end of the last real President's term. President Bannon, oh yes President Tweeter aka Trump.

Read the graphics and oh yeah. get CH to read them! He can understand them.

economic growth?

who needs that?

lil georgie moonbat says we need to strangle our economy to save gaia:

"We need a different system, rooted not in economic abstractions but in physical realities, that establish the parameters by which we judge its health. We need to build a world in which growth is unnecessary, a world of private sufficiency and public luxury. And we must do it before catastrophe forces our hand."

Anger at Mueller Burns Hot on the Right

Anger at Robert Mueller is burning white-hot on the right and in conservative media, where calls for the special counsel to recuse himself from the investigation into Russian election meddling have reached a fever pitch.

This article really raises some powerful points against Mueller. And yet it ends:

Republican leaders in Congress have also defended Mueller's integrity.

"Remember, Bob Mueller is a Republican who was appointed by a Republican, who served in the Republican administration ... and stayed on until his term ended," Speaker Paul Ryan (R-Ohio) said earlier this year. "I don't think many people are saying Bob Mueller is a person who is a biased partisan."

Senate Majority Leader Mitch McConnell (R-Ky.) has said there is no need to pass legislation protecting Mueller from being fired because there is no indication that Trump intends to do so.

"I think the view up here is, let him do his job," McConnell said.

The problem with liberalism: It has no limiting principles.

At its core, liberalism is an incoherent, value-free ad hoc ideology that doesn't promulgate any enduring ideas that stand the test of time. It has no underlying moral foundation to support its ideas other than pilfering those rooted in Judeo-Christian ethics and is parasitical of its foundations and morality. Liberalism is relativistic in that it is constantly contradicting itself based on phony compassion, its pretense of virtue, and its constant search for identity.

Everything liberals and liberalism stands for masks its real objective of seeking and maintaining political power. It is a con and a deception, where millions have fallen for its contrived and manufactured objectives based on accepting it at face value.

Let's look at what the "pastor" posted:

"Blessed are you when people hate you and revile you and persecute you and utter all kinds of evil against you falsely" - here it is not false nor evil

"on my account" - again not so.

"Rejoice and be glad, for your reward is great in heaven. For so they persecuted the prophets who were before you." - since the preceding is not what's happening this obviously doesn't apply to you, though in your sick mind you appear to think so.

He said he wanted to see the United States become “an actually fair, meritocratic society.” Absent that, he would settle for a white ethno-state “where things are fair, because there’s no competing demographics for government power or for resources.”

His fascist ideal, he said, would resemble the early days in the United States, when power was reserved for landowners “and, you know, normies didn’t really have a whole hell of a lot to say.”

He declared the widely accepted estimate that six million Jews died in the Holocaust “overblown.” He said that while the Nazi leader Heinrich Himmler wanted to exterminate groups like Slavs and homosexuals, Hitler “was a lot more kind of chill on those subjects.”

“I think he was a guy who really believed in his cause,” he said of Hitler. “He really believed he was fighting for his people and doing what he thought was right.”

Ivanka told the Associated Press of Moore: “There’s a special place in hell for people who prey on children. I’ve yet to see a valid explanation and I have no reason to doubt the victims’ accounts.” He's got a place in Coldheartedtrth Heaven.

Michael Flynn's legal team won't be sharing information about Special Counsel Robert Mueller's investigation with President Trump's lawyers anymore, a possible indication Flynn may be trying to cut a deal.

The New York Times:

The notification alone does not prove that Mr. Flynn is cooperating with Mr. Mueller. Some lawyers withdraw from information-sharing arrangements as soon as they begin negotiating with prosecutors. And such negotiations sometimes fall apart.

Still, the notification led Mr. Trump’s lawyers to believe that Mr. Flynn — who, along with his son, is seen as having significant criminal exposure — has, at the least, begun discussions with Mr. Mueller about cooperating.

ABC News:

Sources familiar with the discussions between Flynn's legal team and the president's attorneys tell ABC News there was never a formal, signed joint defense agreement between Flynn's defense counsel and other targets of the Mueller probe.

However, the teams have at times engaged in privileged discussions.
Former national security advisor Michael Flynn reportedly told friends he and President Trump stayed in touch for months after Flynn was forced to resign in February after just 24 days on the job. In April, Flynn said the president told him to "stay strong."

The evidence is that almost every day the investigation seems to be, using my favorite visual arts look, that the noose around the neck of The President is getting tighter every single day.

I'll grant that Trump won the election, and that he got an appointment through to the Supreme Court. One was a gift from the Democrats, the other a gift from the Republican Congress, but I'll grant those as accomplishments.

There is nothing else, no other Trump accomplishment that can't be attributed to just sitting in the chair. Even where he's tried to implement his half-witted campaign promises, he's mostly failed. I'm not complaining - that's a good thing, that Trump is an albatross hanging off the GOP's neck, and I don't expect that to change for three years. At least, we're starting to get some comedy back, given the recent stupidity and his die-hard supporters scrambling to find hilarious excuses.

actually we do, wp. it is the spawn of dodd-fwank, it was brought into existence under fauxcahontas warren, and it's data collect techniques rival the NSA. it's publicly stated mission is relatively honorable, but it's actual existence and structure is chilling. at the end of the day, it was devised by those who seethe with envy and anger at the free market capitalist system.

it was designed to fuck with and destroy people and institutions liberals would choose to target. and since there's no oversight, if you land in their kill zone you're dead, with no legal protection available to you.

those who support the CFPB are either ignorant to what it is and how it operates, or approve of it's gestapo-like financial methods and procedures.

really rog?

you mean like the WaPo's 'democracy drowns in bullshit' fake news?

Washington Post reporter Janell Ross gave a presentation at a secretive California gathering where Democratic politicians, liberal activists, and their biggest donors plotted the future of the progressive movement without notifying her superiors that she would be attending, according to a Post spokesman.

The Democracy Alliance went to great lengths to keep the identities of its members and guests confidential at its fall investment conference last week at the La Costa Resort, but the Washington Free Beacon obtained a detailed conference agenda that lists both events and featured guests.

Among them was Ross, a national reporter who closely covered the 2016 presidential campaign for the Washington Post and has since continued to cover the Trump administration.

Ross sat on a panel to assist conference-goers on the topic of "getting the economic narrative right" in future elections, according to the agenda, which can be viewed in full here.

Ross, whose panel was sandwiched by a talk with liberal billionaire George Soros and a message by Democratic senator Amy Klobuchar (Minn.) on Russian interference in the 2016 election, helped attendees explore questions such as: "What do progressives stand for?"

"In this panel discussion, developed by the DA's Inclusive Economy Fund, we pose some fundamental questions, including: What do progressives stand for? How do we grapple with the tough issues? What story are we trying to tell and how does it play out in communities across the country? How do we translate what the polls and research tell us into the compelling narratives that will build the public will to reorient our economy and combat inequality?"

The panel was framed in the agenda as a response to the 2016 election, in which Democrats were criticized for failing to understand the economic concerns in areas of the country carried by President Trump.

"Progressives were knocked flat in 2016, but in our scramble to understand and react to what happened, we run the risk of forcing ourselves into false divides," the agenda writes. "We risk losing focus on the deep systemic flaws in our economic and social frameworks that leave vast numbers of Americans vulnerable and insecure."

I have to take online refreshers on the CFPB and other regulations, every few months so I strongly dispute that notion that anyone who is supportive of it is "ignorant". Maybe the executives higher-up begrudge the productive time spent, maybe not, none of them have ever mentioned it. It's just 10 or 15 minutes, maybe an hour for employees who have to study it, and everything that *I* have to be concerned about are actions that I'd never do anyway.

If you wish you could scam people into buying financial services they don't want, or which aren't what they believe them to be, or steal their private data and sell it, then sure you're going to chafe under the restrictions.

The biggest problem the CFPB has in my opinion is that enforcement is far too lax.

wphamilton said...

Well I'm going to agree with that, yet you'll recall that it was only a real possibility because Trump was the candidate. But if that's all he achieves in four years, and he's a drag on the Conservative agenda, then it's not enough. The fact still remains that he's a zero, and that's being charitable if he's an active impediment.
