The Memo release

What we know (so far) from the memo:
      (full text of memo
  • The Steele dossier formed an essential part of the initial and all three renewal FISA applications against Carter Page.
  • Andrew McCabe confirmed (during sworn testimony to the committee) that no FISA warrant would have been sought from the FISA Court without the Steele dossier information.
  • The political origins of the Steele dossier were known to senior DOJ and FBI officials, but excluded from the FISA applications.
  • the FBI, DOJ, and Fusion GPS, and Richard Steele himself all leaked information to media outlets like Yahoo News, New York Times, Washington Post, CNN, etc, etc. Then those media reports (specifically Yahoo News) were included as additional evidence for the FISA application. The applications suggested that the source was not anyone associated with Steele or the dossier. 
  • DOJ official Bruce Ohr met with Steele beginning in the summer of 2016 and relayed to DOJ information about Steele's bias. Steele told Ohr that he, Steele, was desperate that Donald Trump not get elected president and passionate about preventing it. This information was also withheld from the FISA courts. 
  • Ohr's wife also worked with Fusion GPS, actually working on the same opposition research. All of her research was presented to the FBI through Ohr. 
  • The FICA application suggests coordination between Carter Page and George Papadopoulos. However, the FBI had no actual evidence of such coordination. Subsequently, the Papadopoulos information is said to have triggered the FBI counter-intelligence investigation into possible Trump campaign Russian collusion. 
  • The texts between Peter Strzok and Lisa Page include discussions about orchestrating leaks to the media regarding the investigation. 

Let's first reiterate that the FBI has not suggested any of this memo is inherently false. They went through it, there were some minor alterations, but by all accounts the contents are true as they stand. The argument from the FBI (and the Democrats) is that the memo is misleading based on certain omissions. (otherwise known as - they didn't get to tell their side of the story)

So far, this is nothing that wasn't already speculated about. But it does confirm that the FISA application was provided to a Judge under false pretenses in a variety of ways. Without another reasonable explanation for why the FBI would otherwise do so, it would certainly appear to show clear political bias for the action. It also shows evidence that high ranking members of the FBI investigation team were orchestrating damaging leaks to the media.

There is also speculation brewing that recent postponement of General Flynn's sentencing has to do with whether or not information obtained from Flynn's phone calls had to do with similar warrants (or illegal unmasking). If Mueller used Flynn's recorded conversations to prove his misleading statement charges, the entire plea agreement could be in jeopardy if the reasons to record those conversations are not legitimate.

To be clear, there is nothing in the memo that states this, but the speculation is there in part due to people associated with the separate ongoing Inspector General investigation into this matter. Many expect that report to be the equivalent to a rather large "other shoe" dropping.

WASHINGTON—In the summer of 2016, FBI Agent Peter Strzok had just wrapped up the investigation into Hillary Clinton’s use of a private email server and was embarking on a probe into Moscow’s interference in the presidential election. As he watched the Republican National Convention and scanned intelligence reports and news stories, he made clear how he felt about his new target: “f*ck the cheating motherf*cking Russians,” he texted in late July. “Bastards. I hate them.”

“I think they’re probably the worst,” texted Mr. Strzok, who had spent years tracking Russian spies and was familiar with their tactics. “F*cking conniving cheating savages. At statecraft, athletics, you name it. I’m glad I’m on Team USA.”

The messages were sent to FBI lawyer Lisa Page, one of thousands turned over by the Justice Department to Congress on Jan. 19 as part of an internal inquiry into how the Federal Bureau of Investigation handled its investigation into Mrs. Clinton. Mr. Strzok and Ms. Page, who were in an extramarital affair at the time, have been accused of bias against President Donald Trump after some previously released emails showed their disdain for the president.

In the texts, provided to Congress and reviewed by The Wall Street Journal, the pair’s distaste for Mr. Trump re-emerges. After the 2016 election, Mr. Strzok wrote, “OMG I am so depressed.” Ms. Page replied, “I don’t know if I can eat. I am very nauseous.”

Republicans have said the FBI’s handling of the Clinton probe and the Russia investigation, as well as the criticism of Mr. Trump in the couple’s exchanges, indicate bias against the president and have suggested a conspiracy to undermine him.

Mr. Trump said in an interview with The Wall Street Journal last month that he interpreted Mr. Strzok’s messages to Ms. Page as “treason.” Mr. Strzok’s attorney said at the time the president’s accusation was “beyond reckless.”

Texts critical of Mr. Trump represent a fraction of the roughly 7,000 messages, which stretch across 384 pages and show no evidence of a conspiracy against Mr. Trump. Rather, a broader look shows an unvarnished and complex picture of the lives of an FBI agent and lawyer who found themselves at the center of highly charged probes.

Rojer....lesson learned....texts and e-mails are forever and can be cherry picked to reveal anything someone wants it to be...My own experience goes to an e-mail I received and never forwarded that contained the phrase "kill a commie for Christ" and a holy roller who had a complaint about the sender was emboldened from such words.... Bottom line...I got a letter into my file as an accessory to the BS........

Another huge point: The FISA Application cited a Michael Isikoff article as "corroborating information" for the Steele Memo, despite the fact that it was Steele who had leaked that information to Isikoff.

So, Steele "corroborated himself" by leaking to Isikoff and then saying "Look, Isikoff says so too."

More: Steele was fired by the FBI for breaking rules of confidentiality when he went on his Media Tour, trying to interest Mother Jones and other outlets in his claims. The Memo notes he should have been fired for speaking to Yahoo News/Isikoff much earlier, before the first FISA application, because he gave Isikioff his bullshit too.

So yes, the FISA application was fatally defective from the outset. And yet Rod Rosenstein, Andrew McCabe, and Sally Yates (!!!) just kept re-signing the renewal applications.

The FBI and DOJ do not seem to have alerted the court to Steele's firing or unreliability (or partisan bias) in any application, even after they themselves fired him.

When Comey "briefed" Trump about the memo, he also withheld from Trump the dossier's partisan origins as well as the unreliablity (and firability) of its alleged author.

That's how it works, when you have bosses. You don't follow orders and you get fired. It's not illegal to fire someone for cause (especially open defiance of direct orders).

- The press stated over and over that Comey was investigating Trump.
- Comey testified that he told Trump multiple times that Trump was not under investigation.
- Trump asked Comey to make this fact public.
- Comey refuses.
- Comey works for and answers to the President.
- He got fired.

There is no obstruction here, James.

Yes James... the director of the FBI serves at the pleasure of the President. He can be fired at will for any reason or for no reason what-so-ever. James Comey was not the first FBI director to be fired by the President (in fact Clinton fired one back in the 90s).

There is no "independent" government officials in the executive branch. They all answer to someone, and ultimately they all answer to the President.

And of course, Clapper and Comey would set up a "briefing," allegedly to inform Trump of the Steele Dossier, but actually contrived to create an excuse for CNN to report on the existence of the dossier. Within hours of this bullshit "briefing," someone very high in the intelligence/law enforcement community set off the RUSSIAN collusion narrative by leaking the existence of the briefing to CNN.

So why would Trump have any questions about whether these guys were on his side or, more likely, on the Democrat Party/Media's side?

And of course -- the same people who've been leaking to CNN for a year against Trump now leak against him again.

Gee, why would someone in that position wonder about who his alleged executive-branch employees were actually working for?

A President can fire an FBI director at any time, but it is not wise for a President to do so after asking the director to do something for no good legal reason and perhaps to try to hide the President's illegal actions -- and then lie about the reason for the dismissal while also bragging about the reason for the dismissal, namely, to shut down a worrisome investigation.

Those are the facts.

Comey himself testified under oath that not only was the President (under his watch) never personally under investigation (for any wrongdoing) - but that he told the President this on multiple occasions.

Firing the FBI director does nothing to shut down any investigations. Comey was not personally either leading or involved in the Russian tampering investigation.

That investigation was run by people who worked under him. There was no reason to believe that firing Comey would end any of the 1000's of investigations taking place in the FBI.

The DOJ/FBI basically mislead the Judges. They hid the fact that the dossier was bought and paid for by the Clinton campaign, that the author was someone who openly declared that he was out to stop Trump from being elected. They provided a Yahoo story as further evidence, while literally stating that the story was not from the same source (when they knew it was).

In other words... they lied to the judge to get a warrant.


Imagine if the Trump DOJ mislead and flat out lied to a FICA judge to garner a warrant to eavesdrop someone from his 2020 opponents political campaign? You would want those people drawn and quartered.

The key question for a judge considering a warrant is not whether the informant harbors bias, but whether the information obtained from the informant can be corroborated from other materials. If an application is based on a single source, and that source is dubious, the application might well fail.

Correct... which is why they leaked the same information from the same source to the news media, and then used that news media report to "corroborate" the dossier... by falsely stating that the Yahoo story was not from the same source (even as they knew it was).

Perhaps, you should actually read the memo.... so you would't be foolishly blindsided by the facts.

And Richard Steele admitted in British Court Findings that he met with and provided the information from the dossier to Yahoo news (and other outlets) just prior to Yahoo news account came out.

Problem with the logic Roger:

1) if there was another source, then Yahoo had two sources (but only suggested that they had one).

2) The items in the dossier regarding Carter Page were wrong. It was eventually shown that he was not in the meetings that Steele suggested he was (and was in fact in an entirely different part of Russia meeting with entirely different people). Which would suggest that two people had the exact same "wrong" information?

Special counsel Robert Mueller’s Russia investigation has gathered enough steam that some lawyers representing key Donald Trump associates are considering the possibility of a historic first: an indictment against a sitting president.

While many legal experts contend that Mueller lacks the standing to bring criminal charges against Trump, at least two attorneys working with clients swept up in the Russia probe told POLITICO they consider it possible that Mueller could indict the president for obstruction of justice.

Neither attorney claimed to have specific knowledge of Mueller’s plans. Both based their opinions on their understanding of the law; one also cited his interactions with the special counsel’s team, whose interviews have recently examined whether Trump tried to derail the probe into his campaign’s Russia ties.

“If I were a betting man, I’d bet against the president,” said one of the lawyers.

The second attorney, who represents a senior Trump official, speculated that Mueller could try to bring an indictment against Trump even if he expects the move to draw fierce procedural challenges from the president’s lawyers – if only to demonstrate the gravity of his findings.

“It’s entirely possible that Mueller may go that route on the theory that, as an open question, it should be for the courts to decide,” the attorney said. “Even if the indictment is dismissed, it puts maximum pressure on Congress to treat this with the independence and intellectual honesty that it will never, ever get."

The lawyers’ assessments hardly resolve the public debate about whether a federal prosecutor can indict a sitting president — one that several attorneys involved in the Russia probe said they are closely tracking through online op-eds and Twitter dustups. (“It’s so much fun!” said one.)

but material "omission" of fact is still a fancy way of admitting that everyone stated in the memo was factually accurate. It had been reported prior to the FBI statement, that the FBI brass who reviewed it, could not point to any factual inaccuracies. The wording of their statement confirms those reports.

In other words. It's all true on fact. The FBI disagrees with the conclusions.

As I have continually stated, I believe that the FBI/DOJ/President should all declassify the entire FISA application. All the facts, no omissions, no spin. Then we can all judge for ourselves.


And let's be crystal clear here Roger. The DOJ/FBI had other options.

They could have actually spent some time attempting to corroborate the dossier, especially as it pertained to Carter Page. If reporters can take the time to figure out that Page was in a completely different portion of Russia than the dossier claimed he was, then the FBI could have come to those same conclusions prior to trying to get a FISA warrant.

In other words, investigate all you want. Do the research. Confirm what the sources told you. This is what the FISA courts sort of expects when they want corroboration of a single source.

If they hadn't done enough background to determine for sure is he was actually meeting with the people they claim... then what good is getting a surveillance warrant?

It's almost as if they were more interested in getting permission to put the guy under surveillance than they were to find out if the allegations from the dossier were actually true.

We have the rule of law, and fourth amendment rights that are supposed to protect us from overreaching law enforcement. I am not sure exactly why this doesn't bother you. I am pretty sure if the Trump White House was spying on their political opponents by citing private research to the FISA courts without verification... that you might find that alarming?

They had enough information and enough background(he met with Russians several times, . They had determined for sure is he was actually meeting with the people they claim... then what good is getting a surveillance warrant? That was sufficient to get a FISA warrant. And they are not handed out just for the hell of it. The judges had to get enough probable cause to issue the surveillance warrant. Some of those who haven't read much, you perhaps, don't seem to grasp that those warrants are not given willy nilly to private citizens on a feeling or "hunch" as we often see here by many.

Second, the investigation started in July, this warrant was issued in October, so, your point is? Or is it just the usual Trump can do nothing wrong and anything is just a bunch of left wing hacks in the FBI and DOJ that hated Trump?

Why? So I can join the growing chorus of people who believe that the relentless attacks on the bureau undermine not just America’s premier law enforcement agency but also the nation’s security. My resignation is painful, but the alternative of remaining quiet while the bureau is tarnished for political gain is impossible.

A small number of my current and retired colleagues have said that we should simply keep our heads down until the storm passes. I say this with the greatest respect: They are wrong. If those who know the agency best remain silent, it will be defined by those with partisan agendas.

F.B.I. agents are dogged people who do not care about the direction of political winds. But to succeed in their work, they need public backing. Scorched-earth attacks from politicians with partisan goals now threaten that support, raising corrosive doubts about the integrity of the F.B.I. that could last for generations.

When the F.B.I. knocks on someone’s door or appeals to the public for assistance in solving crime, the willingness of people to help is directly correlated to their opinion of the agency. When an agent working to stop a terrorist plot attempts to recruit an informant, the agent’s success in gathering critical intelligence depends on the informant’s belief that the agent is credible and trustworthy. And, as the former director, James Comey, would frequently say in underscoring the importance of high standards, whether a jury believes an agent’s testimony depends on whether it has faith in the bureau’s honesty and independence. To be effective, the F.B.I. must be believed and must maintain the support of the public it serves.

Do F.B.I. agents make mistakes? You bet. They are human beings. Because they are not infallible, the bureau is subject to a robust system of checks and balances, including its internal affairs division, the Department of Justice inspector general, congressional committees and the courts. These watchdogs ensure that personal opinions regarding politics, causes and candidates do not affect investigations. The system also provides an outlet for any investigator who suspects malfeasance on the part of the agency’s leadership to make those concerns known.

What, then, are we to make of the recent allegations of political bias at the F.B.I., particularly those involving two employees whose cringe-worthy text messages continue to threaten the agency’s reputation? While it would be disingenuous to claim that those two are not at least guilty of exercising incredibly poor judgment, it would be equally disingenuous for anyone who really knows the modern-day bureau to insinuate that the organization is plotting from within.

Furthermore, a congressional memo released on Friday accuses the F.B.I. and the Justice Department of abusing their surveillance powers to spy on a former Trump campaign adviser. But every statement of fact included in an affidavit for foreign intelligence collection must withstand the scrutiny of at least 10 people in the Department of Justice hierarchy before it is reviewed by an independent court.

There is, however, a difference between oversight by those in charge of holding the F.B.I. accountable and criticism by politicians seeking partisan gain. Political operatives are weaponizing their disagreement with a particular investigation in a bid to undermine the credibility of the entire institution. “The system is rigged” is their slogan, and they are now politicizing the Foreign Intelligence Surveillance Act process used to collect critical intelligence about our adversaries.

The assumption among confused and dismayed F.B.I. employees is that the attacks are meant to soften the blow should the investigation by Mr. Mueller, the special counsel, lead to additional charges. However, these kinds of attacks by powerful people go beyond mere criticism — they could destroy the institution. Although those critics’ revisionist supporters claim their ire is reserved for institutional leadership and not the rank and file, it is the F.B.I. agent on the street who will be most severely affected as public support for federal law enforcement is sacrificed for partisan gain.

These political attacks on the bureau must stop. If those critics of the agency persuade the public that the F.B.I. cannot be trusted, they will also have succeeded in making our nation less safe.

I am speculating that the memo isn't going to alter the direction of the investigation into the Russian intervention into the election. I'm not going to speculate on the outcome of the investigation. But I will say that the memo , looks like a young staffers, over a few beers and pizza. "Let's use "Clinton" as often as possible. The President will love it!" National security doesn't matter as long as we discredit the Muller commission!
