Yes, a President could be a "target" of an investigation

So as soon as it was released that Donald Trump was not considered a target in the Mueller special probe, about a million and one liberal pundits (all but a couple without any legal background) suggested that it didn't mean anything because the President cannot be "indicted".

The problem with that suggestion is that an "indictment" is simply a consequence of being a "target". It really has nothing to do with the legal definition. The DOJ has specific definitions of what a target is and what a subject is. Whether or not an indictment will follow isn't within the scope of that definition.

By the guidelines of a federal investigation, if the investigation has uncovered evidence that makes investigators or a Grand Jury feel a particular person has committed a criminal action, then that person becomes a target. A criminal case is likely being made. The criminal complaint might be taking form. Evidence is being analyzed.  Yes, a target should definitely worry about the possibility of an indictment, but it doesn't follow that every target requires an indictment to be considered a target.. 

So just because the President cannot be indicted (according to most experts), that doesn't mean that Special Counsel would not be obligated to still treat that person as if they have committed a criminal action. It would still require the investigator to put the criminal action into a report. It would still require them to build the criminal case. It would still require them to gather and analyze the evidence of said criminal action. They would still be treated as if they were a target.

This is what Ken Starr did when he provided a report stating the specific criminal acts that he believed President Clinton committed. It read pretty much like an indictment might read. It highlighted the laws that were broken, and the evidence of said criminal actions. I am sure if you asked Ken Starr, he would not have told Clinton and his attorneys that he was just a "subject" of the investigation. At least not if Ken Starr was following DOJ guidelines.

I think that Investigations operate according to the resolutions that are possible for the investigation.

To whatever extent that Mueller is looking into Trump (and he's playing that close to the vest), it is unlikely that not characterizing him as a criminal target means Trump isn't being investigated for offenses which may or may not be deemed by Congress to be serious enough for impeachment.

You do realize that unless Mueller finds specific evidence of an illegal conspiracy between Trump and the Russians, that his findings will not matter one iota as it pertains to impeachment.

The most likely offense that Mueller is apparently attempting to pin on Trump is some sort of obstruction charge, or possibly hoping to trap into some sort of false statement charge.

But you can rest assured that there are enough conservative legal experts who will scoff at anything like that. There are plenty of GOP members of congress who have law degrees (or don't) and have already made up the determination that firing Comey was not obstruction, and anything short of a signed confession by the President suggesting that he intended to obstruct justice will fall short.

As you pointed out. Mueller isn't likely to "indict" the President, meaning all he can do is offer a report. Anything that he offers that is considered "subjective" and it will be discounted as just another opinion (because that is all it is).


If he finds "tangible" evidence, such as destruction of evidence, tangibly coercing witnesses, or something up that alley... some tangible action that he was able to dig up from his investigation... then I think he might have a chance at changing some minds.

But otherwise, if it's some hypothetical or opinion about what could constitute obstruction, then he's just another legal guy with an opinion.

That will especially hold true if he attempts to accuse the President of a crime for actions that have never previously been charged or prosecuted (such as firing an FBI director).

There are two things wrong with that. One, impeachment for obstruction of justice is why Nixon resign, and the charge against Clinton, so regardless of what conservative Republicans in Congress have already decided, that's going to matter. And it doesn't have to be (can't be, if he finds obstruction) so narrowly devoted to the Comey firing either.

Secondly, beyond obstruction, if he finds anything that you'd consider high crimes then that will do just as well as conspiracy IMO.

Of course I realize where you're going with that. You want to narrowly restrict the possible outcomes to very specific requirements that you believe are extremely unlikely to be met. It makes good coffe-house arguments. But the fact is, as we've already seen in this investigation, Mueller is digging and whatever he finds will be part of it. Then it's up to Congress, and it may not be as strongly pro-Trump as you believe.

You don't say why you imagine those points to be significant, so I won't speculate on what's going on in your mind. The salient point however is that Trump could well face charges of Obstruction, as have two Presidents before him. Coldheart's declaration that Trump's only problem is if Mueller finds that Trump conspired with Russia is refuted by the precedent of Nixon and Clinton, as you yourself confirm here.

Mueller so far has not revealed any convincing evidence that Obstruction of Justice has occurred.

Firing the FBI director per se is not obstruction and there is no evidence that Trump tampered with witnesses or in any way impaired with the investigation of the special counsel.

(There is however, widespread evidence of abuse of the FISA law by the FBI.)

So the point WP is that unless you have that evidence, there is no impeachable charge that you can credibility bring against the president and you're talking out your ass.

It may seem like it when I write about the statutes, the way courts have used them, and what's going on in the investigation, but that's just the way law is. It's not semantics. When the elements of the statutes are well defined, we must understand precisely what they're referring to. When they aren't, when the courts look to standards such as legislative intent, or various "reasonable" type standards, that might also seem nitpicky but it's really not and can be fairly objective, believe it or not.

Whether Mueller has, right now, any solid evidence against Trump for obstruction is beside the point that if he DOES have evidence, a good case, then that alone would spell trouble for him. I don't know his case nor all the evidence he has; I have said that from the very start, and have never wavered from that. BUT, I can tell you what the law says about it, try to dispel the misconceptions and errors in reasoning, and it's nothing at all like semantics.

You don't like it, or you disagree, that's fine. But everything I've written is sound and legally correct, and I will stand by it.

Washington (CNN) - The United States and North Korea have been holding secret, direct talks to prepare for a summit between President Donald Trump and North Korea leader Kim Jong Un, a sign that planning for the highly anticipated meeting is progressing, several administration officials familiar with the discussions tell CNN.
Central Intelligence Agency Director Mike Pompeo and a team at the CIA have been working through intelligence back-channels to make preparations for the summit, the officials said. American and North Korean intelligence officials have spoken several times and have even met in a third country, with a focus on nailing down a location for the talks.
Although the North Korean regime has not publicly declared its invitation by Kim Jong Un to meet with Trump, which was conveyed last month by a South Korean envoy, several officials say North Korea has since acknowledged Trump's acceptance, and Pyongyang has reaffirmed Kim is willing to discuss the denuclearization of the Korean peninsula.
The North Koreans are pushing to have the meeting in their capital, Pyongyang, the sources said, although it is unclear whether the White House would be willing to hold the talks there. The Mongolian capital Ulaanbaatar has also been raised as a possible location, the sources said.
The talks between intelligence officials are laying the groundwork for a meeting between Pompeo and his North Korea counterpart, the head of the Reconnaissance General Bureau, in advance of the leaders' summit. Once a location is agreed upon the officials said that the date will be set and the agenda discussed in greater detail.
Officials said the decision to use the already existing intelligence channel was more a facet of Pompeo's current status as CIA director as he awaits confirmation as secretary of state than a reflection of the content of the discussions. Pompeo is expected to begin the process of Senate confirmation in the next several weeks.
One of Trump's most trusted national security advisers, Pompeo has led efforts to prepare for the summit, which Trump has pressed his aides to organize. If he confirmed, he will assume oversight of the diplomatic preparations.
As recently as this weekend, Trump told associates he was looking forward to the summit, which he agreed to on the spot when presented the invitation from Kim. The timeline, however, remains unknown. Officials said the current target is late May or even June.
Trump is due to meet in two weeks with Japanese Prime Minister Shinzo Abe at his Mar-a-Lago estate. Abe is expected to come bearing a list of concerns about opening talks with Kim.

You're probably thinking of total numbers, the total dollar amount given to charity, Republican held States in general are more generous for example.

But do you see what you have done here? You have defined a litmus test for what should be considered to be a religious person. Those who donate more money are more aptly religious, according to you. That may be true for certain sects, but it's not universal even among Protestant denominations, let alone religions in general. Almost all of them have a concept for helping those in need, but how much is given? Not a very good test.

I would rank it better than "No real Christian would support a liberal" though.

RRB, polls prove things within a certain range of precision, and a given confidence in the results. Although often less accurate than people tend to believe (mainly due to unsuspected confounding factors and fickle human nature), that is the purpose of polls and the science behind them is sound.

The reasonable test for a person's religion is whatever they profess to be. Religions encompass the lip-service and hypocrites as well - some thrive on them- and don't tell me that you don't know the truth of that. The Pew poll measured by that test, and there is no reason to doubt it.

So let's recap. Unless you're considering ONLY Evangelicals and Mormons, more of them are Democrats than Republicans, or have similar numbers in the case of mainline Protestants (which slightly favor Republicans). Specifically, more Christians are Democrats or lean Democrat than are or lean Republican. Therefore, a randomly chosen "True Christian" is as likely to support a "liberal" as a "conservative".

Even among the Evangelicals, about a quarter of them are Democrats and might support a liberal politician.
