So what exactly is "ballot harvesting" ?

As has been pointed out by many... nearly every Republican in the California House races were defeated by their Democratic counterpoint. In several cases, these were Republicans that were well ahead after the initial ballots were counted, only to lose as record number of absentee ballots were counted in subsequent days. In some cases, the absentee ballots overtook double digit voting day leads, with miraculous margins of the absentee ballots coming from Democrats.

 

Was this some sort of "fraud" or some form of illegal activity? Well the answers to this are "probably" and unfortunately "no".

California has set up a pretty ingenious system, that will pretty much take the average voter out of the loop as it pertains to winning elections. In essence, the voter will be replaced by the ballot harvester as the key to winning elections in California. Why just vote once, when you can go collect or harvest dozens (if not hundreds) of ballots for your candidate.

So what is California doing?

  • First they send an absentee ballot to every voter in the state, whether they requested one or not.
  • Then they allow anyone who would like to do so, the opportunity to go door to door, pick up those ballots from voters, and deliver them to a polling station.
  • On top of that, there is nothing that prevents that third party person (who can be literally anyone) to push for that person to vote for one candidate or the other, and even help fill out the ballot. 
  • Lastly, they are not required (once they knock on the door) to help everyone. If that person is not voting for whom they would like, they can simply refuse to take the ballot (or presumingly they could, in theory, take the ballot and not turn it in). 

So let's start with the fact that in generally all elections it is illegal for a poll worker to make a political pitch for anyone, and those poll workers are limited as to how far they can go in helping a voter fill out the ballot. In fact, there are generally laws that prevent "any" sort of polling station politicking anywhere's near a polling station. 

But with ballot harvesting, these people become (for all practical purposes) poll workers and these homes become the polling station. But these ballot harvesters are not only allowed to help fill out the ballots (or even fill them out for them), but they are allowed (while the person is literally voting) to tell them who to vote for.

Now Democrats in the state are arguing that this is just plain old old fashioned get out the vote tactics, and vote canvassing. But it's unclear to me how this would pass the muster of many of our election laws (and most certainly crosses all sorts of lines as it pertains to election etiquette). The potential for fraud seems almost purposeful.

If your name is not on the voter list at your polling place, you have the right to vote a provisional ballot.

What Is a Provisional Ballot?

A provisional ballot is a regular ballot that is placed in a special envelope prior to being put in the ballot box.

Who Casts a Provisional Ballot?

Provisional ballots are ballots cast by voters who:

Believe they are registered to vote even though their names are not on the official voter registration list at the polling place.
Vote by mail and instead want to vote at their polling place or a vote center, but they did not receive their ballot or do not have their ballot with them (and the elections official is unable to verify that they have not returned their vote-by-mail ballot).
What Happens After You Cast a Provisional Ballot?

Your provisional ballot will be counted after elections officials have confirmed that you are registered to vote in that county and you did not already vote in that election.

You may vote a provisional ballot at any polling place in the county in which you are registered to vote, however, only the elections contests you are eligible to vote for will be counted.

The fraudulent voter would have to know that the person he is imitating wasn't going to vote. If there were hundreds of double vote provisional votes you might have a point. But there is no evidence to support your allegations.

I have been voting in California for decades. The ballots you get in the mail are not the final ballots. In a district in North Carolina the Republican beat the Democrat by about 800 votes. The Charlotte Observer has a story about voter fraud that Scott will never waist his time telling the Coldheartedtruth story here.

Unreturned ballots
A News & Observer analysis of data on mail-in ballots in the district found:

▪ Across the 9th district, which stretches from Charlotte to Fayetteville along North Carolina’s southern border, 24 percent of the requested mail-in ballots were unreturned. In Robeson County, 64 percent of mail-in ballots requested did not make it back to elections officials. In Bladen County, the figure was 40 percent.


▪ The unreturned ballots are disproportionately associated with minority voters. More than 40 percent of the ballots requested by African Americans and more than 60 percent of those requested by American Indians did not make it back to elections officials. For white voters, that figure was just 17 percent.

▪ In Bladen County, the breakdown for African Americans and American Indians generally reflected the district-wide figures. But in Robeson County, 75 percent of the mail-in ballots requested by African Americans and 69 percent of the mail-in ballots requested by American Indians were listed as unreturned.

▪ In other counties hard-hit by Hurricane Florence, as Bladen and Robeson were, the share of unreturned mail-in ballots was not as high. In Columbus County, 29 percent of the mail-in ballots requested were unreturned. In Pender County, the figure was 18 percent.

As the group wrote then, Trump’s tweet about Cohen and Manafort raised serious questions under 18 U.S.C. § 1512(b)—better known as the statute criminalizing witness tampering. Under § 1512(b), it is illegal to “knowingly … corruptly persuade[] another person”—or to attempt to do so—“with intent to … influence, delay, or prevent the testimony of any person in an official proceeding” or “cause or induce any person to withhold testimony . . . from an official proceeding.” The authors concluded then that, while the specific Manafort tweet in question might not in and of itself constitute witness tampering, the tweet fit into a larger pattern of obstructive conduct by the president that could well fit that bill.

In 2014, 63 percent of households headed by a non-citizen reported that they used at least one welfare program, compared to 35 percent of native-headed households.

Welfare use drops to 58 percent for non-citizen households and 30 percent for native households if cash payments from the Earned Income Tax Credit (EITC) are not counted as welfare. EITC recipients pay no federal income tax. Like other welfare, the EITC is a means-tested, anti-poverty program, but unlike other programs one has to work to receive it.

Compared to native households, non-citizen households have much higher use of food programs (45 percent vs. 21 percent for natives) and Medicaid (50 percent vs. 23 percent for natives).

Including the EITC, 31 percent of non-citizen-headed households receive cash welfare, compared to 19 percent of native households. If the EITC is not included, then cash receipt by non-citizen households is slightly lower than natives (6 percent vs. 8 percent).

While most new legal immigrants (green card holders) are barred from most welfare programs, as are illegal immigrants and temporary visitors, these provisions have only a modest impact on non-citizen household use rates because: 1) most legal immigrants have been in the country long enough to qualify; 2) the bar does not apply to all programs, nor does it always apply to non-citizen children; 3) some states provide welfare to new immigrants on their own; and, most importantly, 4) non-citizens (including illegal immigrants) can receive benefits on behalf of their U.S.-born children who are awarded U.S. citizenship and full welfare eligibility at birth.

Except in the case of a candidate or the spouse of a candidate, existing law prohibits the return of a voter’s vote by mail ballot by one of those designees who is also a paid or volunteer worker of a general purpose committee, controlled committee, or any other group or organization at whose behest the individual designated to return the ballot is performing a service.

This bill would remove those restrictions and instead authorize the designation of any person to return a vote by mail ballot.


Roger, this law was enacted for the sole purpose of allowing paid workers or other election volunteers to go door to door and "harvest" ballots.

The other law change is that Californians all are now sent an mail-in (absentee ballot) to all voters (whether they request them or not). This means that literally every voter is a potential "harvest" for a paid campaign worker.


There was a reason why the previous laws required your surrogate to be a relative or someone who lived with you. There is a reason why no other state allows campaign workers to go around picking up ballots.

The violation of the law is an impeachable offense. The House of Representatives has used this in the impeachment charges against Richard Nixon for Watergate.

A sitting President cannot be arrested. If he was impeached and convicted then the Department of justice would be empowered to arrest the civilian Donald J. Trump.

The amount of mail-in ballots counted in Orange County were unprecedented – a whopping 250,000 ballots were produced in OC as a result of the new “ballot harvesting” law.

Republicans such as Mimi Walters, Dana Rohrabacher and Young Kim were all ahead election night only to lose their races after late ballots were counted.

Young Kim was ahead by 8,000 votes on election night and even attended freshman orientation in Washington DC only to lose to her Democrat opponent weeks later.

The new voting system in California is so bad that Democrat TJ Cox, who was down by 6.4% on election night in California’s 21st district ended up defeating GOP incumbent David Valadao three weeks later.

Precinct 38083 in Orange County, California had a 120% turnout – 465 registered voters and 561 ballots cast in this precinct. (screenshot below)

Other numbers don’t add up in Orange County either and The Gateway Pundit has been reporting on this for weeks.


October 22nd totals for voter registration there show 541,665 (R) and 523,624 (D) yet totals from Election Day for D’s surpass that by 40k votes so we’re to believe there was 100%+ turnout of registered Dems?

For Democrats, the ballot harvesting was all part of a greater effort to get out the vote from their supporters, particularly from occasional voters.

“We beat Republicans on the ground, fair and square,” said Katie Merrill, a Democratic consultant deeply involved in November campaigns. “Many of the field plans included (ballot harvesting) as an option to deliver voters or their ballots” to the polls.

Those efforts involved identifying voters who might support Democratic candidates and ignoring those who wouldn’t.

In one Orange County household, for example, both the husband and wife were longtime Republicans, said Dale Neugebauer, a veteran Republican consultant. Democratic volunteers came by the house four times, each time asking to speak only with their 18-year-old daughter, a no-party-preference voter, and asking if she wanted them to pick up her signed and completed ballot.

That’s a perfect example of the “thorough and disciplined” ground game the Democrats used, said Merrill.

“We were not wasting time talking to people who weren’t going to vote for Democrats,” she said.

Many of those harvested ballots arrived in the waning days of the election, adding to the flood of votes that couldn’t be counted on election day. And those late ballots broke heavily for the Democrats.

“Absolutely, ballot harvesting played a very significant role,” said Neugebauer, who worked most recently for Orange County Rep. Dana Rohrabacher, another Republican who lost his seat. Democrats had “a huge advantage by executing a plan to gather ballots from voters.”

“I have a little bit of professional admiration for how well the Democrats executed their plan,” Neugebauer admitted.

While the late vote tally typically favors Democrats, the partisan advantage this year was staggering.

In the Central Valley’s 10th Congressional District, for example, Denham led Democrat Josh Harder by 1,287 votes the morning after the election. As of Thursday, with almost all of the late ballots counted, Harder was ahead by 7,416 votes.

In Orange County, Republican Rep. Mimi Walters of Irvine saw her 6,074-vote lead over Democrat Katie Porter turn into an 11,866-vote deficit.

Speaker Ryan was among the Republicans who couldn’t explain what happened.

“When you win the absentee ballots and you win the in-person vote, where I come from, you win the election,” Ryan said. “I’m not saying there’s anything nefarious about it, because I just don’t know, but we believed we were up about six seats in California the night of the election, now I think we lost just about every single one of those.”

For Democrats, Ryan’s comments were little more than sour grapes from a GOP leader who is retiring after his party was mauled in the midterms.

“Unlike other places in the country, in California we believe in actually counting every vote,” said Rep. Pete Aguilar, D-Redlands (San Bernardino County). “That is sometimes confounding to some of my colleagues, but I think that’s what’s at play here.”

Badly outnumbered in the Legislature, California Republicans have no hope of undoing the new rules. Instead, they’re going to have to adapt.

“The Democrats are creating a new, highly efficient tool to turn out voters,” said Neugebauer, the GOP consultant. “If Republicans can’t find a way to match it, we’re going to lose more elections all over the country.”

In Robeson County, 64 percent of mail-in ballots requested did not make it back to elections officials. In Bladen County, the figure was 40 percent.


▪ The unreturned ballots are disproportionately associated with minority voters. More than 40 percent of the ballots requested by African Americans and more than 60 percent of those requested by American Indians did not make it back to elections officials. If the person in question harvested ballots in North Carolina, the that person should face the consequences of the law. Then that person would be one of many who broke election laws in 2018 and had to face the consequences.

I am not going to "express outrage" at every single act of malfeasance and criminal behavior, because doing so would take up most of my day. But as a general rule, I abhor election crimes and unlike you (and your ilk) I fully admit that they take place and:

SHOULD ALWAYS BE PROSECUTED (Republican or Democrat) to the fullest extent of the law!


But when California decides to sanction something that has been illegal in 50 states since we have had absentee and write in ballots, and still illegal in 49 states... then I take issue with it.

Again Roger, the same reasons why this was illegal in California and is still illegal everywhere else is why I we should all take issue with it.

It's one thing if people like the Koch Brothers and Soros fund advertising, pay staff, or even spend $$$ on get out the vote drives....

at the end of the day, all that is free speech that is designed to convince someone to take the initiative to vote and to vote for who they support.


It's another if you allow them to pay people to go door to door, in order to have them get people to physically vote and then take those ballots from the voter. That brings up everything from Poll worker laws, as well as equal protection questions if not "every" voter in the state is provided the same opportunity to simply hand their vote to a person who comes to their house.

Let's put it this way... would you be okay if 100% of the vote harvesters were bought and paid for by the Koch Brothers and the GOP? Would you trust that they would collect everyone's ballot fairly and turn everyone's ballot in for them?

btw... obviously the guy from North Carolina was not just out there to make sure people's ballots were turned in. He was out there specifically to make sure that Republicans were voting and getting those ballots in.

That is why it is illegal for you to allow campaign workers and other third party advocates to collect ballots. They are not doing it with the best interest of the voter or the state in mind. Everyone knows it. Nobody trusts the results when this sort of thing happens.

The fact is, that in many ways it allows for something that is the opposite of one vote, one person. This allows that "one person" might end up being responsible for multiple votes, and if allowed to continue will end up with California elections being decided by who has the better ballot harvesters. The voters will no longer be anything other than pawns.

CHT what happened in California is not that they sent vote-by-mail ballots to every voter but rather took the following steps (as I recall)

began automatically registering people as voters when the did things like get drivers licenses. People were encouraged to check a box to receive mail ballots for the "ease" (versus everything else where California encourages people to go "green")

They then allowed illegals to obtain drivers licenses

They resisted cleaning registered voter rolls which is why its not unusual for registered voters to exceed population.

They now allowed "harvesting" which even include phone apps showing where voters live and party affiliation. I wouldn't be surprised if this now includes "vote-by-mail" indications.

Knowing that youth voters and new car registrations would be largely either Democratic or Independent leaning that way they now have a fertile target ground. And eligibility while still required is winked at. And with cursive writing no longer being taught in California I wonder if forgery is even so hard any more (printed "signatures" and so many non-English speaking people and their native writing). They print ballots in at least 7 different languages further complicating things. And partisan workers now deposit stacks of filled out ballots in bundles (remember in Florida poll workers were actually seen filling out blank ballots)


We need nationwide voting standards and voter verification and 2018 proved that. And California probably should revote.

The fact that you believe that the GOP advocate probably altered the ballots before turning them in... is exactly why the law in 49 states does not allow paid campaign workers or even volunteer campaign workers to collect ballots.

It undermines the perceived integrity of the election and makes people question the results.



Now I can be honest and say that I don't want the guy from North Carolina doing it anymore than I want the people doing it in California.

Whereas someone like Roger is off the wall over the North Carolina situation, while relentlessly defending the California law (which as of yesterday he argued didn't exist).
