Trump’s authority would come not only from the National Emergencies Act, but also his power to control who may enter the U.S. and to protect the nation, as spelled out in the Supreme Court’s decision in the travel order case:
For more than a century, this Court has recognized that the admission and exclusion of foreign nationals is a “fundamental sovereign attribute exercised by the Government’s political departments largely immune from judicial control.” Fiallo v. Bell, 430 U. S. 787, 792 (1977); see Harisiades v. Shaughnessy, 342 U. S. 580, 588–589 (1952) (“[A]ny policy toward aliens is vitally and intricately interwoven with contemporaneous policies in regard to the conduct of foreign relations [and] the war power.”). Because decisions in these matters may implicate “relations with foreign powers,” or involve “classifications defined in the light of changing political and economic circumstances,”such judgments “are frequently of a character more appropriate to either the Legislature or the Executive.” Mathews v. Diaz, 426 U. S. 67, 81 (1976).
Trump reportedly is preparing a National Emergency Order and has found $7 billion that legally could be spent under such an Order. Jess Bravin at The Wall Street Journal writes that Trump may have as much as $13 billion available for a wall under a National Emergencies Act order:
Currently, $13.3 billion in the Pentagon budget may be available, according to a congressional aide, enough to cover the $5 billion that Mr. Trump is seeking for the border wall. That would have to be diverted from projects such as military housing that Congress previously authorized.
Law Professor Steve Vladeck writes of Trump’s broad statutory authority:
As most Americans have been surprised to discover, the National Emergencies Act gave the president the power to declare a “national emergency” (and to thereby unlock hundreds of special statutory authorities that are only available in such cases), without defining what a “national emergency” actually is. In the process, Congress left the door wide open, at least legally, for presidents to use the act as a pretext for pursuing policy objectives that, whatever their merits, have little to do with meeting and responding to a genuine emergency….
The tragic irony of the National Emergencies Act is that, when it was enacted, it was meant to constrain presidential emergency power, not expand it. Congress put a one-year time limit on all national emergencies (while allowing them to be renewed solely by presidential proclamation), and it created a fast-track procedure whereby a simple majority of the House and the Senate could quickly vote to terminate any existing national emergency — even if the president disagreed.
Congress did not try to define what would count as a national emergency, concluding, quite correctly, that it would be impossible to anticipate all of the myriad episodes, attacks, disasters and other crises that might validly trigger these special, standby authorities. Instead, Congress assumed that the statute’s procedural checks (and political safeguards) would be sufficient both formally and practically to deter future presidents from abusing the powers that came with an emergency declaration.
It seems pretty clear, even from left-leaning legal commentary, that Trump would have the statutory authority to declare the border crisis to be a National Emergency, and assuming he could find funds under the ancillary statutory powers, to spend the money even if there is no new congressional spending authorization. I haven’t seen any analysis of constitutional questions, but if the President is spending funds already authorized by Congress, I’m not seeing the likelihood of a successful constitutional challenge.
Maher questioned Coulter on her initial support for the president: “You voted for him, Donald Trump, and now you’re finding out he’s a lying con man. What was your first clue?”
Coulter shot back: “Okay, I’m a very stupid girl, fine.”

They were Mueller's responsibility to archive and I thought the left was supposed to have the same laws as the right.
And he was fired after the IG was able to miraculously recover texts deleted on his FBI device. Would seem to be very apparent these latest texts on his new device after he turned in his old device may contain similar material and could be a treasure trove.
If the right had done this Mueller would definitely have pursued obstruction of justice charges. Of course odd to charge yourself.
Then maybe Roger can tell us why all Hillary's devices were destroyed by a hammer. Appears quite a radical way of protecting yoga and grandchildren texts. And violates record retention laws. And was done by FBI...

Roger declares his support for "I'm IN her" Harris . Harris is a slut like Rogers current wife. Not like Rogers first wife , which Roger repeatedly cheated on.
If Stone lied under oath to Congress as Mueller alleges, then by all means prosecute him to the fullest.
But what exactly are the federal criteria that adjudicate when and where lying under oath to Congress or to federal authorities is a prosecutable crime? Is it perceived useful only in Robert Muller’s hunt for incriminating evidence against Trump, as in the case of Michael Flynn?
After all, nearly the entire Obama administration intelligence hierarchy not only lied under oath to Congress, but in some cases confessed to such.
None were indicted, certainly not the ubiquitous current pundit James Clapper, former director of National Intelligence, who in 2014 flat out lied under oath about NSA domestic surveillance on Americans. When caught, he confessed that he had given the “least untruthful answer.”.Will Stone use that rejoinder?
Not John Brennan who in 2014 lied under oath that the CIA he directed had not tapped in to Senate staff computers. And in 2011 he earlier had lied when he publicly asserted that there had been not a single instance of collateral killing by drone. And he has likely further lied in his current assertions about his own knowledge of the Steele dossier and its odyssey from government circles to the media.
Not James Comey. To a joint congressional committee, while under oath, on 245 occasions he infamously claimed he either did not know or could not remember, and he seemed mostly to consider the questioning a joke. His assertions about the use and details of the Steele dossier for a FISA warrant likely were not true. He routinely misled Trump by hiding his knowledge of the Clinton origins of the Steele dossier, and he lied in his assurances to Trump that he was not under FBI investigation. Comey’s testimonies about leaks cannot be reconciled with statements of his deputy Andrew McCabe.
And not Andrew McCabe, who at least on four occasions probably lied about FBI leaks to federal investigators, and later argued that he misunderstood or was misunderstood.
It may be one thing (although it should not be) for private citizens to lie under oath to Congress, but when four of the top officials of our intelligence agencies have lied under oath, and in two cases admitted such, and none were indicted, and all have at times been central players in the matters Mueller is investigating throughout the entire Russian collusion fiasco, then what is left of the American idea of equality under the law?
A dozen undocumented immigrant workers who were working on Trump's golf club were fired this month, even though managers knew their legal status for years - some up to 8 years!

He’s in trouble now. As absurd as the Russia nonsense is, the details about Trump’s sleazy associates, the porn star, the Playboy playmate and his seedy business practices leave his supporters feeling queasy, even if he hasn’t committed any crimes.
Instead of joining a fight that will make his most ardent supporters cringe no matter how it comes out, why not choose a battleground where he’s guaranteed a win? If Trump used the military to build the wall — actually build it, not keep telling us he’s going to build it — the Democrats will go mad.
They’ll hold impeachment hearings, file a million lawsuits, produce weeping children reading from phony scripts written by immigrant rights groups — and Trump will win. The public will support Trump overwhelmingly, and the left will be forced to keep reminding voters why they hate Democrats.
Instead, what he’s doing now absolutely guarantees that the next president will be a Democrat and, given today’s Democratic Party, that president will be Kamala Harris.
“They lied to the public for months before Donald Trump was elected — and then repeatedly after he took office. They lied to Congress as lawmakers sought to investigate Russia’s attack on American democracy in 2016. And they lied to the FBI, even when they knew lying was a crime,” the Washington Post reports.
“In indictments and plea agreements unveiled over the last 20 months, special counsel Robert Mueller has shown over and over again that some of President Trump’s closest friends and advisers have lied about Russia and related issues.
“The remaining question — for both Mueller’s team, as it works on a final investigative report, and for the American people — is why.”

D’Amato (R) Tells Trump to Sideline the ‘Whack-a-Doodles’ January 27
Former Sen. Alfonse D’Amato (R-NY) pleaded with President Trump to push back on the far-right flank of his base that urged him to recently shut down the government to fund a border wall, The Hill reports.
Said D’Amato: “Don’t let right-wing whack-a-doodles run the place. They’re out of their mind.”
President Donald Trump is “very worried” that his longtime ally Roger Stone will turn on him after Special Counsel Robert Mueller indicted him on seven counts in the Russia investigation on Friday, according to Vanity Fair reporter Gabriel Sherman.
Sherman cited several anonymous sources within Trump’s orbit, as well as Michael Caputo and Sam Nunberg, who are friends with Stone. They said that Stone has been expecting to get indicted for months now — something Stone has said publicly.
Stone insisted after appearing in Court that he will not plead guilty to the charges against him on Friday, adding: “There is no circumstance whatsoever under which I will bear false witness against the president.”
However, he did not rule out ever working with prosecutors — nor potentially telling them the truth about Trump, whatever that may be.
Writing for the Daily Beast, former prosecutor Peter Zeidenberg called the case against Stone “as close to a slam-dunk case as a prosecutor will ever bring.”
“As someone who prosecuted Scooter Libby and others on similar charges and defended white-collar cases involving similar charges as those alleged here—false statements, obstruction of justice and witness tampering—my takeaway is that Stone should begin getting his affairs in order,” the attorney wrote. “Barring a presidential pardon (always the wild-card possibility with a POTUS like Trump) Stone will be convicted and receive a very substantial prison sentence.”
Peter Zeidenberg: “This is as close to a slam-dunk case as a prosecutor will ever bring… Do not expect to see special counsel Robert Mueller make any attempt to flip Stone and have him cooperate. A defendant like Stone is far more trouble than he is worth to a prosecutor. Stone is too untrustworthy for a prosecutor to ever rely upon.
“Mueller does not need Stone to get to someone else and, even if he did, he could not rely on whatever Stone told him. Stone has nothing to sell that Mueller would be interested in buying.
“Stone is clearly enjoying being in the spotlight now. He should enjoy it while he can. His remaining years won’t be nearly as pleasant.” ______________________

Mueller’s Real Target In the Stone Indictment
Julian Sanchez: “For many, Friday’s arrest of Roger Stone, the veteran political trickster and longtime adviser to Donald Trump, was a sign that the special counsel investigation into Russian electoral interference is entering its final phase. Yet there were also several indications that the probe may not be as near its conclusion as many observers assume — and that the true target of Friday’s F.B.I. actions was not Mr. Stone himself, but his electronic devices.”
“Nancy Pelosi’s first showdown with President Trump began with him publicly questioning her political viability. It ended with the House speaker winning an unmitigated victory and reviving her reputation as a legislative savant,” the Washington Post reports.
“Trump’s capitulation — agreeing to reopen the federal government after a 35-day standoff without funding for a U.S.-Mexico border wall — generated rave reviews for Pelosi from fellow Democrats and grudging respect from Republicans who watched as she kept an unruly party caucus united in the face of GOP divide-and-conquer tactics.
“Pelosi emerges from the shutdown as a stronger leader of her party — and more popular with the public, by early measures — as Democrats eye aggressive efforts to counter Trump’s agenda through ambitious legislation and tough oversight. That suggests the shutdown might have been a strategic misstep for Trump, in addition to a tactical error.” _________________
Clear Majorities Want Trump Investigated
“The American people have mixed feelings about investigating President Trump, with clear majorities wanting newly empowered Democrats to dig into his personal finances and foreign ties but most believing that Congress should not begin impeachment proceedings,” according to a new Washington Post-ABC News poll.
During an interview at Davos, former Secretary of State John (in a landslide) Kerry was asked what advice he would give to Donald Trump, if he was ever asked.
He hemmed and hawed, and finally said he couldn't imagine Trump being open to any advice, but the interviewer persisted,
Ultimately, he just spit out his one-word answer: "Resign."
Yep, that's good advice. Trump should take it before he's impeached. He's about to drive the country into recession over a mythical border wall, he's incapable of nuanced thought, and he is installed as a Putin puppet. Resignation is the least he should do.

Follow the Lies
January 27, 2019
Sean Hannity could be a coconspirater with Roger Stone.
1. As I continue to research the spread of info described in the Stone indictment, it has become clear that @FoxNews needs to explain what role @seanhannity – Cohen’s mystery client – had to do with the Russian conspiracy. And why the hell he is still on the air. The key date…

2…is August 2, 2016, when Corsi sent an email to Stone. In that email, Corsi says that Assange is planning a document dump on October 2 to cause the most damage possible. (Do you Wikileaks fans FINALLY understand what this fraud is?) In preparation of that, Corsi says that….

4…willing to undermine democracy with lies. Drudge picks it up in a few days. Then, EIGHT days after this conspiracy involving Corsi, Stone, Russian hackers, Assange, frigging @seanhannity jumps into the mix. Hillary makes a goofy head movement when someone shoves a mike in….

D’Amato (R) Tells Trump to Sideline the ‘Whack-a-Doodles’
January 27
Roger, you cheated on your ex with your current Skank leg.
That is your life. Those are you bad choices. Stop bleeding bitch.
James, you got everything you wanted from this President.
Nancy and Chuck have a deal put a signable bill on the Presidents desk in 19 days.
Both are completely false.
President Donald Trump.
No Escape for Roger Stone
His remaining years won’t be nearly as pleasant.”

Mueller’s Real Target In the Stone Indictment
Julian Sanchez:
“For many, Friday’s arrest of Roger Stone, the veteran political trickster and longtime adviser to Donald Trump, was a sign that the special counsel investigation into Russian electoral interference is entering its final phase. Yet there were also several indications that the probe may not be as near its conclusion as many observers assume — and that the true target of Friday’s F.B.I. actions was not Mr. Stone himself, but his electronic devices.”
Roger, please don't lie now. You sorry pussy.
Pelosi Emerges from Shutdown Stronger Than Ever
That suggests the shutdown might have been a strategic misstep for Trump, in addition to a tactical error.”

You Said you where shot fucking your current Skank will "legally separated" from your 1st wife.

ROFLMFAO !!!
God she's awful.
