Cohen Testimony

According to sources, all of the blockbuster, behind the scenes, long-time coming, dirt on the President is going to boil down to Michal Cohen talking about four events that have any sort of substance at all:
  • Payments to Stormy Daniels
  • Roger Stone trying to talk to Julian Assange 
  • That he believes Trump knew about the Trump Tower meeting
  • That he was told to lie about the Moscow real estate business

None of this is going to be new, none of the events are really much in dispute (except in context), and none of these events has any real criminal implications for Trump. 

Stormy Daniels - The Truth is that Cohen (and Cohen alone) pled guilty to something that 99% of legal experts, the Federal Election Committee, and past legal precedent says is not a crime. That doesn't prove Donald Trump broke the law. Rather it proves Michael Cohen is an idiot (or had something to gain by pleading guilty). Cohen will offer as evidence a check from Trump for reimbursement, that neither Trump or anyone else denies providing him. 

Roger Stone Julian Assange - Roger Stone was not charged with anything associated with his attempts to garner information on Wiki-leaks. It really makes no difference if Trump knew or didn't know that Stone was attempting to do something (garner information) that was perfectly legal. As far as anyone knows, Trump doesn't deny that Stone was trying to get information or that he was in the know about it.

Trump Tower Meeting - His statement suggests that he "overheard" Donald Jr tell Donald Sr that a "meeting had been set". Of course he will offer no actually proof that he heard this, or that he heard any context to what specific meeting they were discussing. This is little more than his own personal speculation.  

Moscow Real Estate Deal - Again, in this case, Michael Cohen was out on his own island. Everyone else associated with Trump who was asked about this, stated that there had been correspondances with Russian business interests deep into 2018. This includes testimony from Donald Trump Jr as well as the President's own written statements. Cohen will offer (without proof) that he was told to lie, when everyone else was telling the truth.

Now, to be perfectly fair. If Cohen has something tangible (text, email, written correspondence, or recorded conversation) then he could prove me wrong. Of course, as Donald Trump's attorney, all of this would be covered under attorney client privilege. While Cohen may not care if he breaks his oath (as he is likely already disbarred), nothing protected that he reveals is allowed to be used in a court of law. The fact that it is being solicited by Congress is a moral and ethical problem.

Roger, his statements will ALWAYS be covered under attorney client privilege. Privilege doesn't cease to exist just because you are no longer the client's attorney, nor does it cease if the attorney in question is disbarred.

If Cohen does provide information that is client attorney privilege, he could still be fined by the Bar Association (even after he is disbarred) - and any privileged information he provides would not be allowed in any sort of criminal proceeding.

At this point, Cohen just doesn't care anymore. He was paid a legal fee to negotiate and secure a NDA for Stormy Daniels. The check is irrelevant to the law in the first place (because it doesn't show a crime) - but even if it was relevant, it could not be used in court.

Cohen can "claim" that he was committing a crime, and therefore client/attorney privilege would not exist. But isn't that the murky situation here.

In fact, that appears to be the only reason Cohen pled guilty to an action that almost nobody felt was illegal... so that he could talk about it and claim that it was not privileged.

It's actually a clever ploy, however, I am not sure it does him any good. The State of NY can try to charge Trump, and it's going to be highly unlikely that any jury would convict him (anymore than a Jury would convict John Edwards for a much more flagrant example of the exact same thing).

There's nothing partisan about attorney-client privilege, the privilege belongs to the client and only the client can wave privilege. And barring that waving of privilege it exits even beyond the death of a client.

That's a well established principle of jurist-prudence.

Small problem with that. The payment Cohan brought was made after the election. And there is still no evidence that payment had anything to do with Stormy Daniels.

Then the FEC and everyone else would agree that it would be a flagrant misuse of campaign funds, because it would not "just" be something that helped his campaign...

But would also be considered something that helped him professionally (as a television star and well known business tycoon) as well as personally (keeping his wife and family out of the know).


You are only allowed to use campaign contributions for specific things that are limited to helping your campaign.

But it seems like no matter how many times this is explained to you, it just goes right in one ear and right out the other.

Which according to the FEC is the correct manner to handle it.


Roger - I would advise you stop reading people who are providing you with opinion, and check your on your own.

Read it over carefully. According to the FEC, there are a lot of murky areas between Campaign and Personal use. They provide several examples where you can petition the FEC for the ability to campaign funds.

But there is no law that "requires you" to use campaign funds for anything you don't want to. Given Donald Trump is allowed (by law) to pay as much as he would like for his own campaign, he is also allowed to spend as much as he wants on items that he does not want to use campaign funds for.


The entire concept of these laws, Roger...

Isn't to force candidates to use campaign funds.

But rather to prevent candidates from "misusing" campaign funds.


Seems like a very very simple concept...


that becomes entirely confusing and convoluted when liberals start talking about Donald Trump.

Another left-wing node of conspiratorial diffusion can be found at The Palmer Report, a once relatively obscure pro-Hillary blog that has built a large following with its wildly speculative theories about Trump.

According to the site, Trump himself had Russian agent Sergei Mikhailov killed in December to prevent the release of the now infamous “pee tape” that purportedly shows the president-elect watching as Russian sex workers urinate on a bed the Obamas slept in. Vladimir Putin, the site maintains, is using the video to blackmail Trump—and the president “may have already acted on it in a manner which would be both treasonous and murderous.”

The site’s founder, Bill Palmer, routinely blasts out stories that sound serious but are actually based on a single, unverified source. In May, Palmer reported that Supreme Court Chief Justice John Roberts had ordered Trump appointee Neil Gorsuch to recuse himself from all Trump-related Russia hearings. His source? A single tweet from an anonymous Twitter account under the name “Puesto Loco.”

This how far Republicanism has moved toward becoming little more than an organized crime ring, an organization bent on protecting its own members' criminal acts while dealing maximum retribution to those that would oppose them. Trump stands accused at this point of a litany of federal and state crimes; the uniform Republican response is that the true supposed danger to American law and order is efforts to so much as investigate those acts.
