Equal treatment under the law?

Andrew McCabe was fired for lying to investigators on four separate occasions, three of those times he was under oath. He was not charged with any crime. James Comey was accused by the DOJ with lying to Congress. He was not charged with any crime.

General Flynn,  George Papadopoulos, Roger Stone, Michael Cohen, and Alex van der Zwaan have all been charged for Federal crimes by Robert Mueller for providing false statements (either to investigators or to Congress). None of these five people were charged by Mueller for any other crimes other than making false statements.

Can anyone tell me why it's okay for the Director and Deputy Director of the FBI to lie to investigators and Congress, but not okay for anyone loosely associated with Trump?

The U.S. government’s top ethics watchdog has ruled that Commerce Secretary Wilbur Ross violated his ethics agreement by inaccurately reporting stock holdings in his 2018 financial disclosure form.

Ross — one of the wealthiest members of President Trump’s Cabinet — did not sell stock he held in a bank despite reporting otherwise, said Emory Rounds, director of the Office of Government Ethics.

“Therefore, OGE is declining to certify Secretary Ross’s 2018 financial disclosure report,” Rounds wrote in a letter dated Feb. 15, “because that report was not accurate and he was not in compliance with his ethics agreement at the time of the report.”

Observers called the move highly unusual, and one told CNN that the office’s decision amounted to “a pretty giant red flag.” Richard Painter, an ethics lawyer for President George W. Bush, told the outlet that he has never seen a Cabinet member’s disclosure form rejected in this way.

His efforts have exposed him to accusations of obstruction of justice as Robert S. Mueller III, the special counsel, finishes his work investigating Russian interference in the 2016 election.

Mr. Trump’s public war on the inquiry has gone on long enough that it is no longer shocking. In the constitutional confrontation over President Trump’s plan to use emergency powers to build a wall on our southern border, we’re keeping an eye out for the name of Jagdish Rai Chadha. He was the plaintiff in the case in which the Supreme Court read Congress the riot act for trying to interfere with a president’s emergency powers. The case echoes through the years.

At the moment, the President is being opposed by Speaker Pelosi, Senator Schumer, Congresswoman Ocasio-Cortez, and every other Tom, Dick, and Harriet in the Democratic Party. Sixteen states have already gone to court. They’re complaining about what they call Mr. Trump’s “flagrant disregard of fundamental separation of powers principles engrained in the United States Constitution.”

This turns out to be exactly the principle with which the Justices clobbered Congress in INS v. Chadha. In that case, decided in 1983, the president used emergency powers to permit Mr. Chadha, a stateless person who had overstayed a student visa, to remain at America. The House of Representatives turned around and “vetoed” the suspension.

When it got to the Supreme Court, the Justices would have none of it. Congress, the justices concluded, doesn’t get to veto what a president does. Feature the parchment. The veto, as a power, is granted in the Constitution to only the president. He gets to use it against Congress. Nowhere does it say that the Congress gets a veto against the President.

When it comes to dealing with a president, the House can impeach the muskrat, the Senate can try him, Congress can refuse to appropriate money, it can declare war, it can grant a trademark. It can repeal a law. Veto, though, no. In the case of Mr. Chadha’s deportation, moreover, it was just the House of Representatives, acting alone, that tried to veto the president’s emergency action.

This hangs out there today, when we have a Senate controlled by the GOP and the House by the Democrats. “One-house legislative vetoes are invalid because they should be considered an exercise of legislative power, which makes them subject to the bicameralism and presentment requirements in Article I of the Constitution,” is the way the Justia Web site summarizes the case.

The business about presentment means that that if Congress were trying to legislate around a presidential emergency action, the president would get to sign off on it, just like any other act by Congress. This is one of the checks and balances to which everyone is always bowing and scraping. It looks like a problem Congress could face as she seeks to foil President Trump in respect of the Wall.

Trump Has Attacked the Russia Investigation 1,200 Times

“President Trump has publicly criticized dozens of people and groups related to federal inquiries into contacts between his campaign and Russia,” according to a New York Times analysis.

“The attacks, which number nearly 1,200, are part of a strategy to beat back the investigations. They have also opened him to possible obstruction of justice charges. They include statements made on Twitter, in official speeches, at rallies and during news media interviews and other press events.”

“While it is highly unusual for anyone — let alone the president of the United States — to comment on continuing criminal investigations, Mr. Trump has done so at least once on 330 days, or more than 43 percent of his time in office as of Feb. 14.”

Most voters say top Justice Department and FBI officials are likely to have acted criminally when they secretly discussed removing President Trump from office and think a special prosecutor is needed to investigate.

Fifty-six percent (56%) of Likely U.S. Voters believe senior federal law enforcement officials are likely to have broken the law in their discussions in May 2017 to oust Trump, with 37% who say it is Very Likely. The latest Rasmussen Reports national telephone and online survey finds that 36% consider that unlikely, with 19% who say it’s Not At All Likely that they broke the law.

Fifty-one percent (51%) think a special prosecutor should be named to investigate the discussions among senior Justice Department and FBI officials in May 2017 to remove the president from office. Thirty-eight percent (38%) disagree, but 11% are undecided.


BTW I am not one of them calling for a special procecuter. I didn't like the idea when Mueller was appointed and I still don't like the idea.

I had to go to Drudge Report to find your story from the NYT. They seem to be the new source that cried wolf when it comes to this sort of thing. Nothing on Real Clear Politics, Hot Air, The Hill, etc...

What I can say is that Whitaker is on record (sworn testimony) that nothing like this happened. The DOJ stands behind this.

So what would need to happen here, is that the "source" that the NYT suggests they have, would have to step forward, provide sworn testimony and evidence that Whitaker is lying.


Moreover, even if this was "true" and Trump had a discussion with Whitaker about who might be put in charge of an investigation, that would still be a long ways from being considered "obstruction" or anything else illegal.
