If the argument is that Trump is doing an end around because he couldn't convince enough members of Congress to give him more money...
Wouldn't Democrats be doing the same thing by going to court because they could not convince enough members of Congress to sign on to a declaration to overturn his action?

precisely.
from the democrats perspective all this was ever about was denying trump a political victory. the wall was a central campaign promise. the wall getting built improves trump's reelection chances significantly. period. full stop. if democrats truly cared about stopping trump they would have the 2/3's majority in both houses and this thing would be over before it began.

Stephen Miller Grilled on Emergency Declaration
February 17, 2019 at 11:28 am EST
“Fox News host Chris Wallace relentlessly pushed Trump senior adviser Stephen Miller on Donald Trump‘s declaration of a national emergency on Sunday, and nailed him particularly hard by repeatedly asking for a single example of another president who has done what Trump has done,” Mediate reports.
“Wallace was all over Miller, challenging him to provide some explanation for how Trump’s national emergency is a national emergency, when Trump himself essentially admitted it wasn’t a national emergency. And when Miller tried to fend off the questions with talking points, Wallace peppered him with followups.”
TRUMP'S LAST STAND?
How the Border Wall Turned Into a National Emergency
February 17
“President Trump’s declaration of a national emergency to build a wall on the U.S. southern border comes after two years of political neglect of his signature campaign promise, lost amid competing priorities and divisions within his administration,” the Wall Street Journal reports.
Timothy O’Brien: “Trump and his team neither prioritized building a border wall nor assigned someone to be the White House’s point person on the project for most of the president’s first two years in office… It was only after Trump recognized in January that he was being consumed by a government shutdown he set in motion — and that he had been politically emasculated by a woman to his left (House Speaker Nancy Pelosi) and to his right (pundit and firebrand Ann Coulter) — that he fully embraced a border wall as his last stand.”
Quote of the Day
“It’s going to be a real test for my GOP colleagues in Congress and their devotion to this institution… It will not be a separation of powers any more, just a separation of parties. So this is going to be a moment of truth for my GOP colleagues.”
— Rep. Adam Schiff (D-CA), in a CNN interview, on whether Republicans will oppose President Trump’s declaration of a national emergency to bypass Congress to build a border wall.
Rift Between Trump and Europe Now Open and Angry
February 17, 2019
“European leaders have long been alarmed that President Trump’s words and Twitter messages could undo a trans-Atlantic alliance that had grown stronger over seven decades. They had clung to the hope that those ties would bear up under the strain,” the New York Times reports.
“But in the last few days of a prestigious annual security conference in Munich, the rift between Europe and the Trump administration became open, angry and concrete, diplomats and analysts say.”

This is an appropriate time to discuss a recently-surfaced issue involving Chairman Schiff and a witness of an open congressional investigation.
Chairman Schiff stated in March of 2017, he had evidence of collusion between the Trump campaign and Russia and that his “evidence” was more than circumstantial but not quite direct. To date Chairman Schiff has produced no evidence to support that claim.
In addition, The Hill reported last week on a meeting between Chairman Schiff and Fusion GPS co-founder Glenn Simpson in July of 2018 at the Aspen Security Forum.
Recall that Mr. Simpson has been one of the most controversial subjects in the Russian collusion investigation and was a key witness in the House’s probe. In fact, Mr. Simpson appeared and gave sworn testimony before Chairman Schiff and the rest of HPSCI in November 2017 on the subject of how FBI and Justice Department officials handled the Russia investigation and Hillary Clinton’s private email server.
In addition, Chairman Schiff and House Democrats went to great lengths to keep investigators from finding out Fusion GPS was hired by a law firm at the direction of the Democratic National Committee and the Hillary Clinton Campaign. Investigators ultimately had to go to court to secure access to who was behind the still unvetted Steele Dossier. Chairman Schiff obstructed and opposed efforts to identify the funding behind the salacious, still unverified report.
During Mr. Simpson’s testimony before the House, Chairman Schiff even sought direction from Mr. Simpson on where the investigation should go. This is virtually unprecedented: that a now Chairman of an investigative committee would seek direction from a fatally biased witness who was actually paid by political opponents to uncover dirt on the President.
https://www.republicanleader.gov/adam-schiff-fusion-gps-aspen/
Schiff was a force for Sessions to recuse himself for very little reason while it turns out Schiff actually is up to his eyeballs in issues demanding his recusal. This should be a no-brainer if we had equal justice or a free impartial press.

GOP Senator Susan Collins of Maine opposed an emergency order because “it undermines the role of Congress and the appropriations process.”
“The Constitution is very clear at trying to separate the powers, and if we start naming things as emergency I think very quickly we lose sort of the checks and balances of government,” he said.
GOP Senator Rand Paul of Kentucky also told reporters he doesn’t support an emergency declaration.

This will take some time to come to a conclusion. It's going to put a lot of Republicans who are facing an election next year. Even a Senator from South Dakota has been questioning the separation of powers.
The law passed in 1976 has not been questioned about its constitutionality. Only the Congress can declare war. Its been ignored since December 7th of 1941.
His own statement that he doesn't have to do this could lead to impeachment.
Impeachment for following the law? Hardly.
Maybe Obama should be impeached for DACA but that didn't happen either. At least Trump was following the law. Obama? Not so much.
Congress can hem and haw all they want. They authorized Trump and any president to declare emergencies and move funds at his discretion.
It's like blamimg someone for using a loophole in the tax law but they never get around to fixing the loophole itself.
The law passed in 1976 has not been questioned about its constitutionality.
yes it has alky -
In 1976, Congress attempted to pull back the president’s emergency powers by enacting the National Emergencies Act. First, the act revoked (two years after its enactment) any powers granted to the president under the four states of emergency still active at the time. Next, it prescribed procedures for invoking these powers in the future. No longer can a president give force to the hundreds of emergency provisions by mere proclamation. Instead, he must specifically declare a national emergency in accordance with the act and identify the statutory basis for each emergency power he intends to use. Each state of emergency is to end automatically one year after its declaration, unless the president publishes a notice of renewal in the Federal Register within 90 days of the termination date and notifies Congress of the renewal. Finally, the act requires that each house of Congress meet every six months to consider a vote to end the state of emergency.
Not once has Congress met to consider such a vote. It is not exactly clear why. But the provision would have lost much of its intended force even had Congress complied: It originally allowed Congress to end an emergency by concurrent resolution (that is, if majorities in both houses voted to end it). But in 1983, the Supreme Court declared this sort of legislative veto over presidential action unconstitutional. A 1985 amendment to the act now requires a joint resolution to end the emergency, meaning that any Congressional vote to end the emergency is subject to the president’s veto, which may be overridden only by two-thirds majorities of both houses.

I was speaking to the man who had just... won the election for the presidency and who might have done so with the aid of the government of Russia, our most formidable adversary on the world stage."
Andrew McCabe: I'd never been to a meeting in the Oval Office before. I'm a career FBI agent-government worker.
Scott Pelley: Oval Office was above your pay grade.
Andrew McCabe: It certainly was. And the president immediately went off on a almost a gleeful description of what had happened with the firing of Jim Comey. And then he went on to state that people in the FBI were — were thrilled about this, that people really disliked Jim Comey and that they were very happy about this and that it was, it was a great thing.
Scott Pelley: He was telling you what the reaction inside the FBI was?
Andrew McCabe: He was. It was very different than the reaction I had seen immediately before I came to the White House.
Scott Pelley: Which was what?
Andrew McCabe: People were shocked. We had lost our leader, a leader who was respected and liked by the vast majority of FBI employees. People were very sad. But anyway, that night in the Oval Office what I was hearing from the president was, not reality. It was the version of the events that I quickly realized he wished me to adopt. As he went on talking about how happy people in the FBI were, he said to me, "I heard that you were part of the resistance."
Scott Pelley: What did he mean by that?
Andrew McCabe: Well I didn't know. And so I asked him. And he said, "I heard that you were one of the people that did not support Jim Comey. You didn't agree with him and the decisions that he'd made in the Clinton case. And is that true?" And I said, "No sir. That's not true. I worked very closely with Jim Comey. I was a part of that team and a part of those decisions."
Scott Pelley: You had the sense you'd given him the wrong answer.
Andrew McCabe: I knew I'd given him the wrong answer.
Scott Pelley: You weren't trying to hang onto this job.
Andrew McCabe: I wasn't willing to lie to keep it. I didn't know when I'd be out of the job. I thought it would probably be pretty soon. And so I just put my head down and got to work trying to stabilize the people around me and do the things that I felt we needed to do with the Russia investigation, getting cases opened and getting a special counsel appointed.
After firing Comey, Trump calls McCabe about FBI plane use
After firing Comey, Trump calls McCabe about FBI plane use
After Comey was fired, McCabe says he ordered two investigations of the president himself. They asked two questions. One, did Mr. Trump fire Comey to impede the investigation into whether Russia interfered with the election. And two, if so, was Mr. Trump acting on behalf of the Russian government.
Andrew McCabe: I was speaking to the man who had just run for the presidency and won the election for the presidency and who might have done so with the aid of the government of Russia, our most formidable adversary on the world stage. And that was something that troubled me greatly.
Scott Pelley: How long was it after that that you decided to start the obstruction of justice and counterintelligence investigations involving the president?
Andrew McCabe: I think the next day, I met with the team investigating the Russia cases. And I asked the team to go back and conduct an assessment to determine where are we with these efforts and what steps do we need to take going forward. I was very concerned that I was able to put the Russia case on absolutely solid ground in an indelible fashion that were I removed quickly or reassigned or fired that the case could not be closed or vanish in the night without a trace.
Scott Pelley: You wanted a documentary record—
Andrew McCabe: That's right—
Scott Pelley: —That those investigations had begun because you feared that they would be made to go away.
Andrew McCabe: That's exactly right.
mccabepelleywalk21.jpg
Correspondent Scott Pelley with Andrew McCabe
McCabe says that the basis for both investigations was in Mr. Trump's own statements. First, Mr. Trump had asked FBI Director Comey to drop the investigation of National Security Adviser Michael Flynn, who has since pleaded guilty to lying to the FBI about his Russian contacts. Then, to justify firing Comey, Mr. Trump asked his deputy attorney general, Rod Rosenstein, to write a memo listing the reasons Comey had to go. And according to McCabe, Mr. Trump made a request for that memo that came as a surprise.
Andrew McCabe: Rod was concerned by his interactions with the president, who seemed to be very focused on firing the director and saying things like, "Make sure you put Russia in your memo." That concerned Rod in the same way that it concerned me and the FBI investigators on the Russia case.
If Deputy Attorney General Rosenstein listed the Russia investigation in his memo to the White House, it could look like he was obstructing the Russia probe by suggesting Comey's firing. And by implication, it would give the president cover.
He chose to believe Vladimir Putin over his own Security and intelligence services.

America can rest easy knowing that a guy who was too stupid to sniff out the most obvious hoax ever runs the House Intelligence Committee.
If Deputy Attorney General Rosenstein listed the Russia investigation in his memo to the White House, it could look like he was obstructing the Russia probe by suggesting Comey's firing. And by implication, it would give the president cover.
Scott Pelley: He didn't wanna put Russia in his memo.
Andrew McCabe: He did not. He explained to the president that he did not need Russia in his memo. And the president responded, "I understand that, I am asking you to put Russia in the memo anyway."
When the memo justifying Comey's firing was made public, Russia was not in it. But, Mr. Trump made the connection anyway, telling NBC, then, Russian diplomats that the Russian investigation was among the reasons he fired Comey.
Andrew McCabe: There were a number of things that caused us to believe that we had adequate predication or adequate reason and facts, to open the investigation. The president had been speaking in a derogatory way about our investigative efforts for weeks, describing it as a witch hunt…
President Trump on Feb. 16, 2017: Russia is a ruse. I have nothing to do with Russia. Haven't made a phone call to Russia in years.
Andrew McCabe: ...publicly undermining the effort of the investigation. The president had gone to Jim Comey and specifically asked him to discontinue the investigation of Mike Flynn which was a part of our Russia case. The president, then, fired the director. In the firing of the director, the president specifically asked Rod Rosenstein to write the memo justifying the firing and told Rod to include Russia in the memo. Rod, of course, did not do that. That was on the president's mind. Then, the president made those public comments that you've referenced both on NBC and to the Russians which was captured in the Oval Office. Put together, these circumstances were articulable facts that indicated that a crime may have been committed. The president may have been engaged in obstruction of justice in the firing of Jim Comey.
Scott Pelley: What was it specifically that caused you to launch the counterintelligence investigation?
Andrew McCabe: It's many of those same concerns that cause us to be concerned about a national security threat. And the idea is, if the president committed obstruction of justice, fired the director of the of the FBI to negatively impact or to shut down our investigation of Russia's malign activity and possibly in support of his campaign, as a counterintelligence investigator you have to ask yourself, "Why would a president of the United States do that?" So all those same sorts of facts cause us to wonder is there an inappropriate relationship, a connection between this president and our most fearsome enemy, the government of Russia?
Scott Pelley: Are you saying that the president is in league with the Russians?
Andrew McCabe: I'm saying that the FBI had reason to investigate that. Right, to investigate the existence of an investigation doesn't mean someone is guilty. I would say, Scott, if we failed to open an investigation under those circumstances, we wouldn't be doing our jobs.
Scott Pelley: When you decided to launch these two investigations, was the deputy attorney general, Rod Rosenstein, onboard with that.
Andrew McCabe: Absolutely.
Calling Comey? McCabe says Rosenstein wanted Comey's advice
Calling Comey? McCabe says Rosenstein wanted Comey's advice
Rod Rosenstein has spent 28 years at the Department of Justice. A Republican, he was appointed by President Trump as deputy attorney general, number two at the department. Mr. Trump's firing of James Comey on May 9, 2017 set off a week of crisis meetings between Rosenstein, who was in charge of the Russia investigation and acting FBI director Andrew McCabe.

Andrew McCabe: Well—
Pelley: One way or another.
Andrew McCabe: I can't confirm that. But what I can say is the deputy attorney general was definitely very concerned about the president, about his capacity, and about his intent at that point in time.
Scott Pelley: How did he bring up the idea of the 25th amendment to you?
Andrew McCabe: Honestly, I don't remember. He, it was just another kinda topic that he jumped to in the midst of a wide-ranging conversation.

Anyone still believe Trump Tower wasn’t wiretapped?
"Intelligence officials in the briefing responded that that was not consistent with any of the intelligence our government possesses to which the president replied, 'I don't care. I believe Putin.'"
In response to our interview, the Justice Department gave us a carefully worded statement. It says McCabe's story is "inaccurate and factually incorrect." "The deputy attorney general never authorized any recording" [of the president.] "Nor was the deputy attorney general in a position to consider invoking the 25th Amendment."
McCabe told us, as the weeks wore on, the president continued to express what McCabe thought was a strange affinity for russia. He remembers a day when an FBI official returned from the White House to brief McCabe on the results of a meeting with the president.
Andrew McCabe: The president— launched into— several unrelated diatribes. One of those was commenting on the recent missile launches by the government of North Korea. And, essentially, the president said he did not believe that the North Koreans had the capability to hit us here with ballistic missiles in the United States. And he did not believe that because President Putin had told him they did not. President Putin had told him that the North Koreans don't actually have those missiles.
Scott Pelley: And U.S. intelligence was telling the president what?
Andrew McCabe: Intelligence officials in the briefing responded that that was not consistent with any of the intelligence our government possesses to which the president replied, "I don't care. I believe Putin."
Scott Pelley: What did you think when you heard that?
Andrew McCabe: It's just an astounding thing to say. To spend the time and effort and energy that we all do in the intelligence community to produce products that will help decision makers and the ultimate decision maker, the President of the United States— make policy decisions, and to be confronted with an absolute disbelief in those efforts and a unwillingness to learn the true state of affairs that he has to deal with every day was just shocking.
Trump Tower wasn’t wiretapped.

So now Roger thinks its OK to start an investigation if I disagree with something you say, without going through proper channels.
I'd be embarrassed if I was trying to defend McCabe or 60 minutes for the obvious questions they did not ask.
McCabe and those who support him are liars and traitors. rrb
You would gladly pay to watch my execution by a firing squad.
You're no different than the Germans who supported Adolf Hitler.
wiretapping on Trump tower did not happen
Roger is obviously no different than the Americans who supported Adolph Hitler
You would gladly pay to watch my execution by a firing squad.
pay? LOL.
alky, i don't think you truly grasp just how insignificant you are to me.
i wouldn't give two cents to watch your demise. you're the jussie smollet of this blog. everything you post is a lie. you copy/paste the lies of others.
no alky, i wouldn't pay or change my plans at the prospect of your demise. nor would i give a fuck if i heard about it after the fact. there are little piles of dog shit in my backyard that have more value to me than you.
My comment was incorrect.
"154 mass shootings this year and not one committed by a black man or illegal alien.
Let that sink in."
There has been one mass shooting by an African American man.
wiretapping on Trump tower did not happen
The dossier did not initiate the investigation into the President. His own words did .
Still can't elucidate the lesson learned can you jag off!!! The most obvious thing is your bigotry pointing out the shooter was black....

After FBI Director Comey told President Trump that FBI had evidence he had paid a bunch of whores to pee on a bed used by the Obamas in the Moscow Ritz Carlton, why would he believe any thing else they say??
The very words of the President of the United States are unbelievably similar to dictators throughout history, and I quote from his tweets.
Nothing funny about tired Saturday Night Live on Fake News NBC! Question is, how do the Networks get away with these total Republican hit jobs without retribution? Likewise for many other shows? Very unfair and should be looked into. This is the real Collusion!
THE RIGGED AND CORRUPT MEDIA IS THE ENEMY OF THE PEOPLE!
trump tower was not wiretapped...
...says the DOJ.
a DOJ that contains a DAG - rosenstein - who we know as a matter of fact is a liar, and which contains an FBI where we know for a fact that comey, mccabe, page and strzok are liars.
so i have five known and proven liars telling me that trump tower was not wiretapped. but paul manafort WAS wiretapped. and manafort had a residence where?
trump tower.
the cognitive dissonance and invincible ignorance required to believe this mount everest of bullshit is astounding.
And rat hole doubled down with his bigotry, sorry loser you keep up!!!!!.
So it's bigotry to show Roger didn't know what the fuck he was talking about?
You are the dumbest idiot on the internet?
@jabeale
If I ever had a doubt that the FBI had no classified evidence as yet unseen by the public when they decided (in great haste) to open an investigation on POTUS, Andrew McCabe put that to rest in his @60Minutes interview. Every predicate he listed is public, and they've all been either investigated, debunked, or both. He's listing the same reasons @adamschiff and @ericswalwell routinely trot out when they're asked to justify their claims that Trump colluded with Russia - the Comey (give Flynn a break) meeting; the Lester Holt interview; and the firing of their beloved leader.
He also, quite helpfully, notes his disgust and disdain for Trump's treatment of his wife the very week he decided to open the investigation. He speaks of the chaos and confusion of the moment. All in all, he paints a picture of the worst possible scenario for contemplating opening an investigation into a sitting president - A room full of @Comey acolytes, almost all of whom were in the midst of conduct that would eventually get them demoted, fired, or both.
The target of the proposed investigation had just insulted one of their wives, to his face and on national television, that very week. And a Deputy Attorney General who had allegedly expressed his willingness to wear a wire and look into a 25th Amendment solution for all of their problems. Those are the people who agreed to open the POTUS investigations, and we now know that the information they had available to them was the same information available to all of us today. I suppose I should thank McCabe for reinforcing my belief that this entire thing was a cooked-up vengeance play, but I don't think he'd understand.

Yup. Scott Pelley apparently unaware of any material facts relating to, well, any of this mess.
No mention of criminal investigation into McCabe.
No questions on Strzok/Page.
No mention of criminal leak investigation into Baker.
How is that possible?Jeff @ themarketswork added,

the next time a leftist tells you they care about keeping guns out of the hands of criminals, tell them they're full of shit. again.
Democrats this week approved legislation to require background checks for essentially all sales and transfers of firearms -- but rejected GOP-led efforts to amend the legislation to alert law enforcement authorities when gun buyers, including illegal immigrants, fail those background checks.

Checking in to see what Trump cultists are up to, and a little victory dance over Manafort's sentencing. You recall, the "process crimes" that were going to get laughed out of court because Mueller is such a bumbling prosecutor.
and I'm not disappointed to see that they don't know the difference between legal action to correct an unconstitutional power grab, and the illegal abuse of power that it would be correcting.
Carry on. Enjoy what's left of Trump's attempted dictatorship. :)
Obunghole's Border Patrol Chief says the liver is full of shit
“Mark Morgan is the former head of the border patrol. And he’s heard the rhetoric, but he knows the reality. Mark, is the president making up an emergency?” Kilmeade asked.
“Absolutely not,” Morgan responded. “Brian, this is part of the frustration for those of us from a law enforcement, border security perspective. How many more statistics do we have to provide? How many more factually based examples do we have to provide? How many more angel families have to stand in front of some of these individuals before they finally say, ‘Yeah, okay, this is real.’ It’s just incredulous.”

Checking in to see what Trump cultists are up to,
And adding absolutely nothing to the conversation. Thanks for the drive by.
How many more angel families have to stand in front of some of these individuals before they finally say, ‘Yeah, okay, this is real.’ It’s just incredulous.”
how many more?
the number could be measured in the millions, but as long as a swarm of undocumented democrat votes exists south of the border, the left will continue to consider the angel families so much collateral damage and a price worth paying for permanent democrat rule.
the left is playing for keeps by any means necessary. the right had better wake up to that fact.
