If the argument is that Trump is doing an end around because he couldn't convince enough members of Congress to give him more money...

Wouldn't Democrats be doing the same thing by going to court because they could not convince enough members of Congress to sign on to a declaration to overturn his action?

This is an appropriate time to discuss a recently-surfaced issue involving Chairman Schiff and a witness of an open congressional investigation.

Chairman Schiff stated in March of 2017, he had evidence of collusion between the Trump campaign and Russia and that his “evidence” was more than circumstantial but not quite direct. To date Chairman Schiff has produced no evidence to support that claim.

In addition, The Hill reported last week on a meeting between Chairman Schiff and Fusion GPS co-founder Glenn Simpson in July of 2018 at the Aspen Security Forum.

Recall that Mr. Simpson has been one of the most controversial subjects in the Russian collusion investigation and was a key witness in the House’s probe. In fact, Mr. Simpson appeared and gave sworn testimony before Chairman Schiff and the rest of HPSCI in November 2017 on the subject of how FBI and Justice Department officials handled the Russia investigation and Hillary Clinton’s private email server.

In addition, Chairman Schiff and House Democrats went to great lengths to keep investigators from finding out Fusion GPS was hired by a law firm at the direction of the Democratic National Committee and the Hillary Clinton Campaign. Investigators ultimately had to go to court to secure access to who was behind the still unvetted Steele Dossier. Chairman Schiff obstructed and opposed efforts to identify the funding behind the salacious, still unverified report.

During Mr. Simpson’s testimony before the House, Chairman Schiff even sought direction from Mr. Simpson on where the investigation should go. This is virtually unprecedented: that a now Chairman of an investigative committee would seek direction from a fatally biased witness who was actually paid by political opponents to uncover dirt on the President.

Schiff was a force for Sessions to recuse himself for very little reason while it turns out Schiff actually is up to his eyeballs in issues demanding his recusal. This should be a no-brainer if we had equal justice or a free impartial press.

GOP Senator Susan Collins of Maine opposed an emergency order because “it undermines the role of Congress and the appropriations process.”

“The Constitution is very clear at trying to separate the powers, and if we start naming things as emergency I think very quickly we lose sort of the checks and balances of government,” he said.

GOP Senator Rand Paul of Kentucky also told reporters he doesn’t support an emergency declaration.

This will take some time to come to a conclusion. It's going to put a lot of Republicans who are facing an election next year. Even a Senator from South Dakota has been questioning the separation of powers.

The law passed in 1976 has not been questioned about its constitutionality. Only the Congress can declare war. Its been ignored since December 7th of 1941.

In 1976, Congress attempted to pull back the president’s emergency powers by enacting the National Emergencies Act. First, the act revoked (two years after its enactment) any powers granted to the president under the four states of emergency still active at the time. Next, it prescribed procedures for invoking these powers in the future. No longer can a president give force to the hundreds of emergency provisions by mere proclamation. Instead, he must specifically declare a national emergency in accordance with the act and identify the statutory basis for each emergency power he intends to use. Each state of emergency is to end automatically one year after its declaration, unless the president publishes a notice of renewal in the Federal Register within 90 days of the termination date and notifies Congress of the renewal. Finally, the act requires that each house of Congress meet every six months to consider a vote to end the state of emergency.

Not once has Congress met to consider such a vote. It is not exactly clear why. But the provision would have lost much of its intended force even had Congress complied: It originally allowed Congress to end an emergency by concurrent resolution (that is, if majorities in both houses voted to end it). But in 1983, the Supreme Court declared this sort of legislative veto over presidential action unconstitutional. A 1985 amendment to the act now requires a joint resolution to end the emergency, meaning that any Congressional vote to end the emergency is subject to the president’s veto, which may be overridden only by two-thirds majorities of both houses.

Scott Pelley: What did he mean by that?

Andrew McCabe: Well I didn't know. And so I asked him. And he said, "I heard that you were one of the people that did not support Jim Comey. You didn't agree with him and the decisions that he'd made in the Clinton case. And is that true?" And I said, "No sir. That's not true. I worked very closely with Jim Comey. I was a part of that team and a part of those decisions."

Scott Pelley: You had the sense you'd given him the wrong answer.

Andrew McCabe: I knew I'd given him the wrong answer.

Scott Pelley: You weren't trying to hang onto this job.


Andrew McCabe: I wasn't willing to lie to keep it. I didn't know when I'd be out of the job. I thought it would probably be pretty soon. And so I just put my head down and got to work trying to stabilize the people around me and do the things that I felt we needed to do with the Russia investigation, getting cases opened and getting a special counsel appointed.

McCabe says that the basis for both investigations was in Mr. Trump's own statements. First, Mr. Trump had asked FBI Director Comey to drop the investigation of National Security Adviser Michael Flynn, who has since pleaded guilty to lying to the FBI about his Russian contacts. Then, to justify firing Comey, Mr. Trump asked his deputy attorney general, Rod Rosenstein, to write a memo listing the reasons Comey had to go. And according to McCabe, Mr. Trump made a request for that memo that came as a surprise.

Andrew McCabe: Rod was concerned by his interactions with the president, who seemed to be very focused on firing the director and saying things like, "Make sure you put Russia in your memo." That concerned Rod in the same way that it concerned me and the FBI investigators on the Russia case.

When the memo justifying Comey's firing was made public, Russia was not in it. But, Mr. Trump made the connection anyway, telling NBC, then, Russian diplomats that the Russian investigation was among the reasons he fired Comey.

Andrew McCabe: There were a number of things that caused us to believe that we had adequate predication or adequate reason and facts, to open the investigation. The president had been speaking in a derogatory way about our investigative efforts for weeks, describing it as a witch hunt…

President Trump on Feb. 16, 2017: Russia is a ruse. I have nothing to do with Russia. Haven't made a phone call to Russia in years.

Andrew McCabe: ...publicly undermining the effort of the investigation. The president had gone to Jim Comey and specifically asked him to discontinue the investigation of Mike Flynn which was a part of our Russia case. The president, then, fired the director. In the firing of the director, the president specifically asked Rod Rosenstein to write the memo justifying the firing and told Rod to include Russia in the memo. Rod, of course, did not do that. That was on the president's mind. Then, the president made those public comments that you've referenced both on NBC and to the Russians which was captured in the Oval Office. Put together, these circumstances were articulable facts that indicated that a crime may have been committed. The president may have been engaged in obstruction of justice in the firing of Jim Comey.

Scott Pelley: What was it specifically that caused you to launch the counterintelligence investigation?

Andrew McCabe: It's many of those same concerns that cause us to be concerned about a national security threat. And the idea is, if the president committed obstruction of justice, fired the director of the of the FBI to negatively impact or to shut down our investigation of Russia's malign activity and possibly in support of his campaign, as a counterintelligence investigator you have to ask yourself, "Why would a president of the United States do that?" So all those same sorts of facts cause us to wonder is there an inappropriate relationship, a connection between this president and our most fearsome enemy, the government of Russia?

Scott Pelley: Are you saying that the president is in league with the Russians?

Andrew McCabe: I'm saying that the FBI had reason to investigate that. Right, to investigate the existence of an investigation doesn't mean someone is guilty. I would say, Scott, if we failed to open an investigation under those circumstances, we wouldn't be doing our jobs.

Scott Pelley: When you decided to launch these two investigations, was the deputy attorney general, Rod Rosenstein, onboard with that.

In response to our interview, the Justice Department gave us a carefully worded statement. It says McCabe's story is "inaccurate and factually incorrect." "The deputy attorney general never authorized any recording" [of the president.] "Nor was the deputy attorney general in a position to consider invoking the 25th Amendment."

McCabe told us, as the weeks wore on, the president continued to express what McCabe thought was a strange affinity for russia. He remembers a day when an FBI official returned from the White House to brief McCabe on the results of a meeting with the president.

Andrew McCabe: The president— launched into— several unrelated diatribes. One of those was commenting on the recent missile launches by the government of North Korea. And, essentially, the president said he did not believe that the North Koreans had the capability to hit us here with ballistic missiles in the United States. And he did not believe that because President Putin had told him they did not. President Putin had told him that the North Koreans don't actually have those missiles.

Scott Pelley: And U.S. intelligence was telling the president what?

Andrew McCabe: Intelligence officials in the briefing responded that that was not consistent with any of the intelligence our government possesses to which the president replied, "I don't care. I believe Putin."

Scott Pelley: What did you think when you heard that?

Andrew McCabe: It's just an astounding thing to say. To spend the time and effort and energy that we all do in the intelligence community to produce products that will help decision makers and the ultimate decision maker, the President of the United States— make policy decisions, and to be confronted with an absolute disbelief in those efforts and a unwillingness to learn the true state of affairs that he has to deal with every day was just shocking.

McCabe did leak information to The Wall Street Journal. That's the excuse used by the President to justify the firing of McCabe.

The account reason was the initiation of the investigations into the alleged crime of objection of justice by the President of the United States.

Don't expect that the Department of Justice will initiate any further comment or criminal charges against McCabe.

Investigations should not be started without authorization.

Why are these "words" not the basis of the FISA warrant, the subsequent wiretapping on Trump tower and then the unmaskings of those captured conversations?

If I ever had a doubt that the FBI had no classified evidence as yet unseen by the public when they decided (in great haste) to open an investigation on POTUS, Andrew McCabe put that to rest in his @60Minutes interview. Every predicate he listed is public, and they've all been either investigated, debunked, or both. He's listing the same reasons @adamschiff and @ericswalwell routinely trot out when they're asked to justify their claims that Trump colluded with Russia - the Comey (give Flynn a break) meeting; the Lester Holt interview; and the firing of their beloved leader.

He also, quite helpfully, notes his disgust and disdain for Trump's treatment of his wife the very week he decided to open the investigation. He speaks of the chaos and confusion of the moment. All in all, he paints a picture of the worst possible scenario for contemplating opening an investigation into a sitting president - A room full of @Comey acolytes, almost all of whom were in the midst of conduct that would eventually get them demoted, fired, or both.

The target of the proposed investigation had just insulted one of their wives, to his face and on national television, that very week. And a Deputy Attorney General who had allegedly expressed his willingness to wear a wire and look into a 25th Amendment solution for all of their problems. Those are the people who agreed to open the POTUS investigations, and we now know that the information they had available to them was the same information available to all of us today. I suppose I should thank McCabe for reinforcing my belief that this entire thing was a cooked-up vengeance play, but I don't think he'd understand.
