D.C. Court of appeals rules DOJ must redact grand jury information

 McDougal’s argument invoking ... the “[c]ourt’s supervisory power over its own records and files” is unpersuasive.... “[B]ecause the grand jury is an institution separate from the courts, over whose functioning the courts do not preside,” United States v. Williams, 504 U.S. 36, 47 (1992), courts will not order disclosure absent a recognized exception to Rule 6(e)

So the concept spreading like wildfire from all of the pertinent media liars (CNN, MSNBC, NYT, WaPo) is that Congress can either:
  • force Barr to provide Grand Jury testimony subpoena power
  • get a Judge to force Barr to release grand jury testimony
Obviously that is not actually the case here. At least not legally. 

Ironically this particular ruling has nothing to do with the Mueller report. It dealt with an entirely different issue where an author (McKeever) sued the Department of Justice to get them to release grand jury testimony from a case in 1957 for "research purposes". But it obviously becomes a very well timed bit of stare decisis for any new cases brought by Democrats attempting Barr to release "everything" including Grand Jury information.  

To be clear, the only legally recognized exceptions to Rule 6(e) is where the Grand Jury testimony is shown to be relevant to securing a criminal conviction either in the case at hand and/or another relevant case, or where a Grand Jury was put together with the intention of writing a report that might be otherwise released. Neither of these exceptions will be relevant to the Grand Jury proceedings regarding Mueller's special counsel. 

So not only is Barr correct to redact Grand Jury information, this case is the deciding law on the subject at this point in time. While it is possible that McKeever could continue to appeal (both to the full Appeals Court and possibly to the USSC) - at this point in time Barr would be in violation of current court decisions "specific" to what can and cannot be released from the Mueller findings.

Of course, that won't stop Democrats and their liberal cronies from barking at the moon, and demanding that Barr is doing something unethical by following the law.

A federal appeals court on Friday tossed an obstacle in the way of grand jury information in special counsel Robert Mueller’s final report being released directly to the public, but the decision may not slow disclosure of that material to Congress.

The decision from a divided three-judge panel of the D.C. Circuit Court of Appeals did not directly address Mueller’s report, but involved a grand jury investigation more than six decades ago into the disappearance of a Columbia University professor and political activist, Jesús Galíndez..

While there is no exception that covers cases of intense political or historical interest, courts have repeatedly held that they have “inherent authority” to make such disclosures in unusual cases.

However, the D.C. Circuit decision Friday sided with a long-standing Justice Department position that those rulings were mistaken and a formal change to the grand jury secrecy rule would be needed to give judges that power.

“We agree with the Government’s understanding of the Rule,” Judge Douglas Ginsburg wrote, joined by Judge Greg Katsas. “The contrary reading ... which would allow the district court to create such new exceptions as it thinks make good public policy — would render the detailed list of exceptions merely precatory and impermissibly enable the court to ‘circumvent’ or ‘disregard’ a Federal Rule of Criminal Procedure.”

On Wednesday, the House Judiciary Committee passed a resolution authorizing Chairman Jerry Nadler (D-N.Y.) to subpoena the full report and all supporting materials. Such a subpoena may be sufficient to give the House access to grand jury information under an existing exception covering material sought in connection with “judicial proceedings.”

Trump vs Obama’s GDP numbers. Trump’s numbers are sitting at 2.55% for 2017 and 18 (2.2% and 2.9% in 17/18 respectively). Obama’s last 2 years averaged 2.2% (2.9% and 1.6% in 15/16 respectively). Trump is doing slightly better than the final two years of Obama’s administration. Not hugely better as promised or as I hoped.

Well there is a slight difference...

Nixon was actually found by investigators to have committed crimes.

Trump was actually found to have been exonerated of the main charges that prompted the investigation in the first place.


If the House opened impeachment hearings those hearing would have to involve a claim that there was a criminal conspiracy in order to get access to those Grand Jury documents dealing with Russia, etc.

If they opened impeachment hearings over obstruction of Justice, then only those Grand Jury documents dealing specifically with that subject (if there are even any) would be a valid request.

Nielsen didn't resign willingly, a source told CNN, with her resignation announcement coming after a tense meeting at the White House with the President. Nielsen's tenure at Homeland will probably best be remembered for her defense of the administration's zero-tolerance policy, which caused widespread outrage after hundreds of migrant children were separated from their parents. Trump named Kevin McAleenan, who is the US Customs and Border Protection commissioner, as Homeland Security's acting secretary. I don't need to see what the report says to know what's in it. Difficult issues of "law" and "fact" are fairly self explanatory considering the finite amount of possibilities.


The questions on law are simple to guess:

- Some members stuck with the traditional standard view of obstruction
- Some members wanted to move forward with a more subjective viewpoint that legal actions can be considered obstruction if there is "corrupt intent"

Which leads to a difference of opinion on fact:

- Some members believed that it could be proven that Trump had "corrupt intent"
- Some members believed that such intent could not be established


It's not that hard, Denny. I had this figured out a long, long, long time ago, when you were still arguing that Trump Jr and Jared K, and even Ivanka were going to be frog-marched out in cuffs.

There was never, ever going to be a finding of collusion or conspiracy. I maintained that from day one, and I was, am still, and always will be right.

And as long as there were anti-Trump Democrats on the team, some would always want to demand a pound of flesh for their efforts. Since conspiracy was never going to be found, they concentrated those efforts on obstruction.


But the major problem here is when you cannot get your team of investigators and prosecutors to even agree on the law, much less the facts... you certainly cannot charge someone and honestly believe you can unanimously convince a jury beyond a reasonable doubt.

The other thing that is overlooked is that there was no underlying crime. In other words the question is "What justice is being obstructed?"

Now liberals will tell you that you don't need an underlying crime or circumstance to charge a person with obstruction. But good luck getting a jury to convict.

They convinced a D.C. Jury that Scooter Libby was guilty of perjury and obstruction during an investigation that had no underlying crime. There was never any illegal "outing" of Valerie Plame (she didn't even legally qualify as being clandestine).

But that was the pound of flesh that people demanded over a special prosecutor who took two years to finally admit what he knew less than 30 days into the investigation (that there was no illegal outing).


So it's not unheard of that people are charged even with the investigation finds no underlying crime. But when your entire basis of charging someone with obstruction is "corrupt intent" - then proving that that person has something to hide is an important part of proving that.

At least Fitzgerald could offer that Libby might have believed he was in danger of being charged with a crime for releasing information about Plame to people in the media.

Trump pretty much knew that they would never find anything that would tie him to the Russians who were indicted, nor any other connections that could establish any sort of "conspiracy".

Judge Richard Seeborg of the United States District Court for the Northern District of California found that existing law did not give the Trump administration the power to enforce the policy, known as “migrant protection protocols,” which were introduced in San Diego and expanded to other parts of California and Texas.

The judge said in his ruling that in addition to violating immigration laws, the protocols did not include “sufficient safeguards” to comply with the Department of Homeland Security’s obligation against returning migrants to places where their “life or freedom would be threatened.”

Immigration advocates hailed the decision, calling it the latest victory in the legal battles with the Trump administration that began when the president imposed a travel ban on several predominantly Muslim countries just days after taking office in 2017.

Temporary status is a seemingly permanent condition of the Trump administration.

The resignation of Kirstjen Nielsen as homeland security secretary on Sunday means that another cabinet officer who reports directly to President Trump will have the word “acting” next to the official title at a major department of government.

Interim secretaries are also in place at the Departments of Defense and of the Interior, and at the Office of Management and Budget, the Small Business Administration and ambassador’s office at the United Nations. Mick Mulvaney, Mr. Trump’s chief of staff, is also serving in an acting capacity.

“I like acting. It gives me more flexibility. Do you understand that?” Mr. Trump told reporters in January before departing to Camp David. “I like acting. So we have a few that are acting. We have a great, great cabinet.”

But there are concerns about having men and women in such high-level jobs without having been subjected to Senate confirmation for those posts. Leaving cabinet secretaries unconfirmed in their roles could give the president even more leverage over them, or could leave them without full authority in the job.

He's trying to put his cronies in the very important cabinet positions.

He's trying to punish children be separating their children from their parents.
