As was pointed out by many, special counsel determined three things:
- That there was no conspiracy
- That they could not recommend obstruction
- That they were not happy with either result
The irony of the Mueller report is that for a group of straight shooting people supposedly so driven by regulations, laws, and procedures, the Mueller report was in violation of almost every conceived norm. As the old saying goes, if you cannot indict you don't incite. In other words, law enforcement is not allowed to investigate someone, come up short of an indictment, and then issue a public report that in turns criticizes behavior or otherwise works to undermine the person or people that they were investigating.
Yeah, old Bob didn't rob the bank, but he is cheating on his wife, he surfs the web at work, and he lets his dog poop in the neighbor's lawn and doesn't pick it up.
Yet, make no mistake, this is exactly what the report did. The reality is that William Barr's summary during the Press Conference was spot on. Mueller (regardless of the dog and pony show and numerous innuendoes) could not find any actual real tangible "evidence" of the underlying accusations. He couldn't even establish that one single American was complicit or in any way working with the Russians. From a pure constitutional, legal, and regulatory manner, that was all the Mueller report was required to report. That he came up short. That the entire idea of a collusion conspiracy was a hoax.
But that's not what he did. The "straight shooter" grabs a bow and arrow and takes his best shots. He tries to inply a theory here, toss in a coincidence there, and suggest that if he had more information, that the conclusion could change. Ahem. But the bottom line is that given 22 months, 30 million dollars, a few dozen investigators and attorneys, and given an intrusive investigation that searched everywhere but under my bed, Special Counsel found what the little boy shot at and missed.

As far as volume II of his report, he starts off by declaring that he was not going to make a prosecutorial call, even though that was exactly what he was tasked to do. The motivation for this may not be completely clear, but you can all be sure that it was "not" because he thought he had the President dead to rights, and somehow didn't want to pull the trigger. Certainly Ken Starr did not have any issues declaring in his report that President Clinton committed obstruction. Ironically most liberals demanded that Mueller follow the Starr principle.
The reality is that Mueller and his team engage in a pure fictional attempt to create a crime where none exists. You have to go no further than the fact that both the Attorney General and the Deputy Attorney General disagreed with Mueller regarding whether or not the actions mentioned could even be considered for an obstruction charge. Going through the areas of concern, I would be shocked if there is any relevant precedent for anyone EVER being charged for any of these actions.

- "asking someone to say publicly that he did nothing wrong"
- "firing a direct report"
- "asking the A.G. to supervise (which is his job)"

- "expressing anger at a continued investigation"
- "efforts to have someone deny something to the media"
- "coordinating defenses with others being investigated"
- "tweeting about a witness"
- "alleged actions of his attorney"
Amazing that anyone would consider any of these crimes? I suppose they might be when the subject is Donald Trump and your investigative team is a bunch of Hillary supporters.
But even providing Mueller with the benefit of the doubt and using his own logic to draw the conclusion, the A.G. and Deputy A.G. felt that the evidence required to prove these charges was woefully short. Mueller himself, admits that the threshold to declare legal actions illegal by means of "corrupt intent" is a high hurdle to pass. Given the President's many possible alternative reasons for doing pretty much everything on the list, it would be nearly impossible to "prove" that the only "reasonable" conclusion was the corrupt intent required as proof to make any of these legal actions illegal.
The facts (and I understand that liberals hate facts) was that the President did not obstruct the investigation. He handed over to special counsel every document ask for, encouraged anyone and everyone Mueller called to cooperate fully, and allowed the investigation to go to completion. If Special Counsel wanted to interview the President, then they could have attempted a subpoena. But when you charge everyone you interview and their brother with process crimes, nobody is going to want to come talk to you willingly.
Moreover, the President was never guilty of the underlying crime (something that Mueller himself points out), making "incentive" to obstruct a murky argument to make in court.
But most importantly, in spite of issuing ten areas of concern, there was not one area where Mueller could suggest that his investigation was actually obstructed or otherwise hampered. Generally in order to prove obstruction, you have to show that the actions actually tangibly obstructed something. That would seem to be a pretty substantial "missing" piece of the puzzle, if Mueller actually believed he committed obstruction. Go no further than that, if you really wonder why Mueller did not pull the trigger on obstruction.
Bottom line: this whole investigation from start to finish was a complete embarrassment and a stain on our history. While there may still be some dwindling CNN viewers who want to keep this thing alive, I don't think history is going to view this Special Counsel as anything very special.

Mueller's team compiled 10 different episodes where Trump may have potentially committed obstruction of justice.
The report sets out from the start that the investigation accepted the Justice Department's Office of Legal Counsel's 2000 conclusion that a sitting president could not be charged or indicted with a crime. But it also notes that it "recognized that a federal criminal accusation against a sitting President would place burdens on the President's capacity to govern and potentially preempt constitutional processes for addressing presidential misconduct."
The final words of the document are most telling: "Accordingly, while this report does not conclude that the President committed a crime, it also does not exonerate him."
Under the guidelines of the Department of justice, he could not indict the sitting President of the United States.
I think history is going to view this Special Counsel as the most important work to preserve and protect the Constitution and the United States.

I found the most surprising part of the report to be twofold: One, that special counsel Mueller went out of his way multiple times to dispel the notion that there is any concept called “collusion,” and that what he investigated was instead coordination and conspiracy; and two, that the report did not exonerate the president even with respect to conspiracy and coordination.
Although the report stated that there was “no evidence” of conspiracy or coordination, it left open the possibility that there may be evidence out there that the president’s associates suppressed. Some individuals invoked their Fifth Amendment right against self-incrimination. Some information was screened even from the special counsel and his team. Several people affiliated with the Trump campaign (including Michael Flynn, George Papadopoulos, Michael Cohen and Paul Manafort) lied or provided incomplete information to the special counsel about their interactions with Russian-affiliated individuals. Still others deleted communications or used encryption that did not provide for the long-term retention of data. And with respect to redactions within the report, the ones concerning the Trump campaign’s interest in WikiLeaks’ releases of hacked material are particularly concerning.
The special counsel declined to make a recommendation on obstruction mostly because the Office of Legal Counsel has concluded, most recently in 2000, that a sitting president is immune from indictment. The report made clear that it is up to Congress to decide whether to use impeachment as a remedy. So what will matter most for the remainder of the Trump presidency is whether the House of Representatives will file articles of impeachment based on the substantial allegations that the president may have obstructed justice.

Firing special counsel illegal?
These special prosecutors could not be fired by the President or the Justice Department in order to make them independent. But Congress allowed those provisions to expire in 1999 so the only thing left now is special counsel provision. A special counsel is appointed by the Justice Department and thus can be dismissed by the Justice Department. In order to bring back the “special prosecutor,” Congress would have to renew the laws that lapsed in 1999.
There are numerous legal opinions on this law and every last one states that Special Counsels can be legally fired. So the drunken concept that it's illegal or that Trump was ordering an illegal action is in 180 violation of the law as well as common sense.
The only caveat is that Trump would not be able to do it himself or have his personal lawyer do it, but rather the Attorney General or Deputy Attorney General would have to do it. So Trump could only technically order someone else to do it (or to have the correct person do it). As the boss of the entire DOJ, the AG or DAG would (in theory) be required to do so.
It goes right back to the same thing as the Comey firing. Can you charge the President with a crime for performing a constitutionally provided authority? Many, many people say no...

Since the biggest change to the law was the repeal of the individual mandate, it would be closer to the truth to suggest that 1 million Americans decided not to purchase Health Insurance (now that they were given the chance).

It shows in 2018 that 255.9 million Americans were insured.
That actually shows an increase in insurance by 2.6 million.
I think someone wrote an article stating something else, and you simply took their word for it, instead of fact checking it.

I saw it. It went from 29.3 million to 29.9 million. So we are still searching for the whereabouts of the "more than one million".
Considering the fact that our population is growing, as well as the fact that 2.6 million more people have insurance, and only 600K more are uninsured... That still provides that things went in the better direction by approximately 2 million people.
There is nothing in the report to corroborate the claim that "over a million" people "have lost" insurance.
I don't doubt, Denny, that you read that somewhere. But I never take anyone's word for things, or I would continuously look stupid for believing people.
