Once again, McCarthy makes points everyone else misses (or ignores)

Breaking Down the Whistleblower Frenzy
The common meaning of urgent concern is obvious: It could describe anything that raises the specter of imminent harm. But urgent concern is also a specialized term in federal law. Under Section 3033(k)(5)(G) (of Title 50, U.S. Code), an “urgent concern” relates to specified problems involving intelligence activities and classified information that are within the responsibility of the Director of National Intelligence. The DNI is the cabinet official who oversees the so-called community of intelligence agencies. The urgent concerns Section 3033 outlines include, for example, violations or abuses of laws or executive orders, or deficiencies in the funding, administration or operation of an intelligence activity. Section 3033 urgent concerns also include misleading of Congress regarding intelligence activities, and reprisals against whistleblowers who report an urgent concern.
In my view, Chairman Schiff’s claim, based on IGIC Atkinson’s interpretation of the statute, is wrong. Section 3033 does not apply to a president’s negotiations with or commitments to foreign powers, or to a president’s sharing of classified information with foreign powers. To repeat, the statute applies to intelligence activities by government officials acting under the authority of the DNI. If I am right, the Trump administration should not be accused of law-breaking for declining to follow Section 3033, even if the whistleblower had an “urgent concern” in the ordinary understanding of that term.

So McCarthy provides a second point here that rests above and beyond the other point that the Whistle blower in question likely does not have personal proof of what he/she is alleging. McCarthy is suggesting that the Democrats insistence that the complaint must be turned over to Congress is entirely wrong because the laws regarding this do not in fact include the President. McCarthy sides with the Director of National Intelligence based entirely on the reading and meaning of the laws at hand.

Now McCarthy does suggest that more facts are needed to make any sort of determination as to the seriousness of the claims. But McCarthy also makes the point that neither Congress or the American public has a right to hear unsubstantiated complaints that infringe on the President's executive privilege or infringe  on the President being able to conduct sensitive foreign business privately. There is no statute that requires it, and the constitution strictly prohibits such a statute from even being written. I know this is an unpopular position, these days, but the Presidency has many inherent powers under the constitution, and Trump is allowed those powers (just as much as any other President).

Once again, McCarthy points out that the "former intelligence agents" who are leaking this information to the media are quite literally breaking the law, and quite possibly breaking it in very serious fashion. He also points out that the same supposed actions of pressuring Ukraine for political purposes was going on in 2016 with the Obama administration and nobody seems to care. The logic among the brain dead of this country seems to be that Democrats should be allowed to break the law with impunity as long as the breaking is done to harm Trump. But any similar type of action taken by Trump should result in him being drawn and quartered.

This should be a huge loser for the Democrats, but rather will probably just fizzle out as these things normally do. But the reality is that we actually know (pretty much as a fact) that the Democrats did in 2016 what they are accusing Trump of doing in 2020... even if Trump haters actually have no evidence that Trump actually is doing the same thing. We also are being exposed (again) to more illegal leaking of sensitive information from lawless partisans who are doing everything in their power to bring down a legally and fairly elected President.

you could fill volumes with things that should/should've been a huge loser for the left, but with the msm carrying their water and providing them cover they always live to fight another day.

remember this?

As he was leaning toward Medvedev in Seoul, Obama was overheard asking for time - “particularly with missile defense” - until he is in a better position politically to resolve such issues.

“I understand your message about space,” replied Medvedev, who will hand over the presidency to Putin in May.

“This is my last election ... After my election I have more flexibility,” Obama said, expressing confidence that he would win a second term.

“I will transmit this information to Vladimir,” said Medvedev, Putin’s protégé and long considered number two in Moscow’s power structure.

so democrat presidents are free to candidly converse with foreign leaders, but republicans not so much.

huh.

and there are some out there who postulate that it's a warren supporter, and not a trump detractor who's behind all of this. she's gaining momentum and there will come a point where she will need to take him out. that time could be now.

Yeah Denny...

Because you have been so right before, huh?

McCarthy has pretty much been dead on correct about nearly every legal thing that has happened since Trump has been President. Who would be charge, who wouldn't be, who would be found guilty, who wouldn't be, even to a large degree he has been right about what would be found.

On the other hand, you and the people you listen to have been pretty much dead on wrong every time.

The only reason anyone should listen to you is to determine what is wrong.

McCarthy and the rest are covering something up.....

yep. that's it dumb fuck.

a man who has absolutely nothing invested in this issue and only comments as an informed observer with legal training is going to go out of his way to cover something up regarding an issue that doesn't involve him in the least.

and this is why i call you dumb fuck denny.

if you're trying to wrestle the 'blog idiot' crown away from the alky you're off to a great start.

The Long Civil War

If anyone thought the status quo would fold up after the hammer blows of the 2016 populist revolt, they were wrong. Ben Rhodes noted the effects of unremitting resistance with approval. "Bibi backsliding. Boris flailing... Fight back. It will work." Victor Davis Hanson conceded the crushing weight of the establishment riposte: "After nearly four years of ceaseless attacks by Democrats and the press, the strange thing is not that Trump can be occasionally wearisome, but that he is even still breathing."

The tone of the fight was set by Greta Thunberg's declaration to a crowd of environmental supporters: "We can't save the world by playing by the rules because the rules have to change." It was a ringing call to victory over the Deplorables, victory by any means necessary. It was as if the old legalisms themselves had become too restrictive to allow the truly good guys to win. As Hillary Clinton told an audience at George Washington University: “You can run the best campaign and have the best plans and get the nomination and win the popular vote and you can lose the Electoral College and therefore the election.”

“This is one of those moments we stand at a crossroads of our own a crisis in democracy. Racists and white supremacist views are lifted up in the media and the White House. Hard fought for civil rights are stripped back. Rule of law is being undermined, our norms and institutions... are under assault, and that includes the single most important fight of our times…the fight to protect the right to vote.”
She deserved to win but the rules betrayed her. If you can't win the old way, change the rules. To avoid another setback to history, Elizabeth Warren proposes to abolish the Electoral College. “Every vote matters, and the way we can make that happen is that we can have national voting, and that means get rid of the Electoral College,” Ms. Warren said. If that doesn't work, keep getting rid of stuff until it does.

President Donald Trump on Sunday acknowledged that he discussed former Vice President Joe Biden during a July phone call with Ukrainian President Volodymyr Zelensky, but denied accusations that he is using the power of his office to hurt a major political rival.

As noted above, current and former intelligence officials continue to leak like sieves in their years-long campaign against the sitting president.

Deep state conspiracy or Deep throat Trumpism?

The whistleblower who ever he or she is, is that Deep throat that brought down Nixon.

Your continuing commitment to the Deep State conspiracy theory bullshit is not normal behavior.

Racist rodent bastard, Trump is coming to get you!

WASHINGTON, D.C. - Acting Department of Homeland Security Secretary "an outstanding cabinet" Kevin McAleenan announced the agency’s new counterterrorism strategy at an event at the Brookings institute Friday, and for the first time, DHS is focused on addressing the threat of white nationalism coming from within the borders of the United States.

“Today, the United States faces an evolving threat environment, and a threat of terrorism and targeted violence within our borders that is more diverse than at any time since the 9/11 attacks,” said McAleenan.

DHS was founded after the Sept. 11, 2001, terrorist attacks with the mission of safeguarding the country from both foreign and domestic threats.

Trump allies urge release of transcript at center of whistleblower controversy

Some key administration officials are urging President Trump to release the transcript of a conversation with Ukrainian president Volodymyr Zelensky that is at the center of a growing whistleblower controversy.

Those officials believe public disclosure of what was said on the call would quell accusations that Trump broke the law or acted improperly by pressing Zelensky to investigate Trump rival Joe Biden's son. The Wall Street Journal reported that Trump urged Zelensky "about eight times" to help Trump lawyer Rudy Giuliani probe the business dealings of Hunter Biden.

There are also administration officials who oppose public release. The content of the president's conversation with Zelensky, like all presidential conversations with foreign leaders, is privileged. Small portions of it might also be classified. Opponents of public release say that if the Trump-Zelensky transcript were made public, foreign leaders could have no confidence that their talks with Trump would be confidential.

Doesn't sound like they are hiding anything.
