Interests wanes

And for now, there are no more public hearings scheduled?

Herein lies the problem. The Democrats spent a bunch of time teasing everyone with these secret closed door basement hearings, where they would selectively leak information designed to give the impression that they were making big progress.

Then they carefully selected the witnesses that "they" believed would help their cause and called them to testify in public. The problem was that witness after witness after witness went south under cross examination, specifically as it pertained to whether or not they actually had any knowledge of any impeachable offenses.

They all answered no. No first hand accounts, no witness, or no actual knowledge of illegal activity by the President or those close to him.

Well you might have a problem. If thg this decision stands, when the intelligence committee brings out the truth, King Trump will be impeached.

WASHINGTON — The former White House counsel Donald F. McGahn II must testify before House impeachment investigators about President Trump’s efforts to obstruct the Mueller inquiry, a judge ruled on Monday, saying that senior presidential aides must comply with congressional subpoenas and calling the administration’s arguments to the contrary “fiction.”

The 120-page decision by Judge Ketanji Brown Jackson of the Federal District Court for the District of Columbia handed another lower-court victory to House Democrats in their fight to overcome Mr. Trump’s stonewalling.

“Presidents are not kings,” wrote Judge Jackson, adding that current and former White House officials owe their allegiance to the Constitution. “They do not have subjects, bound by loyalty or blood, whose destiny they are entitled to control.”

"The leading feature of our Constitution is the independence of the Legislative, Executive, and Judiciary of each other; and none are more jealous of this than the Judiciary. But would the Executive be independent of the Judiciary if he were subject to the commands of the latter, and to imprisonment for disobedience; if the smaller courts could bandy him from pillar to post, keep him constantly trudging from north to south and east to west, and withdraw him entirely from his executive duties?"

yeah, sure alky.

just because mcgahn has been compelled to testify doesn't mean that what he says is going to result in trump's impeachment. a few dozen "i don't recall's" will end the testimony right where it began - a big nothingburger.

“Whether or not the law requires the recalcitrant official to release the testimonial information that the congressional committee requests is a separate question, and one that will depend in large part on whether the requested information is itself subject to withholding consistent with the law on the basis of a recognized privilege,”

Jackson wrote. “But as far as the duty to appear is concerned, this Court holds that Executive branch officials are not absolutely immune from compulsory congressional process—no matter how many times the Executive branch has asserted as much over the years—even if the President expressly directs such officials’ non-compliance.”

In March of 1974, as a young state attorney general, I reluctantly called for President Richard Nixon’s resignation amid revelations of abuses of power related to Watergate. It wasn’t an easy thing to do. As a Republican, I didn’t enjoy breaking with my party or my president. As an elected official and practical politician, I didn’t particularly enjoy the implications of turning against someone who had comfortably carried Washington State just two years earlier. None of it was pleasant, but I believed it was the right thing to do on the facts and on the merits.

John Adams said, “Facts are stubborn things.” Forty-five years after Mr. Nixon resigned before he could be impeached by the House, the facts should be the focus of every elected official, Republican or Democrat, as they decide what to do about another president facing impeachment and a possible Senate trial.

To my fellow Republicans, I give this grave and genuine warning: It’s not enough merely to dismiss the Ukraine investigation as a partisan witch hunt or to hide behind attacks against the “deep state,” or to try to find some reason to denounce every witness who steps forward, from decorated veterans to Trump megadonors.

History demands that we all wrestle with the facts at hand. They are unavoidable. Fifty years from now, history will not accept the position that impeachment was a referendum on the House speaker, Nancy Pelosi. It must be a verdict reached on the facts.

My judgment so far as an objective observer is that there are multiple actions on this president’s part that warrant a vote of impeachment in the House, based on corroborated testimony that Mr. Trump and his personal lawyer, Rudy Giuliani, pressured leaders of Ukraine to investigate the Democratic presidential candidate Joseph Biden and his family.

From what I have read, it seems clear that President Volodymyr Zelensky of Ukraine was subjected to a shakedown — pressured to become a foreign participant in President Trump’s re-election campaign, a violation of the law.

Several credible witnesses have testified to the existence of a quid pro quo, including William B. Taylor Jr., the acting ambassador to Ukraine; Lt. Col. Alexander Vindman, the White House’s top Ukraine expert; and Gordon Sondland, Mr. Trump’s ambassador to the European Union. They and others have testified that there was a push for politically motivated investigations, and three of them were so alarmed that they attempted to report their concerns up the chain of command at the National Security Council.

Coldheartedtruth Teller said...

Are they to be believed? Here’s my bottom line: That’s what an impeachment inquiry and a Senate trial are designed to find out. That’s why there’s a process under the Constitution.

But make no mistake: This is precisely the kind of crisis Alexander Hamilton feared. In Federalist No. 75, he warned that a president might be tempted to betray the interests of the country for his own benefit, “to sacrifice his duty to his interest, which it would require superlative virtue to withstand”; that “an avaricious man might be tempted to betray the interests of the state to the acquisition of wealth”; that a president might “make his own aggrandizement, by the aid of a foreign power, the price of his treachery to his constituents.”

Given the temptations a president might have in dealing with foreign powers, Hamilton’s solution was equally clear: Congress should be involved. “The participation of the whole or a portion of the legislative body in the office of making them,” he wrote of treaties. And in the same vein, the founders gave Congress the power to check a president accused of abusing the power of his office. They expected Congress to render its judgment on the facts.

So, to my fellow Republicans who have been willing only to attack the process, I say: engage in the process. If the president is innocent, use the process to surface those exculpatory facts so that Congress and the country can agree whether or not Mr. Trump should be removed from office. The facts — not rhetoric — should answer this question: Is there an offense serious enough to undo the results of the 2016 election?

A heavy burden to meet, but not an impossible one.

Here’s what I know: Neither the country nor the Constitution is served by a partisan shouting match divorced from the facts, a process boycotted by one side refusing to engage on the merits. John Adams is still right 250 years later: Facts are stubborn things. Facts are what should determine whether a stubborn president stays in office. Republicans, don’t fight the process, follow the facts wherever they lead, and put country above party.

Slade Gorton was a Republican senator from Washington from 1981 to 1987, and again from 1989 to 2001.

In this wider context, impeachment is rebooted as no longer a rare gambit, but a sort of parliamentary vote of no confidence, analogous to a European government. When Democrats lose elections, they can now immediately talk of impeachment first, and find the supposed crimes later. Democrats are not fearful of institutionalizing impeachment without cause. Indeed, they welcome its normalization in times of Republican presidencies.

The common denominator in all this frenzy hatred?

None of the haters cares that unemployment is at near record lows, the stock market at record highs, economic growth steady, inflation and interest rates low, minority employment at all-time levels—or that there is a looming shared need to address entitlements and deficit sooner than later.

None care that for three years, there has been a nonstop effort from within and outside government to end the Trump presidency, or at least to sabotage it along the lines outlined by the anonymous New York Times op-ed writer, the whistleblower lawyer Mark Zaid, or departing Department of Defense official Evelyn Farkas, or as bragged about by #TheResistance.”

We are in new territory now. Hating a president is equivalent to finding him guilty of supposed high crimes. Impeachment is a casual affair. Hearsay is as valid as direct testimony.

We are now living is a brave new American world never envisioned by the Founders.

The precedent, if it stands, any future President can do anything he or she wants to do!

If a Democratic candidate wins in 2020, and the Democratic party controls the house and Senate, do you want to see that power used to write an executive order declaring that all Americans have the right to have Medicare for all Americans?

I don't support the idea, but you are granting the President the right to impose his or her policies on every single person in the country.

WASHINGTON (The Borowitz Report)—In what could be his most explosive allegation to date, Rudolph Giuliani claimed on Monday that he had “mountains of evidence” linking the Democratic Presidential candidate Joe Biden to former President Barack Obama.

Appearing on “Fox & Friends,” a visibly excited Giuliani said that he had stored the evidence of the Biden-Obama ties in his office safe and was prepared to reveal it “at the proper time.”

“This isn’t a case of the two men sharing an occasional phone call or meeting,” Giuliani charged. “For eight years, they were basically joined at the hip.”

Giuliani argued that Obama and Biden had a “secret understanding” that, if anything happened to Obama, “You know who would take his place? That’s right: Joe Biden.”

Their corrupt deal enabled Biden to “feast at the teat” of the federal government, the former New York mayor said. “Biden took military aircraft around the world and got free housing in Washington, all with the seal of approval of his best pal, Barack Obama,” he said.

In his most serious allegation, Giuliani said that all of these “lush perks” amounted to a “payoff” for nefarious services that Biden had rendered to Obama.

“In both 2008 and 2012, Joe Biden meddled in the U.S. elections to benefit none other than—you guessed it—Barack Obama,” Giuliani said. “Talk about a quid pro quo.”

if trump was abusing power in the manner you just described he would wipe away 0linsky-care with the stroke of a pen. but he hasn't done so and that pile of shit is still with us, however weakened by LEGISLATIVE, not executive action.

i'll tell you what COULD happen in 2020. if a democrat wins the white house roughly 19 minutes after being sworn in impeachment talk could begin, and impeachment articles could be published, just like you assholes did to trump.

we'll just declare the inaugural speech to be an abuse of power - a high crime and misdemeanor - and go from there. presto, we get our shot at throwing a tantrum and trying to overturn the result of a free and fair election. sow the wind, reap the whirlwind.

Swing State Dem Flips on Impeachment

Over the summer, Congresswoman Brenda Lawrence fully backed the move to impeach President Trump, but the Detroit-area Democrat said over the weekend that she has since changed her mind.

“I feel we should begin that process,” Lawrence told CNN on June 12. “If we impeach him, he is still sitting in the White House because the Senate must act.”

“Our democracy is bigger than Donald Trump, and we need to act,” added the congresswoman, who since 2015 has represented Michigan’s 14th District, which includes eastern Detroit.

Now, however, Lawrence said she sees things differently.

“You can censure, you don’t have to remove the president,” Lawrence said Sunday on No BS News Hour with Charlie LeDuff. “Sitting here, knowing how divided this country is, I don’t see the value of kicking him out of office, but I do see the value of putting down a marker saying his behavior is not acceptable.”

“I’ll be g-damned,” the host said at one point in response to Lawrence’s remarks. “To hear you say, and you are a Democrat, and you are a liberal minded person; I know you don’t like Trump For the betterment of all of us, in an election year, it’s unwise to tear him from the chair. Is that how you think?”

Yeah,” Lawrence responded.

The real story is that she's a member of the progressive caucus from a D+30 district.

Well first, that decision has been appealed. I would give it pretty good odds that the USSC will weigh in and I would think Trump has a better than even chance of prevailing at that point.

While this particular Obama Judge sees this as a Trump thing (quite obviously) and has tossed a whole bunch of politically charged rhetoric into her decision (such as the talk of dictatorships)... the reality isn't about whether or not Congress should have executive branch subpoena power... it's about whether or not a Court is going to continue to acknowledge executive privilege or (in the case of Don McGahn) whether they are going to respect attorney/client privilege.

The very fact that McGahn was a White House attorney and the very fact that Trump would have confided in him for legal advice is exactly why this has nothing to do with "Dictatorships" or any other rhetorical nonsense. Any attorney who breaks the Attorney Client Privilege can be immediately disbarred.

You cannot change the long standing legal principles regarding attorney client privilege (or even executive privilege) because you don't like the "Bad Orange Man".

C.H. Truth said...

Also Roger...

Keep in mind that even if McGahn testifies, he can still refuse to answer questions bases on executive privilege and/or attorney client privilege. Would Congress hold an Attorney in contempt of court for claiming attorney privileges?

That would be some serious bad optics that would likely resonate fairly loudly.

Boomerang! Liberal Watchdog Group Publishes FOIA Documents to Target Giuliani, Fails to Realize Documents Detail Biden/Ukraine Corruption

What the group fails to realize is that the documents include Giuliani’s interview notes which provide detailed accusations of corruption against the Bidens.” Giuliani had interviewed Victor Shokin, the Prosecutor General who was investigating Ukrainian natural gas company, Burisma Holdings in March 2016. Shokin was about to question Hunter Biden when former Vice President Joe Biden ordered then-Ukrainian President Petro Poroshenko to fire Shokin or he would hold back $1 billion in U.S. aid. Giuliani had also interviewed Yuriy Lutsenko, who had succeeded Shokin as Prosecutor General. The notes indicate that Lutsenko “believes Mr. Viktor Shokin the former Prosecutor General is honest.”

(So Biden did withhold aid to fire an honest prosecutor, or so says the one Biden replaced him with)

“Mr Shokin further stated that there were several Burisma board appointments were made in 2014 as follows:

1. Hunter Biden son of Vice President Joseph Biden
4. Devon Archer roomate to the Christopher Heinz the step-son of Mr. John Kerry United States Secretary of State

WASHINGTON (AP) — President Donald Trump is donating his third-quarter salary to help tackle the nation’s opioid epidemic.

A White House official says Trump has given the $100,000 he would be paid in the quarter to the Office of the Assistant Secretary of Health, which oversees federal public health offices and programs, including the surgeon general’s office.

The White House says the funds are being earmarked “to continue the ongoing fight against the opioid crisis.”

Trump has made tackling the misuse of opioids an administration priority. More than 70,000 Americans died in 2017 from drug overdoses, the bulk of them involving opioids.

Trump is required to be paid, but he has pledged to donate his salary while in office to worthy causes. Trump donated his second-quarter salary to the surgeon general’s office.

The U.S. intelligence community has concluded unequivocally that it was Russia who meddled in the 2016 election, and last week former National Security Council adviser Fiona Hill slammed the Ukraine conspiracy theory as a “fictional narrative” propagated by “Russian security services themselves.”

Yet Pompeo pushed the false claim anyway on Tuesday, asserting that the U.S. “should leave no stone unturned.”

“Whatever nation it is that we have information that so much as suggests that there might have been interference or an effort to interfere in our elections, we have an obligation to make sure that the American people get to go to the ballot box, cast their ballots in a way that is unimpacted by these malevolent actors trying to undermine our Western democratic values,”

Max Boot: “Republicans have turned their back on conservative principles to become a cult of personality for an aspiring authoritarian. All voters with a conscience should now turn their back on the Republican Party. For aiding and abetting the president’s egregious abuses of power, the Republican Party deserves to be destroyed from top to bottom. We need a center-right party in this country. What we have instead is a party with no fixed principles that is willing to do anything — no matter how vile — to serve its maximum leader, a.k.a. ‘the chosen one.'”

Two top officials who served on President Donald Trump’s National Security Council staff testified that they had seen no evidence that the Ukraine government interfered in the 2016 election, contradicting a claim the president has made in public and private.

The former officials, Fiona Hill and Lt. Col. Alexander Vindman, were responding to questions from House impeachment investigators, who released transcripts of their depositions on Friday.

WASHINGTON — President Trump had already been briefed on a whistle-blower’s complaint about his dealings with Ukraine when he unfroze military aid for the country in September, according to two people familiar with the matter.

Lawyers from the White House counsel’s office told Mr. Trump in late August about the complaint, explaining that they were trying to determine whether they were legally required to give it to Congress, the people said.

The revelation could shed light on Mr. Trump’s thinking at two critical points under scrutiny by impeachment investigators: his decision in early September to release $391 million in security assistance to Ukraine and his denial to a key ambassador around the same time that there was a “quid pro quo” with Kyiv. Mr. Trump used the phrase before it had entered the public lexicon in the Ukraine affair.

Mr. Trump faced bipartisan pressure from Congress when he released the aid. But the new timing detail shows that he was also aware at the time that the whistle-blower had accused him of wrongdoing in withholding the aid and in his broader campaign to pressure Ukraine’s new president, Volodymyr Zelensky, to conduct investigations that could benefit Mr. Trump’s re-election chances.
