USSC blocks Trump's Financial records from being turned over

Supreme Court blocks subpoena for Trump financial records
The U.S. Supreme Court late Monday blocked a House subpoena directing President Donald Trump's accounting firm to turn over several years' worth of financial documents, giving the president at least a temporary legal victory.
In a brief order, the court said the subpoena would remain on hold until the president's lawyers file their appeal and the court acts on the case. The court gave his lawyers until Dec. 5 to file their appeal, a sign the justices intend to move quickly. But if the court agrees to hear the appeal, the stay would remain in effect for several more months.

So this was not unexpected. The USSC was always likely to hear this case and they are likely leaning towards siding with the President (one of the criteria for staying a lower court order depends on the court believing there is a reasonable chance that the petitioner will win an appeal).

This has become a little bit of a paradox with the liberal press. They seem to act as if the USSC are the ones going "rogue" because they seem to be in continuous disagreement with lower court rulings. It's almost as if they do not quite want to accept the fact that the Supreme Court is the authority. These are highly respected Judges who have paid their dues.

The reality is that most of these lower court "resistance" decisions going against Trump simply do not have the law, precedent, or basic common sense going for them. Even the 9th Circuit Court of Appeals has started to overrule their District Judges, perhaps a bit tired of being overruled themselves.

The bigger problem is that we are at a point where District Court decisions (especially in places like the 9th Circuit Court) and no longer really taken seriously. If you know that the decision will be appealed, and you know that it's likely going to be overturned, it makes very little sense for a Judge to make a "resistance" ruling. It feels like these District Judges are more interested in handing down politically motivated decisions that make some sort of statement, rather than handing down a grounded legal decision that will likely hold up on appeal.

It may "not" feel fair for some of these liberal Judges to have to take into consideration how their decision will hold up under appeal, but that "used" to be one of the key factors in whether or not a Judge was considered a "good judge" and whether they would be considered for a nomination to a higher court. It used to be that Judges "never" wanted to have a decision overturned. Now it seems like some of these Judges wear it like a badge of honor.

A House Democratic aide declined comment on whether the Judiciary Committee expected it would have received a report on the Intelligence Committee-led investigation into the Trump administration's dealings with Ukraine before the hearing.

Representative Jerrold Nadler, the Democratic chairman of the committee, said in a statement that he had written to Trump to remind him that the committee's rules allow the president to attend the hearing, and for his counsel to question the witnesses.

"At base, the president has a choice to make: he can take this opportunity to be represented in the impeachment hearings, or he can stop complaining about the process. I hope that he chooses to participate in the inquiry, directly or through counsel, as other presidents have done before him."

The chairman of the House Intelligence panel, Representative Adam Schiff, said on Tuesday the committees leading the impeachment probe - Intelligence, Foreign Affairs and Oversight - would issue their report on the investigation shortly after lawmakers return to Washington on Dec. 3 from their break for the U.S. Thanksgiving holiday.

These hearing are supposed to be "legal experts" that will determine what the meaning of impeachment is and what should or should not constitute impeachment. That should be at best a C-Span moment, but I would bet you a dollar that the Major Networks will piss everyone off by covering them anyways.

Net support for impeachment grew steadily during U.S. congressional hearings, poll shows!!!!!!!!!

NEW YORK (Reuters) - Public support for impeaching President Donald Trump has tracked steadily higher over the past few weeks while a U.S. House of Representatives committee held a series of televised impeachment hearings, according to a Reuters/Ipsos opinion poll released on Tuesday.

The latest poll, conducted on Monday and Tuesday, found that 47% of adults in the United States felt Trump "should be impeached," while 40% said he should not.

The result, combined with Reuters/Ipsos polling over the past several weeks, showed that the number of Americans who want to impeach the president increasingly outnumbers those who do not.

Just before the hearings started on Nov. 13, the Reuters/Ipsos poll found that "net support" for impeachment, which is the difference between the number who support impeachment and the number who oppose, was 3 percentage points.

That increased to 4 points after the first week of hearings, and then to 5 points as the second week of hearings started. The latest poll shows that net support for impeachment is now at 7 points.

(CNN)A new CNN poll shows that half the country believes that President Donald Trump should be not only impeached by the House, but also removed from office by the Senate.

That result is being spun in some corners of the internet as great news for Trump, because that 50% number is unchanged from a CNN poll in mid-October, the conclusion being that the last 10 days of public impeachment hearings have not convinced more of the public that the President needs to go.

Except that we are missing the forest for the trees here: A majority of the country believes the current President of the United States should be impeached and removed from office!


A quick check of history shows how strange that is.

The peak of support for the impeachment and removal of then-President Bill Clinton in 1998 was 29% in CNN polling. That's the highest that number ever went, despite the fact that the House Republican majority did vote to impeach late that year!

Ditto impeachment sentiment for the two presidents between Clinton and Trump. In a 2006 CNN poll, 30% of the public wanted George W. Bush impeached and removed from office; in 2014, 33% said the same of Barack Obama. (Unlike Trump and Clinton, neither Bush nor Obama ever faced any sort of formal impeachment investigation or vote.)

What those historical numbers tell us is that for at least the last two decades, there is roughly 30% of the country that is ready to impeach a president (usually of the party to which they do not belong) at all times.

What makes the Trump number so remarkable, then, is that 20% more of the public is now convinced not only that he should be impeached but that he should be removed from office -- despite the fact that, unlike Clinton, Bush and Obama when those CNN polls were taken, Trump will face voters in a bid for a second term in less than a year's time.

Now, it is fair to say that Democrats -- if you gave them truth serum at the conclusion of last week's public impeachment hearings -- believed they had hit a home run, and that polling would reflect that. That polling so far hasn't changed all that much is worth noting.

So that point is right -- for now. But it's also worth noting that we are in the immediate aftermath of the hearings, and its findings may not have fully seeped into the public consciousness just yet. And more importantly, whether it's 50% or 51% or 55%, it's noteworthy that a majority of the public wants the President gone.

Don't get so close to the painting that you can't see the full picture. And that full picture is this: 50% of the public believes Trump should be impeached and removed -- almost double the amount who have said that about any of his three most recent predecessors, including one who was actually impeached by the House.

Don't lose sight of those facts amid the narrow focus on whether the impeachment numbers have moved since the last poll. That 50% number is both astounding and ahistorical.

Two weeks of public impeachment hearings in the news haven't hurt President Trump's popularity among American voters. While 40 percent of all registered voters approve of the job President Trump is doing, 54 percent disapprove. This compares to a 38 - 58 percent approval rating in an October 23 poll, and falls within the range of where his job approval rating has been over about the last two years.

The country remains closely divided on whether to impeach and remove President Trump from office. While 45 percent of American voters think President Trump should be impeached and removed from office, 48 percent don't think he should be. In an October 23 poll, 48 percent thought he should be impeached and removed and 46 percent didn't think so.

"The televised impeachment hearings haven't had much of an effect on the president's approval rating, or how voters feel about impeachment. The numbers still don't look good for Trump, but they definitely haven't gotten worse," Malloy added.

Voter opinion on impeachment will be difficult to move as 86 percent say their mind is made up, while only 13 percent say they might change their mind. Among those who think the president should be impeached and removed from office, 8 percent say they might change their mind, while among those who think the president should not be impeached and removed from office, 17 percent say they might change their mind.

Despite days of focus by national and international news media on the impeachment proceedings currently underway in the House of Representatives, President Donald Trump's job approval rating remains statistically similar to where it has been for weeks. Gallup's latest poll, fielded Nov. 1-14, failed to show a noticeable impact of the impeachment hearings in Congress on presidential approval. In fact, the last time the president's approval rating was 43% was in mid-September, just before news outlets began to report that a whistleblower complaint had been filed regarding a call between Trump and the president of Ukraine.

Two officials at the White House Office of Management and Budget recently resigned while voicing concerns over the holdup on Ukraine aid, a career employee of the agency told impeachment investigators, according to a transcript of his testimony released Tuesday.

Mark Sandy, the only OMB official to testify in the impeachment inquiry, did not name the employees in question. He said one worked in the OMB legal division and described that person as having a “dissenting opinion” about how the security assistance to Ukraine could be held up in light of the Impoundment Control Act, which limits the ability of the executive branch to change spending decisions already made by Congress.

The other person, who resigned in September, “expressed some frustrations about not understanding the reason for the hold,” Sandy said.


Sandy, the agency’s deputy associate director for national security programs, testified on Nov. 16, and his remarks revealed some of the White House’s internal machinations when it came to blocking the money. Other White House officials have defied congressional subpoenas to participate in the House Democrats’ impeachment inquiry.

The release of Sandy’s testimony came as House Democrats on Tuesday took steps forward in their impeachment inquiry into President Trump’s actions, with the judiciary panel scheduling its first hearing for December 4 and the budget panel releasing a report alleging the White House broke the law by withholding money from Ukraine.

The moves show the impeachment process quickly advancing beyond the hearings held by the House Intelligence Committee this month to proceedings that could lead to a formal vote on impeachment.
