Independents souring on impeachment underscores risk for Democrats
New public opinion polls are moving against Democrats on impeachment as independents sour on the House inquiry and increasingly express opposition to the hearings that have consumed Washington in recent weeks.
The new data comes as a surprise to Democrats, many of whom believe witnesses have offered damning testimony about President Trump’s dealings with Ukraine.
Witnesses have testified that Trump pressed Ukraine’s leaders to conduct investigations of the energy company Burisma Holdings — which was seen as code for probes of former Vice President Joe Biden and his son Hunter Biden, given the younger Biden’s work for the company as a board member.
There has also been testimony that security aid for Ukraine was delayed to put more pressure on that country’s government. Other witnesses have castigated Trump for pursuing conspiracy theories that Ukraine and not Russia was a major player in electoral interference in 2016.

This pretty much reads as a parody. The "Hill" (much like liberals and the coastal elitists) just see things differently than the rest of the Country.

“There’s always a disconnect between Washington and what people are thinking out in the states,” said Dick Harpootlian, the former chairman of the South Carolina Democratic Party and a surrogate for former Joe Biden’s presidential campaign.

The reality is that testifying to secret codes (rather than real evidence), delays (rather than actual withholding), or issues irrelevant to the impeachment allegations are not going to move anyone who isn't already convinced that Trump is guilty of something, everything, and anything in between. 

I cannot personally figure out exactly why Schiff, Pelosi and the rest of the gang believe that they can continue to push impeachment without actually being able to prove what they are alleging. A majority of the witnesses do not even pretend to have any relevant information about the allegations. Rather they spent all of their time disagreeing with the manner in which the President is conducting his Ukrainian foreign policy.

I guess if you are one of those people who believe that Presidents shouldn't be allowed to make their own foreign policy, then these are effective witnesses (even thought they have nothing to do with the issue at hand). On the flip side, if you are of the opinion that the Constitution matters, then these witnesses are proof positive that a deep state does exist and that they are no longer hiding the fact.

But anyone holding the Democrats to the point that they are trying to make are going to be extremely disappointed with the case being made so far. This would be exactly why support is dropping and why the support is dropping specifically in "flyover country" (which of course is where pretty much all of your battleground states are located).

Impeachment will make some Senate Republicans squirm
There is speculation whether impeachment will hurt some House Democrats from marginal districts; no doubt, a few will squirm.

If, as seems likely, the House votes to impeach Donald Trump, and it goes to the Senate for a trial, a handful of Republicans there — who may hold the balance in next year's elections — may squirm EVEN MORE.

These include Sen. Susan Collins (R-Maine), Sen. Cory Gardner (R-Colo.), Sen. Martha McSally (R-Ariz.), Sen. Joni Ernst (R Iowa) and Sen. Thom Tillis (R-N.C.). All are either slight favorites or in toss-up races against likely formidable opponents.

Voters, according to politicians and polls, care more about health care, the economy, immigration and education than impeachment. But a pitched congressional battle over removing Trump will affect marginal races, probably energizing voters on both sides.

Any possible Senate votes wouldn't occur for at least ten weeks. Ten weeks ago, little was known about the scandal, in which the president pressured the Ukrainians to dig up dirt on former Vice President Joe Biden while holding up much-needed military assistance.

Senate Republicans have to be worried what ELSE may come out in the weeks and months ahead; court tests may be settled that would require turning over more information — and perhaps even the TESTIMONY OF ADMINISTRATION WITNESSES in the face of White House stonewalling. Static analysis is perilous in this saga.

Polls show a pronounced partisan split on impeachment: Democrats overwhelmingly for; Republicans overwhelmingly against — with independents divided.

That's why a vote might cause some angst for maybe 15 percent of the new House Democrats who won Republican-held seats last year and several non-freshmen Democrats.

But any on the fence have a believable argument: Impeachment is like an indictment, and plenty of abuse of power and obstruction of justice particulars have emerged.

That won't avail in the Senate, where Republicans hold a 53 to 47 Republican majority and it takes a two-thirds vote to convict.

If this scenario plays out, it will pressure a few Democratic Senators — but it will mainly affect those handful of Republicans in battleground states, where the public is divided. Three of those states — North Carolina, Iowa and Arizona — voted for Trump, who likely would be on the ballot next year. Democrats say all these states will be in play next year.

If more comes out and Senate Republicans look for a compromise like censure instead of impeachment, that's likely to be opposed by one prominent party leader: Donald J. Trump.

Senior Senate Republicans, Like Tennessee's Lamar Alexander, who's retiring, and Rob Portman of Ohio, not up until 2022, may offer an easier cop-out. They say the president's actions were "inappropriate" and "wrong," but trying to shake down a foreign country to go after your political opponent isn't an impeachable offense. In the House, Portman voted to impeach Bill Clinton for lying about sex. Alexander wasn't in Congress yet.

These office holders know Trump owns the party and his base will punish any Republican who goes off the reservation. A recent illustration: Sen. Mitt Romney (R- Utah) has been one of the more outspoken GOP critics of Trump's behavior; in 2012, Romney and former Sen. Rick Santorum basically tied for first in the Iowa caucuses — in last weekend's Iowa poll, Republicans gave Romney a 36 percent favorability rating. Trump, by contrast, has an 85 percent rating.

Most of the marginal Republican Senate incumbents, keenly aware of the Trump base, have indicated, as of now, they'd vote against an impeachment conviction, while trying to avoid the issue. Ernst struggled over a Trump impeachment-related question at a town hall. Gardner has repeatedly declined to say whether it was proper for Trump to pressure a foreign country to smear his political opponent, but he laments impeachment as a "partisan exercise."

McSally, who literally rushed away from reporters at the Capitol when asked about the issue, knows the dangers of trying to walk a fine line. In the Arizona Senate race last year, she tried to self-identify both with Trump and the late Sen. John McCain, two men of profoundly different values and views who had contempt for one another. She lost. She was appointed to the Senate this year to fill a vacancy.

Collins, facing the toughest race of her career in Maine, may be walking the most delicate line. A recent Boston Globe analysis concluded that other than the president, no politician "is more jammed up by impeachment than Collins."

Other than Collins (who is the only coastal Republican in the mix) - the rest will be representing states where impeachment will be largely underwater. Iowans, Arizonians, and Carolinians are not supporting impeachment.

Schiff on why Democrats didn’t call the Ukraine whistleblower to testify

Despite two weeks of extraordinary impeachment hearings, which amassed a dozen witnesses and over 30 hours of testimony, there was one person the public and Democratic-led House of Representatives did not get to hear from: the still-anonymous whistleblower who triggered the impeachment inquiry into President Trump.

House Intelligence Committee Chair Adam Schiff (D-Calif.) on Sunday told NBC “Meet the Press” host Chuck Todd the committee wanted to call for the whistleblower’s testimony but declined to do so for a pair of reasons.

“You did pledge that the intelligence committee would hear from the whistleblower in some form or another,” Todd said. “Are you going to fulfill that pledge?”

“We had a deep interest in having the whistleblower testify until two things happened,” Schiff said. “One, we were able to prove everything in the whistleblower complaint with witnesses that had firsthand information; and second, the president and his allies effectively put that whistleblower’s life in danger.”

He continued: “The president said the whistleblower and others should be treated as a traitor or a spy and we ought to use the penalty we used to use for traitors and spies and that’s the death penalty."

“So here’s the thing, Chuck, we don’t need the whistleblower secondhand evidence anymore,” Schiff added. “It would only serve to endanger this person and to gratify the president’s desire for retribution and that is not a good enough reason to bring in the whistleblower.”

Trump, at the conclusion of the televised impeachment hearings, continued his calls for the whistleblower’s identity to be revealed as he lashed out at the inquiry in an interview with FOX & Friends last Friday.

“The bottom line is all of those witnesses, they're all shifty Schiff, don't forget. There was no due process. You can't have lawyers. We couldn't have any witnesses. We want to call the whistleblower,” Trump said, before adding, “I want a trial” in the Senate if the House votes to impeach him.

Meanwhile, the FBI recently sought to question the whistleblower, as Yahoo News first reported last week. No interview has been scheduled.

The inquiry, which followed the whistleblower’s complaint over President Trump’s July 25 Ukraine call, is centered on the president’s efforts, conveyed through his personal lawyer Rudy Giuliani, to coerce the government of Ukraine to announce investigations that he thought would help his 2020 campaign, including of his potential opponent Joe Biden and his son Hunter. Part of the pressure on Ukraine involved the temporary withholding of military aid.

While the public hearings have ended and Schiff on CNN's "State of the Union said “the evidence that's been produced overwhelmingly shows serious misconduct by the president,” the Democratic lawmaker doesn’t “foreclose the possibility of more depositions, more hearings.”

“We are in the process of getting more documents all the time. So that investigative work is being done," he told host Jake Tapper. "What we're not going to do is wait months and months while the administration plays a game of rope-a-dope in an effort to try to stall. We're not willing to go down that road. And what's more, the evidence is already overwhelming.”

Schiff spoke about another potential witness, John Bolton, the president’s former national security adviser, who reemerged on Twitter last week amid the hearings and had refused to testify before Congress, but, as the Democratic leader acknowledged, would more likely testify before a Republican-majority Senate.

“We have certainly been in touch with his lawyer. And what we have been informed by his lawyer -- because we invited him to come in, and he did not choose to come in and testify, notwithstanding the fact that his deputy Fiona Hill and his other deputy, Colonel Vindman, and Tim Morrison and others in the National Security Council have shown the courage to come in -- is, if we subpoena him, they will sue us in court,” Schiff told Tapper.

“Now, he will have to explain one day if he maintains that position, why he wanted to wait to put it in a book, instead of telling the American people what he knew when it really mattered to the country,” he added.

Schiff, nodding to the possibility of upcoming investigations, told Todd “there are still other witnesses, other documents we would like to obtain" before articles of impeachment would be moved from the House likely before the year’s end.

When asked by Todd whether he would testify if called by the Senate in an impeachment trial in the event that the House impeaches Trump, Schiff said, “If the Senate wants to call me as a witness then they pretty much made the decision not to take this process seriously.”

“I’m not a fact witness,” he added.

That's politics. But the truth is that the President has committed bribery, and abused the power of the President of the United States of America.

If this was just about politics or policy decisions, I would agree with you.

But it is much more dangerous.

Any President in the future would be able to do anything he or she wants.

The Congress is granted to power to check the power of the President. Is it a big problem? Fuck yeah. But I don't want any future President to be a virtual dictator!

Sandy testified that he had never seen a senior political OMB official assume control of a portfolio in such a fashion, according to the people familiar with his testimony.

Sandy told impeachment investigators he had questions about whether it was legal to withhold aid Congress had expressly authorized to help Ukraine defend itself from Russia, but OMB lawyers told him it was fine as long as they called it a temporary hold, according to a person familiar with Sandy’s account. Sandy, the deputy associate director for national security programs at the OMB, signed formal letters to freeze the funds, but top political appointees were unable to provide him with an explanation for the delay.

Trump has continued to describe that impeachment investigation as a “hoax” and maintain that he did nothing wrong.

“This is a continuation of the witch hunt which has gone on from before I got elected,” he told Fox News on Friday.

Great exclusive here from Josh Kovensky who’s been working this story for several weeks and has more coming on this front. Another Trump-aligned attorney — actually a former U.S. Attorney, Bud Cummins — was pushing the Southern District of New York on investigations of Joe Biden based on clients he was working for in Ukraine. He was trying to serve as an intermediary for Yuriy Lutsenko, the crooked prosecutor who later hooked up or was already working with Rudy Giuliani. Yesterday, Giuliani published a letter to Senator Lindsey Graham, offering new purported evidence for Graham’s investigation into the Biden family. This is what he was talking about.

The big picture here is that when you have a crooked President who puts out word that he’s looking for foreigners to take out his political rivals, a lot of shady people come out of the woodwork — unsurprisingly.

As far back as October 2018, a former U.S. attorney acting on behalf of Ukrainian interests tried to get federal law enforcement to bite on bogus political dirt about the Bidens and on whether Paul Manafort’s notorious Black Ledger was a forgery.


Bud Cummins, a former U.S. attorney in Arkansas, emailed the U.S. attorney for the Southern District of New York relaying a request for a meeting on the same topics into which President Trump would later demand Ukraine conduct investigations.

TPM has been investigating Cummins’ role in attempting to serve as an intermediary between certain Ukrainian interests and federal law enforcement. Cummins’ involvement has not been previously reported. However, Rudy Giuliani sent a letter on Saturday to Senate Judiciary Committee Chair Lindsey Graham (R-SC) claiming that a former U.S. attorney was ready to provide emails and memoranda about an attempt to get the FBI to investigate Biden and the list of Manafort bribes, called the Black Ledger.

Cummins confirmed to TPM Sunday morning that Giuliani’s letter was referring to him.

The meeting proposed by Cummins would have been between Ukraine’s then-prosecutor general, Yuriy Lutsenko, and Manhattan U.S. Attorney Geoffrey Berman. Lutsenko waged a campaign to push out Marie Yovanovitch, the then-U.S. ambassador in Kyiv, in part by spreading the same allegations that he had sent to Cummins. Lutsenko has emerged as the figure who also channeled dirt to Giuliani as it made its way into the U.S. media ecosystem.

The email proposing the meeting, which Cummins said he sent on Oct. 4, 2018, laid out allegations about Hunter Biden and his work for Burisma, and that the Black Ledger was falsified, Cummins told TPM in a phone interview.

Cummins said that he received the information about Hunter Biden and Manafort from two intermediaries of Lutsenko in September 2018.

“The information I gave to them was a request to meet with Lutsenko,” Cummins said, adding that he had a brief phone call with Berman and sent three follow-up emails after the information was sent.

Speaking over the phone Sunday morning, Cummins expressed to TPM a mixture of dismay that Berman broke off contact and mild embarrassment at having dealt with Ukrainians whose motivations he admitted he did not understand. Cummins added that when he sent the email to Berman he “wasn’t advocating for the legitimacy of any of this.”

“At the time, I didn’t know a whole lot about Ukraine. I didn’t make any real attempt to vet this.” He added “I didn’t care, that wasn’t my job” in a discussion of what may have been motivating Lutsenko.

Lutsenko and a spokesperson for Lutsenko didn’t immediately return requests for comment. Berman’s office declined to comment.

Cummins told TPM that he had tried to signal to Berman that he was not vouching for the credibility of the allegations themselves. He said that he suggested to Berman that Lutsenko could “delegate some investigators to meet with some line [prosecutors] in his office,” referring to Berman.

Cummins called the lack of response from the Manhattan federal prosecutor a “breathtaking double standard,” given how the Mueller investigation “targeted” President Trump.

A former U.S. Attorney for the Eastern District of Arkansas, Cummins was one the federal prosecutors fired by the George W. Bush administration during the U.S. attorneys scandal. A New York Times editorial at the time described Cummins as “one of the most distinguished lawyers in Arkansas” who is “respected by Republicans and Democrats alike.” Cummins was pushed out of office in favor of a deputy to Karl Rove.

In 2016, Cummins served as chair of Donald Trump’s campaign in Arkansas, then as a Trump whip at the 2016 Republican National Convention in Cleveland. He went on to serve on the Trump administration transition team.

Democrats were on cloud nine when the closed-door impeachment inquiry began. Back then, Rep. Adam Schiff was lying to the American people about what the president said on his July 25 phone call to the president of Ukraine. House Democrats selectively called witnesses, selectively leaked testimony, and continued to fool independent voters into thinking the Democrats were actually hysterical for a good reason.

The Soviet show trial really wasn't a good look for the Democrats, so the House voted on a bill that gave the process the false appearance of fairness while keeping the Democrats in full control of the narrative and substance of the impeachment inquiry. Two Democrats joined every Republican in voting against the bill, but Speaker Pelosi managed to ram it through.

But what little sunlight the Democrats allowed into the process was enough to start turning the American people away. Despite calling their best witnesses forward – most of whom, like the whistleblower, didn't actually hear Trump's July 25 phone call – support for impeaching the president fell as soon as the public hearings began. A recent poll finds support for impeachment has fallen five percent since October, and Trump's approval rating has shot up five percent during the same period. It seems the more Americans learn about Trump's handling of foreign aid to Ukraine, the more Americans approve of the president's job performance and want Trump to remain in office.

“Widening the price ... gap between illicit and regulated products will further drive consumers to the illicit market at a time when illicit products are demonstrably putting people’s lives at risk,” the group said, referring to the national vaping health crisis.

Los Angeles dispensary owner Jerred Kiloh, who heads the United Cannabis Business Association, said the increased levies added to the heavily taxed market “seems like a slap in the face.”

The changes involve taxes paid by legal businesses, which ultimately get passed along to consumers at the retail counter.
