On September 25, 2019, Stefanik announced that she did not support impeachment of President Trump.

During the November 2019 hearings in which Congress heard gathered evidence and heard witness testimony in relation to the impeachment inquiry into Trump, Stefanik emerged as a key defender of Trump. She also criticized House Intelligence Committee Chairman Adam Schiff, a Democrat, of "making up the rules as he goes" and of preventing Republican members on the committee from controlling their own time.

The rules of the hearing were voted on by the House and set in October 2019, authorizing only Schiff (and his legal counsel) and Devin Nunes, the ranking Republican member on the committee (and his legal counsel), to ask questions during the first 45 minutes of each party's questions for witnesses.

Transcripts released Saturday in the impeachment inquiry show Ambassador Gordon Sondland playing a central role in President Donald Trump’s effort to push Ukraine to conduct political investigations as a condition for receiving needed military aid.

The fresh details come from hundreds of pages of testimony released by House investigators from Tim Morrison, a former top official at the National Security Council. They contradict much of the ambassador’s own testimony behind closed doors. Both Morrison and Sondland are expected to testify publicly before the House next week.

While some, including Trump himself, have begun to question Sondland’s knowledge of events, Morrison said the ambassador “related to me he was acting — he was discussing these matters with the President.”

Morrison, a longtime Republican defense hawk in Washington, largely confirmed testimony from current and former officials testifying in the impeachment inquiry. But his account also provided new insight on what others have called a shadow diplomacy being run by Trump’s personal lawyer, Rudy Giuliani, often at odds with U.S. national security interests.

I wonder if he will refresh his memory.

That poll showed Vice President Joe Biden widening his lead over President Trump in a head to head to 14 points. The President also loses by 8 points to Senator Bernie Sanders and 6 to Senator Elizabeth Warren.

Bribery attempts are often very subtle and are preceded by attempts to do small favors for or give gifts to an employee. Bribery is a violation of the law. The solicitation or acceptance of a bribe is a also a serious breach of the public trust.

The difference between an attempt to bribe and the actual passage of money or property as a bribe is of little practical importance where the definition of the crime includes an attempt to commit it. This was true at common law and is often true under statutory definitions of bribery. However, separate statutes may be enacted to proscribe a bribery and an attempt to bribe and different punishments may be prescribed for the separate offenses.

Va. Code § 4496 (1936) places the corrupt gift, the offer, and the promise all on the same plane. It defines each of such acts as bribery and provides the same punishment. An attempt to corrupt, evidenced by an offer or promise of a gift, constitutes bribery on the part of the offeror or promisor as if a corrupt gift had been made and accepted. The gist of the offense is the criminal intent to undermine the proper and orderly administration of justice. The crime is committed by the making of the corrupt offer[i].

Further, Ill. Crim. Code § 32 provides that every person who shall offer or attempt to bribe any state’s attorney or other officer ministerial or judicial, every such officer who shall propose or agree to receive a bribe shall be fined[ii].

Where an attempt to bribe is punishable as bribery, the mere tender of a bribe or the expression of an ability and a desire to pay a bribe may be sufficient to constitute the offense. However, a charge of attempted bribery cannot be sustained in the absence of some contact, communication, or conversation with the person alleged to have been bribed.

BATON ROUGE – Louisiana Gov. John Bel Edwards won a second term Saturday to remain the only Democratic governor in the Deep South despite an all-out effort by President Donald Trump to flip the seat to the Republican column.

Edwards beat wealthy Republican businessman Eddie Rispone in a tight race by fewer than 20,000 votes.

Rispone invested more than $14 million of his own money to finance his campaign, tying himself to Trump from start to finish.

While many Republicans bemoaned the lack of star power in their candidates – powerhouse Republican U.S. Sen. John Kennedy and popular GOP state Attorney General Jeff Landry passed on the race – Edwards had to fend off Trump and vice President Mike Pence during the months-long campaign.

Trump headlined three Louisiana rallies to oust Edwards, first in Lake Charles on the eve of the Oct. 12 primary election and then in Monroe and Bossier City during the runoff campaign.

The president told Louisiana voters the race was a symbolic referendum on his presidency, which he said is under attack by Democrats who've started impeachment hearings in the House.

"I need you to send a message to the corrupt Democrats in Washington," Trump said Thursday during a rally at the CenturyLink Center in Bossier City.

And that could be done, Trump said, by electing Rispone.

"You've got to give me a big win, OK?" Trump told the crowd.

The president continued the onslaught on Twitter during Election Day Saturday: “Good morning Louisiana! … Get out and VOTE for @EddieRisone to be your next Gov!”

But in the end Trump’s coattails weren’t long enough to carry Rispone across the finish line.

Edwards predicted as much during his own rally in Shreveport Thursday, expressing confidence voters wouldn’t allow the president to nationalize the election.

"The voters of Louisiana are going to decide this election on Louisiana issues," Edwards said. "They don't need the president or anybody else to tell them how to vote."

And Edwards also overcame history. Before Saturday no incumbent Louisiana governor had ever won when pushed to a runoff, although the only time that’s happened in modern history was 1987 when then Gov. Edwin Edwards conceded to Buddy Roemer after the primary election.

But Edwards’ victory won’t bring with it a mandate for him to push through priorities like equal pay legislation and a Louisiana minimum wage higher than the national mandate of $7.25 per hour.

As a Democrat he’s still an anomaly both in the South and in Louisiana, where Edwards is the only Democrat to hold statewide office.

And he’ll face possible Republican super majorities in both chambers of the Louisiana Legislature during his second term.

Still, Edwards expressed optimism he and lawmakers can find common ground.

“Practically every major thing I've done as governor was done on a bipartisan basis,” he said.

Rispone has not led any recent polls (down about two points on average).
Edwards is very popular in Louisiana.
Early voting was high in Democratic strongholds.

I am not sure why anyone would be "shocked" that a popular governor, leading in the polls, and enjoying a known early voting advantage would actually win?

Unless you are part of the MSM. Then you let on like it was a surprise so people who don't pay attention (like you) think it's something big.

And the reason the NSA was moving sensitive discussions between Trump and world leaders off the normal grid, was to prevent people like Eric Ciaramella from breaking the law by "leaking" those conversations like so many other calls between Trump and world leaders.

Attorney General William Barr vociferously attacked Democratic lawmakers and federal judges on Friday and accused them of trying to limit Trump's presidential power.

He stated during a sweeping speech at The Federalist Society, a conservative legal organization, that Democrats "essentially see themselves as engaged in a war to cripple, by any means necessary, a duly elected government."

Barr's speech drew swift criticism from legal experts, some of whom decried its ideas as "authoritarian" and "dangerous." It come as Trump's use of presidential power faces intense scrutiny. Lawmakers involved in the impeachment inquiry are trying to determine whether the president abused the power of the presidency by seeking to trade military aide to Ukraine for a political favor.

Barr stated that the powers of the executive in the U.S. have been encroached upon for decades by the other branches of government. "This process, I think, has substantially weakened the function of the presidency to the detriment of the nation," he said.

Painter, now a law professor at the University of Minnesota, says he has seen the opposite – an expansion of executive power under Trump and previous presidents, including Bush and Barack Obama. "President Trump has gone further than his predecessors on the policy side," he said.

Kinkopf also viewed Barr's claim as ahistorical. He said that while Congress strongly reasserted its role in the aftermath of Vietnam, presidential power has been steadily expanding for decades since then. "I think since 1981, it's been nothing but an upward line," he said. Claims that Trump's lawyers are making that he should be immune from criminal prosecution, Kinkopf added, are "virtually unprecedented."

Barr also dished out criticism of the federal courts, which have frequently issued injunctions that acted to freeze controversial Trump policies, such as the travel ban that restricted entry into the U.S. for citizens of certain countries.

"It is no exaggeration to say that virtually every major policy of the Trump administration has been subjected to immediate freezing by the lower courts," Barr stated. "No other president has been subjected to such sustained efforts to debilitate his agenda."

The attorney general criticized the courts for considering the president's motives when they assess the legality of a policy, saying this amounts to "attempts by courts to act like amateur psychiatrists."

"Well, if that's right, there is very little in the way of a legal constraint on the president's exercise of his powers," said Kinkopf. For example, if the president was motivated by a bribe to issue a pardon, there would be little mechanism to hold him accountable because it's well within his authority to issue a pardon. "The suggestion that we can't question his motives, that that's somehow improper, cuts to the heart of the rule of law."

He added that Trump is providing, in real time and on Twitter, clear statements about his motivations in a way that other presidents did not. "We have now a president who tweets his motives right in the middle of the night, constantly ... and so what's a court to do now that it has evidence that it never had access to before?"

WASHINGTON – Ukraine’s top prosecutor said he hasn’t seen any evidence of wrongdoing by former Vice President Joe Biden nor his son Hunter Biden in dealings with the country.

Prosecutor General Yuriy Lutsenko said Hunter Biden and Burisma, a Ukrainian private gas company of which the younger Biden served on the board, were not the targets of investigations by his office.

He also said the former vice president, and current Democratic 2020 hopeful, didn’t act improperly when he called for the dismissal of Ukraine’s former prosecutor general, Victor Shoki, who had been investigating the company.

President Trump’s allies – including Donald Trump Jr. – have suggested the Bidens acted inappropriately. The president’s outside lawyer, former New York City Mayor Rudy Giuliani, had threatened to travel to Ukraine to investigate things on his own, but has since canceled those plans.

Edwards is basically a Joe Manchin Democrat and personal non grata in the Nancy Pelosi, Elizabeth Warren wing of the party. A social conservative pro-life conservative with a populist economic message.

That use to be a winning formula for Democrats in the south. I don't know why they abandon it.
