CNN spins and spins

CNN Poll: The nation remains divided on impeachment as House vote approaches
(but technically the polls shows support has collapsed from +5 to -3)
The American public is about evenly split over whether President Donald Trump should be impeached and removed from office, according to a new CNN Poll conducted by SSRS, with the House of Representatives poised to vote on articles of impeachment this week.

Support for impeaching Trump and removing him from office stands at 45% in the new poll, down from 50% in a poll conducted in mid-November just after the conclusion of the House Intelligence Committee's public hearings. Opposition to impeachment and removal stands at 47% in the new poll, up from 43% in November. Support for impeachment and removal among Democrats has dipped from 90% in November to 77% now.

So basically, none of the past five polls listed in the Real Clear Politics averages has shown support for impeachment, after almost exclusively showing support in nearly every poll. What has changed over the past week or so? I would assume the fact that the Democrats have now actually finished their hearings and written the actual articles.

It's one thing when you are in the middle of a hearing and witnesses are telling a compelling story. It's quite another when those hearings end without anyone actually providing any evidence that the story was true. It also doesn't help when your main argument throughout the hearings is actually changed when you write your so called "articles of impeachment".

There is no more spinning the truth. This is literally a partisan misuse of the House impeachment authority. They have convinced nobody that didn't already want to see the President impeached (and probably didn't need anything more than a weak pretense to justify it).

Andrew Weissmann, one of former special counsel Robert Mueller‘s top lieutenants, writes for Just Security that President Trump has committed several federal crimes while in office.

“We are surely to learn more about the criminality underlying the impeachment inquiry. And whether or not you believe the current evidence meets the beyond a reasonable doubt standard, because it is clear what the President was up to, that new evidence is sure to be damning. Why else would the President be stonewalling its release? When that new evidence comes to light, Senators who have resisted impeachment now on the ground of lack of evidence may seek to cling to that legal argument, but will look darn foolish in the annals of history, when the documents prove up what we all already know to be true.”

“The story that appeared on The Hill website on March 20 was startling. Marie Yovanovitch, the American ambassador to Ukraine, had given a ‘list of people whom we should not prosecute’ to Ukraine’s prosecutor general, Yuriy Lutsenko, according to a write-up of an interview Lutsenko gave to the conservative columnist John Solomon.

“Five days later, an image of that purported list appeared in a post on the website Medium and on a number of other self-publishing platforms in locations as disparate as Germany, South Africa and San Francisco. In less than a week, the Medium essay had been translated into Spanish and German and posted to other websites.

“Now, a social media analysis firm, Graphika, has traced those posts to a Russian disinformation campaign — in the first evidence that a network of accounts involved in spreading disinformation before the 2016 election also participated in circulating the false claims about Yovanovitch that led earlier this year to her recall from the U.S. embassy in Kyiv.”

Under the Tax Cuts and Jobs Act, 91 profitable Fortune 500 companies paid $0 in taxes on U.S. income in 2018, according to a new report from the Institute on Taxation and Economic Policy (ITEP). Across all 379 profitable companies in the Fortune 500 the effective tax rate was just 11.3%, just over half the 21% tax rate under the law.

“In 2018, the 379 companies earned $765 billion in pretax profits in the United States,” the report noted. “Had all of those profits been reported to the IRS and taxed at the statutory 21% corporate tax rate, the 379 companies would have paid almost $161 billion in income taxes in 2018.”

Instead, the companies only paid $86.8 billion, roughly 54% of what they owed.

A ‘pernicious effect’

But how?

Matthew Gardner, senior fellow at ITEP and lead author of the report, says that what companies are doing is “entirely legal” — but that they can avoid paying taxes thanks to tax breaks.

“A whole host of tax breaks in the code collectively have this pernicious effect,” Gardner said. But he added, though legal, “this doesn’t exonerate these companies from wrongdoing.”

“What we are seeing is a product of the actions of Congress, aided and abetted by corporate lobbyists,” he explained. “This is the predictable consequence of creating tax breaks for any activity you can think of.”

This trend is supported by data from the IRS. In 2018 — the first year the TCJA was in effect — the Treasury Department collected $91 billion less than it did in 2017.

In 2017, the IRS collected over $338.5 billion in income taxes (before refunds) from businesses. That number dropped by 22% to about $262.7 billion for fiscal year 2018. In comparison, in FY 2016, income taxes collected from corporations was on par with 2017, at $345.6 billion.

The 2018 figures represent the lowest amount the Treasury has collected from business in nearly a decade; in 2011 the IRS pulled in $242.8 billion from corporations’ income tax.

“It’s a very old problem,” said Gardner.

“Monday’s announcements dealt a blow to Trump and his allies, who had been encouraging Democrats to defect to bolster their depiction of impeachment as a crusade by extremist liberals.

Playbook:
“There are a few ways to look at this. If you take these lawmakers at their word, they are so disgusted with Trump’s behavior that they need to vote to remove him from office. It’s their duty. And perhaps so.

“But Congress is a political institution, where even matters of conscience are judged for their political wisdom. First of all, take note that the announcements all came within hours of each other — a sign of unity among a group of vulnerable politicians. They’re leaping together.”

Yeah... would have been good to hear from them BEFORE the House votes on impeachment. Perhaps they should wait till they subpoena the ones who they didn't (but claim they want to talk to)... and then pursue it through the courts like a normal process?

the house, by every honest analysis, did an absolutely piss poor job of making their case. once they figured out the issue polled for shit, they were like - "oh fuck. we had better get this fucking thing over with, and quick."

so the house impeachment effort was an epic fail. now the senate gets their turn to address it with their GOP MAJORITY. the senate has no obligation to do anything other than convict or acquit.

the house, without the benefit of securing the outcome in advance, had no fucking business embarking upon an effort to impeach.
