Former Justice Department official says Barr 'twisted' her words to justify dropping Flynn case

Washington (CNN) May 11, 2020 - A former Justice Department official says Attorney General William Barr "twisted" her words to justify the decision to drop the criminal case against former national security adviser Michael Flynn.
Mary B. McCord, former acting assistant attorney general for national security, wrote in a New York Times op-ed Sunday that Barr cherry-picked from her 2017 testimony to special counsel Robert Mueller, which the DOJ cited more than 25 times in the motion to dismiss Flynn's case. She said her testimony is "no support for Mr. Barr's dismissal of the Flynn case."
"It does not suggest that the F.B.I. had no counterintelligence reason for investigating Mr. Flynn," she wrote. "It does not suggest that the F.B.I.'s interview of Mr. Flynn — which led to the false-statements charge — was unlawful or unjustified. It does not support that Mr. Flynn's false statements were not material."
McCord continued, "And it does not support the Justice Department's assertion that the continued prosecution of the case against Mr. Flynn, who pleaded guilty to knowingly making material false statements to the FBI, 'would not serve the interests of justice.'"
The op-ed from McCord is a blistering rebuke of Barr and the political appointees at the DOJ who took over the Flynn case from career prosecutors. McCord spent nearly 20 years at the DOJ, rising to top posts in the Obama administration and early months of the Trump administration.
In those senior roles, McCord was involved in the internal DOJ deliberations over how to handle the Flynn debacle in January 2017, when senior Trump officials were caught in a public lie about Flynn's ties with Russia.
Her comments come less than a week after the Justice Department dropped the case against Flynn, whose lies about his contacts with Russia prompted President Donald Trump to fire him three years ago. Flynn later flipped on Trump, pleaded guilty to lying, and cooperated in the Russia investigation. But he reversed course last year, started attacking the Russia investigation, and tried to undo his guilty plea.
Barr said the department had a "duty" to move to dismiss the charges against Flynn during an interview with CBS News on Thursday. He denied that he was following instruction from Trump and instead said that he was "doing the law's bidding."
"I'm doing my duty under the law, as I see it," Barr said. He echoed the legal reasoning to drop the case that was laid out in the filing, saying that "a crime cannot be established here."
Barr also said the FBI "did not have a basis for a counterintelligence investigation against Flynn at that stage," adding that "people sometimes plead to things that turn out not to be crimes."
In addition to McCord, the filing drew swift criticism from former top FBI officials who had worked on the case and supported the investigation into Flynn.
The court must still formally approve the DOJ's request to dismiss the case.

Mary McCord makes an inept attempt to justify persecuting Michael Flynn
In its Motion to Dismiss Flynn, the DOJ relied heavily upon McCord's factual statements in the 302. On Sunday, the New York Times published McCord's lengthy opinion piece taking umbrage at the fact that the DOJ relied upon her facts to reach conclusions different than those she would have drawn.
It's unnerving to think a career DOJ attorney would be incapable of distinguishing between facts and conclusions or unable to recognize that the same facts can lead to different conclusions. She seems not to understand that a person analyzing the facts who is not blinded by bias or groupthink (both of which affected McCord) might reach conclusions different from hers.
McCord's Times piece is too long to deconstruct in full here. A few examples should be enough to show how muddled and prejudiced her thinking is.

Where McCord really goes astray is her claim that Flynn's falsehoods were material. She contends that Flynn lied to Pence, leading the Russians to believe either that Pence was involved in or the dupe of a conspiracy. What McCord doesn't realize is that it's her argument that is immaterial, for two reasons.
First, there was no Russian conspiracy! Her argument matters only if Flynn or anyone else had been conspiring with the Russians. No one was — and the FBI knew by January 4 that Flynn was not. That means that any misstatements he made, whether to Pence or the FBI, were irrelevant, not criminal. The conspirators' hope to use the Logan Act to elevate the Kislyak call to a criminal act only confirms that the FBI knew that Flynn was not conspiring with the Russians.
Second, there's a difference between lying to Pence and lying to the FBI. Recall that Flynn was prosecuted for lying to the FBI. However, any misstatements Flynn made to the agents interviewing him were immaterial because (a) the agents had the transcript and knew the truth, so nothing derailed their investigation, and (b) the agents agreed at the time that Flynn wasn't lying. If he said something inaccurate, it was done innocently and could not be a material lie to the FBI.
McCord is a dullard, for only someone with no understanding of law or logic would argue as she does.
Alternatively, McCord is not a dullard at all. Instead, she's simply another arrow in the quiver of a panicked Democrat establishment desperately working to destroy Barr to protect itself

Reality: Whether the interview was "legal" has nothing to do with whether or not you can charge someone with a crime for perjury or making false statements. Nobody is "arresting" the FBI agents for talking to Flynn.
What Barr and the DOJ has determined is simple and factual.
1) There was no longer an DOJ counterintelligence investigation. It had been closed at the time of the interview and the DOJ had determined that there was no reason derogatory information found on Flynn and he was not considered any sort of suspect.
2) There was never any sort of criminal investigation from within the FBI for anything having to do with General Flynn. Not only was there no investigation open at the time, they never did open any sort of criminal investigation for any reason. You cannot simply claim that you were "thinking" about opening an investigation. You must have one open.
Perjury or false statement charges must involve questioning that involves some sort of open investigation. Since there was no open investigation for them to be questioning Flynn, none of those question could be (BY FACTUAL AND LOGICAL CONCLUSION) "material" to an investigation.
The fact is that the closure of the DOJ counterintelligence investigation and the information from the DOJ that deemed Flynn to not any sort of agent of Russia and the conclusion that there was no derogatory information found on him...
was never shared with the court. They used the concept that the counterintelligence investigation was still in play (along with the idea that there was a violation of the Logan act) as their pretense.
But the "proof" is in the technical pudding. They had neither an open valid DOJ investigation or an ACTUAL Logan act investigation to fall back on.

Now perhaps he should have remembered that or perhaps he did and simply fudged on it. Or perhaps he really didn't recall the exact specifics of one of dozens of calls that he had made (considering it was several days or weeks prior). But to say that you can "prove" that he lied and that it constituted something that undermined the FBI's ability in an investigation (that he wasn't a part of) is sort of silly.

Doubtlessly implying some kind of racist motive, Asian-American reported Weijia Jiang dropped her face mask and screamed at President Trump this afternoon in the White House Rose Garden, forcing an early ending to the press event.
Towards the end of the presser – the first in a week – President Trump called on CBS’s Weijia Jiang who asked the President why he was treating coronavirus testing as a competition between countries.
The President had never implied it was a competition, but had repeatedly put the U.S.’s number one in testing status into context with other countries.
Nevertheless, Jiang – the same reporter who alleged a White House staffer used the phrase “Kung Flu” but quickly went silent when she was asked to reveal who – attempted to excoriate him and the White House Task Force for daring to place the U.S. at #1.
“Why is this a global competition to you when Americans are losing their lives every day?” asked Jiang.
POTUS rebuked her: “Maybe that’s a question you should ask China,” he began to reply.
China is known to have hidden the outbreak of the coronavirus early on, leading to many unnecessary deaths in the West. Jiang, however, chose to deflect from China and instead have a meltdown on the White House lawn.
“Why are you saying that to me, specifically?” she cried, to which the President responded: “I’m saying it to anybody who would ask a nasty question like that.”
At that moment the President tries to move on, only to be told by CNN’s Kaitlin Collins that she too was waiting for Trump to answer to Jiang’s outburst.
At this point Jiang dangerously dropped her face mask and began shouting across the lawn in the President’s direction.
It was at this point the presser was brought to a close.

Secret Service members test positive for COVID-19 and fears of it spreading through the White House are mounting

11 Secret Service members have tested positive for COVID-19, according to new documents from the Department of Homeland Security (DHS) seen by Yahoo News.
The documents also show that 23 employees have already recovered from the disease, with an additional 60 who are reportedly self-quarantining.
It is not known whether they have been working at the White House or if they have had any recent contact with President Donald Trump or Vice President Mike Pence.
The report comes after it was confirmed that Ivanka Trump's personal assistant and Pence's press secretary, Katie Miller, tested positive for the coronavirus.
Trump has repeatedly said he is "not worried" about being infected by the virus but this week switched from getting tested weekly to a daily basis, amid concerns that it is spreading in the White House.
Both Trump and Pence get tested for the disease regularly but have not tested positive so far. However, Trump said this week that he would switch from having weekly to daily tests following the new cases, according to The Hill.
Justin Whelan, a spokesperson for the Secret Service told Yahoo News that the agency is following guidelines from the Centers for Disease Control (CDC).
"To protect the privacy of our employee's health information and for operational security, the Secret Service is not releasing how many of its employees have tested positive for COVID-19, nor how many of its employees were, or currently are, quarantined," Whelan added.
This follows a US Navy member who serves as one of Trump's valets who tested positive for the coronavirus on Thursday, according to CNN.
The string of recent diagnoses in the White House raises concerns about the president's possible exposure to the virus, which has since infected more than 1.3 million people in the US, according to Worldometer.
Trump has previously said that he's "not worried" about getting infected and has notably been seen not wearing a face mask at recent meetings and public appearances, despite the advice on face coverings by the CDC.
The country that has done the best job of handling the Covid-19 outbreak is South Korea, and they have done it using strict lockdown followed by very intensive testing and tracing every new emerging case to effectively isolate it.
That is what we should have been doing and should be doing, and we are not, and the way we mishandle breakouts and testing and tracing, even at the White House, may result in disasters greater than we yet have seen.

Nearly 2,000 former Justice Department and FBI officials on Monday signed an open letter strongly critical of Attorney General William Barr's decision to abandon the prosecution of Michael Flynn, calling the action "extraordinarily rare, if not unprecedented."
If anyone else who is not a friend of the president "were to lie to federal investigators in the course of a properly predicated counterintelligence investigation, and admit we did so under oath, we could be prosecuted," the letter said.
The letter calls on Barr to resign and encourages Congress to formally censure Barr over "his repeated assaults on the rule of law in doing the President’s personal bidding rather than acting in the public interest."
Barr directed federal prosecutors to abandon their prosecution of Michael Flynn, who served briefly as national security adviser in the early days of the Trump administration. Flynn admitted that he had lied to the FBI about his conversations during the transition with Russia's ambassador to the U.S.
