NEW YORK (AP) — A judge ordered the release from prison of President Donald Trump’s former personal lawyer on Thursday, saying he believes the government retaliated against him for planning to release a book about Trump before November's election.
Michael Cohen's First Amendment rights were violated when he was ordered back to prison on July 9 after probation authorities said he refused to sign a form banning him from publishing the book or communicating publicly in other manners, U.S. District Judge Alvin K. Hellerstein said during a telephone conference.
Hellerstein ordered Michael Cohen released from prison by 2 p.m. on Friday.
“How can I take any other inference than that it’s retaliatory?” Hellerstein asked prosecutors, who insisted in court papers and again Thursday that Probation Department officers did not know about the book when they wrote a provision of home confinement that severely restricted Cohen's public communications.
“I’ve never seen such a clause in 21 years of being a judge and sentencing people and looking at terms of supervised release,” the judge said. “Why would the Bureau of Prisons ask for something like this ... unless there was a retaliatory purpose?"
In ruling, Hellerstein said he made the “finding that the purpose of transferring Mr. Cohen from furlough and home confinement to jail is retaliatory.” He added: “And it’s retaliatory for his desire to exercise his First Amendment rights to publish the book.”
Cohen, 53, sued federal prison officials and Attorney General William Barr on Monday, saying he was ordered back to prison because he was writing a book to be released before the November presidential election.
He has been in isolation at an Otisville, New York, prison camp, quarantined while prison authorities ensure he does not have the coronavirus.
His attorney, Danya Perry, said in a statement that the order was “a victory for the First Amendment” and showed that the government cannot block a book critical of the president as a condition of release to home confinement. “This principle transcends politics and we are gratified that the rule of law prevails," she said.
The book will address “Trump’s personality and proclivities, his private and professional affairs, and his personal and business ethics," according to the lawsuit. It further stated that the government’s demand that Cohen agree not to speak to or through any media, including by publishing a book, violated his constitutional rights.
Cohen had been furloughed in May along with other prisoners as authorities tried to slow the spread of the COVID-19 in federal prisons.
He was one year into a three-year prison sentence after pleading guilty to campaign finance charges and lying to Congress, among other crimes.
Campaign finance charges related to his efforts to arrange payouts during the 2016 presidential race to keep the porn actress Stormy Daniels and model Karen McDougal from making public claims of extramarital affairs with Trump. Trump has denied the affairs.

Former Congressman Charged with Ballot Stuffing, Bribery, and Obstruction
A former U.S. Congressman was charged Tuesday in an indictment unsealed today, with conspiring to violate voting rights by fraudulently stuffing the ballot boxes for specific candidates in the 2014, 2015, and 2016 primary elections, bribery of an election official, falsification of records, voting more than once in federal elections, and obstruction of justice.
Michael “Ozzie” Myers, 77, of Philadelphia, Pennsylvania, is charged with conspiring with and bribing the former Judge of Elections for the 39th Ward, 36th Division, Domenick J. Demuro. Demuro, who pleaded guilty previously in federal court in Philadelphia, was responsible for overseeing the entire election process and all voter activities of his division in accord with federal and state election laws.
“Free and fair elections are the hallmark of our system of government,” said Acting Assistant Attorney General Rabbitt of the Justice Department’s Criminal Division. “The Department of Justice has zero tolerance for corruption of the electoral process, and we will spare no effort in investigating and prosecuting those who would seek an unfair advantage at the polls by bribing state and local officials responsible for ensuring the fairness of our elections.”
“Voting is the cornerstone of our democracy. If only one vote has been illegally rung up or fraudulently stuffed into a ballot box, the integrity of that entire election is undermined,” said U.S. Attorney William M. McSwain of the Eastern District of Pennsylvania. “Votes are not things to be purchased and democracy is not for sale. If you are a political consultant, election official, or work with the polling places in any way, I urge you to do your job honestly and faithfully. At about 9:00 p.m. a group of about 150 people gathered at Cal Anderson park. The group roamed about the Capital Hill neighborhood, doing massive amounts of property damage, looting, shooting fireworks, and committing arson.
Individuals from the group broke the windows of a business in the 1400 block of East Olive Way and then started a fire inside. Seattle Fire was called to extinguish the fire.
The group then went to the 1500 Block of 11 Avenue, breaking more businesses’ windows along the way. Individuals then broke into a business, took merchandise, and put it in middle of the street where they lit it on fire.
The group went to Broadway and Madison, where individuals used baseball bats and pipes to break windows at a store. They threw fireworks into the store and then began looting.
The group headed to the area of Summit and Madison where they damaged property at two banks.
After leaving the banks, the group returned to Cal Anderson Park and then dispersed.
No arrests were made. No officers were injured.

Napolitano wrote in the column published on Fox News’ website Thursday that “there is nothing lawful or orderly” about the aggressive tactics Department of Homeland Security officers are wielding against people protesting racism in the wake of the police killing of George Floyd in Minneapolis.
Unidentified federal agents in tactical gear, sent by President Donald Trump to “quell” unrest, have been using excessive force, tear-gassing crowds and bundling protesters into unmarked vans. The strongarm tactics, defended by Deputy Secretary of Homeland Security Ken Cuccinelli, are “unlawful, unconstitutional and harmful,” said Napolitano.
“Portland is in America, right? What’s going on here?” asked Napolitano, a former New Jersey Superior Court judge.
Napolitano has frequently criticized Trump. He even said there was “ample evidence” to remove the president from office following his impeachment for Ukraine misconduct.
He suggested the actions of the militarized agents in Portland would “chill others from public dissent.”
