Democratic moderates are said to be against removing the filibuster and packing the court

This has been the quiet buzz lurking in the background, all the while we have been forced to listen to the heavy metal sounds of the angry progressives who have their amplifiers turned up to 11 on this one. It doesn't matter how badly a certain subset of the Party wants something to happen, there would have to be total buy in by all Democrats in the Senate for a move so drastic as to basically change the way that the Senate has done business for nearly 200 years.

Obviously there are traditionalists on both sides who have a tendency to put a wrench in otherwise drastic moves demanded by certain partisans on both sides. The amount of Democrats in the Senate who are against it is said to be "several" and include senior leadership.  Harry Reid is said to have opened the floodgates when he removed the filibuster from certain juridical nominees. Baby steps as it were. But removing it from legislation would only work to further a 50% plus one winner take all type of down your throat government that would lead to serious problems.

Most recently Diane Feinstein has openly expressed that she is both against the idea of killing the filibuster and packing the court. If Feinstein is against it, you can rest assured that other Democrats in the Senate are also against it. It's possible that someone like Chuck Schumer himself is actually against both moves and only sent out a thinly veiled threat as a bluff to try to prevent the process of replacing RBG from moving forward. 

All that being said, Democrats are putting the cart before the horse on all of this, very similar to how they behaved in 2016 when they believed that they would also be running the table. There were a ton of suggestions about all that would get done with full control of all branches of government. We had more of the same in 2018  when there were a ton of red state Senators who were supposed to be in serious trouble, only to hang on in the end. Everyone expected the Democrats to take control of the Senate and send Trump a message and Democrats ended up losing two seats.  

Those two seats won by Republicans in 2018 is the reason they have the votes to replace Ginsburg.

I think when Trump puts a face on his Supreme Court nominee reasonable people will be fine with it.

And every effort by the dems to blow it up will backfire.

Trump can then very likely name more during his next 4 years.

It's got a long history. The record for the longest individual speech goes to South Carolina's J. Strom Thurmond who filibustered for 24 hours and 18 minutes against the Civil Rights Act of 1957.

I strongly believe that if the Democrats get the majority next year, the Republicans will demand that the filibuster should be allowed again.

We can still see the look on Mrs. Kavanaugh's face as she walked side by side with her husband on the way to a hearing that was more like entering a torture chamber.

We remember a grown man crying and pleading for his name.

And we remember laughing Democrats without a shred of humanity sitting there, levying false and defamatory accusations at a man for daring to keep a calendar of his juvenile years and enjoying beer.

We were there. Did they forget?

This moment in time was so intensely unfair and maddening that I locked myself in my office for six months and pounded out a book about all the times in history women have lied to destroy men. Believe all women??? Ha! Tell that to the victims of the Salem witch trials or the Scottsboro boys...

Revenge.

This is for you, Kavanaugh family. Any other action than immediately filling and confirming that seat with the president's choice is a capitulation to the terror tactics the Democrats unleashed on the Kavanaughs. It would be an admission that what they did was legitimate and can be done again. There is no other way to see it. They will have gotten away with it if we do any less. Not only does this seat need to be filled (this week preferably) but it should be done while acknowledging that our entire motivation is payback for the disgusting attempt to destroy a man purely for political reasons.

As the late Andrew Breitbart famously said, "F*ck you. War."

And we are in a war, both a hot war on the streets of our cities nationwide and in the halls of Congress. Let's have it out already. Take off the gloves and fight to win. If GOP senators refuse to do their jobs and vote with the president at this unprecedented and dangerous time in America then they should be labeled as traitors and dealt with accordingly. This is not a joke. Our enemy is as serious as a Molotov cocktail through your window, so you better catch up...

The coronavirus pandemic, a reckless incumbent, a deluge of mail-in ballots, a vandalized Postal Service, a resurgent effort to suppress votes, and a trainload of lawsuits are bearing down on the nation’s creaky electoral machinery.


Something has to give, and many things will, when the time comes for casting, canvassing, and certifying the ballots. Anything is possible, including a landslide that leaves no doubt on Election Night. But even if one side takes a commanding early lead, tabulation and litigation of the “overtime count”—millions of mail-in and provisional ballots—could keep the outcome unsettled for days or weeks.

If we are lucky, this fraught and dysfunctional election cycle will reach a conventional stopping point in time to meet crucial deadlines in December and January. The contest will be decided with sufficient authority that the losing candidate will be forced to yield. Collectively we will have made our choice—a messy one, no doubt, but clear enough to arm the president-elect with a mandate to govern.

As a nation, we have never failed to clear that bar. But in this election year of plague and recession and catastrophized politics, the mechanisms of decision are at meaningful risk of breaking down. Close students of election law and procedure are warning that conditions are ripe for a constitutional crisis that would leave the nation without an authoritative result. We have no fail-safe against that calamity. Thus the blinking red lights.

If the Electoral College does not produce a President due to Democratic lawsuits and a multitude of attempts to circumvent the law... then the House of Representatives (based on one vote per one state) will vote on the President and whoever wins that vote will become President.

Puerto Rico is still a predominantly Spanish speaking colony of the United States. The could just as easy a country of it's own.

It will require a constitutional amendment for DC to become a state. I'm sure the other states would love to give primacy to the seat if the US government over any other state,
