USSC Justice Amy Coney Barrett

And now the sore loses are talking about everything from "expanding the court" to the most recent concept of a potential President Biden "demoting" Supreme Court Justices to a lower court and then replacing them with new Justices. 

At the end of the day, demoting a Justice would likely be unconstitutional and I doubt you could get anything like that past the courts (all things considered). I would venture a guess to say that "any" attempt to upset the Supreme Court will find court challenges that ultimately and ironically be decided by the USSC. 

Wouldn't it be a kick in the pants if attempts to alter the USSC was actually shot down by the USSC.

70% of Gen Zers have negative opinions about the president, including 61% who view him “very” unfavorably.

Former Vice President Joe Biden lacked support from America’s youngest voters in the Democratic primary earlier this year, but they’re solidly backing his campaign against President Donald Trump, who has earned the disfavor of most of the country’s newest voting bloc.

According to Morning Consult Political Intelligence daily tracking conducted Sept. 18-20 among 619 likely Generation Z voters, who were born after 1996, the Democratic nominee leads the incumbent president by 38 percentage points, 65 percent to 27 percent. Four percent of Gen Zers said they would vote for someone else, and another 4 percent were undecided.

Senator Marco Rubio plans to propose a new constitutional amendment to permanently limit the Supreme Court to nine Justices. While Rubio faces a difficult task, the effort does raise some questions.

“To prevent the delegitimizing of the Supreme Court, I will introduce a constitutional amendment to keep the number of seats at nine. There is nothing magical about the number nine,” Rubio said in an editorial published on Wednesday. “It is not inherently right just because the number of seats on the Supreme Court remains unchanged since 1869. But there is something inherently good and important about preventing the further destabilization of essential institutions.”

Rubio is responding to reports that some Democrats would consider using congressional powers to change the number of Justices on the Court if they were to regain control of the White House and both chambers of Congress in 2021. In one past incident in 1937, such efforts were called “court-packing” and proved to be unpopular.

One question is why would Rubio propose an amendment to set a permanent number of Justices? The constitutional amendment route requires two-thirds of the House and Senate to approve Rubio’s amendment text - a very high bar indeed. And then three-quarters of the states need to ratify the amendment. Given the current ideological split in Congress, such an effort faces long odds. (The second Article V option, which allows the states to propose and ratify amendments, is a bigger long shot, as it has never been successfully called.)

The answer is that under the Constitution, the number of Supreme Court Justices is not fixed, and Congress can change it by passing an act that is then signed by the President. Article III, Section 1, starts with a broad direction to Congress to establish the court system: “The judicial Power of the United States, shall be vested in one supreme Court, and in such inferior Courts as the Congress may from time to time ordain and establish.”

And as Rubio said, the number of Justices has changed over time. The Judiciary Act of 1789 established the first Supreme Court, with six Justices. In 1801, President John Adams and a lame-duck Federalist Congress passed the Judiciary Act of 1801, which reduced the Court to five Justices in an attempt to limit incoming President Thomas Jefferson’s appointments. Jefferson and his Democratic-Republicans soon repealed that act, putting the Court back to six Justices. Then, in 1807, Jefferson and Congress added a seventh Justice when Congress added a seventh federal court circuit.

In early 1837, President Andrew Jackson was able to add two additional Justices after Congress expanded the number of federal circuit court districts. Under different circumstances, Congress created the 10th Circuit in 1863 during the Civil War, and the Court briefly had 10 Justices. Congress then passed legislation in 1866 to reduce the Court to seven Justices. That only lasted until 1869, when a new Judiciary Act sponsored by Senator Lyman Trumbull put the number back to nine Justices, with six required at a sitting to form a quorum. (President Ulysses S. Grant eventually signed that legislation and nominated William Strong and Joseph Bradley to the newly restored seats.)

Pack the court? Sure. How about if by some miracle the Republicans regain the House and President Trump nominates five more extremely young and extremely conservative judges and Cocaine Mitch McConnell rams them through in the next few months. How does that sound?

Article III of the U.S. Constitution does not specify the number of judges on the Supreme Court. The current number was set by the Judiciary Act of 1869, which is an act of Congress and can be changed by any subsequent Congress.

Or maybe we should go in the other direction. How about a Supreme Court of three judges? Thomas as Chief Justice, with Barrett and Alito as associate justices.

And while we are at it, how about if Congress limits the scope of the court's authority? The Constitution seems to give them that power in Article III Section 2:

In all Cases affecting Ambassadors, other public Ministers and Consuls, and those in which a State shall be a Party, the supreme Court shall have original Jurisdiction. In all the other Cases before mentioned, the Supreme Court shall have appellate Jurisdiction, both as to Law and Fact, with such Exceptions, and under such Regulations as the Congress shall make.

That would open up some interesting possibilities. How about a specific prohibition against limiting any of the 10 amendments in the Bill of Rights?

It is these insanities that makes conservatism immensely satisfying as a political philosophy. Chesterton's Fence is a lesson that needs endless repetition. I'll bet Harry Reid would like to revisit his destruction of the filibuster and the consequent boon for the Republican party. He claims to be happy with it, but legislation can always be changed, but the court is for a generation and can set the tone of legislation and even the direction of the political process of the country. As much as the Left would like to radically remake the structure of our government, there is the possibility that their enemies on the other side of the aisle will be emboldened to use those same tools, and the end result might be unpleasant for them.

If President Trump wins reelection next week, he will have a tremendous opportunity to do just that. Gut the regulatory state and empty the departments of the thousands of apparatchiks who have nurtured the Deep State. And a rational Supreme Court will be much more supportive of a return to basic principles!

Defying health orders

Local public health officials in several counties tracked cases back to Trump’s rallies and, in one case, to affiliated counter-protests that his presence drew. 

The Minnesota county that’s home to Bemidji saw a 35% increase in coronavirus cases in the two weeks after Trump’s rally – from 365 to 499. State health officials said 20 people who tested positive for COVID-19 attended the Sept. 17 event. Sixteen of them attended the rally, and four attended a protest outside. 

Minnesota also traced three cases to a Trump rally in Duluth on Sept. 30, just days before Trump and other White House officials tested positive for the coronavirus. 

Health officials additionally tracked cases back to campaign events held by other candidates, including one positive case to a Joe Biden rally in Duluth on Sept. 18, three to a speech by Mike Pence in Minneapolis on Sept. 24 and one to an Eric Trump rally on Oct. 1.

The gatherings have irked local and state officials. 

In a document obtained by the Center for Public Integrity, just a week before the president’s Oct. 17 rally in Janesville, Wisconsin, the White House coronavirus task force concluded Wisconsin was in the red zone for test positivity. They warned of extreme concern for continued increases in community transmission. 

Among its mitigation recommendations? A warning to avoid crowds.  

Ahead of an Oct. 14 rally, Iowa’s top public health official, Lina Tucker Reinders, sent an email to the Des Moines Register saying they could be looking at “another super-spreader event.” 

In North Carolina, Gov. Roy Cooper asked elected leaders and candidates “to lead by example on the campaign trail this fall by holding events with face coverings and social distancing to protect North Carolinians when visiting. 

Even though activities exercising First Amendment rights are exempt from the requirements of Cooper’s executive orders about large events, “large gatherings increase the risk of spreading COVID-19,” said Amy Adams Ellis, a spokeswoman for the North Carolina Department of Health and Human Services.

Rallies in at least three states – Pennsylvania, New Hampshire and Nevada – defied orders limiting the number of people at an event. 

The city of Henderson, Nevada, issued a $3,000 fine to Xtreme Manufacturing for hosting a Trump event that violated its 50-person limit on public gatherings. Some 5,600 guests attended the Sept. 13 indoor rally.

James: I have been at a noon meeting, and have just seen KD's request. So let me for once bother to answer KansasDim (which I don't usually do) by stating very simply that it is found in the part of the Constitution that mentions "advise and consent."

But what I did at 11:23 was far more important:

I showed that there have been several times when the number of Justices on the Supreme Court HAS been changed, and that would surely indicate that the possibility to do that is not only found in the Constitution, but that doing it has been ruled Constitutional each time it was done, or else doing it would have been overturned.

If Kansas Dim needs someone to help him understand that, let him ask someone else. I have learned a long time ago that all he can do is ask what he thinks are clever questions, even when they are not, present case being an example of that.

That's why I usually ignore him, and will continue to.

Florida has just been given to Trump on the NO TOSS UPS MAP at RealClearPoltics.com, meaning that in the latest polling aggregates Florida is now LEANING toward Trump. That may change, but for now it drops Biden all the way down to to a mere

BIDEN 311 electoral votes to
TRUMP 227 electoral votes

Still, Trump has a long way to go to get to 270, and Florida (now standing at +.4 for Trump, while yesterday it was +.4 for Biden) may change again.
