The discovery of mail-in ballots cast by dead voters has emerged as an issue in the neck-and-neck race between first-term upstate Democratic Rep. Anthony Brindisi and rival Republican Claudia Tenney.
Tenney, who held the seat before being ousted by Brindis, was ahead by a razor-thin 100 votes as the two campaigns appeared before a state judge who will rule on hundreds of disputed absentee and affidavit ballots that could determine the winner.
Madison County Attorney Tina Wayland-Smith reported that election officials there disqualified absentee ballots filed by three “deceased” voters” in a filing with state Supreme Court Justice Scott Del Conte, who is overseeing the count in Oswego County.
As pointed out by the attorney, this isn't an issue so much as to whether or not "deceased" voters make the difference between winning and losing the race, but rather this is about obvious election fraud that authorities seem vigilantly disinterested in.
Too many times, these suits pop up and are dismissed because the amount of fraud presented isn't enough to overturn the results of the race. But when these lawsuits suggest something illegal, then shouldn't there be a place to push forward with these investigations?
Certainly the deceased people did not cast the vote from beyond the grave. That means someone filled out the ballot and mailed it in. This action is fraud and quite honestly a "felony" that could bring jail time to whomever filled it out and sent it in. This is a crime that should be treated like any other known crime.
We don't not investigate or prosecute a car jacking, burglary, or assault because there isn't some larger issue involved. We investigate these because they are a crime and that is the job of law enforcement to investigation and otherwise prevent crime.
Update: Another not-so-funny bit of information
Apparently there are 39 disputed ballots that nobody knows why they were disputed. They all had "sticky notes" attached to them, and now some sticky notes are missing, multiple sticky notes are on some ballots, while there were sticky notes apparently stuck to each other at the bottom of the envelope.
Just another great example of why we need a better system to "count" the ballots, rather than just making improvements on how to cast ballots.

HARRISBURG, Pa. (AP) — Democrat Joe Biden has been certified as the winner of the presidential election in Pennsylvania, culminating three weeks of vote counting and a string of failed legal challenges by President Donald Trump, state officials said Tuesday.
The Pennsylvania State Department “certified the results of the November 3 election in Pennsylvania for president and vice president of the United States,” Gov. Tom Wolf, a Democrat, tweeted.
“As required by federal law, I’ve signed the Certificate of Ascertainment for the slate of electors for Joe Biden and Kamala Harris," Wolf wrote.
The State Department said Wolf's “certificate of ascertainment” has been sent to the national archivist in Washington. Pennsylvania's electors, a mix of elected Democrats, party activists and other staunch Biden backers, will meet in the state Capitol on Dec. 14.

“These findings highlight the far-reaching effects that gatherings in one area might have on another area,” the authors wrote. “The motorcycle rally was held in a neighboring state that did not have policies regarding event size and mask use, underscoring the implications of policies within and across jurisdictions.”
Roughly 460,000 people from across the U.S. gathered together for the rally in western South Dakota, attending both indoor and outdoor events from Aug. 7-16.
“We know that the risk of contracting Covid increases as people gather and have consistently provided the facts and science on how Covid spreads to the public,” the South Dakota Department of Health said. “In South Dakota, we’ve trusted and continue to trust people to take personal responsibility for their health.”
Public-health authorities have generally warned against large gatherings throughout the pandemic, especially when other mitigation measures, such as mask-wearing, aren’t implemented.

Last week, our nation once again demonstrated the strength of our democracy as more than
140 million Americans cast ballots to select their leaders. I want to thank each of you and your
teams for your extraordinary efforts to ensure that all Americans could exercise this most
fundamental ofrights with confidence and in safety.
Now that the voting has concluded, it is imperative that the American people can trust that
our elections were conducted insuch a way that the outcomes accurately reflectthe will ofthe voters .
Although the States have the primary responsibility to conduct and supervise elections under our
Constitution and the laws enacted by Congress, the United States Department of Justice has an
obligation to ensure that federal elections are conducted in such a way that the American people can
have full confidence intheir electoral process and their government.
The Department's general policies with regard to election fraud investigations are
contained inthe Justice Manual. Those policies require, among other things, consultation with the
Public Integrity Section's Election Crimes Branch ( ” ) in some instances. Those policies
already allow preliminary inquiries, including witness interviews, to be conducted without ECB
consultation. In instances in which they are consulted, the ECB's general practice has been to
counsel that overt investigative steps ordinarily should not be taken until the election in question
has been concluded, its results certified, and all recounts and election contests concluded. Such a
passive and delayed enforcement approach can result in situations in which election misconduct
cannot realistically be rectified. Moreover, this ECBpractice has never been a hard and fast rule,
and case - specific determinations and judgments must be made. While most allegations of
purported election misconduct are of such a scale that they would not impact the outcome of an
election and, thus, investigation can appropriately be deferred that is not always the case.
Furthermore, any concerns that overt actionstaken by the Department could inadvertently impact
an election are greatly minimized, ifthey exist at all, once voting has concluded, even ifelection
certification has not yet been completed.
Given this and given that voting inour current elections has now concluded, I authorize you
to pursue substantial allegations ofvoting and vote tabulation irregularities prior to the certification
ofelections in your jurisdictions in certain cases, as I have already done inspecific instances. Such
inquiries and reviews may be conducted ifthere are clear and apparently -credible allegations of fraud
irregularities that, iftrue, could potentially impact the outcome of a federal election in an individual
State. Any investigationofclaims ofirregularities that, iftrue, would clearlynot impact the outcome
of a federal election in an individual State should normally be deferred until after the election
certificationprocess is completed. While U.S.Attorneys maintaintheir inherent authorityto conduct
inquiries and investigations as they deem appropriate, it will likely be prudent to commence any
election -relatedmatters as a preliminary inquiry so asto assess whether available evidence warrants
further investigative steps.
While itis imperative that credible allegations be addressed ina timely and effective manner,
it is equally imperative that Department personnel exercise appropriate caution and maintain the
Department's absolute commitment to fairness, neutrality and non- partisanship. You are the most
senior leaders in the United States Department of Justice and I trust you to exercise great care and
judgment in addressing allegations of voting and vote tabulation irregularities. While serious
allegations should be handled with great care, specious, speculative, fanciful or far - fetched claims
should not be a basis for initiating federal inquiries. Nothing here should be taken as any indication
that the Department has concluded that voting irregularities have impacted the outcome of any
election. Rather, I provide this authority and guidance to emphasize the need to timely and
appropriately address allegations of voting irregularities so that all of the American people,
regardless of their preferred candidate or party, can have full confidence in the results of our
elections. The American people and the leaders they freely elect deserve nothing less.
