How does breaking and entering, trespassing, disorderly conduct in the Capital building, and theft amount to an insurrection?
So let's start the charges that have been brought so far against those arrested:
- entering or remaining in a restricted building without lawful authority
- violent entry and disorderly conduct on Capitol grounds
- theft of government property
- disrupting the orderly conduct of government business
- disorderly conduct in a Capitol building
What we do not have is any sort of weapons charges , any sort of conspiracy charges, or anything else you would associate with an insurrections (which by nature is an armed uprising against a government with the intent of taking over said government). Sure, I know there are many different "definitions" of the word, but if I had asked this same question a month ago, everyone would have agreed that an insurrection would be more than just a riot where the participants are attempting to get into a Federal building.
Because let's face the facts; well planned riots with actual armed rioters attempting to breach Federal buildings happened nearly every day for a period of time this summer, and nobody demanded those were "insurrections". If we are now going to define any act to rise up against police or security during the course of some protest as an insurrection, then every riot is an insurrection. Plain and simple.
But that isn't the case... is it?
In order for this to be considered an insurrection, you would need proof that the same people entered the building had a coordinated plan to somehow take over the government. You would have to show that they were NOT just rioters who decided that it would make some sort of political point by disrupting the counting of the electoral votes. You know, like the thousands of protesters who acted in such to prevent Justice Kavanaugh from being first confirmed and then sworn in. One should remember that protesters occupied the Senate Hart building, breached both the Senate and USSC chambers, all in an attempting to disrupt both the confirmation and the swearing in of Justice Kavanaugh. I fail to remember anyone calling any of that an insurrection.
Apparently some believe that by stealing Nancy Pelosi's podium or by sitting in someone's office that you are able to control the US Government. Pretty sure it doesn't work that way. But if that is your argument, then feel free to make it.
Update: I stand corrected - there are two weapons charges - both involving unauthorized carrying and/or carrying an unlicensed hand gun. But still hardly the sort of armed invasion that would be required to take on the Capital Police.

The police reports and charges do not show any gun charges at this point and there has not been a single "conspiracy" charge to anyone. I watched several videos of what took place inside the capital building and the only guns were in the hands of Capital Police and Security agents, and the only person shot was a unarmed vet.
The prosecutors are not charging anyone with being part of an insurrection. The charges are completely consistent with the actions, which are completely consistent with the actions of most riots we have seen over the past year.
When someone is charged with a conspiracy to take over the Government then you can make this argument. Until then, it's just you being gaslighted by propaganda.

So if this prosecutor is correct, then I guess we will see someone on this list being charged with that?
Unless, of course, there is a disconnect between what certain people were "planning" on line versus the lack of evidence that those arrested were a part of said "planning".
In other words, anyone on social media (FB) who were wanting to come down to the Capital and kill politicians should be treated the same way as any on-line threat should be treated. But the fact that person A said we should invade the capital and kill Nancy Pelosi wouldn't make person B (who possibly entered the building) liable for the statement of another person.
You would have to prove that the same people who were arrested entering the capital building were responsible for the threats and intended to act on them. If that is the case, then you throw the fucking book at them and punish them to the fullest extent of the law.
But that is just me... if it was up to me, we would have been punishing any and all protesters to the MAXIMUM extent of the law and then perhaps instead of making Rioting a socially acceptable means of protest, we may have discouraged this from happening at the Capital.

The violence, property destruction, and in some cases loss of life last summer were deeply regrettable, as I and Biden and other Democrats often said, but also regrettable is the fact that MILLIONS of protestors in numerous cities and towns across this land acted peacefully, and this was sadly overshadowed by the violence.

Threats are being covered under the Obstruction of an Official Proceeding charges. If they believe that they can prove that this person entered the building with the intent to kill congress people, then I would expect that they will amend those charges.
But at this point, I think we should be looking at the official charges rather than relying on opinions of unnamed prosecutors.
Moreover, there is no legal manner to hold the other rioters accountable for statements that Chansley might have made, as these stories seem to claim. Even if Chansley entered the building wanting to seek out and kill people, that doesn't mean the other protesters/rioters were doing the same.

Police have seized an alarming number of guns from President Trump 's supporters who descended on Washington, D.C., last week and stormed the Capitol in an effort to stop Congress's certification of the 2020 election results.
The details revealed in court documents over the past week paint a disturbing picture indicating that some of the demonstrators flocked to the Capitol prepared to carry out violence. The cases, likely only the beginning of a lengthy federal investigation, also suggest that the riot that overran the halls of Congress and left five people dead could have been much worse.
One man, Lonnie Coffman, is facing multiple weapons charges after police say they found him in possession of five guns, eleven Molotov cocktails, a crossbow, smoke bombs and a stun gun.
Coffman was arrested only because police were investigating pipe bombs that were discovered near the Capitol at the Republican Party and Democratic Party headquarters and noticed one of the guns in his truck while securing the area.
Authorities have said they don't believe Coffman was behind the pipe bombs and have yet to identify a suspect.
In charging documents filed with the federal district court in D.C., police said they searched Coffman’s truck while sweeping the areas around the pipe bombs, finding the weapons along with hundreds of rounds of ammunition and a list of public officials and journalists that identified them as “good guys” and “bad guys.”
“In the end, this is a defendant with access to firearms and numerous other lethal weapons, dangerous incendiary mixtures creating napalm, who appears to have been motivated to conduct violence against our elected representatives,” prosecutors wrote in a court filing.
“The defendant brought these weapons to the immediate vicinity of the U.S. Capitol Building, and traveled to the area with two firearms on his person. The amount of weapons suggests an intent to provide them to others, as no one person could reasonably use so many at once,” they added.
A man named Cleveland Meredith, who traveled from Colorado in order to participate in the protests at the Capitol, was arrested at his hotel in D.C. last week after law enforcement received a tip that he had threatened to kill House Speaker Nancy Pelosi (D-Calif.). Meredith told investigators that he mistakenly arrived in the District a day after the riot.
The FBI said in court documents that it found a handgun, an assault rifle and hundreds of rounds of ammunition in Meredith’s trailer and text messages on his phone in which he talked about killing Pelosi and told a friend “headed to DC with a shit ton of 5.56 armor piercing ammo [purple devil emoji].”
Prosecutors have also charged two men who were seen in social media images carrying plastic flex cuffs, which are plastic restraints often used by military and law enforcement when detaining groups of people.
One of those men could be seen sporting what appeared to be a weapon in a holster on his hip in pictures of him inside the Capitol. The day of the riots, FBI identified the man as Eric Munchel, of Nashville, Tenn., and arrested him at his hotel in D.C.
He was carrying a Taser in a holster when he was arrested, which he told investigators was for protection, according to an affidavit from an FBI agent.
Another man, Christopher Alberts of Maryland, was arrested on the Capitol grounds as police were clearing the building when an officer noticed that he was carrying a pistol.
The defendants’ attorneys did not respond when asked for comment.
The gun charges that have emerged in court over the past week are only a fraction of the more than 70 cases that federal prosecutors have filed in the wake of the riot. And Justice Department officials have suggested that many more are likely to be charged in the coming days as their investigation unfolds.
It’s unclear just how many of the rioters were armed as they stormed the Capitol, forcing Vice President Pence to evacuate and hundreds of lawmakers to flee both chambers.
Those who have already been charged may be only a small percentage of the total number of armed rioters given the prevalence of firearms at right-wing demonstrations across the country in the past year.
And according to numerous media reports, there’s mounting evidence that the demonstration was organized in advance, with some Trump supporters discussing plans for violence online.
“All this bullshit about not bringing guns to D.C. needs to stop,” one Trump supporter wrote in an online forum, according to BuzzFeed. “This is America. F--- D.C. it's in the Constitution. Bring your goddamn guns.”
