Chauvin Trial starts today - Opening statements

Can Chauvin get a fair trial?

Can Chauvin is innocent.

The prosecution must prove a reasonable doubt that he's guilty as charged.

The video and again the autopsy conducted by the government will be entered into the trial.

The prosecution is speaking right now.

C.H. Truth said...

Roger..

Wait till the defense plays "the rest of the tape" where George Floyd had already told the two arresting officers that he "couldn't breath" somewhere in that same vicinity of times... He couldn't breath when they attempted to have him walk to the police car. He couldn't breath when they put the handcuffs on him. He couldn't breath when they tried to get him into the back seat of the police car.

All that took place before Officer Chauvin was even there.

Curious Roger. How did a knee to the neck cause Floyd to have trouble breathing even "prior" to the officer who did it even being there?

If you can reconcile that for me, Roger... then we can continue.

But if you are gullible enough to be pulled in by emotions, then there is no sense in discussing this with you.

rrb said...

I watched the entire tape. Junkie Floyd was saying "I can't breathe" and "Please don't kill me" before he was even on the ground with a knee on his neck.

The asshole had enough Fentanyl coursing through his system to kill 5 adults.

To the original question - can Chauvin get a fair trial. Imo that's 50-50 at this point. With powerful scumbags like Ellison involved, all bets are off.

On this particular topic the alky is just a fucking clown. He had Chauvin convicted of murder the day it happened.

Scott, I'm not being emotionally involved, I want officer Chauvin to be given a fair trial. He's the person in the trial, not George Floyd.

Well Reverend...

Perhaps the first two officers should have left him be when they first heard him say he couldn't breath. Then obviously they should not have put handcuffs on him when he said he couldn't breath. They obviously should not have requested he walk when he was complaining that he couldn't breath. More obviously they should not have tried to get him into the police car when he was complaining he couldn't breath.

I guess they are a guilty of murder and should be summary executed because a drug addict with three times the fatal amounts of Fentanyl in his system died while in their custody.

They should have just let him go the minute he said he couldn't breath. Because calling an Ambulance (as they did) was not enough.

Shoot em on the spot, the Reverend says!

Better yet, flog them first. Maybe demand they suffer in pain to purify their souls like they did at the end of Braveheart. Then maybe draw and quarter them. No trial. No jury. No defense. Just make them pay!!!

Obviously they deserve that because a "person of color" died in their custody.

Coldheartedtruth Teller said...

Dependence and tolerance.

Tolerance and dependence may still occur, even with a legitimate prescription. Tolerance means the body needs more of the drug to create the same effect – a common occurrence with opioid painkillers that fentanyl is designed to combat, so people with severe chronic pain can still get relief when other opioids stop working.

The defense is actually claiming the state government intended to alter the results of the autopsy in order to convict officer
Chauvin

C.H. Truth said...

Everyone understands an increased amount of tolerance for a drug, Roger.

But he had three times the lethal limit. No matter what sort of drunk someone is they can only tolerate so much.

For comparable purposes, three times the lethal amount of alcohol would be between 0.70 and 1.20 (when you can be arrested for being drunk at 0.10).

So that would be like trying to argue that it's virtually impossible for a person who had 1.0 alcohol in the bloodstream to have actually died from it.

Keep in mind, they have to prove that he he did "not" die from Fentanyl. They cannot just make it seem "unlikely" that he died. If it is even fairly reasonable to assume he could have died from Fentanyl, then the prosecution will not have proven their case.

Again.... Roger seems to believe that the defense will have to prove that he died from Fentanyl beyond a reasonable doubt. They just have to introduce that it is possible that it was the cause of death, and that creates reasonable doubt.

rrb said...

Well alky, with a scumbag like Keith Ellison involved, that's extremely feasible. Not a stretch at all.

Lead defense attorney Eric Nelson gave a 25-minute opening statement for the defense, arguing the evidence in the case is "far greater than 9 minutes and 29 seconds." Of course not. The second autopsy report that he was strangled to death, and the drugs were not the case of his death.

Of course they did...

Because it is an obvious defense and 99 times out of a 100 the prosecution would have never brought this case to trial because the defense is not only obvious, but pretty solid.

If the prosecution is going to allow this to becomes a debate over whether or not three times the lethal amount of Fentanyl can kill someone, then they will lose (or should lose) - because if there is any question as to the underlying reason that is the very definition of "reasonable doubt".

They have to completely eliminate the possibility that Fentanyl could have killed him. Both sides will provide expert opinion. But I would rather be the person arguing that having three times the lethal amounts of an Opioid in your system "can" actually kill someone, rather than the one arguing that it's impossible.

rrb said...

Do you remember the violence in Mpls this summer, Roger... or has that already slipped your mind?

Local people here believe that the reason that they pushed so hard to reinstate a 3rd degree charge (which makes no sense given what 3rd degree is and what he did) - was because city officials are worried about rioting if he if found guilty of anything other than murder.

Local officials are worried that even a manslaughter conviction will cause riots.

Dive Brief:Major Wall Street firms and publicly traded construction companies are eagerly awaiting President Joe Biden’s Build Back Better infrastructure plan, which he said he will detail in his first State of the Union address scheduled for Feb. 23.  Expectations for a multitrillion dollar initiative have already sent public construction companies’ stocks higher, as institutional investors and contractors that perform civil work signal their bullishness on the issue.  Major institutional investor Blackstone, the world’s largest manager of alternative assets, said on its recent earnings call it raised $14 billion for a fund tailored to invest in infrastructure, with deal activity accelerating in both the U.S. and Europe. “We could see more dollars into infrastructure, an area [in which] we haven't underwritten a lot of corporate activity or government activity,” said Jon Gray, the firm’s chief operating officer, during the call. “That could change with a big push by the government.”

It will also build renewable energy systems and perhaps Nuclear Power plants.

A tracheostomy is a medical procedure — either temporary or permanent — that involves creating an opening in the neck in order to place a tube into a person's windpipe. The tube is inserted through a cut in the neck below the vocal cords. This allows air to enter the lungs.

Prosecutors introduce previously unseen cellphone video of Floyd’s arrest with second witness

By Kim Bellware

Prosecutors called their second witness to the stand Monday afternoon as they introduced seven cellphone video clips of Floyd’s arrest that had not been made public until now.

The newly-public footage was captured by 23-year-old Alisha Oyler, who worked at the Speedway gas station across the street from Cup Foods and filmed the series of short clips for more than eight minutes. Prosecutor Steve Schleicher asked the visibly nervous Oyler why she continued to film the interaction at length.

“It’s always the police — they’re always messing with people. And it’s wrong and it’s not right,” Oyler said.

Oyler testified she first saw Floyd when he was still on the corner near the Dragon Wok restaurant before police took him to the squad car in front of Cup Foods.

Through his line of questioning, Schleicher sought to establish Oyler’s perspective and her observations about the number of people on the scene at that point in the arrest — a move seemingly geared toward undermining the defense’s claims about a gathering crowd it said increased pressure on the officers as they tried to subdue Floyd.

Sleepy Joe said this live today.

2:30 P.M. EDT

THE PRESIDENT:  Good afternoon.  Last week, we set a goal of 200 million shots by day 100 of our administration — double the original goal that I had set.  And to make that progress, over the last three days, we’ve had a record number of shots in arms with over 10 million shots recorded in the weekend.  Over 10 million shots in three days — that would have been inconceivable in January.

The progress we have made on vaccinating this country is a great American story.  The federal government has stepped up, taken responsibility, and launched a massive federal vaccination program.  Governors and mayors of both political parties — Republicans and Democrats — have stepped up as well.  Our military, our National Guard, FEMA — they have all been incredible.  Healthcare providers, community leaders from all walks of life — so many volunteers of all ages and backgrounds stepped up as well.  And my fellow Americans, look at what we have done the past 10 weeks.  No other country has come close: 100 million shots in less than 60 days, and now we’re moving on to the next 100 million shots in just 40 days.

Coldheartedtruth Teller said...

A Michigan judge on Monday ordered three men to stand trial in a plot to kidnap Democratic Michigan Gov. Gretchen Whitmer over her coronavirus restrictions.

Jackson County District Court Judge Michael Klaeren ruled there was enough evidence and bound over Paul Bellar, Joe Morrison and Pete Musico to circuit court to stand trial.

“The defendants are joined at the hip here,” Klaeren said before announcing his ruling. “The prosecution did a good job in establishing who knew what and when.”

Arguments were heard Monday by Klaeren following three earlier days of testimony.

The three men are accused of aiding six others who are charged in federal court with conspiring to kidnap Whitmer. Five more people are also charged in state courts.

The FBI in October said it broke up a plot to kidnap Whitmer by anti-government extremists upset over her coronavirus restrictions.

Klareen said there was enough evidence for trial on charges of providing material support for terrorist acts, gang membership and using a firearm during a felony. Klaeren dismissed a charge of threat of terrorism against Musico and Morrison. Bellar didn't face that charge.

The threat of terrorism, providing material support for terrorist acts and gang membership charges each are 20-year felonies. Felony firearm charges carry two-year maximum prison sentences.

Blood vessels are irrelevant because the lack of oxygen is the cause of death, according to the autopsy report.

Editor’s Note (3/29/21): The murder trial of Derek Chauvin, the former Minneapolis police officer charged in the death of George Floyd, began with the defense arguing that Floyd died of underlying medical conditions and drug use. This contradicts two autopsy reports—one by the Hennepin County Medical Examiner’s Office and the other by private doctors commissioned by Floyd's family—that ruled the cause of death was homicide. This story from June 2020, written by 12 physicians, explains how inaccurately portraying the medical findings from Floyd’s autopsy emboldens white supremacy under the cloak of authoritative scientific rhetoric.

The world was gaslit by misreporting about George Floyd’s initial autopsy report. As concerned physicians, we write to deconstruct the misinformation and condemn the ways this weaponization of medical language reinforced white supremacy at the torment of Black Americans.

Gaslighting is a method of psychological manipulation employed to make a victim question their own sanity, particularly in scenarios where they are mistreated.

Scott is a prime example of gaslighted

Lolololololololololol The Los Angeles Times.

It would be coldhearted indeed if President Trump were to end the Obama administration’s policy of not deporting immigrants who were brought illegally to the United States as children.

Yes, illegal immigration is a problem; yes, the United States has the right to control who comes in and out of the country; yes, there are people in the U.S. who ought to be deported. But telling people who were raised here and educated here (thanks to decisions made by their elders) and whose dreams are rooted here that that they are no longer welcome — well, that would be an inhumane act. These people, many now adults, should not be forced to pay the price for the choices of their parents.

The Deferred Action for Childhood Arrivals program — which Trump is considering killing, according to White House leaks — was designed to give stability to people whose undocumented status is no fault of their own. Some arrived here as newborns or toddlers, and in many cases didn’t even realize they had no legal status until they needed a Social Security number for a job or documentation to prove their eligibility for their first driver’s license. Others have known from a young age, and have learned to live as quasi-fugitives, afraid to be questioned by police or, even worse, by ICE agents. Since Obama created the program by executive action in August 2012, roughly 750,000 people have received deferments that allow them to live and work in the U.S. without fear of deportation. (The deferments do not grant citizenship or legal residency.) By what calculation is it in the best interest of the country to eliminate their deferments and make them eligible for deportation?

Judge tosses terrorism threat charge against 3 accused in alleged Whitmer plot

Three men accused in an alleged plot to kidnap Gov. Gretchen Whitmer will not face charges of false report or threat of terrorism, a Jackson County judge ruled Monday.

Judge Michael Klaeren of 12th District Court in Jackson dismissed the charge against Joseph Morrison, 26, and Pete Musico, 43, both of Munith, and declined a request by prosecutors to add it to the charges against Paul Bellar, 22, of Milford.

"There has to be some form of intent here to incite mayhem," said Judge Michael Klaeren of 12th District Court in Jackson.

The charge carried a possible penalty of 20 years in prison.

...

Klaeren on Monday ordered Bellar, Morrison and Musico to stand trial on three remaining charges, gang membership and providing material support for terrorism, both punishable by up to 20 years in prison, as well as felony firearm, punishable by up to two years in prison.

This contradicts two autopsy reports

Well if we just used the "conclusion" of an autopsy report.... there would be no need for a trial!

Roger, like the Reverend... just believes you should just shoot the four cops where they stand, summary execution style. No trial, no jury, no nothing. Just what a pressured medical examiner and a paid medical hack state. Who, btw, contradict each other.
