Motions and jury selection is the all important part of the trial
They say that many of these trials are won or lost before opening statements. Make the right arguments and get the right rulings on evidence, pick the best jury possible, and it could very well make all the difference in the world.
One of the most heated discussions was whether or not to admit as evidence a prior arrest that George Floyd had where he had admitted to ingesting a large amount of drugs when confronted by cops to hide the drugs from being found. He ended up being admitted to a local Hospital and almost died from a similar amount of Fentanyl that was found in his body. This happened pretty close to one year prior to his death.
The defense wants this admitted as evidence of support of their theory that George Floyd did the same thing on the day of his death. That he ingested the large amount of Fentanyl to avoid being arrested for drug charges. The prosecution on the other hand is arguing that it is more prejudicial than probative. From what legal analysts are describing the Judge is leaning towards not allowing it.
While this obviously seems like good news for the prosecution and somewhat puzzling news for the defense (who could show some modus operandi in Floyd's behavior), it does actually show that everyone is basically stipulating to the idea that George Floyd had purposely ingested a lethal dose of Fentanyl. The judges ruling would most certainly be reversed if the prosecution "opens the door" by making any suggestions that Floyd had not intentionally ingested the lethal dose of Fentanyl.
So, at this point, the jury will be hearing about the Fentanyl that was found in the toxicology reports as well as expert testimony that will suggest that this is why George Floyd died and that it wasn't because he was choked or otherwise physically killed. Moreover, it will be argued (and not challenged) that Floyd ingested the Fentanyl of his own free will. This is quite obviously the most solid portion of the defense's case and will be the most difficult for the prosecution to overcome.

I have already stated in numerous posts (not that you read them) that I believe the jury will find Chauvin guilty, even though these charges would not have even been brought if the races of the two people involved were different.
We are talking Mpls jurors who are under pressure not just to avoid more riots, death, and destruction, but there have already been "threats" made against potential jurors who would not find the cop guilty. If Chauvin is found not guilty, the city will burn and people WILL hunt down the jurors.

Since we watched him fight getting out of his car, getting into the police car, and collapsing (on his own) to the sidewalk, it's unlikely that abrasions to his elbows and forearms came from Chauvin. Certainly Chauvin did not give him any oral lesions, and the handcuffs were on because he was being legally arrested.

The real question is according to the law. What charges against him are.
First degree murder is the most serious homicide charge. In order to be charged with first degree murder, the prosecution must prove that the murder was premeditated, that is to say, the defendant planned the murder of the victim with the intention to kill him or her before the crime occurred. Law mandates life in prison without parole for anyone convicted of first degree murder. I would find him not guilty.
There is also a felony murder statute.
Second degree murder is a homicide charge, but does not involve premeditation. Someone convicted of second degree murder could face any number of years in prison, up to a life sentence. Unlike first degree murder, there is a possibility of parole.
If the other court decision is to allow second degree murder, I would vote to convict.
Manslaughter is the unlawful killing of another individual without malice, but is not the same as homicide. There are two degrees of manslaughter. Voluntary manslaughter involves intentionally killing another person, but in the heat of passion. Involuntary manslaughter is an unintentional loss of life. Manslaughter of both degrees is punishable under Minnesota law. I would vote to convict.
Based upon what I know now, but if I was on the jury. I would base it upon the evidence not my opinion.

Those are facts that cannot be changed by "other facts".
There is also no actual physical evidence of a heart attack. There is no physical evidence that he died from Covid. There is no physical evidence that he was choked or that he was strangled, or that the carotid arteries were damaged.
There is literally no physical or scientific evidence that backs up the opinion that it was a heart attack caused by being held in an uncomfortable position. In fact, you can watch him during the entire time and see that there was no physical signs of a heart attack while he laid on the ground.
In case you were not aware... heart attacks are extremely painful and a man would not just be able to lie there quietly while he died of one.

New York's Chief Eugenics Officer Andrew Cuomo Not Only Packed the Old Age Homes with Covid Patients, But Group Homes for the Mentally Retarded as Well

New York Gov. Andrew Cuomo's administration ordered homes for people with developmental disabilities to accept coronavirus patients -- and never rescinded the order.
The April 10 directive, which mirrored the Cuomo administration's controversial order to nursing homes, also told homes for people with developmental disabilities that they could not require hospitalized residents to be tested for coronavirus prior to admission or readmission.
Five hundred fifty-two residents at homes for people with developmental disabilities have died of coronavirus, the New York Office for People With Developmental Disabilities (OPWDD) told Fox News on Monday.
More than 6,900 people out of the more than 34,552 who live in such resident homes have been infected with the virus, according to OPWDD.
Not as many died, one imagines, because they weren't necessarily old or unhealthy. Just developmentally challenged.

Fortunately, the US political system has many sources of resilience. One is the integrity of local and state officials, such as those who certified last November’s presidential election result in Michigan, despite threats from Trump supporters, and Georgia’s Republican governor and election administrators, who stood up to threats from Trump himself. Another is the judiciary, with even judges appointed by Trump refusing to give any credence to the groundless claims of electoral fraud propagated by the president and his allies. These officials did their job and believed in the system.
But the Achilles heel of Trump’s populist appeal was his extreme anti-statism. He hated the government and couldn’t bear to strengthen its capacity. For proof, one need look no further than the countless appointed positions in the federal government that remained unfilled throughout his four-year term, not to mention his administration’s disastrous COVID-19 response, capped by a botched vaccine rollout.
Successful populist leaders, by contrast, harness the power of the state in discretionary ways to create jobs for their supporters, and to provide them with goods and services. That was anathema to Trump, and he paid the electoral price for it. Many Americans face genuine problems, and Biden – thankfully – is not hamstrung by antipathy to using the state’s power to make a difference in their lives.
Democracy’s survival requires both the state and society to be strong and counterbalance each other. Maintaining this equilibrium demands constant effort. Ultimately, it engenders greater state capacity to deliver what citizens want and encourages greater social mobilization to monitor this capacity.
This is the corridor in which Trump could not function. It is also, one hopes, where all aspiring destroyers of democracy will ultimately fail.

Susan Shaffer, president of the Mid-Atlantic Equity Consortium, paid her husband Mark Shaffer's law firm $282,996 from 2011 through 2019 for "ongoing legal services," according to tax documents reviewed by the Washington Free Beacon. Mark Shaffer is the sole attorney listed on his firm's website.
The consortium has become one of the country's most prominent antiracist auditing nonprofits. It works in 15 states, often in partnership with left-wing organizations like the Southern Poverty Law Center. The group, which has ties to the Department of Education, has been exclusively funded by taxpayer dollars since 2017. Susan Shaffer has raked in more than $1.6 million from her antiracist consulting work since 2011.
Montgomery County Public Schools in Maryland awarded the Mid-Atlantic Equity Consortium a $454,680 grant last fall to conduct an audit of the district's K-12 curriculum and hiring policies, the Free Beacon reported in November. The group's tax documents revealed ties to the county government. Ginny Gong, who was listed as the group's director on the its 2018 tax filings, is also the director of a Montgomery County agency.
The consortium's antiracist work is largely funded by taxpayer dollars. Of the $19 million it has raised since 2001, $17 million is from taxpayer-backed government grants. The group has not received a single private donation in four years, though it previously received donations from the Gates Foundation.
Last year, the consortium received a $202,229 bailout from the Paycheck Protection Program. PPP loans were intended to help struggling small businesses survive the economic downturn brought on by the coronavirus pandemic.
Shaffer paid herself an average $200,000 in salary and other benefits every year since 2011. Shaffer's pay accounts for roughly 20 percent of what the consortium paid all its employees. Most of the group's officers were not compensated for their work. The consortium's website shows it currently has 20 employees.

I found this to be the greatest source of encouragement, seeing so many brave Patriots out there supporting each other while the world derides and attempts to cancel them.
People may not agree with every opinion they emit or they may even disagree with each other on certain issues – but they are united in one thing: their love for America and their unyielding determination to preserve what makes her great.
And it is this very unity that must be fostered in order to successfully take back the country, as President Trump rightly pointed out.
Yes, the country hangs in the balance until election integrity is fully examined and restored, as President Trump also clearly outlined in his speech. But, in the meantime, every effort must also be made to push the America First agenda and support these candidates across fifty states and government levels who firmly believe that American principles need to be protected.
Over are the days in which patriotism was whispered behind closed doors for fear of appearing offensive. Meek Republicans will not convince voters, and the party is now doomed to fail unless America First candidates are put forward, as confirmed by the unwavering support for President Trump to this day.
It’s simple. Americans want fighters who will defend an America First agenda, not grifters posturing as conservatives who will cower in the face of intimidation tactics or be seduced by bribes.

The Biden administration notified the Supreme Court on Tuesday that it will no longer defend a government policy seeking to impose new limits on the admission of immigrants considered likely to become overly dependent on government benefits.
The Department of Homeland Security announced in 2019 that it would expand the definition of "public charge" to be applied to people who could be denied immigration because of a concern that they would primarily depend on the government for their income.
In the past, the designation was largely based on an assessment that an immigrant would be dependent upon cash benefits. But the Trump administration proposed to broaden the definition to include noncash benefits, such as Medicaid, supplemental nutrition and federal housing assistance.
Anyone likely to require that broader range of help for more than 12 months in any three-year period would be swept into the expanded definition.
The federal government has long had authority to refuse admission of immigrants who were likely to become public charges, but the term has never been formally defined.
The Trump policy proposed to fill that void, adding noncash benefits and such factors as age, financial resources, employment history, education and health, arguing that the expansion would reinforce "the ideals of self-sufficiency and personal responsibility, ensuring that immigrants are able to support themselves and become successful here in America."

In a 1998 report, the U.S. Department of Agriculture ascribed this decline to a long and “well-documented” history of discrimination against black farmers, ranging from New Deal and USDA discriminatory practices dating from the 1930s to 1950s-era exclusion from legal, title and loan resources.
Discriminatory practices have also affected who owns property as well as land. In 2017, the racial homeownership gap was at its highest level for 50 years, with 79.1% of white Americans owning a home compared to 41.8% of black Americans. This gap is even larger than it was when racist housing practices such as redlining, which denied black residents mortgages to buy, or loans to renovate, property were legal.
