As the trial heads into day 12, we are being told that the defense is "only" planning a case that should take about three days. Of course, "only" three days is a misnomer because three days should be more than enough time for a case to be brought, both by the prosecution and the defense.
The odd thing isn't that the defense will only take three days, but that the prosecution took twelve. Moreover there has been a growing criticism in legal circles that the Judge in this case is been allowing too much "cumulative" testimony as it pertains to "expert witnesses". While typically prosecution of defense is allowed to call as many physical "witnesses" (people who saw something) as they desire, even if those witnesses will say the same thing, the idea of expert testimony is to allow one expert per area and avoid duplication of expert testimony.
Obviously this hasn't been the case. We are up to I believe six different medical witnesses who testified regarding cause of death, and we have now heard from seven people from within law enforcement who all provided opinions on use of force. Now certainly it makes sense that you would call different sorts of doctors to testify to different types of things. A pulmonary expert would take about thing related to that expertise. The coroner would talk about his/her findings. A toxicologist might go over the toxicology reports, etc. In theory there should be very little overlap of these testimonies. Same might be true of a use of force expert. You might want to call a choke expert, and a use of force trainer, and possibly someone who can attest to in the field realities. But seven?
For the last use of force witness who quite literally gave almost identical testimony as previous use of force witnesses, the Judge apparently allowed it because he gave the perspective from a "national" and not local level? The state could not even provide any evidence that Chauvin was aware of any of the "national" standards, but his duplicate testimony was allowed. Meanwhile we heard the exact same direct and cross of the States sixth medical expert and learned nothing new other than apparently an enlarged heart is a good thing and that 90% blockage of major arteries is not a big deal, at least in Floyd's case.
Now the reason that our court system does not allow the cumulative expert witnesses to basically repeat other testimony is that it can create the "illusion" that because there are "more" witnesses brought forth by one side, that it means that argument is more valid. Obviously three witnesses seeing the same thing, while only one seeing something different favors the word of the three witnesses, correct? But that is not how the system is designed to work with expert testimony (as you can generally find as many experts as you can afford to make your case). The general idea is that each side should be calling their absolute best of the bunch to represent their testimony and then the jury has a fair means to determine which one they believe.
Moreover, the state has almost unlimited resources to try this case. Chauvin is one guy with one attorney. He simply cannot afford to hire 10 experts to come in and testify on his behalf. This is another reason why the courts will limit each side to one expert per subject. I even read one legal expert who believes that a conviction could be appealed based on these reasons alone. That Cahill not controlling the sheer amount of State witnesses denied Chauvin a fair trial.
Now there are obvious pitfalls to calling multiple experts as was on display yesterday, as once again the State's own expert disagreed with a previous State witness to the degree that he demanded that the previous witnesses opinion was not "reasonable". Moreover, does anyone have a real consistent idea of why Floyd actually died? So far the State has produced six medical experts and they have provided three distinct medical reasons for death. If you add in the MMA expert, that makes four different medical reasons for death. It doesn't take much for the defense to muddy up that water even more.

Well you don't seem to remember that originally the knee was demanded to have been across Floyd's neck and choked him to death. Something that was proven basically incorrect before they got to their first medical expert.
You also have someone claiming a 140 pound man "crushed" Floyd to death with the pure pressure of his distributed weight between two knees/shins.
Another claimed that the death was mainly due to pressing down on the hypopharynx and blocking an airwave.
Then we had Doctor Baker who stated that not only was there no evidence that Floyd was crushed or that his hypopharynx was blocked, but in his professional medical expert opinion, that neither was possible in that situation based on the position of the knee.
Which of course accounts itself directly with the testimony of two of the use of force experts who also agreed that how Chauvin had his knee was not a lethal position and not a problem in and of itself.
So it's not that the differences are all working in the same direction. They are literally opposed 180 degrees from some experts saying that Chauvin killed him with his restraint, and others saying that the restraint was not lethal or deadly. Then you have Doctor Baker who basically stated that it was largely health issues, drug use, and other factors that was just exasperated by the arrest and restraint (which ultimately led to his death).
So even within the prosecutions own witnesses, Roger.

He says he is "not often" asked to assist city police officers.

And then one witness that shows Floyd was falling asleep and obviously out of it, and then body cam and witness testimony showing the scene appears dangerous. Then one witness who suggested that physical restraint was part of training in that situation and that Chauvin (as a veteran) would probably not have received some of the same training as new cadets (specifically to the point of rolling him to the side).
On cross they got that witness to admit that Chauvin has received CPR training but did not even ask if he had been taught the rolling to the side procedure.

Everyone who testifies as an expert is giving an opinion.
His opinion just differs from the opinions of the states witnesses, as we would expect. So either opinions are okay or they are not? But you don't get to make some sort of distinction that you previously refused to make.\
So when you have a bunch of different people with differing opinions about something, who do you believe? Or do you believe any one of them to the fullest degree?
Perhaps it muddies up the water and you are not sure who to believe. Perhaps they all sound equally plausible?
But if you are the prosecution... better hope that they believe your witnesses and discount the defense witnesses to the degree that it would be unreasonable to believe them.
Otherwise that create a situation where you have... what do they call that? Two words, one starts with an R the other a D. Used it all the time to see if someone is guilty or not? I just can't remember?
Prosecution is arguing semantics with the witness. We on like question seven tor eight times he tried to get witness to say he was on "top" of him.
Defense witness cleverly keeps saying that it's use of force based on "intent" and keeps arguing that Chauvin displayed no intent.
Every time the prosecutor attempts to get him to say something about "use of force" - he keeps talking about "no intent" to harm seen.
Whether or not pain was or was not inflicted in this position is really moot when the prosecution has to prove "intent".
Not sure why they keep pushing this line?
Prosecution really trying to show that Chauvin should have put him on side to avoid positional asphyxia. Witness replies that an extremely obese person might have issues with positional asphyxia... but says "you or I" (meaning normal sized people) not so much.
Again, witness has given opinion that positional asphyxia not in play because Floyd was not obese, because Chauvin was not large, but prosecution wants to imply that he should have turned him to the side anyways.
Even if that is what Chauvin might have done in hindsight, suggesting he should have done it, doesn't imply either assault, intent, or murder.
