One of their star witnesses ended up being so bad under cross for prosecution that the defense actually told the court that she was now going to be "recalled" as a defense witness when it is their turn to present their defense.
So the issue at hand is unlike the movies and television where defense attorneys are allowed ask pretty much whatever they want under cross, the real laws of the court room is that the defense is actually limited on cross to the subjects brought up on direct. Same goes for redirect or any subsequent crosses. A redirect is only allowed to work within what the defense asked about. They cannot introduce anything new or otherwise circle back to previous points (unless the defense had asked about it in cross examination). That is why redirects and recrosses tend to fizzle quickly as the available lines of questioning closes down.
So apparently there was some line of questioning that the prosecution did not open the door for, and the defense feels that it is something they want to bring up when it it their turn. This apparently almost never happens and quite obviously the defense is not obligated to call her again. But if they do, the state would not be allowed to circle back to anything they previously ask her. They would not be allowed to clean up the mess so to speak. They would be obligated to stay within the confines of what the defense brings up.
This also exposes some basic truths of the prosecution case, which is largely built on selective information and omission of key facts. According to at least one legal observer, they feel that the defense may choose to recall several state witnesses when it comes their turn to present, thus giving them a chance to bring up certain facts and points that the prosecution would rather leave untold, and using the State's own witnesses against them.

Because of your personal preference not to coldheartedtruth.
Hey Roger...
One of your key analysts yesterday (Roger Amick) said the defense had a really good day. You should tell that Roger guy how wrong he was to make such a stupid statement. You should also have a talking to him, because he also stated once or twice that Chauvin is innocent until proven guilty.
I know you generally like this Roger Amick and think he is smart (maybe even a genius). But he appears to be disagreeing with your emotional and over the top line of insult reasoning today.

That's nice. And it's also completely subjective. Basically the same type of wisdom espoused by liberal geniuses who would have the police shoot to wound, like in the leg or something.
Alky, if I'm a cop and I've got some fuckstick who's is openly acting like he's jacked up on enough narcotics to kill a fucking Clydesdale, I'm going to pin his ass as I see fit until I believe the threat to be mitigated. I've seen dash cam and body cam video of cops being murdered who thought they had a scumbag in custody.
Chauvin decided he didn't want to die that day, and considering the massive amount of fentanyl Junkie had in his system, he apparently decided he didn't care whether he lived OR died.
Only an asshole second guesses this situation. But thanks for your armchair quarterbacking skills. Not quite on par with your plagiarizing skills, but everyone has to have a dream.

Alky always lies.
Scott,a people who thinks about his own words, and looks at further information, a rational and intelligent person can rethink his opinions. You think that they are emotional, not rational.
So what you are saying, Roger...
Is that the Roger who stated after testimony yesterday that the defense had a good day was actually wrong. That the Roger who had repeated stated that he was still objectively watching testimony and objectively stating that Chauvin was innocent until proven guilty was also wrong.
And the Roger that is spewing insults and demanding that Chauvin committed murder with 100% degree of certainty is the actual objective Roger just objectively rethinking what he say yesterday.
Objectively no longer agreeing with all the legal experts who stated that the State struggled, but rather now after watching yesterday's events can conclusively and with 100% absolute certainty declare Chauvin guilty.
Objectively, knowing full well that the Defense has not even presented their case yet, the objective Roger can still tell us that we are all crazy and being political for not agreeing with your assertion that...
Chauvin murdered Floyd and we should all just accept that and agree with it.
Is that what you are arguing Roger?
Biden's Plan ?

Some experts, said upon further research stated the defense is trying to get the jurors to connect emotionally with the defendant. A typical example of defense policy.
So which is the objective Roger, Roger?
The one who believes that a defendant is innocent until proven guilty and deserves a fair trial? The one that actually agreed with all of the experts that the defense had a rough day and are struggling to prove their case?
Or the Roger who every so often just blurts out that Chauvin is already been proven guilty in his mind and only racists and people with politicized feelings could possibly think differently?
I can separate my feelings about the event and again the trial.
The defense only needs one person to acquit him. We shall see.
McCarthy brought up something I have wondered about...
The state keeps trying to imply that because Floyd was being arrested for a non-violent crime, that somehow the police were out of line for using any force to detain him. The implicit and even explicit argument is that a non-violent criminal is not a threat and should not be treated as one.
The judge is not allowing Floyd's previous criminal record (which includes violence criminal acts) to be introduced, because of the reasoning that would only serve to be prejudicial. It has no use in the trial.
But, by the time Chauvin and his partner got to the scene, they would have already been privy to this guy's rap sheet and were probably aware that he had committed violent crimes in the past.
McCarthy is arguing that the prosecution might be opening the door for Floyd's previous arrests for violent crimes to be introduced to counter their claims that Floyd was not a threat because he had not committed a violent crime.
He calls it a "reckless gambit" in his article this morning. He has not been impressed with the prosecutions case which I get the impression he believes would be winnable if handled correctly (or maybe that is just the prosecutor in him).

This is key: the defense is trying to get the use-of-force expert to say that suspects who appear subdued or unconscious can start to fight again. But the witness says that officers can only go by the suspect’s actions, not what they might do.
McCarthy is arguing that the prosecution might be opening the door for Floyd's previous arrests for violent crimes to be introduced to counter their claims that Floyd was not a threat because he had not committed a violent crime.
By not allowing Junkie's violent crime rap sheet the judge is explicitly putting his thumb on the scale, hard. And by doing so the prosecution has been given a gift from the judge that they appear to be poised to fuck up.

Stinger said that in evaluating appropriate use of force, officers can only go by the suspect’s actions, not what they might do.
But the witness says that officers can only go by the suspect’s actions, not what they might do.
The witness is an idiot. If I'm Chauvin and I'm pulling up Junkie Floyd on my MDT and I see he has a violent rap sheet, I'm treating him as such. The fact that the crime he's in the process of committing is supposedly "non-violent" is irrelevant.
Cops including FBI have been killed recently as they nonchalantly served a warrant.
A smart cop who wants to go home to his family at the end of his shift assumes nothing but the worst case scenario, and anyone who would second guess that is an asshole.
Gotta love how the State seems to continuously "object" to various slides and other physical evidence being shown to the Jury. That has to make the jury wonder what they are trying to hide. Especially when they go to sidebar where the Jury doesn't get to hear the argument and the State is overruled.
Gotta look bad.
Second of the State's witnesses that has admitted under cross-examination that the knee was not on the carotid artery, but rather further back on the neck and upper back.
That is just dissolving the theory that this was a "blood choke hold" as it requires both carotid arteries to be compressed. In this case, it appears that neither are compressed.
State had to have known that these witnesses would see the other angles of the photographs and testify as much. It's hard to imagine how they prove strangulation when there is no actual evidence that the esophagus was blocked or the carotid arteries were being cut off.
The defense lawyer said what they might do. Five times. At least
I think he's trying to stay the prosecution edited the photos
Simply put, Defense has set a reasonable doubt in the minds of the jury.

"Second of the State's witnesses that has admitted under cross-examination that the knee was not on the carotid artery, but rather further back on the neck and upper back." CHT.
It only take one jury to find "not guilty".
Under Biden Socialism, that one member of the jury would have no say.
Repeatedly, the defense has suggested or insisted that Derek Chauvin’s knee was on George Floyd’s shoulder, not his neck. One reason this is important: The medical examiner cited “neck compression” as a cause of death.
They are trying to discredit the second comment by the first autopsy report of strangulation and asphyxia.
The period of time upon the neck is critical. Scott. Three minutes of the lack of blood flow into his brain, would have caused the brain damage, sufficient to cause death.
Both of the knees of the defendant were on his shoulders and neck.
They are quibbling again about the placement of the knee based on different angles. While Stiger has already admitted that the knee was not over the carotid artery, he is now admitting that based on the angle from Officer Keung's Body Cam that the knee was more on the shoulder blade and base of the neck.
More over, Stiger ended up admitting that even while in the restraint that Floyd was able to pick up his head and move it. Stiger grudgingly admits that he could move it "slightly".
Stiger is much less defense friendly than Mercil was. Mercil gave away the farm, basically willingly. Stiger is still giving away the farm, but doing so with a little more fight to him. Doesn't just "give it up" like Mercil does. Nelson has to pry the same information from him.
Both admitted that the placement of Chauvin's knee was not "lethal".
Unless you are willing to discount their expertise, training, and testimony, the knee to the neck was not the cause of death. Sorry, but it's true!

Cerebral hypoxia occurs when there is not enough oxygen getting to the brain. The brain needs a constant supply of oxygen and nutrients to function.
Cerebral hypoxia affects the largest parts of the brain, called the cerebral hemispheres. However, the term is often used to refer to a lack of oxygen supply to the entire brain.
Causes
In cerebral hypoxia, sometimes only the oxygen supply is interrupted. This can be caused by:
Breathing in smoke (smoke inhalation), such as during a fireCarbon monoxide poisoningChokingDiseases that prevent movement (paralysis) of the breathing muscles, such as amyotrophic lateral sclerosis (ALS)High altitudesPressure on
(compression) the windpipe (trachea)
Strangulation

The Case for Becoming a Biden Republican
April 7, 2021 at 1:00 pm EDT
Max Boot:
“We won’t transform our political system anytime soon. In the meantime, centrists have a binary choice: Support either an increasingly extremist and obstructionist Republican Party or a Democratic Party that, under President Biden, is working to solve our most pressing problems.
“Biden is governing from the ‘new center’ while Republicans are increasingly catering to the far right with shrill, divisive rhetoric and antidemocratic actions such as bills to restrict voting. Under those circumstances, those of us on the center-right can’t afford a third-party flirtation. We need to become Biden Republicans.”

Former House Speaker John Boehner (R-OH) continued his attacks on the Republican Party in a New York Times book excerpt, accusing former President Trump of inciting “that bloody insurrection for nothing more than selfish reasons.”
Writes Boehner:
“I’ll admit I wasn’t prepared for what came after the election — Trump refusing to accept the results and stoking the flames of conspiracy that turned into violence in the seat of our democracy, the building over which I once presided.
He added:
“Watching it was scary, and sad. It should have been a wake-up call for a return to Republican sanity…
Whatever they end up doing, or not doing, none of it will compare to one of the lowest points of American democracy that we lived through in January 2021.”

Since the first day of the trial of Derek Chauvin, it has been one of the central arguments in his defense: that the bystanders who witnessed George Floyd’s arrest last May in Minneapolis also influenced Mr. Chauvin’s actions.
On Wednesday, Eric J. Nelson, a lawyer for Mr. Chauvin, returned again to the crowd of people who had gathered outside Cup Foods and watched Mr. Chauvin kneel on Mr. Floyd, their voices raised and their cellphones recording. Mr. Nelson repeated insults that had been heard on videos from that day and suggested that the bystanders made up an aggressive, unpredictable group.
So yes they were almost all African Americans.

ONLY ONE? Top Biden officials busted telling an enormous lie about ‘infrastructure’ plan:
Wow! A whopping 19 million jobs created! Who could oppose that!?
There’s just one problem: This 19 million figure is based on a gross distortion of an economic report. The claim that Biden’s spending bonanza would create 19 million jobs has no basis in reality. The figure comes from Moody’s Analytics, a respected economic analysis firm, albeit one often very generous and favorable to big government spending plans. However, what the Moody’s report does is map out projections for several different scenarios.
In the scenario where Biden’s infrastructure proposal is passed, Moody’s projects that the economy will create 18.96 million jobs over a decade. Yet as Washington Post fact-checker Glenn Kessler aptly explained, that’s compared to a baseline projection of 16.3 million jobs being created without the infrastructure proposal. (But with the already-passed stimulus legislation). So the real number of jobs Biden’s plan would create, according to this Moody’s report, is 2.7 million. That’s a far cry from the “19 million jobs created” in Biden’s initial telling. Indeed, the White House and Buttigieg have had to retract their objectively false claim publicly.
Oops.
It’s par for the course — Biden’s previous government experience was as part of the administration that invented the imaginary “jobs saved or created” metric in 2009.
https://pjmedia.com/instapundit/442808/
The argument about the car, catalytic converter, etc... is apparently whether or not the liquid seen under the car was in fact from the AC unit of the car or if it was urine from Floyd.
Apparently we might need to hear from someone who is both a Mechanic and at the scene to clarify this important detail. Either way, the fact is that there is otherwise no way to know one way or the other.

The tech-heavy Nasdaq Composite dipped 0.1% to 13,688.84 even as Big Tech stocks registered solid gains. Amazon, Apple and Alphabet all climbed more than 1%, while Facebook jumped 2.2%.
He said that he will talk with the Republicans about his epic bill, but he implied he would use the same thing to pass legislation without the filibuster.

WASHINGTON—President Biden’s proposed 15% minimum tax on profitable corporations would affect far fewer companies than the version he campaigned on, according to details the Treasury Department released Wednesday.
The tax—aimed at companies that report large profits to investors but low tax payments—would apply only to companies with income exceeding $2 billion, up from the $100 million threshold used during the campaign. The Biden plan would now also let companies subject to the tax get the benefit for tax credits for research, renewable energy and low-income housing—in a recognition that the campaign-trail version could have undercut the president’s preference to encourage companies to invest in those areas.
The result is that just 180 companies would even meet the income threshold and just 45 would pay the tax, according to administration estimates that assume the rest of the administration’s plan gets implemented. Nearly 1,100 U.S.-listed companies would meet the $100 million threshold, according to S&P Global Market Intelligence. Many of them would still face sharply higher tax bills from the rest of the Biden agenda, which raises rates on domestic and foreign income.
Small businesses will not pay higher taxes!
Biden's April 2021 vaccine goal is the same one Trump put out and was dismissed for by the media. Hmmm.

Given the evidence presented so far at the Floyd trial, it isn't fair for the judge to complete the trial to a jury verdict. Given the obviousness of the outcome, the jury should not be asked to risk their lives to vote their conscience.

What Marjorie Taylor Greene’s LARGE Fundraising Haul Tells Us
Vox:
“The very actions that got Greene kicked off her committee assignments and drew the ire of House Democrats helped boost her national name recognition — and led to a great deal of coverage in conservative media. Greene’s popularity among Republicans went up 11 percentage points in the days following the vote, with 30 percent of GOP voters viewing her favorably, according to a Politico/Morning Consult poll.
“Ultimately, Green’s big fundraising haul is a reminder that gaining notoriety on conservative media — rather than making efforts to pass meaningful legislation — is what holds real value in the modern Republican Party.”

In simple words, you can be a terrible, selfish, immoral, lying person like Trump and do well in what present day Republicanism has become.

Biden Picks Gun Control Advocate to Lead ATF
President Joe Biden is expected to nominate David Chipman, a former federal agent and adviser at the gun control group Giffords, to be director of the Bureau of Alcohol, Tobacco, Firearms and Explosives, the AP reports.
Politico:
“Biden will direct the administration to begin the process of requiring buyers of so-called ghost guns — homemade or makeshift firearms that lack serial numbers — to undergo background checks.
“Other executive actions remain unclear. But stakeholders have speculated that the president could announce
*regulations on concealed assault-style firearms;
*prohibitions on firearm purchases
for those convicted of domestic violence against their partners;
*and federal guidance on home storage safety measures.”
GO FOR IT, JOE! GO!

STAY OUT OF POLITICS, MCCONNELL SAYS
Extra Bonus Quote of the Day
YESTERDAY April 6, 2021 at 5:19 pm EDT
“My warning, if you will, to corporate America is to stay out of politics. It’s not what you’re designed for. And don’t be intimidated by the left into taking up causes that put you right in the middle of America’s greatest political debates.”
— Sen. Mitch McConnell (R-KY), quoted by the New York Times, issuing a warning to corporations.
McConnell’s position now seems to be that campaign donations are free speech, but actual speech is not.

McConnell Backs Off Warning to Corporate America
April 7, 2021 at 4:24 pm EDT
Sen. Mitch McConnell (R-KY)
backed off his “warning” that businesses should stay away from politics, the Wall Street Journal reports.
Said McConnell: “I didn’t say that very artfully yesterday.”
He clarified that companies are entitled to be involved in politics:
“My principle complaint is, they didn’t read the darn bill… There are many states right now after the new Georgia law, that are much more restrictive than the new Georgia law.”
BS, MITCH. IT'S SO BAD EVEN BIG COMPANIES ARE AFRAID THEIR EMPLOYEES AND CUSTOMERS WILL REBELL.
Relationships In Congress Still Frayed Post January 6
April 7, 2021 at 7:00 pm EDT By Taegan Goddard
New York Times:
“What has unfolded instead has been something of an uneasy détente on Capitol Hill, as Democrats reckon with what they experienced that day and struggle to determine whether they can salvage their relationships with Republicans — some of whom continue to cast doubt on the legitimacy of President Biden’s victory — and whether they even want to try.”
Said Rep. Veronica Escobar (D-TX) about working with Republicans:
“I don’t want to permanently close that door. But I can’t walk through it right now.”
WASHINGTON (AP) — President Joe Biden will unveil a series of executive actions aimed at addressing gun violence on Thursday, according to a person familiar with the plans, delivering his first major action on gun control since taking office.
He's also expected to nominate David Chipman, a former federal agent and adviser at the gun control group Giffords, to be director of the Bureau of Alcohol, Tobacco, Firearms and Explosives.
Two people familiar with the matter told The Associated Press that Chipman’s nomination is expected to be announced Thursday. The people could not discuss the matter publicly ahead of an official announcement and spoke to The AP on condition of anonymity. If confirmed, Chipman would be the agency’s first permanent director since 2015.
Biden has faced increasing pressure to act on gun control after a spate of mass shootings across the U.S. in recent weeks, but the White House has repeatedly emphasized the need for legislative action on guns. While the House passed a background-check bill last month, gun control measures face slim prospects in an evenly-divided Senate, where Republicans remain near-unified against most proposals.

Trump predicted most of what is happening in America. The speed in which Democrats are proving him right is stunning.
"New York, Michigan, Florida, Pennsylvania and New Jersey "
So , the focus is that 4 states are run by Socialist Democrats that have their state in lockdown and are doing it by the Biden Book.
Yet, Florida that is allowing work, income and living is no worse then those 4 states.
Unemployment
New York. 8.9%
New Jersey. 7.8 %
Michigan. 5.3 %
Pennsylvania 7.3 %
Florida 4.7%
So , The soul crushing Comparative states using the Biden Playbook are hurting their residents twice.

Total Covid1984 Deaths (per 100,000)
New York. 258
New Jersey. 278
Michigan. 174
Pennsylvania 198
Florida. 157
So, Florida has the lowest Unemployment, the best Economy and Least amount of deaths.
Jamie. thanks, that was fun.
Here are the highlights from Wednesday.
Sergeant Stiger testified that “no force should have been used” once Mr. Floyd was subdued, handcuffed and facedown on the pavement. “He was in the prone position, he was handcuffed, he was not attempting to resist, he was not attempting to assault the officers — kick, punch, or anything of that nature,” Sergeant Stiger said. The prosecution has argued that Mr. Chauvin’s force continued for far longer than necessary; in all, Mr. Chauvin pinned Mr. Floyd with his knee for about nine and a half minutes.
Responding to questions from the defense, Sergeant Stiger said that Mr. Floyd resisted arrest when the responding officers tried to put him in the back of a squad car. In that moment, Mr. Chauvin would have been justified in using a Taser, Sergeant Stiger said. The defense has suggested that people who do not appear to be dangerous to officers can quickly pose a threat. The line of questioning appeared to be an attempt to establish that Mr. Floyd had been combative at first, and therefore could have become so once again. Sergeant Stiger pushed back on the argument, saying that officers should use force that is necessary for what suspects are doing in the moment, not what they might do later.
Asked to interpret footage from a police body camera, Mr. Reyerson initially said Mr. Floyd appeared to say, “I ate too many drugs.” But in later testimony, Mr Reyerson changed his assessment and said that Mr. Floyd had actually shouted, “I ain’t do no drugs.” His revised judgment could chip away at Mr. Chauvin’s defense, which has tried to argue that Mr. Floyd died from complications of drug use, not the actions of Mr. Chauvin. A toxicology report found methamphetamine and fentanyl in Mr. Floyd’s system. Sergeant Stiger told the jury that he could not make out what Mr. Floyd said in that moment.
___
The defense team had a tough day. They claimed that he died of drug overdose, but since they continued to kneel down on his neck and shoulders and yes on his neck. For three minutes after he quit breathing.

So he hears it one way during cross examination. "I ate too many drugs"
State asks for a break.
After break the witness comes back on redirect and provides a different answer? He actually provide an answer of jibberish that makes no sense under the context.
Only a complete idiot would fall for that.
The jury will be able to hear the tape and view it under context. There was no reason at that point to "deny" that he did drugs, especially since he had previously used that same gambit (previously complaining about being high on drugs so he could be taken to the ER instead of Jail).
It worked for him once, why not try it again?
We all heard the tape. We all know exactly what he said.
The defense team had a tough day. They claimed that he died of drug overdose, but since they continued to kneel down on his neck and shoulders and yes on his neck. For three minutes after he quit breathing.
What the fuck does that even mean, Roger?
That because someone had a knee on someone else that drugs can no longer kill them?
Please explain?
So, Florida has the lowest Unemployment, the best Economy and Least amount of deaths.
