How the prosecutors "snookered" the court system regarding Chauvin.

Take a little time to read through these.

609.224 MISDEAMOR ASSAULT IN THE FIFTH DEGREE. 
(1) commits an act with intent to cause fear in another of immediate bodily harm or death; or (2) intentionally inflicts or attempts to inflict bodily harm upon another. 

 609.223 FELONY ASSAULT IN THE THIRD DEGREE. 
(1) Substantial bodily harm. Whoever assaults another and inflicts substantial bodily harm may be sentenced to imprisonment for not more than five years or to payment of a fine of not more than $10,000, or both.

609.20 MANSLAUGHTER IN THE FIRST DEGREE. 
(2) violates section 609.224 and causes the death of another or causes the death of another in committing or attempting to commit a misdemeanor or gross misdemeanor offense with such force and violence that death of or great bodily harm to any person was reasonably foreseeable,

609.19 MURDER IN THE SECOND DEGREE.
(1) causes the death of a human being, without intent to effect the death of any person, while committing or attempting to commit a felony offense other than criminal sexual conduct in the first or second degree with force or violence or a drive-by shooting

So in the simplest terms, a misdemeanor assault can turn into a felony assault if the end result includes substantial bodily harm, even if there is not an intent to inflict that harm.  To take it one step further, a simple misdemeanor assault can turn into first degree manslaughter if the end result is death of the victim, even if there is not an intent to kill.

Based on the argument of the prosecution Derek Chauvin knee to the back was assault. Jerry Blackwell went so far as to explain to the jury that it didn't matter that Chauvin might not have intended to inflict any bodily harm, Chauvin "intended" to put his knee on Floyd's back and that provided enough to prove necessary intent and prove assault. A wrong interpretation of the statute, but par for the course.

Now here is where it gets clever. Had the State introduced first degree manslaughter as a charge, then the logic (as applied by Blackwell) would have fallen under the umbrella of Chauvin committing an assault, with the unintended consequence of that assault being the death of George Floyd. This is textbook manslaughter.

But by not introducing First Degree Manslaughter, they instead simply made the argument that the unintended consequence of the knee to the back (simple misdemeanor assault) was substantial bodily harm, rather than death. They don't ever argue what that substantial injury (other than the actual death was) but what does that matter?

They go on to argue that the substantial bodily harm  now make the "misdemeanor assault" a "felony assault" and that the unintended consequences of that "felony assault" was death, and therefore second degree murder. 

The bootstrap argument.

While this is clever, for all practical purposes it would render the concept of first degree manslaughter stemming from assault to be obsolete. Obviously a prosecutor could argue that every assault that leads to death could be considered at some point in time prior to death to be a felony assault. After all, there has be great bodily harm administered almost by definition for someone to have died from an assault. 

The fact that prosecution argued that intent didn't matter would make the first degree manslaughter even less viable. Every assault that leads to death regardless of intent would be second degree murder rather than manslaughter.

Now some may argue that every assault that leads to death should be murder rather than manslaughter. Hey, whatever blows your hair back. But that is not the law here in Minnesota or anywhere else for that matter. Either way, the prosecution just made a mockery of our laws, and Judge Cahill was either a victim of or an accessory to this mocking. 
 
Bottom Line: The manner in which they argued the facts here was a classic first degree manslaughter argument. But they chose not to charge him with it. Likely because that was the law that best fit their case, and they were desperate for a murder charge.  By eliminating it, they bet that the jury would not be willing to hand down a simple second degree manslaughter charge because of the charged political nature of the case. Obviously they bet correctly.

Expert witnesses differed over the cause of Floyd’s death. The police restraint was the most obvious culprit, but the defense pointed to Floyd’s severe heart disease and that he had recently consumed fentanyl and methamphetamines, which can interfere with cardiopulmonary function. But police witnesses for the prosecution said Mr. Chauvin had violated standard police practice.

The multiracial jury appeared to have little doubt about the facts and law, as it returned the verdicts after only 10 or so hours of deliberation. The second-degree murder charge, the most severe, carries a maximum sentence of up to 40 years in prison. Unless the verdict is overturned on appeal, the 45-year-old Mr. Chauvin is likely to live behind bars for more than a decade.

It would be nice to think all of this would prompt reflection among those who have exploited Floyd’s killing for political purposes. But it probably won’t. Even after the verdict, commentators who applauded the jury gave last year’s riots in American cities the credit for inspiring it.

Not the facts. Not the law. But lawless protests. If a large faction of Americans really believe that only mayhem in the streets can guarantee justice in America, then this verdict will mean little and we are in for far more unrest ahead.

On this point, President Biden has been little help, despite his inaugural pleas for unity and healing. On Tuesday before the verdict, Mr. Biden said he was “praying” for the jury to reach “the right verdict” and that the evidence was “overwhelming.” That’s an outrageous interference with the administration of justice. Though the jury was sequestered at the time, it’s possible word of his comments could have made it to the jury had their deliberations gone on. That could have been grounds for a mistrial. Someone should ask the new Attorney General, Merrick Garland, what he thinks of those needless presidential comments.

The case also isn’t over. Mr. Chauvin’s fellow arresting officers will go on trial later this year. And Mr. Chauvin’s lawyers are sure to use the political atmospherics surrounding the case as grounds for appeal.

One defense witness had his former house vandalized, which might have unsettled some jurors about the implications of an acquittal. The city settled a civil case with Floyd’s relatives that wasn’t shielded from the jury. Trial Judge Peter Cahill said Monday that Rep. Maxine Waters’s weekend call in nearby Brooklyn Center that protesters should get “confrontational” in the event of an acquittal could be grounds for mistrial on appeal.

As the cases move ahead, the politicians and media elites should be calming tempers, not inflaming them. The verdict showed that the legal system isn’t systemically racist, and that a police officer who exceeded his power can be found guilty. The challenge as always is to let police defend the innocent and public order while punishing those who misuse their power. American justice isn’t perfect, but it works.

Floyd died while Chauvin kneeled on his neck for over nine minutes, long past the time that Floyd was resisting or even a threat, and the jury found Chauvin was directly responsible for the man’s death. Bryant died after being shot multiple times in the process of attempting to stab another person. Yet, both deaths are being blamed on bad policing, regardless of the facts of the case.

Yes, Floyd’s death could absolutely have been avoided. The justice system worked, and Chauvin will be punished for killing Floyd. The officer who shot and killed Bryant is currently off patrol duty while the shooting is being investigated. There is currently not enough evidence to say it was a bad shooting, though. In fact, the video evidence and the 911 call that brought officers to the scene both heavily suggest Bryant was the aggressor and officer made a tragic, but correct, decision that, by the evidence we currently have, saved lives

Perhaps some of them are dim enough or deluded enough to believe that the votes were illegitimate. But if anything, that’s the best-case scenario. It’s even scarier that some members of this group knew that there was no legitimate reason to object to counting the votes, but voted to overturn the election anyway.

And yet, 12 weeks later, we’re debating corporate tax rates, Dr. Seuss, and trans bathroom access, like nothing ever happened.

Tensions were high in a small North Carolina city on Wednesday after a sheriff’s deputy shot and killed a Black man.

Deputies were executing a search warrant Wednesday morning in Elizabeth City when Andrew Brown Jr. was shot, the Pasquotank County sheriff said.

The sheriff, Tommy Wooten, offered few other details about what happened and said the State Bureau of Investigation is taking the lead.

Protesters gathered in the town Wednesday evening as the city council hosted an emotional emergency meeting.

Here’s what we know so far about Brown.

Andrew Brown Jr. was shot and killed when deputies were executing a search warrant Wednesday morning in Elizabeth City.

A father and friend
Brown was 42 years old, online records show. He was a father of 10, WAVY reported.

Brown’s son, Khalil Ferebee, said his father didn’t own guns, according to the The Virginian-Pilot.

“He wasn’t a violent person,” Daniel Bowser, who said he and Brown were friends for nearly 30 years, told The News & Observer. “He didn’t mess with guns, he didn’t tote no guns.

“I don’t care what they put out there, he didn’t deserve to die.”

A grandson and nephew
Brown’s grandmother, 92-year-old Lydia Brown, told The Associated Press she learned of his death on the news.

“I am upset. Andrew was a good person,” she said. “[The deputy] didn’t have to shoot him like that.”

Clarissa Brown Gibson, his aunt, said she didn’t understand how her nephew’s encounter with deputies cost him his life, the AP reported.

“We want to know if he was served with a warrant, why they shooting over a warrant?”

Another aunt, Martha McCullen, said she raised Brown after the death of his parents.

“The police didn’t have to shoot my baby,” McCullen told the AP. “Andrew Brown was a good person. He was about to get his kids back. He was a good father. Now his kids won’t never see him again.”

‘Beautiful smile, infectious laugh’
Jadine Hampton told the website Heavy that Andrew Brown was her cousin. She said she last saw him in October, during a birthday celebration for a family member.

“We exchanged numbers with hopes of him visiting me in Atlanta once the pandemic lifted,” she sad. “He had a beautiful smile, infectious laugh. A great storyteller like a comedian. A wonderful father, who pushed his kids to be honor roll students even though he never finished school.”

Many people noted that Brown’s death came one day after former Minneapolis police officer was convicted of murder in the death of George Floyd, an unarmed Black man — and also one day after police in Columbus, Ohio, shot and killed a 16-year-old Black girl.

51% White, 26% Black, 19% Hispanic, 2% Asian, and 2% Native American victims
23% of victims showed signs of mental illness, indicated by on-scene mental health crises or news reports
91% of victims were determined to be armed, with objects ranging from toy weapons to pepper spray to tasers to guns

Lisa Christensen sat through every minute of the trial of Derek Chauvin as prosecutors and the defense each made their case in the killing of George Floyd.

She was an alternate juror, so she did not have a role in the verdict, but in an exclusive interview for "CBS This Morning," she said she was happy with the jury's decision to convict Chauvin after weeks of hard testimony. Christensen said she was reluctant to be on the jury when she was first called up.

"I was worried about, you know, whatever the verdict may be if some people felt strongly on one side, other people felt strongly on the other side. So no matter what, I felt like somebody wasn't going to be happy," Christensen told CBS News' Jamie Yuccas.

She was known to the court as juror number 96, and even though she wasn't part of the deliberations, she came to a decision.

"I felt he was guilty. They read the jury instructions to us in the courtroom briefly, but I didn't know it was going to be guilty on all counts but I would have said guilty," Christensen said.

"Why did you think he was guilty? What led you to that belief?" Yuccas asked.

"I just felt like the prosecution made a really good, strong argument. Dr. Tobin was the one that really did it for me. He explained everything. I understood it down to where he said this is the moment that he lost his life, really got to me," she replied.

During the 13 days of sometimes tense and emotional testimony and cross-examination, both the prosecution and defense promised the jury that they were going to prove their case, but Christensen said only one side did.

"So who made an impact with the defense? Good or bad?" Yuccas asked.
"I don't think they had a good impact," Christensen said in reference to Chauvin's defense team.

"I think he over-promised in the beginning and didn't live up to what he said he was going to do," Christensen said.

The prosecution did have a witness that made an impact on Christensen - Darnella Frazier, the teen who filmed the video showing Chauvin pressing his knee into Floyd's neck for more than nine minutes.

"I really felt that she felt guilty for not doing more and she feels responsible in a way, and I feel really bad for her. But I commend her on taking the video because, without her, I don't think this would have been possible," Christensen said.

The nine-and-a-half minute video has been seen worldwide by millions of people, but up until the trial, Christensen hadn't watched it in its entirety. She went from watching pieces of it two or three times on the news to watching the full video several times.

"It was emotional. I think my eyes teared up a couple of times, so especially seeing it from different angles and things," she said.

Christensen said she locked eyes several times with Chauvin during the trial due to seating arrangements. She said she was "pretty uncomfortable" and got another impression of him as she watched the video.

"I felt like he was the leader, and the other officers were following his lead. I kind of felt like he wasn't taking the warnings seriously, obviously, kind of like I know what I'm doing," Christensen said.

Christensen and another alternate juror were excused after Judge Peter Cahill sent the jurors to deliberate. Two days later, and after more than 10 hours of deliberation, Chauvin was found guilty of unintentional second-degree murder, third-degree murder, and second-degree manslaughter in George Floyd's death. He faces decades in prison and will be sentenced by Judge Cahill in about eight weeks.

While the trial may be over, Christensen said it will have an impact on her a while.

"I just don't understand how it got from a counterfeit 20 dollar bill to a death. It kind of shocks me," she said.

We must face the hard truth that Chauvin is more of a symptom than a cause of policing’s problem.


To end this cycle of traumatic police violence, we have to recognize that we have turned policing into an impossible endeavor — one that underprotects communities even as it needlessly provokes conflict. It is not realistic, and perhaps not even reasonable, to expect that police will ever be able to carry out the multiple, often conflicting tasks we’ve given them in a manner that is consistently lawful, ethical and effective. Holding individual officers accountable for their actions, and investigating departments to remedy systemic misconduct, are part of the solution, but we must also continue to reimagine safety and the role police play in helping to achieve it.

No proof was ever offered that Chauvin’s knee killed George Floyd, because no such proof could ever be offered. The very notion was ridiculous. Floyd died from a lifetime of health-destroying decisions coupled with the lethal amount of drugs in his system. If Floyd hadn’t died on camera, nothing would have happened. Instead, for political expediency, Chauvin was made into a human sacrifice. He was disowned by the state he served and the public he protected.

Chauvin was never going to receive a fair trial.
