Why the Capital Riot prosecution is a reach and why it may eventually backfire...

The main charges you will see if you look through the list of people the Government is charging in relation to the Capital Riot on January 6th.
  • "Knowingly enters or remains in any restricted building or grounds without lawful authority to do so.” 18 U.S.C. §1752(a)(1).
  • "Knowingly, and with intent to impede or disrupt the orderly conduct of Government business or official functions, engages in disorderly or disruptive conduct in, or within such proximity to, any restricted building or grounds when, or so that, such conduct, in fact, impedes or disrupts the orderly conduct of Government business or official functions.” 18 U.S.C. §1752(a)(2).
In some cases, they are simply duplicating the same charges under different statutes.
  • Utter loud, threatening, or abusive language, or engage in disorderly or disruptive conduct, at any place in the Grounds or in any of the Capitol Buildings with the intent to impede, disrupt, or disturb the orderly conduct of a session of Congress or either House of Congress, or the orderly conduct in that building of a hearing before, or any deliberations of, a committee of Congress or either House of Congress; 40 U.S. Code § 5104 (2)(D)
  • (parade, demonstrate, or picket in any of the Capitol Buildings.40 U.S. Code § 5104 (2)(G)
Yes - it is true. There is a law against even a peaceful protest at the Capital Building (who knew) and our Federal Government is looking to charge people who are not being accused of anything violent or destructive with a Federal crime. In some cases, they are holding people without bail.

But here is the rub... none of these particular charges are anything more than a misdemeanor, and the normal sentencing for a person with no prior criminal record would be a fine with no jail time. The maximum (even for a repeat offender) is one year, which would be a fraction of that if actually served.

In order for any of this to be more than a misdemeanor is if they were carrying a firearm in the building or if they knowingly engages in an act of physical violence that results in substantial bodily harm. So far only four people were charged with having firearms and not sure that any of those people were also in the building. So these seem to be rather harmless charges for something being called by some as akin to an attempted overthrow of the Government. 

So they keep on keeping on!

The latest charge that they appear to be adding is impeding law enforcement. This charge has been added to approximately two dozen people . Yep, just like a peaceful protest at the Capital building is a crime, not following orders from law enforcement during a protest is also a crime.  If you read the charges, it's basically something that anyone, in any protest, who refuses to yield to law enforcement could be charged with.
  • Whoever commits or attempts to commit any act to obstruct, impede, or interfere with any fireman or law enforcement officer lawfully engaged in the lawful performance of his official duties incident to and during the commission of a civil disorder which in any way or degree obstructs, delays, or adversely affects commerce or the movement of any article or commodity in commerce or the conduct or performance of any federally protected function—18 U.S. Code § 231 (A)(3)
This charge could be considered a class E felony (up to five years) but it opens up a whole can of worms as we look at all of the BLM and Antifa protests that are still raging in many parts of the country. If you are going to charge "some" people who otherwise were peaceful with a class E felony for obstructing or impeding law enforcement, how do you justify allowing the vast majority of violent protesters off without so much as a warning as they stand off against police and quite literally engage them physically?

Lastly, about two dozen people have the term "conspiracy" add to their charges in most part because they traveled to or otherwise participated in the event together. Now interestingly enough this is only attached to cases where there is something that might qualify as a Class E felony (because conspiracy to commit a misdemeanor has no additional penalty).  Destruction of Federal property and the before above mentioned Impeding or Interfering with law enforcement during a civil disorder seem to be the underlying crimes that they "conspired" to commit. 

The reality here is that this is not just overzealous prosecution. This is quite literally legal hypocrisy as they are looking to specifically charge people in this situation where they refuse to charge others for the same (if not worse) behavior in other situations.

Either way, with the news that Officer Sicknick was not murdered and the so called bear spray assault never actually happened, this is starting to look more and more politically motivated. With Biden and the Democrats doubling down on the idea that White Supremacy and Racism is the reason for everything, eventually people will start to push back. The constant political drumbeat, cancel culture, and censorship of political speech is one thing. Holding people without bail because you don't like the reason for this protest is quite another.

Trump had fomented the violent uprising, telling his supporters earlier in the day that they should walk to the Capitol to protest the election results. Inside, some Republican lawmakers had said they would object to the results and promoted far-fetched ideas that the election outcome could be overturned.

Debates surrounding certifying Biden's win were delayed until the complex had been secured, but his victory was ultimately certified by vote in the early morning hours Thursday.

"We have just been through an intense election and emotions are high. But now tempers must be cooled and calm restored. We must get on with the business of America," Trump said in the Thursday address, without acknowledging or taking responsibility for the role he played in inciting the crowd.

Trump's remarks came after a cabinet secretary resigned and several aides quit. White House press secretary Kayleigh McEnany had earlier condemned the violence on "behalf of the entire White House."

New videos released by the Department of Justice show the assault on Capitol Police Officer Brian Sicknick, who died of natural causes after engaging with rioters during the Jan. 6 attack on the U.S. Capitol.

The videos have been entered into evidence in the criminal cases against Julian Khater, 32, of State College, Pennsylvania, and George Tanios, 39, of Morgantown, West Virginia. They are accused of spraying Sicknick and others with chemical spray, but not of causing his death.

The video was taken by six surveillance cameras, three Washington, D.C., police body cameras and one bystander cellphone video, the Justice Department said.

The videos show Sicknick and other officers being hit by a chemical spray and immediately falling back while a crowd of rioters grapple with police and attempt to push past a barricade. Another video shows Sicknick washing his eyes out and recovering after he’s been sprayed.

Tanios and Khater were indicted in March on 10 counts, including conspiracy to injure an officer, assault on a federal officer with a dangerous weapon and engaging in physical violence in a restricted area.

The Washington Medical Examiner released a report last week concluding that Sicknick had died of natural causes the day after the riot after suffering two strokes at the base of his brain stem.

The videos released Wednesday have been described by prosecutors and played in court, but have not been previously released outside the courtroom.

Dr. Steven Koonin, the former undersecretary for the Department of Energy under President Obama, is calling out the Biden administration for its position on the “climate crisis” and says the data doesn’t support the “hysteria.”

“What I realized, is that, although you hear people talking about ‘we’re going to believe in the science, the science is settled, we’ve got an existential crisis’ – when you actually read the science, it doesn’t support that kind of hysteria at all,” he said in an interview with Fox News last week.

Koonin explained that according to the data in the assessment reports from the United Nation’s Intergovernmental Panel on Climate Change (IPCC) and the U.S.’s National Climate Assessment, there is no justification for radical measures proposed by Joe Biden’s climate agenda.

Joe Biden’s plan, announced during a two-day climate summit that began on Earth Day, calls for the slashing of carbon emissions by over half in less than ten years, and the United States becoming a zero-emissions economy by 2050.

“Eventually we will probably need to do something about this, but the scope and scale of what the Biden administration proposed for the U.S., I think is just not there in the data,” he said, adding, “It’s not there in the science.”

“For example, both research literature and government reports state clearly that heatwaves in the US are now no more common than they were in 1900, and that the warmest temperatures in the US have not risen in the past fifty years,” Koonin wrote in the New York Post last week. “When I tell people this, most are incredulous. Some gasp. And some get downright hostile.”

Koonin also noted that humans have had “no detectable impact on hurricanes over the past century,” that “Greenland’s ice sheet isn’t shrinking any more rapidly today than it was 80 years ago,” and that the “global area burned by wildfires has declined more than 25 percent since 2003 and 2020 was one of the lowest years on record.”

“Trillion-dollar decisions about reducing human influences on the climate should be informed by an accurate understanding of scientific certainties and uncertainties,” says Koonin. He also called much of the public portrayal of climate science “an effort to persuade rather than inform, and the information presented withholds either essential context or what doesn’t ‘fit.”

A commitment to the rule of law also means calling out where it’s being abused, that is, where rhetoric of “law and order” is used as a means to intimidate communities here at home, or where law is used as means to control and oppress, abroad.

The second is to recognize that working to diffuse domestic political polarization is a national security imperative. Political disagreement and debate are hallmarks of a healthy democracy. Destructive political polarization makes America weaker. Our foreign adversaries seize on these divisions, amplify them on social media, and use them to undermine American society. We saw this take place when Russian agents exploited racial divisions to exert influence in the 2016 election, and we see it again as they seize on misinformation concerning the efficacy of coronavirus vaccines. Political polarization and extremism are also taking root in the U.S. military and law enforcement communities. Focused efforts to reaffirm the apolitical nature of military and law enforcement service will be important in the years ahead.

The third is to strengthen our national security institutions, especially those involved in domestic security. This does not mean making them bigger or giving them more legal authorities at the expense of privacy. Instead, strengthening them means keeping their legal authorities relevant and useful, and giving them the access to people, technologies, and tools that will enable them to work more creatively and smarter. It also means investing in oversight, accountability and transparency to better provide an environment that enables the national and homeland security enterprise to do its work for the American people, and not be perceived as just an imposition on them.

In his address to the joint session of Congress on April 28th, President Biden emphasized that our democracy has been severely tested over the past year. And in his first major speech articulating the Biden administration’s foreign policy on March 3rd, Secretary of State Antony Blinken emphasized that disinformation, racial inequality and polarization are contributing to a weakening of American democracy at home. If left unaddressed, this weakening will contribute to a loss of confidence in the United States the eyes of our allies and partners. That strain on international partnerships will leave us less safe in the world, whether from a military aggressor or an invisible virus.

Focused attention on strengthening the foundations of our democratic system does not need to come at the expense of attention to other recognized threats that fall under traditional concepts of national security. Instead, this focused effort is critical to remind the national security and foreign policy public servants what, exactly, it is they are out there every day and night defending.

The Biden Justice Department is “actively considering” whether to give prosecutors new authorities to bring specific charges against “domestic terrorists.”

“One of the things we’re looking at is would we need new authorities,” Brad Wiegmann, deputy assistant attorney general for the department’s national security division, said Thursday.

Because the current laws on the books to bring charges for arson, violations of weapons or explosives laws isn’t enough.

The reality is the DOJ is looking to make new laws to persecute people with whom they politically disagree.

The Justice Department did not mention BLM terrorists or Antifa terrorists; they are focused on so-called “white supremacists” – which is just code for Trump supporters/conservatives.

The FBI said white supremacists pose the most lethal threat despite the fact that BLM and Antifa have caused billions in damage, killed dozens of people and burned countless buildings to the ground over the last year.

Bloomberg reported that Wiegmann told a House Appropriations subcommittee that the one question the DOJ is wrestling with is: “Are there gaps?”

“Is there some type of conduct that we can envision that we can’t cover or would it be an otherwise benefit in having something else other than what we’re having now?” Wiegmann said, admitting the DOJ is looking to politically persecute conservatives.

“Currently, no U.S. law lets the government designate domestic extremists as terrorists or bring specific charges for domestic terrorism. That contrasts with laws to combat international terrorism, which allow the government to designate groups and bring charges for providing those groups with material support.” Bloomberg reported.

“This is a cancer on our country,” said Rep. Matt Cartwright (D-PA), chairman of the subcommittee. “Right-wing extremist attacks and plots have greatly outnumbered those from all other groups combined and caused more deaths as well.”

Again, no mention of BLM or Antifa terrorists and no mention of black on black violence that kills hundreds of blacks every year in Chicago.

Not a word about blacks attacking Asians. The Biden regime is specifically hunting down white people.

A man has been ordered to pay $12m (£8.6m) for his role setting a Minneapolis police station on fire during rioting last May.
