Juror No. 52, Brandon Mitchell, answered “no” to two questions in the juror questionnaire that asked about participation in demonstrations
The Post-Millenial was the first to reveal a pre-trial photo of Juror No. 52, Brandon Mitchell, in a T-shirt with an image of George Floyd and the words “Knee Off Our Necks.” As you may recall from the trial, the assertion that pressure from Chauvin’s knee to Floyd’s neck caused Floyd’s death was not the theory put forward by the prosecution’s medical experts, who asserted that Floyd died from positional asphyxiation being held face down in the prone position with pressure from three officers on his back and legs. The prosecution’s own experts acknowledged that Chauvin’s knee was mostly on Floyd’s upper back and back of the neck, and he did not die from damage to the structures of the neck, of which there was none.
Two problems with this. First would be that the jurist in question has actually committed perjury and could be charged with a crime. The Second is that if a jurist lies on their juror questionnaire that it could be grounds for a mistrial. Obviously most of America cares very little if Brandon Mitchell might be charged with a crime, but they might be very concerned about a possible mistrial.
Does that mean that anyone is predicting that this will cause a mistrial?
- Change of venue was justified and denied
- Request to delay trial in wake of $27 million settlement offer was justified and denied
- Request to sequester jurists was justified and denied
- In spite of judge specifically warning prosecution that bringing up a subject was grounds for a mistrial, the prosecution brought it up and there was no mistrial.
So any sort of appeal success seems a longshot here. No matter how justified a mistrial might be given this situation, I doubt very seriously that the Judge will declare one. Legal experts claim that some sort of hearing is almost a foregone conclusion. Something where this Jurist is questioned about this protest and his participation. But...
I know it's one thing for a Judge to take someone at their word when they claim that they are impartial. But it's another when they want to claim that a rally that included the family of George Floyd addressing the crowd and passing police reform in George Floyd's name had nothing to do with Floyd. But... still.
I think it's hard to imagine that Brandon Mitchell really doesn't recall that he was wearing this particular t-shirt or that being from Minnesota that he didn't notice that the family of George Floyd was there addressing the crowd. That seems a little too far fetched at this point. But will something this obvious be enough to overturn a conviction? Doubtful.
Even it it would... I suspect that Federal Marshals would be waiting in the wings to arrest Chauvin the moment he is set free.

If he was acquitted there was already a plan to immediately arrest him on other bullshit charges.
If there IS any justice Chauvin is freed and Ellison is locked up for life.
