Is this the final nail in the coffin?

MANCHIN STATEMENT ON INFRASTRUCTURE AND RECONCILIATION NEGOTIATIONS

Washington, DC – Today, U.S. Senator Joe Manchin (D-WV) released the following statement about infrastructure and reconciliation negotiations.

“Every Member of Congress has a solemn duty to vote for what they believe is best for the country and the American people, not their party. Respectfully, as I have said for months, I can’t support $3.5 trillion more in spending when we have already spent $5.4 trillion since last March. At some point, all of us, regardless of party must ask the simple question – how much is enough?

What I have made clear to the President and Democratic leaders is that spending trillions more on new and expanded government programs, when we can’t even pay for the essential social programs, like Social Security and Medicare, is the definition of fiscal insanity. Suggesting that spending trillions more will not have an impact on inflation ignores the everyday reality that America’s families continue pay an unavoidable inflation tax. Proposing a historic expansion of social programs while ignoring the fact we are not in a recession and that millions of jobs remain open will only feed a dysfunction that could weaken our economic recovery. This is the shared reality we all now face, and it is this reality that must shape the future decisions that we, as elected leaders, must make.

Since the beginning of this reconciliation debate, I have been consistent in my belief that any expansion of social programs must be targeted to those in need, not expanded beyond what is fiscally possible. Our tax code should be reformed to fix the flaws of the 2017 tax bill and ensure everyone pays their fair share but it should not weaken our global competitiveness or the ability of millions of small businesses to compete with the Amazons of the world. Overall, the amount we spend now must be balanced with what we need and can afford – not designed to reengineer the social and economic fabric of this nation or vengefully tax for the sake of wishful spending.

In August, I recommended we take a strategic pause to provide time to develop the right policies and to continue to monitor how the pandemic and economic factors are affecting our nation’s fiscal situation before we spend more. Throughout September, I have made it clear to all those who would listen the need to means test any new social programs so that we are helping those who need it the most, not spend for the sake of spending.

While I am hopeful that common ground can be found that would result in another historic investment in our nation, I cannot – and will not - support trillions in spending or an all or nothing approach that ignores the brutal fiscal reality our nation faces. There is a better way and I believe we can find it if we are willing to continue to negotiate in good faith.

If there is one final lesson that will continue to guide me in this difficult debate ahead it is this: America is a great nation but great nations throughout history have been weakened by careless spending and bad policies. Now, more than ever, we must work together to avoid these fatal mistakes so that we may fulfill our greatest responsibility as elected leaders and pass on a better America to the next generation.

Betting here is that Schumer will lay the 3.5 (5) trillion reconciliation bill on the table rather than suffer the embarrassment of it being voted down with a bipartisan majority .

He actually believes in the same thing I have from the Reagan era.

He wants bottom up economics, by taxing the rich and again keeping it limited to people who make more than $400,000 per year.

So if the Democrats pass the infrastructure bill, even if the reconciliation process is delayed, it will be voted on next year.

Because like someone else said that she is throwing the liberals under the bus.

Politico reported on topic...

Joe Manchin proposed a deal to Senate Majority Leader Chuck Schumer this summer to limit the total cost of Democrats' sweeping spending bill to $1.5 trillion, according to a copy of the agreement obtained by POLITICO.

Manchin also suggested beginning debate no earlier than Oct.

The West Virginia senator has been distributing the document to Democratic colleagues and leaders in recent days to underscore that he has outlined his red lines on President Joe Biden’s jobs and families plan. The one-page understanding is dated July 28, right before the Senate passed a bipartisan infrastructure bill that Manchin helped write and ahead of Senate passage of a budget setting up a spending bill as large as $3.5 trillion.

In the document, Manchin proposes raising the corporate tax rate to 25 percent, the top tax rate on income to 39.6 percent, raising the capital gains tax rate to 28 percent and says that any revenue from the bill “exceeding” $1.5 trillion will go to deficit reduction.

----

In effect it increases the taxes to pay for half of the costs. $1.5 trillion pays for part of the $3.5 trillion
.

Sanders, Pelosi, the Squad, and others are threatening to pull their support for the bipartisan infrastructure bill if they do not get their way on the reconciliation bill.

For them to accept that Manchin and the Senate will "look at this" a year from now would be a huge slap across their collective faces. So, the question is whether or not the progressives (as a whole) will all bend a knee to Manchin, Sinema and the moderates in the Senate.

At the end of the day, I believe that they will suck it up and bend a knee on this one. But I never underestimate the stupidity of the hardcore politicians on either side of the aisle. They seem very willing to cut off their own noses to spite their faces.

He added that Democrats need to elect more liberals if they want to go above his $1.5 trillion top line.

I just wonder what is going on? Schumer already knew it.

Coldheartedtruth Teller said...

Interesting day.

Republicans and Democrats in the Senate worked together to pass the infrastructure bill earlier this summer, but Democratic leaders, including President Joe Biden, said they would only enact the legislation if it passed with the much broader social spending bill that Democrats believe could define their legacy for generations. They intend to pass the bigger bill using the special budget reconciliation process that would let them bypass the GOP in the Senate — but given their tiny majorities in both chambers, Democratic leadership needs almost every Democrat on board in order to succeed. The standalone infrastructure bill has been waiting on a House vote since early August.

When a reporter asked if Thursday’s vote would be delayed if it appeared the bill lacked support, Pelosi sidestepped the question. She had noted Wednesday that she had the power to delay the vote if she wanted.

“I do not plan on not doing anything,” she said Thursday. “I plan on moving forward in a positive way.”

------

If they pass it today it will be significant by the President soon after.

Coldheartedtruth Teller said...

Actually Scott I believe that they will work out a plan to compromise on this situation.

(Bloomberg) -- Democratic Senator Joe Manchin wants the tax and social spending bill that would encompass the bulk of President Joe Biden’s economic agenda whacked back to $1.5 trillion -- less than half the outline written by congressional Democrats.

Manchin told reporters Thursday that $1.5 trillion remains his so-called topline for the bill, as he had outlined in a memo over the summer. The West Virginia moderate said Democrats could then campaign on the rest of the items in the current $3.5 trillion draft package during the November 2022 midterm elections.

Progressive Democrats have argued that they already compromised on the “reconciliation” bill, which spans spending on health, education and climate initiatives. Senate Budget Committee Chair Bernie Sanders had originally aimed for $6 trillion.

In a memo dated July 28 made public Thursday, Manchin also called, as a basis for the outline of the social-spending bill, to wait until the Federal Reserve ended its quantitative easing policy. Since that list of demands was made, Congress passed -- with Manchin’s vote -- the budget resolution outline the memo was addressing. The Fed has also now signaled that it will soon start phasing out its asset-purchase program.

Because even the liberals are not going to destroy Joe Biden's campaign promises.

He is actually the most liberal Democrat President in history.

He won the election by hiding in the basement!

Government shutdown looms as Senate approves funding bill hours before deadline

The bill will quickly head to the House, where it is expected to pass.

TAP TO UNMUTE

Sept. 30, 2021, 7:47 AM PDT / Updated Sept. 30, 2021, 10:55 AM PDT

By Teaganne Finn and Sahil Kapur

WASHINGTON — The Senate passed a stopgap government funding measure on Thursday to prevent a shutdown, approving the measure hours before the midnight deadline.

The Senate voted 65-35 in a display of bipartisanship, to advance the measure. The bill will then go to the House, which needs to pass it before it goes to President Joe Biden’s desk for his signature.

Earlier in the week the Senate blocked the House version of the bill in a procedural vote because of Republican opposition to extending the debt ceiling, which for political reasons they want to force Democrats to approve on their own.

House Speaker Nancy Pelosi said the House would pass the short term government spending measure on Thursday.

"We hope it will be a strongly bipartisan bill, Pelosi told reporters during her weekly press conference. "It will happen today."

An amendment to the spending bill from Sen. Roger Marshall, R-Kan., sought to prohibit federal funds from being used to enforce Covid-19 vaccine mandates, but it failed on a 50-50 vote, with all Republicans in favor and Democrats opposed.

If the spending bill is not enacted, the federal government would face a shutdown beginning Friday. The deal announced by Schumer would keep the government open through Dec. 3.

Coldheartedtruth Teller said...

The infrastructure bill will probably pass sometime today. By midnight

House Speaker Nancy Pelosi (D-Calif.) said she's moving full steam ahead with her plans to hold a vote on the Senate-passed bipartisan infrastructure bill on Thursday, sounding optimistic about the bill's chances despite progressive Democrats threatening to sink it.

Why it matters: Today's vote — should it occur — will be a crucial indicator of how long it will take, and how difficult it will be, to pass President Biden's agenda.

The impact is less about deadlines (they've been set arbitrarily by leadership), and more about the broader power struggle within the party.Pelosi has repeatedly made clear she doesn't plan to put the bill on the floor unless it has the votes to succeed.

What she's saying: "We are proceeding in a very positive way" to pass the $1.2 trillion bipartisan infrastructure bill, Pelosi told reporters at her weekly press conference this morning.

"We're on the path to win the vote," she added.

Yes, but: Almost immediately after Pelosi projected confidence in today's vote, House Majority Leader Steny Hoyer (D-Md.), No. 2 in House leadership, told Politico he isn't confident the vote will succeed.

Between the lines: As late as Wednesday evening, progressives were still digging in their heels that, at a minimum, the House, Senate and White House strike specific agreement — including a price tag — on the reconciliation package before voting on the infrastructure bill.

I still believe that not enough liberals will not vote no.

The spokesperson is reportedly talking about a segment from MSNBC’s Morning Joe about claims that a deal has been struck with the senator.

Sen. Joe Manchin (D-W.Va.) announced Thursday that his top-line spending number for the budget reconciliation package is $1.5 trillion, far below the $3.5 trillion spending goal set by the budget resolution that he and every other Senate Democrat voted for last month.

“My top-line has been $1.5 [trillion],” he said, explaining that he doesn’t want “to change our whole society to an entitlement mentality.”

Manchin also said that he had shared his figure with President Biden.

This depends upon the outcome of the vote today on the infrastructure bill today.

The reconciliation bill will pass later this year, if they work out compromised entitlements.

Like 16 years of public schools nationwide.

Taxation is the best way to defeat fascism.

Most of the very obscenely rich are fully supportive of the Republican Party's efforts to sabotage the country just enough to maintain parasitic control of it. The GOP and the very obscenely rich don't want to kill off democracy. That would be bad for business. They only want to weaken it. As I said earlier this week, the party voting against America's credit is the same party "undermining the national recovery from the covid pandemic, which is the same party tolerating insurgents who nearly brought down the republic, which is the same party eroding the rule of law, which is the same party welcoming interference by Russia, which is … so on and so forth." The very obscenely rich, meanwhile, have resumed campaign donations to Republicans who voted to toss the 2020 election results. Firms like Home Depot and Walmart want the people to buy their stuff. They also want to prevent the people from flexing the sovereignty that would prevent them from continuing to extract wealth from the people.

Those of us worried about the future of democracy have pinned hope on the Democrats passing election reform. I've pointed out one reason that's not enough. We need to crack down on lawlessness, too. But all of the above is another reason reforming elections is insufficient. If we're going to fight authoritarianism creeping through the body politic, we need to do more about the very obscenely rich who are paving the way for that authoritarian creep with their money. The democratic way of doing that is with higher, much higher, taxation.

This piece is only available to Political Wire members.

It appears Speaker Nancy Pelosi is trying to take the win.

The general consensus among Democrats this morning was that Pelosi would not bring the bipartisan infrastructure package to the House floor because she did not have the votes.

When House Majority Leader Steny Hoyer (D-MD) was asked whether he’s confident the infrastructure bill will pass today, he responded simply: “Nope.”

But after meeting with House moderates — who are demanding it be brought to the floor — Pelosi said she was pushing ahead with a vote.

This “stare down” strategy — as described to Politico‘s Heather Caygle — would mean Pelosi would hold the vote open until she gets to the 218 she needs to pass the bill.  That suggests she would corral votes on the House floor, from progressives, Republicans who want to back bill despite their leadership or both groups.

Meanwhile, Pelosi is asking labor groups to turn up the pressure. And if it gets close, expect President Biden to twist some arms as well.

Pelosi is expected to call a Democratic caucus meeting later today, so her strategy might change.

But this is pretty high stakes.

More than half of voters in a new poll support Congress's bipartisan infrastructure bill as Democrats scrounge for the votes needed for the legislation to pass the House.

In a new Morning Consult-Politico poll, 56 percent of registered voters surveyed said they approve of the bill, including 27 percent who "strongly support" it. Only 27 percent either "somewhat" or "strongly" oppose it, and 17 percent were unsure.

The results are split along partisan lines, with 77 percent of Democratic respondents supporting the legislation and only 37 percent of Republicans backing it. A narrow majority of 52 percent of independents polled support the bipartisan bill.

A slight plurality of respondents approves of the bill's $1 trillion price tag, with 43 percent of registered voters saying it's the "right amount" to spend on infrastructure and 42 percent saying it's "too much."  Fourteen percent said $1 trillion is "too little."

That includes 23% who Strongly Support passage of the reconciliation bill. Fifty-three percent (53%) are opposed to passage of the $3.5 trillion spending measure, including 41% who Strongly Oppose passage. Ten percent (10%) are not sure.

LOL:

Progressives also offered what now appears to be a lie about them -- that neither Sinema nor Manchin were willing to state what size bill they could support. If they could not support the progressives' favored Zero Point Zero Zero dollars bill, what would they support? Zero Zero point Zeroety Zero dollars, or what?

In fact, Manchin and Sinema both now say they've already communicated to Schumer and Pelosi what size bill they could support. Machin publicly told us he could support an additional $1.5 trillion in spending (or, as Biden and Pelosi and the leftwing media term it, Zero Point Zero trillion in spending).

Sinema hasn't publicly stated what her best offer is, but she has issued a press release stating that she has submitted the figure to the congressional leaders.

Pelosi says she won't bring the bill to a vote unless she knows she has the votes.

And hasn't brought either bill to the floor for a vote. Nor has she announced the vote will occur, say, tomorrow.

Which means she doesn't have the votes, not even for the smaller boondoggled of the "Bipartisan" Infrastructure Bill.

Even the leftwing media admits Democrats are in "disarray" and that Biden's entire agenda will be set back, or even ended, if he fails to get his huge spending bill through. (Which, by the way, he believes will make him LBJ or FDR.)

But when asked about progressives' bleats about her, Kyrstin Sinema engaged in some Beatles-like drollery.

Frank Thorp V @frankthorp
Q: What do you say to progressives who are frustrated they dont know where you are?

SINEMA: "I'm in the Senate."

Q: There are progressives in the Senate that are also frustrated they don't know where your are either.

SINEMA: "I'm clearly right in front of the elevator."

Manchin offers his own "Turn left at Greenland" quip, noting that if progressives want to spend $3.5 trillion, they should elect more liberals, not pressure him to join them.

Trump Server Mystery Produces Fresh Conflict

A recent indictment suggested that researchers who found strange internet links between a Russian bank and the Trump Organization did not really believe their own work. They are pushing back.

By Charlie Savage and Adam Goldman

Sept. 30, 2021Updated 4:03 p.m. ET

WASHINGTON — The charge was narrow: John H. Durham, the special counsel appointed by the Trump administration to scour the Russia investigation, indicted a cybersecurity lawyer this month on a single count of lying to the F.B.I.

But Mr. Durham used a 27-page indictment to lay out a far more expansive tale, one in which four computer scientists who were not charged in the case “exploited” their access to internet data to develop an explosive theory about cyberconnections in 2016 between Donald J. Trump’s company and a Kremlin-linked bank — a theory, he insinuated, they did not really believe.

Mr. Durham’s version of events set off reverberations beyond the courtroom. Trump supporters seized on the indictment, saying it shows that suspicions about possible covert communications between Russia’s Alfa Bank and Mr. Trump’s company were a deliberate hoax by supporters of Hillary Clinton and portraying it as evidence that the entire Russia investigation was unwarranted.

Emails obtained by The New York Times and interviews with people familiar with the matter, who spoke on the condition of anonymity to discuss issues being investigated by federal authorities, provide a fuller and more complex account of how a group of cyberexperts discovered the odd internet data and developed their hypothesis about what could explain it.

Speaker Nancy Pelosi is launching an aggressive last-minute push to lock down the votes for President Joe Biden’s infrastructure bill, even as members of her leadership team have bluntly warned the vote could fail.

Pelosi is publicly and privately indicating that she is muscling ahead with the vote despite mounting progressive threats to tank the bill without a clear path forward for the party’s separate — but politically linked — social safety net bill, according to several people familiar with the discussions.

And the border is still out of control

Nearly 30,000 Haitian migrants have already made their way over the U.S.-Mexico border in recent weeks, but Panama's foreign minister says far more are on their way – and she has been sounding the alarm for months.

In a new interview with Axios, Foreign Minister Erika Mouynes said that since the beginning of 2021 more than 85,000 Haitians have crossed through Panama and that she believes "they all are heading toward the U.S."

"We've engaged with every single authority that we can think of, that we can come across, to say, 'Please, let's pay attention to this,'" Mouynes told the outlet.

The Haitians have been coming from Colombia, traveling through the dangerous Darién Gap jungles into Panama before making their way northward through Central American and Mexico to to the U.S. Mouynes said senior officials from South American countries, Mexico, Canada and the U.S. met in August to address the issue, and she thought it was "shocking" that this had not happened sooner.

Mouynes said she also met with members of Congress and DHS Secretary Alejandro Mayorkas earlier this week.

Fox News reached out to the Department of Homeland Security for comment but it did not immediately respond.

Mouynes told Axios she wants to see additional meetings between the U.S. and other countries in which they can work out plans to better control the volume of people coming through their respective borders. She said Haiti needs to be involved as well in order to get to the root of the problem.

"We all have a role to play in this issue, and the regional approach is the correct approach," she said. "It is impossible for Panama to solve it on its own."

In addition to the 85,000 people that have already made their may to Panama and beyond, Mouynes said another 30,000 are waiting in Colombia while Panama is unable to take them.

"When we receive them on the Panamanian side, they're malnourished. The children are in terrible condition, so even getting them up to a healthy state takes time," she said.

Mayorkas told Fox News on Sunday that the vast majority of the migrants who had entered the country had been released into the U.S. At the time, he said as many as 12,000 had been released until their court date, with 3,000 in detention and 5,000 still awaiting the processing of their cases.

Biden's experience is working.

The White House is convinced progressives’ end goal is still aligned with theirs and see the pressure they’re exerting as ultimately helpful rather than damaging.

“We want to know what will be in a bill, especially if it’s going to be anything less than $3.5 [trillion],” said Rep. Chuy García, (D-Ill.). “The holdup isn’t with progressives, because we’ve maintained our position throughout. It’s the moderates that have slowed this down and delayed it.”

White House press secretary Jen Psaki seemed deferential to progressives in the briefing room Wednesday when asked about the progress of negotiations.

“[M]embers of the Progressive Caucus want to have an understanding of the path forward on the reconciliation package,” Psaki said. “They have stated that publicly. You know why? Because they think it's a historic progressive package that will make bold changes into addressing our climate crisis, into lowering costs for the American people, bringing more women back into the workplace.”

Still miles apart: Americans and the state of U.S. democracy half a year into the Biden presidency
Bright Line Watch June 2021 surveys

As the country turns 245 years old, Americans have reasons to worry about the state of their democracy. In June 2021, we surveyed a representative sample of Americans and an expert sample of political scientists on the performance of U.S. democracy, the threats it faces, and how their political representatives should address these matters.1 We find deep partisan polarization in perceptions of what is right and wrong with American democracy and the steps that should be taken to fix it. In addition, experts express reservations about current changes to election law at the state level. Still, we find some signs that Americans regard partisan attacks on election administration with skepticism.

Our key findings are:

Constitutional hardball politics like gerrymandering, packing the Supreme Court or blocking Court nominees, voter suppression, abolishing the filibuster, adding new states to the union, or refusing to certify election results enjoy little support among the public and, with few exceptions, among experts. However, these strategies appear to go unpunished by voters when used by elites.

Experts expect these tactics to be used more frequently in the years ahead, rating extreme partisan gerrymandering a near certainty; obstruction of Supreme Court nominations highly likely; and refusal to certify popular vote totals as a likely outcome as well. By contrast, the experts place low probability on hardball tactics that are more favored by Democrats, such as adding states to the union, abolishing the filibuster, or packing the Supreme Court.

Among the electoral reform proposals recently adopted or currently under consideration in the states, experts perceive grave threats from bills that encroach on the political independence of local election officials and that restrict mail voting.

Exposure to information about the official audit in Maricopa County, Arizona more than doubled confidence in the vote count in Republicans, suggesting that information about standard processes intended to verify the results of elections can be reassuring to skeptical members of the public. Surprisingly, exposure to news about the partisan “audit” there also increased confidence among Republicans somewhat, though this effect seems unlikely to persist when the supposed results of that process are announced.

The legitimacy of the 2020 presidential election and Donald Trump’s actions afterward remain central to how Americans assess political candidates. In the past six months, Democrats and Republicans have not budged in how they reward or punish prospective candidates for voting to certify the election and for Trump’s impeachment. Independents did shift in favor of candidates who supported the certification of the 2020 vote and who supported transportation infrastructure spending.

Distressingly high proportions of respondents say they would be willing to secede from the United States to join a new union of states in their region. Support is higher among Republicans in Republican-dominated regions and among Democrats in Democrat-dominated regions, but the idea’s popularity has risen in some partisan groups and regions of the country since Biden’s inauguration.

Experts rate Donald Trump’s continued refusal to accept the results of the 2020 election as highly abnormal and important.

Constitutional hardball

The June 2021 survey asked both our public and expert samples about their support for a range of practices that have come to be known as “constitutional hardball.” The term describes strategies by which political actors seek to extend their political power and gain advantage by actions that are within the formal bounds of constitutional doctrine but that break with longstanding political practices. In October 2019, we reported on support for hardball politics. The current survey repeats some of those questions and adds new ones about tactics that have entered mainstream political discussion more recently. These scenarios fall into four broad categories: legislative process, impeachment, the courts, and elections and representation. The list below contains our 12 constitutional hardball statements by category.

Legislative process

A majority party in either chamber of Congress refusing to raise the limit on the amount of money the U.S. government can legally borrow. The majority party in the Senate abolishing the filibuster rule so it can pass legislation without minority party support. The minority party in the Senate routinely using the filibuster rule to block legislation supported only by the majority party.

Impeachment

A majority of the House of Representatives seeking to impeach a president because they believe he or she is unfit for office rather than because of specific evidence of high crimes and misdemeanors.

Courts

The majority party in the Senate refusing to consider any nomination by a president to fill an open seat on the Supreme Court.A party that controls Congress and the presidency creating and filling new seats on the Supreme Court to change the partisan balance of power.

Elections and representation

A party that controls both chambers of Congress granting statehood to Washington, D.C. and Puerto Rico.A state political party drawing Congressional districts that ensure it will receive a share of seats much larger than its share of votes.A state political party proposing measures that make it more difficult to vote, especially for members of the other party.Local election officials refusing to certify the vote totals recorded in their area.A state legislature naming electors to the Electoral College other than those designated by the popular vote in that state.Congress refusing to certify presidential election results that have been submitted by the states.

Each survey respondent was shown all twelve statements in random order and asked to indicate “how appropriate or inappropriate you consider each scenario to be” on a four-point scale from “Entirely appropriate” to “Entirely inappropriate” or to indicate that they are not sure.

House Democrats on Thursday delayed a vote on a roughly $1 trillion proposal to improve the nation’s infrastructure, a dramatic reversal after hours of negotiations that marked a major setback for President Biden’s economic agenda.
The decision came after House Speaker Nancy Pelosi (D-Calif.) and other Democratic leaders strained late into the night to try to repair the schisms among their own moderate and liberal ranks, whose distrust of each other turned the public-works bill into a political bargaining chip in a fight over the full array of new spending Biden seeks.
The source of the Democratic stalemate was a second, roughly $3.5 trillion package that proposes to expand Medicare, combat climate change and boost federal safety-net programs, all financed through tax increases on wealthy Americans and corporations. To safeguard the initiative from cuts at the hands of centrists, including Sens. Kyrsten Sinema (D-Ariz.) and Joe Manchin III (D-W.Va.), liberals threatened to oppose the infrastructure bill that the moderate duo originally helped negotiate.
Pelosi had spent the day huddling with Democrats’ warring factions in private meetings, while the White House labored to work with Sinema and Manchin on a spending deal they could support. But the flurry of outreach, sometimes from Biden personally, failed to bring the two camps together — generating acrimony among Democrats’ own ranks.

Will 2024 the day the American Dream Dies?

Nearly nine months after rioters stormed the U.S. Capitol to stop the certification of the 2020 presidential election, a question still lingers over how to place it in history: Were the events of Jan. 6 the doomed conclusion of an unusually anti-democratic moment in American political life, or a preview of where the country is still heading?

Richard L. Hasen, a professor at the University of California, Irvine, School of Law and an expert in election law, believes the second possibility shouldn’t be ruled out. In a paper published this month, he wrote that “The United States faces a serious risk that the 2024 presidential election, and other future U.S. elections, will not be conducted fairly, and that the candidates taking office will not reflect the free choices made by eligible voters under previously announced election rules.”

It could be a bloodless coup, he warns, executed not by rioters with nooses but “lawyers in fine suits”:

An independent board of experts monitoring the trial recommended the study be stopped early because of the positive results, a significant and telling step in a pharmaceutical study.
Merck and partner Ridgeback Biotherapeutics said in a news release they would apply for emergency use authorization for the drug, molnupiravir, in the United States as soon as possible. It would be the first antiviral pill for covid-19.
A simple, easy-to-prescribe pill that prevents mild and moderate cases of covid-19, the illness caused by the coronavirus, from turning into dire episodes has been one of the missing pieces of the medical armamentarium to fight the virus.

Monoclonal antibodies, treatments that have kept people out of the hospital, are expensive, tricky to manufacture and cumbersome to administer, requiring infusions or injections. Vaccines have been remarkably effective, but access is limited in much of the world.

The numbers: The cost of goods and services rose sharply again in August and left the rate of U.S. inflation at a 30-year high, with all signs pointing to price pressures snaking into next year.

The personal consumption expenditure price index climbed 0,4% in August, the government said Friday. It was the sixth straight big increase.

The rate of inflation in the 12 months ended in August edged up to 4.3% from 4.2% — the highest rate since 1991, when George H.W. Bush was president.

Until very recently, Federal Reserve leaders insisted inflation would start to fall back to toward pre-pandemic levels of 2% or less by the end of this year.

Yet in the past week senior central bank leaders acknowledged inflation could remain high well into 2022 because of ongoing shortages of crucial business supplies and and even labor.

President Joe Biden wants to put an actual Communist -- self-proclaimed "radical" Cornell University law school professor Saule Omarova -- in charge of the nation's banking system. . .

. . . There's a reason the USSR is defunct and the U.S. isn't -- at least until Omarova gets her way. . .

. . . Or as Kristin Tate wrote for The Hill on Wednesday:

Taken to its extreme, this would mean that the Federal Reserve, acting on behalf of Washington, could become the only place citizens could deposit their money. Such a massive transformation would be accomplished by replacing consumer deposits into a new digital dollar, held by the Fed.

Nationalized banking with, if I'm reading this correctly, nothing but a centrally controlled digital currency for legal tender -- what could go wrong? . . .

. . . Nominating Omarova to serve as Comptroller of the Currency, as Biden has done, is worse than putting the inmates in charge of the asylum. It's more like putting a convicted arsonist in charge of the Forest Service.

Biden checked off another progressive identity box last week by nominating Saule Omarova as Comptroller of the Currency.

She graduated from Moscow State University in 1989 on the Lenin Personal Academic Scholarship. Thirty years later, she still believes the Soviet economic system was superior, and that U.S. banking should be remade in the Gosbank’s image.

WASHINGTON (AP) — Drugmaker Merck said Friday that its experimental COVID-19 pill reduced hospitalizations and deaths by half in people recently infected with the coronavirus and that it would soon ask health officials in the U.S. and around the world to authorize its use.

If cleared, the drug would be the first pill shown to treat COVID-19, a potentially major step forward in global efforts to control the pandemic. All COVID-19 therapies now authorized in the U.S. require an IV or injection.

A pill that could be taken at home, by contrast, could keep many patients out of the hospital, easing the workload on strained health care professionals. It could also help curb outbreaks in lower-income countries that don’t have access to the more expensive infusion therapies.

Merck and its partner Ridgeback Biotherapeutics said early results showed patients who received the drug, called molnupiravir, within five days of COVID-19 symptoms had about half the rate of hospitalization and death as patients who received a dummy pill. The study tracked 775 adults with mild-to-moderate COVID-19 who were considered higher risk for severe disease due to health problems such as obesity, diabetes or heart disease. The results have not been peer reviewed by outside experts, the usual procedure for vetting new medical research.

Among patients taking molnupiravir, 7.3% were either hospitalized or died at the end of 30 days, compared with 14.1% of those getting the dummy pill. There were no deaths in the drug group after that time period compared with eight deaths in the placebo group, according to Merck.

Why have five Supreme Court justices spoken out publicly about the court's reputation in recent weeks?

Several conservative justices have argued strenuously that the court should not be seen in political terms.

Justice Amy Coney Barrett gave a speech at the McConnell Center at the University of Louisville Law School on September 12 proclaiming that justices are not a "bunch of partisan hacks" and denied that they are following their personal beliefs.

A few days later, on September 16, Justice Clarence Thomas gave a speech at Notre Dame Law School, echoing Barrett's view that justices do not act on political ideology or their own beliefs when making decisions. "I think the media makes it sounds as though you are just always going right to your personal preference," Thomas said. "So, if they think you are anti-abortion or something personally, they think that's the way you always will come out."

And on Thursday, Justice Samuel Alito, gave a speech, also at Notre Dame, defending the court. He sharply attacked media coverage of it and said the justices are not a "dangerous cabal."

Justice Stephen Breyer, in promoting his new book, "The Authority of the Court and the Peril of Politics," gave many interviews, and often said, that the court is not made up of "junior league politicians." He criticized the media for speaking of justices in terms of the presidents who appointed them and of thinking of justices like politicians.

But on Wednesday, Justice Sonia Sotomayor, in a program for the American Bar Association, conveyed a very different message. "There is going to be a lot of disappointment in the law, a huge amount. Look at me, look at my dissents."

It is surely not a coincidence that so many justices are speaking publicly about the court, its reputation, and its processes.

Some of it may be a response to its sharp dip in public approval ratings. A September 2021 Gallup poll indicated that approval of the US Supreme Court fell to a new low of 40%. Fifty-three percent said they disapproved of the court.

But I think something more basic -- and more troubling -- is occurring. The court is about to begin a term where it will decide high profile cases on ideologically divisive issues, such as abortion, gun rights, support for religious schools and perhaps affirmative action. For example, on December 1, the court will hear oral arguments in a case where it is being urged to overrule Roe v. Wade and uphold a Mississippi law that prohibits abortions after the fifteenth week of pregnancy.

Honest, decent, truthful Rev. said...

With five staunch conservatives, who all at some point have opposed abortion rights, it is hard to imagine that a majority will strike down the Mississippi statute. Likewise, it is probable that these justices will significantly expand gun rights and the requirement of the government providing aid to religious schools.

In their public pronouncements, the conservative justices are trying to send a message that these rulings are not about their personal or political beliefs. But that is nonsense and I doubt anyone who disagrees with the justices will believe it.

The reason Republican senators blocked Merrick Garland's confirmation and rushed through Amy Coney Barrett's is because they know, like we all do, that the beliefs and ideologies of the justices matter enormously in determining the outcome of many cases.

President Donald Trump said he would pick justices who would vote to overrule Roe v. Wade and selected for the court three of the most conservative appellate judges in the country in Neil Gorsuch, Brett Kavanaugh and Barrett. No one thinks for an instance that if Hillary Clinton had been elected president and had filled these three seats that there would be any question about the future of Roe v. Wade.

Justice Breyer's defense of the court is harder to explain, but I think it reflects his deep caring and concern about the court as an institution. He is fearful of the backlash the court will face and wants to shore up public esteem for an institution he loves.

And while I am sure that Sotomayor shares such reverence for the court, her remarks at the ABA event reflect the enormous frustration of what she sees in the year ahead. She knows what her colleagues are likely to do and laments it and what it will mean for people's lives. She faces the reality of being in dissent on issues about which she cares passionately.

Nothing the justices say off the bench is going to make much difference in how people perceive the court. People praising themselves never carries much credibility. And more important, the American people know that whether Roe is overruled or gun rights are expanded is all about who is on the court and what they believe.

Why the GOP Wants to Kill Its Voters
Understanding the seemingly illogical political logic behind the Republican embrace of anti-vaccine conspiracy theories

Dan Pfeiffer
In its simplest form, politics is a game of numbers. The goal is to attract more voters. Therefore, exposing your most loyal voters to a deadly virus seems to be a particularly stupid way to go about winning elections. Yet a surprising number of Right-Wing politicians and media figures have spent a lot of time and energy pushing conspiracy theories about the COVID vaccine. This messaging has undoubtedly killed thousands of voters that the Republicans need in the 2022 elections.

While some Republican leaders have pushed the COVID vaccine from the outset and others, like Sean Hannity, have recently kinda, sorta changed their tone due to pressure from advertisers, there is no question significant elements of the Republican Party have embraced the anti-vax movement in the post-Trump Era.

Progressives were mystified about the Republican embrace of the anti-vax movement. Reactions ranged from outrage to condescension. Maybe the Republicans are too dense or demented to know what’s in their best interest. Perhaps, they are so committed to “owning the libs” that they are willing to kill their own voters. But the reason is neither idiocy nor performative assholery.

While the modern Republican Party is nihilistic, immoral, corrupt, and racist, it is not stupid. There is an underlying — albeit twisted — political logic behind the decision of so many Republican politicians to push anti-vax conspiracy theories. Killing their own voters is disgusting but not as self-defeating as it seems. It’s not a good or moral strategy, but it is a strategy. And defeating that strategy requires understanding why Republicans think killing their voters is good politics.

It’s B.S., and They Know It
The first — and most important thing — to understand is that the Right-Wingers pushing anti-vax messaging are full of cynical B.S. If you don’t believe me, listen to them. The Washington Post’s J.M. Rieger put together a video compilation of leading GOP anti-vaxxers like Senators Ron Johnson and Rand Paul praising the Trump Administration for their efforts to speed the development of the vaccine. Here are some examples from Rieger’s research:

In December, Sen. Ron Johnson (R-Wis.) praised the Trump Administration’s “brilliant” Operation Warp Speed for helping expedite the development of coronavirus vaccines. Since then, Johnson has inflated the number of adverse reactions and deaths linked to the vaccines.

Rep. Ronny Jackson (R-Tex.), a former White House physician, told Fox News in November that he would get vaccinated to contribute to herd immunity. By July, Jackson was warning Fox viewers that “this is still an experimental vaccine being used under an emergency use authorization.”

In March, Rep. Marjorie Taylor Greene (R-Ga.) praised former president Donald Trump for saving lives with the coronavirus vaccines. By July, Greene was telling Americans not to get vaccinated.

Not one public figure has done more to sow distrust in the COVID vaccines than Fox News’ Tucker Carlson. On a nightly basis, Carlson pushes disinformation about the safety and efficacy of the vaccines. He regularly invites discredited conspiracy theorists like Alex Berenson on his show. Berenson — whom The Atlantic dubbed “The Pandemic’s Wrongest Man” — is a former New York Times reporter who has desperately sought relevance by becoming a champion of the anti-vaccine movement. Despite his efforts to convince his viewers not to get the vaccine, Carlson has refused to tell viewers whether he has been vaccinated.

Carlson is not the only anti-vaxxer on Fox’s airwaves. Despite a recent shift in tone, the Right-Wing propaganda network has been a fount of COVID misinformation. A Morning Consult poll from June found that people who regularly watch Fox News are significantly less likely to get vaccinated than those who consume other media.

However, what Fox News says on-air and what it does behind the scenes are two very different things. Due to his advanced age and immense wealth, Rupert Murdoch was one of the first people on Earth to receive the vaccine. The fact that Murdoch can profit off the death of his viewers yet be secure in his own immunity is more evidence that he is one of history’s great villains. The network has also railed against the idea of vaccine mandates or passports. Yet, as CNN reported:

Fox Corporation, the Right-Wing talk channel's parent company, has quietly implemented the concept of a vaccine passport as workers slowly return back to the company's offices. Fox employees, including those who work at Fox News, received an email, obtained by CNN Business, from the company's Human Resources department in early June that said Fox had ‘developed a secure, voluntary way for employees to self-attest their vaccination status.’This level of cynicism and dishonesty among Republicans is nothing new and surprises no one reading this, but it is relevant because it speaks to the fact that these folks are pushing the vaccine conspiracy theories as part of a specific political strategy.

So, if all these Republicans are lying, why are they doing it? Not every purveyor of vaccine misinformation is doing it for the same reasons or incentives. The online Right is a loosely connected, incoherent mishmash of militants, grifters, and attention merchants. With the exception of the Mitt Romney’s and Liz Cheney’s of the world, the Republican Party itself can be divided into pure Trumpists who gleefully drank the MAGA Kool-Aid and performative Trumpists that choked it down. Here are the reasons for pushing misinformation:

Sow Distrust in (Democratic) Government
Many people think the last century or so of American politics has been a battle over the size of government. Democrats want an expanded social safety net and more government intervention, while Republicans want to shrink government to enable the market. This is the central narrative for most political reporting. It is also dangerously wrong. The battle over government is not about the size of government, but the role of government. Republicans want the government to serve as a bulwark against the growing political and economic power of a diversifying America that they view as an existential threat to their primarily White, Christian base. This viral quotation from composer Frank Wilhoit perfectly encapsulates the modern Republican Party:

Conservatism consists of exactly one proposition, to wit: There must be in-groups whom the law protects but does not bind, alongside out-groups whom the law binds but does not protect.

This is why Republicans defend the police when they murder our citizens. It is why they pour money into border enforcement. And it is why they expand military and domestic surveillance. But when a Democrat is in charge — particularly if it’s a Black president with a white vice president or a white president with a Black vice president — the government becomes an existential threat. The Republican narrative depends on sowing distrust and fear about the government. Pushing conspiracy theories about the vaccines should be seen in the same vein as Republican paranoia about gun confiscation, “Deep State” opposition to Trump, the “War on Christmas,” and schoolchildren being indoctrinated with “Critical Race Theory.” Republicans need their base jacked up on a high dosage of fear, particularly of institutions. The idea the government is forcing you to get an unproven shot for an overhyped virus serves that exact purpose.

Hurt Joe Biden (and America)
The fact Republicans switched from praising the vaccines to questioning them the moment Donald Trump skulked back to Mar-a-Lago tells you everything you need to know. If Trump was reelected (or had successfully stolen the election), the Republican Party and Fox News would be the #1 booster of the vaccine program. Carlson would get his shots live on air. Ron Johnson and Rand Paul would be running vaccine clinics out of their offices. The D-list MAGA celebrities would do PSAs on OAN and Newsmax. But Donald Trump is not president. Joe Biden is president. Republican success in the midterms depends, in part, on Biden’s failure to control the pandemic and resuscitate the economy. Just as the Republicans did everything in their power to prolong the recession under Obama, they are now making it harder for President Biden to control the pandemic. Railing against mask mandates, questioning science, and pushing anti-vax conspiracy theories are crucial in that effort.

Honest, decent, truthful Rev. said...

Desperately Seeking Supporters
The Republican Party’s embrace of the anti-vax movement is not new. It predates COVID. Long before he became president, Donald Trump was pushing discredited conspiracy theories about links between vaccines and autism. In 2011, Texas Republicans revolted against the idea of an HPV vaccine mandate proposed by the state’s Republican governor. In 2019, Politico wrote an article headlined “How the anti-vaccine movement crept into the GOP mainstream” which discussed how Republican politicians started questioning vaccine mandates for schoolchildren — upending decades of science and cultural norms.

The Republican Party cozies up to anti-vaxxers for the same reason that they cozy up to QAnon, White Supremacists, and Right-Wing militias like the Oathkeepers; they have no choice. With every passing day, the Republicans become a smaller and smaller part of the electorate. Winning political power — even an Electoral College and Senate tilted dramatically in their favor — becomes more challenging. They need higher and higher turnout from a shrinking base. The anti-vax movement is a relatively small but highly engaged and very online group of people. Exactly the sort of people that stayed home in 2012 but turned out for Trump in 2016 and 2020. Electoral math dictates that the Republican Party simply can’t turn away likely supporters — even if it means killing some of them through collateral damage.

Chasing Facebook Engagement
Like much else that is wrong with the world, the anti-vaccine sentiment penetrating mainstream Republican thinking can be blamed partially on Facebook. While Democrats and journalists flock to Twitter in search of retweets and approbation from the echo chamber, the Republicans are focusing their time and energy on Facebook. Ben Shapiro, Candace Owens, and Dan Bongino have become power players within MAGA politics through their ability to generate massive and consistent Facebook engagement. Posting vaccine misinformation on Facebook is a great way to generate engagement and attention, the currency of Right-Wing politics. According to “What’s Trending” — an essential newsletter by CAP Action’s Alex Witt — attacking the COVID vaccine and fearmongering about vaccine mandates was the subject of a number of top Facebook posts from conservatives. As Jesse Lehrich, the co-founder of Accountable Tech, pointed out on Twitter, the top Facebook post in the entire United States on July 16th was one from Rep. Marjorie Taylor Greene pushing a vaccine-related conspiracy theory.

The problem of vaccine misinformation and a growing anti-vaccine movement is much bigger than Facebook. But the perverse incentivizing structure of the world’s largest social media platform is a factor in why Republican politicians see a political upside in “killing people,” to paraphrase President Biden.

Like so much else in Trump-Era Republican politics, the decision to sow distrust in the COVID vaccine is instinctual rather than intellectual. It is a massive indictment of our politics and media environment that such a cynical and dangerous approach is not the death knell for those who adopt it. Understanding the political forces that reward such behavior is crucial to Democratic success in 2022 and beyond.

Marine lied at Trump rally about pulling baby over wall in Afghanistan: report

John Wright

October 01, 2021

A Marine who spoke at former president Donald Trump's rally in Georgia last weekend lied about pulling a baby over a wall in Afghanistan, according to a military spokesperson.

Lance Cpl. Hunter Clark, who's under investigation for taking part in political activities by speaking at the Trump rally, claimed he was the Marine shown in a viral video lifting the child over the wall at the Kabul airport.

"We're also honored to be joined by one of the Marines who bravely served in Kabul during the withdrawal — and helped evacuate children over ... the airport wall. You saw him. He did a great job," Trump said in introducing Clark, calling him a "handsome guy."

Clark then told the audience: "I am the guy that pulled the baby over the wall and it's definitely probably one of the greatest things I've ever done in my entire life."

Trump's Save America PAC later issued a statement promoting a Fox News story with the headline, "Trump invites Marine who pulled baby over Kabul wall onto stage at rally prompting 'USA!' chants."

CNN reported Friday that Kelton Cochran, a spokesman for the 24th Marine Expeditionary Unit, said in a statement: "Regarding the viral photo that began circulating around August 20, 2021, the Marine identified in that particular image was not LCpl Clark."

"The 24th Marine Expeditionary Unit (MEU) has initiated a command investigation regarding LCpl Hunter Clark's attendance at the event last weekend to determine if any DoD policies were violated," Cochran said, adding that "details pertaining to this incident are not releasable while the investigation is being conducted."

CNN noted that, "It's not clear if there are other instances of US troops hoisting babies over the wall at the Kabul airport."

Clark's mother, Peggy Clark, told CNN by phone that her son was "not going to comment" on the network's fact check of his story.

"He's asked that I not give out any information right now," Peggy Clark said. "He can't do any interviews or speak with anybody right now. I'm sorry. He's got to go through some things and when he gets the chance and can do that then I'm sure he'll make a statement.

He is a faker like the bone spurs draft dodger sob

Paul: “Quit lording it over people, acting as if these people are deplorable and unwashed. Try persuasion instead of government cudgels. Try humility instead of arrogance. Try freedom instead of coercion.

Most of all, try understanding there is no more basic medical right than deciding what we inject into our bodies. Today, half a hearing that millions of people in a study prove — show without a doubt that there is a great deal of immunity from getting it naturally, do you want to apologize to the 100 million Americans who suffered through covid, survived, have immunity, and yet you want to hold them down and vaccinate them?

Do you want to apologize for calling those people flat earthers?”

The funny thing about it Reverend...

Is that these opinions in many ways are proving the opposite of what they suggest. The idea of opposing or supporting abortion really should be almost of no consequence to what laws are being passed. It's not up to the court to determine the amount of abortions that are provided or even when those abortions are allowed.

They are strictly there to determine if laws passed on the subject pass constitutional muster and to a lesser degree follow stares decisis. They cannot simply rule for or against a law because they like or dislike the outcome.

The recent court cases that the USSC heard in regards to the Texas laws are a case in point. The actual lawsuit filed was filed against a doctor who was quite literally being sued for a hypothetical of what he "might" do based on the law being passed. This is not in any manner, shape, or form a legitimate lawsuit REGARDLESS of the underlying reasons for it.

But to expect a court to accept and rule on a case that has no real legal standing simply because you believe that the underlying issue is important is exactly the sort of thing that the courts should be avoiding. It is the politicizing of the court and it is Judges putting their personal feelings in front of the law.

Eventually a lawsuit will reach the court that will likely have standing and then the USSC justices will rule. Their ruling will really have nothing to do with the previous ruling (because the previous ruling has nothing to do with the merits).

At the end of the day, it's the liberal justices (not the conservative ones) who are willing to push an agenda fist and come up with a legal justification for it later.
