So some more on the Arbery case via Legal Insurrection

Background

Ahmaud Arbery, a 25-year-old black man, was shot and killed on February 23, 2020 when he charged an armed Travis McMichael on a Georgia roadway and fought McMichael for control of his shotgun. Travis McMichael was standing beside his stopped pickup truck at the time, and his father Greg McMichael was in the bed of the truck armed with a pistol.
The McMichaels had been pursuing Arbery in the belief that he was a serial felony burglary who had been plaguing their suburban neighborhood for weeks. A short distance from where the shooting took place, neighbor William “Roddy” Bryan followed in his own vehicle, making a shaky recording of the final confrontation on his cell phone–it was this video that would bring this case to national attention a few weeks after the shooting took place, and after initial prosecutorial review had resulted in no charges against either the McMichaels or Bryan.
The defense in this trial is arguing that the men were acting consistently with a lawful citizens arrest of a fleeing suspect for whom they had “reasonable and probable grounds of suspicion” of being in flight from a felony–the controlling language from the then-existing Georgia citizen’s arrest law, a law which has since been repealed as a consequence of this event. In the course of executing this citizen’s arrest, Travis McMichaels was attacked by Arbery, who fought him for control of his shotgun, and Travis ultimately shot Arbery in lawful sef-defense.
In fact, Arbery is known to have “visited” a home under construction, from which costly items had been repeatedly stolen, at least five times, each visit captured on surveillance cameras installed in an effort to quell the thefts. The prosecution argues that there’s no evidence that Arbery actually stole any of the taken items, but George felony burglary law does not require an actual taking of property–unlawfully entering a property for the purpose of committing a crime is felony burglary under Georgia law even if nothing is actually taken. Both McMichaels had seen these surveillance videos, and on the day in question had observed Arbery in apparent flight from the burglary scene–conduct the prosecution and media characterize as mere recreational jogging.

This is a completely different story from what we have been told all along. Granted, the manner in which the person was running could have been seen as someone "jogging" although he was not really dressed to be out jogging and he really would have little reason to be "jogging" in that particular neighborhood. 

According to all accounts, he was fleeing the scene of a construction site after a 911 call and was being followed by this neighborhood watch team. Obviously the two in the pickup were set up almost in ambush and appear to be waiting for him, while the person taking the video was following in that vehicle.

While we do not see exactly what happened behind the truck, it looks very likely that it was actually Arbery (not either of the McMichaels) who appears to make first physical contact, with an attempt to grab the gun from Travis McMichaels. 

If we think back to the Rittenhouse trial, there are some real similarities here. It doesn't appear that the prosecutors are trying to argue that there wasn't a struggle made for the gun (that is obvious from the video), but rather they are making that same sort of provocation argument that prosecutors tried to make against Rittenhouse. That had they not been trying to pursue or stop Arbery, then there would have been no need for Arbery to go after the gun.

Not sure watching this video how you get charges like "false imprisonment" as he never looked to be detained at any time. Also wondering where the felony Assault comes into play. But that is the charges that were brought. The more I find out about this case, the less I will ever trust the media to tell me anything.

The subpoena was supported by a citation to Bob Woodward’s book “Peril.”

Except for one eensie weensie minor detail:

Kerik was 300 miles away in the New York City area on Jan. 5, 2021, according to his own car’s toll booth records reviewed by Just the News. He left Washington the night of Jan. 4 and did not return until the morning of the riots, according to Kerik’s own account at a speech this weekend in Chicago. And that book by Woodward? It makes no claim about Kerik attending a meeting at the Willard on Jan. 5. In fact, the book doesn’t even mention the former NYPD commission once in its 482 pages.

Reporter John Solomon went as far as fact-checking with Woodward himself. Maybe Thompson had a different edition? Maybe Solomon was missing something? Nope:

Woodward and his coauthor, fellow Washington Post journalist Robert Costa, confirmed to Just the News in a statement Monday night that they did not allege Kerik attended a Jan. 5 meeting at the Willard. “The subpoena for Mr. Kerik references page 234 of our book, ‘Peril,'” the Post journalists said. “That page, however, does not mention Mr. Kerik in any way. In fact, he is not mentioned anywhere in our book.”

Making up facts to obtain a subpoena? There oughta be a law!

It looks very much like the defendants were stalking Aubrey.

Not saying Aubrey committed or didn't commit a crime.

Well from the video, there is no evidence they witness a crime.

The police had been called when Arbery was seen (for the fifth or sixth time) at a construction site where several burglaries had been committed. The problem for this neighborhood is that the police had been largely non-responsive.

According to Georgia law at the time, you don't need to witness that he took something, just that he was on property that he should not have been and was likely there to steal something.

That law was literally changed "after" this situation.


So this video had been taken after Arbery had fled the scene of the construction site and after the police had already been called. The McMichaels were looking to detain Arbery for the police.


So while in most states, you would have had to have witnessed him take something, in Georgia you only need to witness him trespassing on the property and have a good faith belief that he was there to steal something. Again, that law has been changed "now" - but that change is irrelevant to the trial.

Kyle Rittenhouse is a hero


On August 25, 2020, Kyle Rittenhouse resolved, despite obstacles, to pick up a weapon and defend law and order.  In November 2021, he took the stand, confronted his accusers, and then faced the jury eye-to-eye as they delivered his fate.  And for the next week, he was again libelously slandered by the president, the vice president, governors, congressmen, professional athletes, celebrities, elites, and almost the entirety of the mainstream media. 

And the Monday morning quarterbacks of Conservative Inc., ashamed that they’d submissively surrendered to circumstances rather than help Rittenhouse, joined the Left in their attacks.  They dismissed his courage and attempted to paint him as a naïve, video-game playing, wannabe Rambo who became a vigilante the minute he crossed into Kenosha and picked up a weapon.  He also picked up a first aid kit, a fire extinguisher, and graffiti cleaner, but don’t let that wreck your narrative.  But assuming vigilantism was his original intention… what’s your point?

In August 2015, the mostly peaceful Moroccan national Ayoub El Khazzani boarded a Paris-bound train and began shooting passengers.  American citizens Anthony Sadler, Spencer Stone, and Alek Skarlatos, as well as British citizen Chris Norman and two French citizens who remain anonymous, tackled and subdued Khazzani.  And in October of this year, former Marine James Kilcer happened to be at a Chevron gas station in Yuma, Arizona, when three mostly peaceful masked thugs entered the store brandishing handguns.  Kilcer quickly disarmed and tackled one, sending the other two fleeing the scene in a mostly peaceful manner.

These citizens did their duty, in an unofficial way, because the official organizations are not controlling crime effectively.

Kyle Rittenhouse was attempting to prevent crime because the official organizations in this country, from the DoJ and FBI to governors and mayors and Soros-funded district attorneys, are buffoonishly inadequate at best and brazenly treasonous at worst.  Conservatives who admonish Rittenhouse for not “staying home” have no realistic solution for an entrenched bureaucracy and a Pravda media which openly supports criminals, encourages riots, and attempts to crush any and all dissent with the entirety of the state security apparatus and its legions of ski-masked brownshirts. 

Was Rittenhouse naïve?  Maybe.  But naivete does not preclude heroism.  If Rittenhouse was naive to the degree of nihilistic destruction of which the unhinged Left is capable, then he shares this fault with his conservative critics.  And it is here, thankfully, where their commonalities end.

It could be said that the state of Virginia went to Republicans during the last election because the Loudoun County School Board covered up the rape of a student and then sent the offender to another school where he did it again! Mr. Trump has told advisers the issue will help the party win control of Congress next year and win back the White House in 2024. He has privately floated the possibility of an early presidential campaign announcement to underscore the message to conservative voters.

Many Republican candidates have fallen in line. Some have refused to concede defeats from 2020—and, like Mr. Trump, used fraud claims to raise money. Others seeking office have tailored their campaign messages to echo Mr. Trump’s claim that he won to avoid facing a backlash from his supporters.

Still other Republicans, including Glenn Youngkin, who won the Virginia governor’s race earlier this month, have aimed to navigate the issue by sidestepping many of Mr. Trump’s election-fraud claims without disavowing the man himself. Meanwhile, several of the former president’s most persistent Republican critics, such as six-term Rep. Adam Kinzinger of Illinois, have said they aren’t running for re-election.

On the local level, some election chiefs have been harassed and subject to intimidation for refusing to say the vote counting isn’t secure. A wave of election officials and longtime professional staff have left their jobs under pressure.

In three of those five elections, moreover, the results have been publicly questioned.

In 2000, Democratic nominee Al Gore conceded the race to Republican George W. Bush after a bitter battle and a Supreme Court ruling. He said he disagreed with the ruling to end the decisive recount in Florida, but would abide by the verdict. Even though the recount would have made Al Gore the Presidency of the United States of America because he is not a authoritarian leader like the former President Trump.

In a nutshell, ADA Dunikoski’s closing rebuttal struck me as an hour of frantic, pleading, and desperate. It reeked of fear of losing this case. And I expect it was that fear that led Dunikoski to so frequently misstate the law to the jury, giving rise to a plethora of objections from the defense—a defense that no longer has any opportunity to argue its own case to the jury.

The most serious misstatement of law occurred within the first two minutes of the start of Dunikoski’s rebuttal, and in a manner that can only be described as shocking in the context of criminal law.

I’ll share her exact language with you, but in effect, Dunikoski told the jury that they are free to convict the defendants of these criminal charges even if they find the crimes merely proven by a preponderance of the evidence, rather than requiring that the crimes be proven beyond a reasonable doubt.

Specifically, Dunikoski was talking to the jury about the concept of beyond a reasonable doubt, clearly attempting to minimize the threshold of that burden in the minds of the jury, stating:

“It’s just beyond a reasonable doubt. In other words, do you think they committed the crime? If you go, OK, yeah, I think they committed the crimes, you’re good. That’s all you need.”

As you might expect, this led to a fair-sized eruption on the part of the defense teams.

What Dunikoski was describing in plain English to the jury was not the concept of beyond a reasonable doubt, but rather the threshold of a mere preponderance (majority) of the evidence.

Preponderance of the evidence is the standard applied in civil court—is it more likely than not that someone has been proven liable for some harm. It is utterly different and enormously lower legal standard than beyond a reasonable doubt—guilt had been proven to such a degree that it has removed any reasonable doubt on the question.

American law requires proof beyond a reasonable doubt before the government is privileged to strip a citizen of his liberty and put them in a cage—before they can be deemed guilty of any criminal act at all.

This means that a jury that concludes it is more likely than not that the defendant committed the crime charged has not met the threshold for conviction. A jury that concludes that a large majority of evidence, say 75%, supports a verdict of guilty has still not met the threshold for conviction. The jury may not convict until they believe guilt has been proven beyond any reasonable doubt.

And that burden is squarely on the State. The defense need prove nothing.

Fitchburg State University in Massachusetts hosted several "processing" spaces segregated by race in response to the Kyle Rittenhouse trial verdict, which found Rittenhouse not guilty on all charges.

The Fitchburg State University Center for Diversity & Inclusiveness announced the "processing" spaces in an email to campus community members, which also erroneously stated that Jacob Blake was killed.

"The Center for Diversity and Inclusiveness is creating space for our community to process the ’not guilty' on all accounts verdict in the Kenosha, Wisconsin case where Kyle Rittenhouse, an Illinois native shot and killed two people protesting the wrongful death of Jacob Blake in 2020. Kyle was acquitted of all charges in the case after driving to Wisconsin with an automatic rifle," the email read.

Blake was paralyzed, but not killed, after being shot by a police officer in August 2020. The police officer who responded to the domestic disturbance call that led to Blake's shooting was not charged by the state or by the federal government after investigations.

The email went on to say that Fitchburg State University would be providing "virtual and in-person physical spaces" where students and staff will get the chance to "discuss your thoughts, emotions, and reflections."

The four "processing" spaces include a "Students of Color Processing Space," "White Student Ally Processing Space," "Faculty and Staff of Color Processing Space" and a "White Faculty and Staff Ally Processing Space."

I'm not going to talk about the Rittenhouse Case verdict or my opinion on it, but instead I wanna reflect on the insane amount of people praising Rosenbaum, including celebrities.

In the Early 2000s, my younger brother was sexually abused with I think about a dozen other kids by Rosenbaum. The court cases are sealed because they/we were minors so I won't be providing the names of any of them or the exact charges. He and every other victim deserves privacy. We already had batshit crazy conservatives try to unseal the case so they could tout around the victims stories as a "gotcha" moment.

Anyways, the fucker plead out of like 11 counts of child rape (there were more accusations, they just never made it to court) and only got like 10 years (ended up only being 8). My brother and I are late 20s/Early 30s now and he has mostly moved on but up until he was 14 he would cry almost every night and ask to sleep In the same bed as me or my sister or mom. I can only imagine what the other victims are going through.

Now, somehow he made his way to Kenosha and was shot dead. Whatever. Couldn't care less. Also couldn't care less about the trial or the verdict of Kyle.

What gets me is all these fucking celebrities calling him cutesy fucking nicknames and talking like him like he was such a great human being. "RIP Joseph" "Such a kind soul" "He didn't deserve this" Pedro Pascal is a good actor but somehow saw fit to call this POS a Hero.

What finally made me lose it was Mark Ruffalo's "RIP JoJo" What the whole fuck? Literally petnaming him. I'm so fucking angry. This man was a terror who deserved hell 20 years ago and major celebrities are making him to be a Martyr.


My brother is acting like he's ok through this whole thing and he has been on a media blackout. I on the other hand have been listening since day one and am so sick of people defending a pedophile. And yet, it is noteworthy that in the past few days we have heard from two major figures in the conservative camp telling Trump that he should stop whining about the election he lost and let the Republican Party focus on real issues, instead of his self-serving fantasies.

The statements from Rupert Murdoch -- who controls a media empire that includes, among other properties, the shamelessly pro-Trump Fox News -- and from former New Jersey Gov. Chris Christie -- an adviser who worked with the former president and helped him prepare for the presidential debates during the 2020 election -- may serve as a test for Republicans who understand just how harmful Trump's dominance of the GOP is, and how it could ultimately sink the party.

It was startling when Murdoch, addressing his company at the annual shareholder meeting on Wednesday, said that the United States faces a number of major political decisions that conservatives will fail to shape unless Trump moves on. "The current American political debate is profound," he said, citing education, welfare and economic opportunity. "It is crucial that conservatives play an active, forceful role in that debate," he added, "but that will not happen if President Trump stays focused on the past."

Murdoch is not alone in arguing that Trump is a threat to conservatives. Christie, who has just published a new book that looks very much like his unofficial entry into the 2024 presidential race, is making the same case, only more forcefully.

Consider the title of Christie's book -- which effectively labels Trump a threat to the GOP: "Republican Rescue: Saving the Party from Truth Deniers, Conspiracy Theorists, and the Dangerous Policies of Joe Biden." So next question is, if they're not filing for unemployment, where are they? Are disability claims up? Small business filings? Are welfare rolls up? Are home foreclosures up?

A key measure of inflation showed consumer prices rising at the fastest pace in three decades, as energy prices and demand for goods and services soared, posing a challenge to both the White House and the Federal Reserve.

Prices climbed by 5 percent in the 12 months through October, according to Personal Consumption Expenditures price index data released Wednesday. That was the fastest pace of increase since 1990.

The gauge was lifted by a 30.2 percent annual increase in the price of energy and a 4.8 percent increase in the price of food. Prices rose 0.6 percent from September to October, as supply chain disruptions continued to clamp down on the availability of certain products and components.

The increases were in line with what analysts had expected, but the rise in the Federal Reserve’s preferred inflation gauge will only add pressure on the central bank to take quicker action to maintain stable prices.

Price increases have shown few signs of fading, as some officials in the Biden administration and at the Fed argued they would earlier this year. The central bank is facing growing calls to hasten plans to end their stimulative bond-buying program and to begin to raise interest rates, a process that could risk slowing job gains and economic growth.

While inflation has soured consumer sentiment and weighed on Mr. Biden’s approval ratings, those price increases have been spurred in part by a strong economic recovery. Separate data released by the Labor Department on Wednesday found that initial jobless claims dropped to their lowest point since 1969, falling by 71,000 to 199,000 last week.

Mr. Biden hailed the drop in unemployment claims on Wednesday but conceded that the country was still far from a full recovery and that it had to address rising inflation.

“We have more work to do before our economy is back to normal, including addressing prices increases that hurt Americans’ pocketbooks and undermine gains in wages and disposable income,” Mr. Biden said in a statement on Wednesday.

In an attempt to drive down gas prices, the United States and five other world powers announced a coordinated effort on Tuesday to tap into their national oil stockpiles. Mr. Biden has ordered the Energy Department to release 50 million barrels of crude in the Strategic Petroleum Reserve, lower than what traders had expected from the emergency stockpile, which is the biggest in the world with 620 million barrels.

Consumers have grown increasingly concerned about the spike in prices. A survey from the University of Michigan released on Wednesday found that consumers expressed less optimism in November than at any other time in the past decade about prospects for their finances and the overall growth of the economy. The decline in consumer sentiment was a result of the rapid increase in inflation and the lack of federal policies that would address the damage to household budgets, according to the report

In 2018, before the COVID-19 pandemic, the average family with children that was defined as poor by the government received $20,700 in cash, food, and housing benefits, and another $17,000 in medical care and $5,000 in social services.

Taxpayers also spent $22,500 on non-means-tested public education for the family’s children. Total government resources came to $65,200 per family per year.

The average poor family also had $18,100 in earnings and other private resources. Adding this to the government assistance brought the average total resources to $83,300 per poor family. Even if the count were restricted to earnings, private resources, as well as government cash, food, and housing, the average would total nearly $40,000 per family, well above the average official poverty threshold of $26,400.

How does the government determine that a family with $83,300 in annual resources is poor? It systematically ignores nearly all the benefits and resources the family actually has.

For starters, the government undercounts earnings in low-income families by a third. Then, government deliberately excludes nearly all of the current 89 means-tested welfare programs when calculating its official measures of poverty and inequality. Of the $65,200 in government benefits and support received by the average poor family, Washington counts only $3,125 as income in its official poverty measure.

Omitting almost the entire welfare state from the poverty measure creates the misperception that the U.S. has a meager welfare system. The Biden administration is capitalizing on this misperception to demand the largest expansion of means-tested welfare in U.S. history.

The Build Back Better Act would add another $11,300 in annual benefits to the average poor family, bringing total government support to $76,400 per family.
