Murkowski Says Confidence In Court Is Rocked

Sen. Lisa Murkowski (R-AK) said a draft Supreme Court opinion aimed at possibly overturning Roe V. Wade “rocks my confidence in the court right now,” Politico reports.

Said Murkowski: “Roe is still the law of the land. We don’t know the direction that this decision may ultimately take. Sen. Collins and I in February introduced a bill that would codify Roe v. Wade. I thought it made sense then and I think it makes perhaps more sense now.”

Leftists are also greenlighting powerful precedents for the next Republican president. He may follow their lead by simply changing any rules, laws, customs, and traditions anytime he deems them inconvenient.

The poll broken down

39% believe it should be allowed as a matter of personal choice
28% believe it should be allowed only in cases of rape and incest
11% believe it should be allowed for other reasons on top of rape incest (health of child or mother)
17% believe it should not be allowed at all

So it would be more honest to say that a "minority" (39%) want abortion as a matter of personal choice.. while a "majority" (56%) either want it limited to special circumstance or banned all together?


So that is a different factual explanation of events than the "narrative" provided to you by Goddard.

Supreme Court Chief Justice John Roberts is furious over the leak of Justice Samuel Alito’s draft majority opinion that appears to portend the complete demolition of constitutional abortion rights in the U.S. Calling the leak to the website Politico a “betrayal” of confidences and a “singular and egregious” breach of trust, Roberts announced that the marshal of the court would “launch an investigation to get to the source of the leak.” The prime suspects, of course, are the Court’s 36 clerks and the other justices themselves, each of whom might have had access to Alito’s draft. Roberts appears, either intentionally or otherwise, to have absolved the clerks, whom he called “intensely loyal” with and exemplary tradition of respecting confidentiality. That leaves the possibility of a rogue justice, whose possible motives – for either conservative or liberal objectives – have been the subject of much speculation in the press. If it turns out that Politico’s source was one of his colleagues, Roberts bears more underlying responsibility for the breach than he has been willing to admit.

The Supreme Court has long operated in a culture of ethical impunity, although obscured by an aura of legitimacy, and Roberts has done nothing but enable it since becoming chief. The natural result has been a court in which the justices each act independently, even on ethics issues, answerable to no one. It was predictable, if not inevitable, that a justice might one day decide that respect for confidentiality was less important than some other strategic advantage or strongly held value.

Notably, Scalia made the decision entirely on his own, following the Court’s “historic practice” of deferring to individual justices on recusals, thus making them the only judges in the U.S. to exercise unreviewable discretion over their personal ethics choices. As the new Chief Justice, Roberts might have instituted a change in this protocol, presenting recusal motions to the full court rather than to the challenged justice. Instead, he has consistently doubled down on the justices’ prerogatives, resisting every call to establish a system of collective responsibility.

In 2011, Roberts devoted his entire Year-End Report of the Federal Judiciary to explaining why the Supreme Court – unlike every other court in the U.S. – has never adopted a code of conduct. “Every Justice seeks to follow high ethical standards,” he said (capitalization original), stressing that the consciences of his colleagues were sufficient to allow each individual to make their own ethical judgments. “For that reason,” Roberts continued, “the Court has had no reason to adopt the Code of Conduct as its definitive source of ethical guidance.”

The justices have engendered no shortage of ethics issues, notwithstanding Roberts’s dismissal of a comprehensive code of conduct, but neither he nor the Court have issued a word in response. Justice Clarence Thomas had to revise thirteen years of his annual financial disclosures due to his improper failure to report his wife’s income, including $680,000 from the conservative Heritage Foundation, which often files amicus briefs in the Supreme Court.  The late Justice Ruth Bader Ginsburg created a well-deserved uproar when she repeatedly denigrated then-candidate Donald Trump during the 2016 presidential election. She eventually expressed regret for what she called her “ill-advised” remarks, but she did not apologize. In neither of these instances did Roberts or anyone else at the court comment on the two justices’ obvious ethical lapses.

Justice Elena Kagan and Justice Ginsburg encountered their own recusal controversies for sitting in cases involving their personal or political interests. Most recently, Justice Amy Coney Barrett sat in in a case where one of the parties was the charitable arm of an organization that had spent over $1 million supporting her confirmation to the Court, with the evident approval of Chief Justice Roberts. Justice Barrett did not even reply to a letter from two Democratic senators who requested that she recuse herself.

When it comes to ethics issues, the nine justices have acted as unconstrained free agents for decades, resolving questions and making decisions entirely according to their own lights, with no acknowledged rules or collective frame of reference. Uniquely lacking a written code of conduct, there is actually no provision barring a justice from disclosing a draft opinion or any other information from the Court’s deliberations. And indeed, several justices have been anonymous sources for journalists, without suffering apparent reprimands or repercussions.

Chief Justice Roberts apparently thought it was just fine to proceed by consensus or tacit agreement on questions of ethics, but the leak to Politico suggests that he might well have been wrong. Justices who have come to regard themselves as the sole arbiters of their own ethical obligations may have very different priorities from their colleagues when the chips are down on matters of historic weight.

It will be some time before the leaker’s identity is discovered, if ever. Should it turn out to have been a rogue justice, it would be a stretch to call the release of the abortion opinion a “singular and egregious” breach of trust, rather than the ultimate expression of a decades-old, accountability-free regime. And if so, nobody is more to blame than the Chief.

Mike Pence has been slammed by Democrats ahead of the Republican former vice-president’s appearance in South Carolina today at a fundraising event for the Carolina Pregnancy Center, a Christian organization that provides services to pregnant people.

According to a press release, Pence’s remarks would focus on “protecting the right to life [and] restoring the sanctity of life,” per the Charleston Post and Courier.

Pence’s speech comes days after the supreme court’s draft opinion in Dobbs v Jackson Women’s Health Organization leaked to the public. The draft decision indicated the court plans to overturn Roe v Wade, which established the right to abortion access.

Abortion rights activists have criticized centers such as the one in South Carolina as “fake clinics” over their efforts to dissuade clients from terminating their pregnancies.

Democrats attacked Pence for touting his anti-abortion views just as the supreme court appears ready to override nearly 50 years of precedent and jeopardize reproductive rights across the country.

Jaime Harrison, chair of the Democratic National Committee, said on a press call:

Make no mistake, this draft opinion is the direct result of the Republican party’s extreme, decades-long campaign against reproductive rights and Americans’ fundamental freedom to make their own decisions about their health care.

Looking ahead to the midterm elections in November, Harrison added:

On Wednesday, Texas's Republican Governor Greg Abbott announced that his administration wishes to "resurrect" a 1981 Supreme Court case that guarantees the right of all children to public education. The case in question is Plyler v. Doe, in which the court looked at a Texas law that withdrew funds from public schools that enrolled undocumented immigrants as students. After determining that undocumented immigrants are, indeed, "persons," the court struck down the Texas law.

While Republicans are dusting off their obsessive desire to police American bedrooms, they are starting to notice that Alito's argument has implications for all the human rights they wish to end. No more men or women restrooms.

Why the stock market is getting thrashed after rallying on Fed hike

So much for the Federal Reserve being the friend of the stock market.

The Dow Jones Industrial Average plunged 1,000 points on Thursday as traders reassessed what Fed Chair Jerome Powell said at his post-decision press conference yesterday.

A perception of a less hawkish Powell was embraced by the markets on Wednesday afternoon.

The Dow Jones Industrial Average soared 932.27 points and the S&P 500 gained 2.99%, which were the largest gains for the two indices since 2000. Even the beaten-up Nasdaq Composite popped 3.19%.

It now appears that after a few hours of deep thought, traders have formed a more lasting near-term view that the Fed is far from dovish, has let inflation get out of control, and is still poised to dramatically slow down the economy through a series of 50 basis point rate increases.

"Inflation is still going to be a major problem throughout the rest of this year and beyond," Miller Tabak Chief Markets Strategist Matt Maley said.


Selling pressure today was widespread and in some cases severe.

So here's the reality: It's not going to be single 0.5% basis hike that does the trick. It's going to take a sustained series of 0.5% hikes, and maybe even a full 1.0% hike if inflation won't stop.

And this is going to go on for a year or two. A year or two of constantly tightening up the money supply and therefore tamping down economic activity.

This is going to be grueling. Grueling, miserable, sad, dispiriting, heartbreaking, immiserating, depressing, and, seemingly, never-ending.

And they're going to have to raise interest rates so high they're probably -- almost certainly -- going to crash the economy into deep recession.

And the inflation is such a threat that "deep recession" is now an acceptable alternative to very high inflation which would wipe out retirees' savings.

That's where Brandon has brought us. This moderate, sensible man vouched for by NeverTrump who would bring about a Return to Normalcy.

How the Second Amendment will save the world

It is no secret that the founding of the United States of America has profoundly and beneficially impacted the prosperity of the entire world.  By extension, the Second Amendment of the U.S. Constitution is one of the key tools, and last resort, to ensure that prosperity continues.

According to the American Enterprise Institute:

In the decades that followed World War II, America exercised its leadership to underpin and shape globalization in a manner that ensured economic prosperity both at home and abroad. This international economic system, which could not have been created without America, has been responsible for lifting nearly a billion of people [sic] out of poverty at a pace never before seen.

We did this by promoting lower international trade barriers, fairer trade standards, and consistency.  Our conservative and capitalist values and the strategic use of military power ensured the safe and cost-effective movement of goods throughout the world.

The exceptions, at first, were socialist countries and other dictatorships that sought to exert absolute control over the local production of goods and food.  They sought absolute control over their citizens, too.

Although it is not the case today, during the height of the Cold War, the U.S. shipped millions of tons of grain to the USSR, which could not sufficiently feed its own people.  In 1985 alone, the U.S. sold 85 million tons to the USSR.  The USSR's dependence on imported grain became one of the driving factors behind perestroika.  Economic reforms and the collapse of the Soviet Union's centralized economy led to Russia and Ukraine being major exporters of grain today.

In other words, freedom and capitalism matter, and the drift of the U.S. toward socialism is a huge threat to global prosperity.  The U.S. Constitution is based upon limited government, the primacy of the people, personal freedom premised on a capitalist economic system, and the moral precepts of Judeo-Christianity.

To ensure the primacy of the people over the inevitable encroachment of the government into our lives, the Founders enshrined the Second Amendment into the Bill of Rights.  Contrary to popular belief, this amendment is not so hunters may hunt or for the sake of protecting shooting sports.  The Second Amendment exists so that the people can protect themselves from government encroachment.

It took a decade of frustration with England's actions in the American colonies after the French and Indian War for free-minded conservatives like the Founders to decide to act — and act they did.  Despite attempts to work with the English government to stay a part of the United Kingdom, over time, the Founders saw no alternative than to declare independence.  By force of arms and a tragic war, the United States was born.  It was as much a civil war as a war with England.

Is there still time to use political means to shift our trajectory back to the principles that made our country the "shining city on the hill" that so many others have tried to imitate?  I pray for the political answer but take some comfort in the fact that our Second Amendment is there as a backup.  War is a horrible thing and a very last resort for preserving our freedoms, realigning our principles, and staying in a leadership position in the world.  If we fall to socialism, so too will the rest of the world.

The US anti-abortion legal organisation, the American Center for Law and Justice (ACLJ), a second religious freedom organisation that takes on legal cases to challenge abortion and LGBTQ+ rights, has also operated in Europe. Set up by the Republican Pat Robertson, who famously accused feminism of turning women into lesbians, ACLJ’s chief counsel is a former Trump defence attorney, Jay Sekulow. ACLJ spent $15.7m in Europe from 2008-2019.

So far you can see how big money, the judiciary and religious freedom movements have come together in the US and Europe. But there’s another active force that has pushed us towards the end of Roe: the far right.

Far-right theories circulate globally – that’s why people outside the US shouldn’t just act in solidarity with American women at this time, but prepare to stand up against the possible erosion of their own hard-won rights.

The cooperation deal would also technically involve Giuliani turning over documents in addition to appearing before the select committee, the sources said, but the logistics were unclear given the FBI last year seized his devices that he used on January 6.

The justices ruled that while abortion is not specifically referenced in the constitution, it is protected under rights to privacy that are themselves protected under the constitution’s guarantees of liberty, particularly within the ninth and 14th amendments, the latter of which prohibits a state from depriving “any person of life, liberty, or property, without due process of law”.

Scott, the chairman of the National Republican Senatorial Committee, issued a memo with proposed talking points on abortion after the leak of a draft Supreme Court opinion that would overturn Roe v. Wade, which in 1973 made abortion legal across the United States.

The problem with this talking point is that one can easily find laws proposed or passed by Republicans that would jail doctors.

We can start with Scott himself. Along with 44 other Republican senators, he is co-sponsor of a bill, the Pain-Capable Unborn Child Protection Act, that makes it a criminal offense to perform an abortion if the development of the fetus is at 20 weeks or more. A violator is subject to criminal penalties — a fine, a prison term of up to five years, or both.

Hmm, who would perform an abortion other than a doctor?

In Scott’s home state of Florida, Gov. Ron DeSantis (R) signed a bill last month that bans virtually all abortions after a gestational age of 15 weeks, even in cases of rape or incest. “If a physician violates the ban, they would be guilty of a third-degree felony, punishable by up to five years in prison and a $5,000 fine,” said the Tallahassee Democrat.

In Oklahoma, the Republican-dominated legislature passed — and the Republican governor signed — a bill that made abortion a felony and penalized doctors who perform abortions. A doctor convicted of violating the law could face up to 10 years in prison and $100,000 in fines. “The penalties are for the doctor, not for the woman,” said GOP state Rep. Jim Olsen, who sponsored the bill.

In 2019, Alabama’s Republican governor signed a law that put doctors who perform abortions in the same legal category, Class A felony, as rapists, murderers and kidnappers. The minimum sentence for a Class A felony is 10 years, but it can go as high as 99 years in prison or life.

There are many more examples, such as a new law in Arizona that threaten doctors who perform certain abortions with a minimum of six months in jail and a GOP proposal in Ohio to punish doctors who perform abortions with up to two years in jail.

To sum it up, this talking point is bunk. Anyone who made this claim would make a fool of themselves.

America’s labor market maintained its strong momentum in April, as the U.S. economy added 428,000 jobs — above the consensus estimate of 395,000. The unemployment rate remained unchanged at 3.6 percent.

Average hourly earnings for workers climbed by 0.3 percent month-on-month, a slower pace than the 0.5 percent seen last month. Year-on-year, earnings were up 5.5 percent, compared with an inflation rate of 8.2 percent. That means many workers, even if employed, may not be benefiting from the post-pandemic economic recovery.

The data will most likely keep pressure on the Federal Reserve to act aggressively to pull inflation down from 8 percent to 2 percent.

Economists believe the Fed is likely to raise rates by another 0.5 percent in June. In a news conference Wednesday following the Fed's announcement of a 0.5 percent interest rate increase for May, Chairman Jerome Powell noted that labor demand remained "very strong," while labor supply remained subdued.

"Employers are having difficulties filling job openings, and wages are rising at the fastest pace in many years," Powell said.

The factors that led to the so-called Great Resignation — too-low wages, federal economic stimulus, higher savings and workers seeking to avoid in-person jobs amid the pandemic — appear to be persisting.

Now, to fight inflation, Powell and the Fed are seeking to guide economic growth down to a trend where workers would keep their existing jobs while businesses would announce fewer job openings. This week, the U.S. Department of Labor announced job openings had increased from 11.3 million to 11.5 million in April — a new all-time.

The proportion of working-age people who have a job or want one fell by 0.2 percentage points to 62.2%, and the number of people not in the labor force rose by 478,000.Construction employment rose by a mere 2,000 jobs in April, which again could be a statistical fluke — or could be the canary in the coal mine suggesting that higher interest rates are starting to bite in building industries.

The bottom line: The job market remains in excellent shape for now; indeed, Fed chair Jerome Powell has called it "tight to an unhealthy level." If it softens in the months ahead, he won't be upset.

He may not raise the interest as fast as expected.
We might not have a recession.

The government’s measure of productivity for the first quarter sank 7.5 percent, far more than the 2.5 percent expected. Productivity is a blunt measure of economic performance that balances hours worked against total output. So, a big decline in productivity is unwelcome at any time, but it is particularly bad for a quarter where we already know the economy contracted 1.4 percent. Also, many of those jobs were in some of the least productive parts of the economy, like leisure and hospitality. We tend not to like to think of the bartender at our local saloon as unproductive, and certainly the waitress at the local diner seems to get more done in an hour than we would; but those are low productivity jobs as measured by the government’s official statistics.

Skyrocketing prices on essentials are forcing some older Americans out of retirement as U.S. inflation continues to hit new highs.

In just the past six months, about 480,000 adults over 55 began looking for a job, according to reporting by the Wall Street Journal. That’s compared to the 180,000 adults looking in the six months prior to the pandemic. This increase is credited in part to the outsized impact inflation is having on the ability of people to retire.

The government’s consumer price index, released Tuesday morning, showed prices shot up 8.5% in March compared to 12 months earlier, according to a report by the Labor Department. This marks the fastest year-over-year inflation rise since December 1981 and surpasses the 7.9% 12-month increase in February, which itself set a 40-year high.

There are tens of millions of jobs that don't require a college degree. But they are highly trained and motivated to work for their families.

A prime example is the construction business. They require highly skilled and trained employees to build highly complex structures and even like I worked.

The construction unions provide highly complex training for mechanics and electrical systems and plumbing systems and carpenters who build the structures , you have no idea how complex it is. There are many people who don't move up into foreman jobs or superintendent jobs, but they still make good money and insurance and defind benefit pension that are guaranteed for life.

You really don't understand how complex it is now especially since the internet systems have been put in place.

This administration is probably going to eliminate right to work legislation. Millions of people will have good jobs and health insurance

The presence of such laws was not the only factor involved, to be sure, but the data is strongly suggestive of a correlation of some significance, especially considering that seven of the 10 biggest gainers are RTW states, while seven of the bottom 10 are not.
