The biggest issue with the Jan 6th "get Trump" commission is that they are trying to use a whole bunch of either perfectly legal (at best) or constitutionally questionable (at worst) action to create this narrative that when you put it all together... the end result is criminal?

From the concept of alternate electors, to Pence delaying the counts, to filing election challenges in court, absolutely none of it is actually illegal. They can refer to alternate electors as "fake electors" or whatever. They can word Pence delaying the count into something that sounds nefarious. They can even suggest that court cases are somehow illegal.
But rhetoric is not law.
To the questions of whether or not Pence had the right to delay the counting...what the USSC might have declared at the end of the day would sort out the constitutional issue, but it would not create a criminal statute to charge anyone. Pence would never be criminally liable for taking that action and certainly Trump could not be criminal liable for requesting it.
So what about this idea that delaying the certification for a period of time is criminal?
Some sort of "obstruction of Congress?
Let's be clear here folks!
Everyday Congress attempts to perform certain duties. Everyday someone tries to hold it up through blocking of some committee vote, some procedural move, or even the classic filibuster. Delaying Congress from moving forward with something is as natural to Congress as anything they do. If delaying a Congressional act was illegal, every member of congress would be in jail and someone would have thrown away all the keys.
This is why we have had hours and hours of Democrats and a couple of Trump hating Republicans trying to tell us what Trump was "thinking". Because at the end of the day, their entire case is built on the premise of "corrupt intent". It literally has to be, because otherwise nothing that was done is criminal or even close to it. You can only "make" it criminal by proving some sort of criminal or corrupt intent.
But how do you prove that Trump believed that he lost when Trump still demands every single day that he won. He has not wavered one bit from this belief and there are literally tens of millions who believe the same thing.
Here is the deal... Then could roll out a million "experts" who can demand that Trump had no legal recourse and that anything he did would fail. That still doesn't make it a crime or provide criminal intent for him to have tried. They could roll out two million more witnesses to demand that he was wrong about election fraud. But Trump believing as such (along with over 50% of the population) is also not a crime, nor does it provide criminal intent.
Smoking gun? Nope. Not even close. They don't even have a wet squirt gun.

Retired U.S. Judge J. Michael Luttig, a former appellate judge on the Fourth Circuit, and a respected conservative voice, was one of several legal experts who testified on the third day of public hearings.
The goal of the hearing was to argue that Trump had pressured then-Vice President Mike Pence to follow what they considered an constitutional path of refusing to certify the Electoral College vote from several states, sending the vote back to the state legislatures for further consideration.

Jacob also noted that Democrats had tried to stop the certification of the Electoral College vote in 2000, 2004, and 2016. Among those was Raskin himself, who tried to reject Electoral College votes to declare Trump the winner in 2016.
Luttig also declined to take the bait when presented with evidence that Eastman had once argued against his own position. (Lawyers often make opposing arguments in different circumstances, and must often argue against their own past or personal views if a client wishes to pursue a case.)
Rep. Pete Aguilar (D-CA) then tried to defend of Democrats’ past actions by pointing out that Vice President Al Gore never claimed the power to declare himself the winner in 2000. But nor did Trump and his team; they wanted the states to decide.

One of America's top constitutional experts predicted that his former student, Attorney General Merrick Garland, would criminally charge Donald Trump for his attempted coup.
On Thursday, CNN's Erin Burnett interviewed Laurence Tribe, professor emeritus at Harvard Law School where he taught for 52 years, teaching the Constitution to some of the most powerful people in America.
Tribe taught Jan. 6 select committee members Jaime Raskin (D-MD) and Adam Schiff (D-CA) and Supreme Court Chief Justice John Roberts.
"With the hearing today that focused so much on Trump causing violence against Pence, do you believe the committee has proven that Trump himself knowingly committed crimes?" Burnett asked.
"Without any doubt," Tribe said.
Trump and Eastman were co-conspirators. Recall that when a federal judge recently posited that laws were broken in connection with Jan. 6, he asserted that both Trump and Eastman may have committed crimes.
In those court papers, the judge wrote that they may have committed “conspiracy to defraud the United States.” He suggested they enter into an agreement to obstruct a lawful function of government — Congress’s counting of electoral votes — and that both “likely knew” the plan was an illegal violation of the Electoral Count Act of 1887. Corrupt pressure on Pence may have constituted the requisite “act” in furtherance of that conspiracy.

Luttig outlined in his statement how close he believed democracy came to the brink.
"It is breathtaking that these arguments even were conceived, let alone entertained by the President of the United States at that perilous moment in history," Luttig wrote.
"Had the Vice President of the United States obeyed the President of the United States, America would immediately have been plunged into what would have been tantamount to a revolution within a paralyzing constitutional crisis."
Luttig was involved in advising the Pence team against claims from Trump allies like attorney John Eastman, who wrote a memo saying Pence had the power to single-handedly block the certification of the election for Joe Biden.
Luttig concluded that January 6 "was the final fateful day for the execution of a well-developed plan by the former president to overturn the 2020 presidential election at any cost."
The retired judge praised Pence for his actions on January 6 and his willingness to stand up to Trump and his allies. "There were many cowards on the battlefield on January 6," Luttig wrote. "The Vice President was not among them."
On January 5, 2021 -- after Pence's lawyer, Richard Cullen, called Luttig asking for help -- Luttig tweeted a statement explaining that the Constitution gave Pence no powers to reject electors and overturn the election, as Trump was demanding. Pence cited the statement in his letter on January 6 explaining why he would defy Trump and certify the election.

U.S. stocks opened higher Friday, putting major indexes on course to extend the whipsaw moves that have injected fresh volatility into markets this week.
The S&P 500 rose 0.7% after the opening bell. The Dow Jones Industrial Average added 0.3%, and the Nasdaq Composite climbed 1.4%. All three major indexes fell Thursday, closing at their lowest levels since 2020. Thursday's decline reversed a rally in stocks Wednesday.

The hearings of the House committee investigating the Jan. 6 insurrection have already provided conclusive evidence that the effort to overturn the 2020 election was a conspiracy directed by a corrupt sitting president who knew the effort was based on lies and encouraged violence in pursuit of power.
The damning testimony before the committee and the persuasiveness of its case has been widely analyzed. But a frank discussion of accountability for the insurrection has been muted.
There is a reason for this. The gravity of the crime exceeds any an American president has ever been suspected of committing, and the scale of culpability is greater than many citizens are comfortable contemplating.
Another reason, one that puts the country in peril, is that too many Americans continue to support the perpetrators.
Rep. Bennie G. Thompson of Mississippi, the Democratic chairman of the House Select Committee to Investigate the January 6th Attack on the United States Capitol, set the tone for the hearings a week ago in his opening statement.
“It was domestic enemies of the Constitution who stormed the Capitol and occupied the Capitol who sought to thwart the will of the people to stop the transfer of power,” he said. Later he said, “Ultimately, Donald Trump — the president of the United States — spurred a mob of domestic enemies of the Constitution to march down the Capitol and subvert American democracy … January 6th was the culmination of an attempted coup. … Violence was no accident. It represented Trump’s last stand, most desperate chance to halt the transfer of power.”
Thompson’s use of the phrase “domestic enemies” was deliberate. He noted the Civil War-era adoption of language regarding “all enemies — foreign and domestic” in the federal oath to account for the South’s rebellion.
In other words, the crimes committed by Trump and his co-conspirators are categorically akin to war-waging against the United States.

If the House Jan. 6 committee proceeds to its seemingly predetermined conclusion that President Donald Trump incited the Capitol riot and tried to reverse the results of the 2020 election and if it recommends to the Department of Justice that Trump committed criminal acts and should be prosecuted, President Joe Biden will face a serious choice.
Biden, who promised to unite the country but who most Republicans believe contributed to its division, could either allow the prosecution of the former president to proceed or travel the high road taken by President Gerald Ford when he pardoned President Richard Nixon for acts associated with the Watergate scandal. If Biden chooses the former, the division will likely widen to a chasm not to be repaired for years to come. If he chooses to follow Ford’s example, he would arouse the ire of progressives but might avoid the specter I doubt most rational Americans would wish to see — a former president in court and possibly in prison.
Perhaps a deal could be struck. In exchange for a pardon, Trump would agree not to run for president again.

It would be difficult for any prosecutor to convince a jury (except in heavily Democratic Washington, DC) that Trump caused the riot by his language. In a sound bite played by the committee, it is true that Trump did urge protesters to go down to the Capitol. True, he seemed to agree with the sign brought by one protester that said, “Hang Mike Pence,” but that is different from giving the order.
One can be disgusted by Trump’s behavior and failure even now to accept the results of the 2020 election — I am — and still not want to see a precedent set that leads to the trial, conviction and imprisonment of a former president. Not only would this add fuel to the political forest fire that is already consuming the country, it would encourage some Republicans to do the same to a future Democratic president. Impeachment and indictments would become a norm, not an exception.

Tribe further predicted that Attorney General Merrick Garland would criminally charge Donald Trump.
If so, Garland may want to consult with other experts before including this particular charge. Tribe’s suggestion that Trump could be prosecuted for attempted murder on this evidence is utter nonsense.
The Select Committee has not made such a claim but has promised that a criminal conspiracy will be established by the hearings. That evidence may still be forthcoming, but that case has not been made in my view in the last three hearings. There have been new videotapes and testimony supporting what we already knew: that Trump was told that the election fraud claims were unsupported and that he continued to assert a theory about Pence’s authority that most of us rejected as unfounded. The testimony has been powerful and gut-wrenching. Yet, there has to be more direct and substantial links to the violence to offer a compelling basis for prosecution.

People like Turley and McCarthy remain the adults in the room... and are the only ones willing to consider precedent, the law, the facts, and the reality that Garland is facing.

His words to walk "peacefully" to the Capital can be edited out by the Jan 6th commission (as they dishonestly did)... but Garland cannot edit them out in a trial.
There has been no establishment of Criminal intent.
Again, Trump's own actions and words even today make it damned clear that he believed and still believes that there was election fraud and that it could be (or should be found). Ironically the recent exposure of ballot harvesting schemes and guilty pleas of people committing fraud strengthens his argument.
Garland cannot (as the Jan 6th commission is doing) rely on second hand opinions on how someone else believed Trump felt or should have felt about that subject. None of that would be allowed at a trial.
Garland would NEED to have proof that Trump himself stated that he believed that there was no election fraud, that he lost fair and square, but was determined to overturn things anyways. He would need to get either Trump on the stand to admit it. Provide multiple witnesses who heard Trump say this very specifically. Or he would need some sort allowable audio of this.
This is where people do not understand the difference between what a political hearing is allowed to do and what a prosecutor is allowed to do.
It is also why media experts and never right scholars like Tribe seem to have 180 degree differing opinions than actual prosecutors like McCarthy or people like Turley. They are willing to consider the limitations to what a prosecutor can and cannot take to trial.

The warning about “a revolution within a constitutional crisis,” didn’t come from Rachel Maddow, the guys who run Pod Save America, the NYT’s editorial page, or the usual prophets of Armageddon.
This was Michael Luttig, a conservative’s conservative; a former federal appeals court judge, who was on George Bush’s short-list for the Supreme Court.
Unfortunately, because we are all doomed to spend eternity in middle school, much of the buzz yesterday focused on how slowly Luttig spoke.

Also, despite the staff assistance they may get from experienced prosecutors (there are several working for the January 6 committee), congressional committees are not steeped in criminal law. The reporting on the basis for the January 6 panel’s assumption that sufficient evidence has been gathered to warrant a referral of Trump indicates that the committee’s grasp of the crimes at issue is tenuous.
And then there is the matter of comparative risk. In recommending charges, congressional partisans have everything to gain and nothing to lose. When they make provocative criminal allegations, they score political points, but no one expects them to prove their claims. It is the executive branch that bears the burdens of prosecution, grappling with complexities of the case and the fact that evidence sometimes writes more compellingly in a political referral than it plays out in the adversarial test of a criminal trial.
Further, the DOJ, unlike congressional committees, must go through a second layer of analysis in exercising prosecutorial discretion. Even if there may technically be a potential crime, the offense may not meet the DOJ’s standards, such that charging it would leave prosecutors open to charges of selective prosecution and politicized enforcement. Or there may be other public interests that weigh against charging — for example, bringing a weak or legally dubious case in an electoral context would intrude law enforcement into politics and invite payback when, eventually, the other party is back in power.
Apparently, committee sources told the Times that they believe they had proof of Trump “conspiring to defraud the American people.” There is no such crime — and many politicians should be grateful for that, including several January 6 committee Democrats.

It came in the context of civil litigation over Trump lawyer John Eastman’s effort to block the committee from access to subpoenaed emails. These comprised communications about Trump’s legal strategy for overturning Biden’s election victory.
Eastman invoked the attorney–client privilege (ACP). As a result, one narrow question for the court was whether the so-called crime/fraud exception to the ACP applied. Under that exception, the ACP does not protect lawyer/client communications that are in furtherance of illegal or fraudulent schemes. The burden of proof for such questions is not onerous: the civil law’s preponderance of the evidence standard — in this instance, was it “more likely true than not” that Trump and Eastman had engaged in a crime?
Carter concluded it was likely that they had committed the crime of conspiracy to obstruct a congressional proceeding (i.e., to impede the January 6 joint session at which state electoral votes were to be counted and Joe Biden’s victory acknowledged). That is one of the main criminal charges brought against many of the Capitol riot defendants. Significantly, Carter did not draw any conclusions under the criminal law’s demanding burden of proof. That is, he neither made nor was asked to make a finding that there was proof beyond a reasonable doubt that Trump (or anyone else) was guilty of a crime. Again, he employed the civil-preponderance standard. Plus, Carter made his ruling on a sparse record. Trump was not a party to the lawsuit, and thus did not have counsel presenting a defense and challenging the crime/fraud claim. Clearly, it would be far more difficult for prosecutors to convict Trump of this charge in a criminal jury trial, than it was for the committee to convince a sympathetic judge that he is “probably” guilty in a civil proceeding where Trump had no opportunity to defend himself.

The select committee has long emphasized its belief that Trump’s actions amounted to a crime. It asked U.S. District Court Judge David Carter in March to invalidate Eastman’s claims of attorney-client privilege over thousands of emails, in part by suggesting some fell under the “crime-fraud” exception. Carter agreed, and issued a ruling — cited over and over again by the committee in its first three public hearings — saying Trump and Eastman “likely” entered into a criminal conspiracy to obstruct Congress.

The frustration goes both ways, as the select committee has vented about the department’s refusal to act on criminal contempt referrals of key witnesses in their investigation.
