USSC overturns Roe v Wade 6-3

The only real surprise was Roberts joining the majority

Falls in with the majority

Roe v Wade was never a good decision and is proof of what happens when you decide to run to court when you don't have the votes to change something. In some cases time might help with a court decision. I doubt there will be any reason to readdress gay marriage. But abortion has been a hot button issue, is currently a hot button issue, and will continue to be a hot button issue.

Live by the courts, die by the courts. Better off winning elections and passing laws. Abortion was never a constitutional right or a law. It was always a fragile court decision. Nothing more.

Justice Clarence Thomas on Friday confirmed some of the darkest warnings about the U.S. Supreme Court overturning Roe v. Wade.

The conservative-dominated court overturned the landmark decision that enshrined a woman's right to an abortion and said individual states can permit or restrict the procedure themselves.

"The Constitution does not confer a right to abortion; Roe and Casey are overruled; and the authority to regulate abortion is returned to the people and their elected representatives," the court said.

The right-wing court had been expected to overturn the ruling after a draft circulated showing that Justice Samuel Alito had written a decision striking down Roe in the case Dobbs v. Jackson Women's Health Organization, and many warned the court would next target other agreed-upon rights.

Thomas opened the door to that in a concurring opinion to the 6-3 ruling in Dobbs, saying the court should reconsider rulings that protect the rights to contraception, same-sex relationships and same-sex marriage.

Women will be forced to carry pregnancies resulting from rape, and incest, to give birth to children with fatal diseases, and, in some states, to give birth even when it threatens their own life.

If you have a teenage girl, if she is raped she has to give birth to the baby. I understand feelings but she should have a choice.

The court said its decision was limited to abortion, because it alone involves the termination of a potential life. But in a concurring opinion, Justice Clarence Thomas said the line of cases related to Roe—which under the constitutional guarantees of due process and liberty recognized rights to birth control pills, struck down sodomy laws and, in 2015, provided for same-sex marriage—should be overruled as well.

Republican senator Susan Collins supported justices Neil Gorsuch and Brett Kavanaugh during the confirmation hearings and repeatedly reassured the public that they would not vote to overturn Roe v Wade. But both men joined in today’s opinion doing just that, and now the Maine lawmaker says she was duped.

“This decision is inconsistent with what Justices Gorsuch and Kavanaugh said in their testimony and their meetings with me, where they both were insistent on the importance of supporting long-standing precedents that the country has relied upon,” Collins said.

She elaborated further on her thoughts regarding the decision:

The Supreme Court has abandoned a fifty-year precedent at a time that the country is desperate for stability. This ill-considered action will further divide the country at a moment when, more than ever in modern times, we need the Court to show both consistency and restraint. Throwing out a precedent overnight that the country has relied upon for half a century is not conservative. It is a sudden and radical jolt to the country that will lead to political chaos, anger, and a further loss of confidence in our government.

Collins noted she supported legislation that would codify the rights previously established by Roe v Wade into law, though its unclear if such legislation would win enough support from her Republican colleagues to make it through the senate.

“Our goal with this legislation is to do what the Court should have done — provide the consistency in our abortion laws that Americans have relied upon for 50 years,” Collins said.

WASHINGTON (AP) — President Joe Biden said Friday that “it’s a sad day for the court and the country” after the Supreme Court overturned Roe v. Wade, the landmark 1973 decision that legalized abortion nationwide.

“Now with Roe gone, let’s be very clear, the health and life of women across this nation are now at risk,” he said from the White House.

He added that “the court has done what it’s never done before — expressly taking away a constitution right that is so fundamental to so many Americans,” he said.

The White House has been preparing for this moment since a draft of the decision leaked in May. Officials have been huddling with state leaders, advocates, health care professionals and others to prepare for a future without Roe v. Wade.

Now Biden’s plans will be tested in terms of politics and policy. Biden said his administration would defend a woman’s right to cross state lines to seek an abortion.

Outside the Supreme Court, a crowd of abortion supporters swelled to the hundreds after the ruling was issued. One chanted into a bullhorn, “legal abortion on demand” and “this decision must not stand.” Some shouted “the Supreme Court is illegitimate.”

“It’s a painful day for those of us who support women’s rights,” said Laura Free, an Ithaca resident and women’s rights historian who came to Washington to do research. When she learned of the decision, she said, “I had to come here.”

While the question is whether or not a state can create an abortion ban before the viability question, it sounds like Roberts would have preferred the question to not be "yes" or "no" but rather a situation the "viability" from Roe is replaced with a new criteria from this court.

By overturning Roe v. Wade and Planned Parenthood of Southeastern Pennsylvania v. Casey, the Supreme Court has taken away the guaranteed right of people to make the most basic decisions about their bodies, their pregnancies, their families, and their futures.

As a result of this ruling, many people will lose access to abortion or face new difficulties in obtaining this vital service as states use the Court’s new permission slip to abrogate the freedom to control one’s own body. The Court’s actions today signal that other fundamental rights could be at risk as well.

“No one should have to cross state lines to exercise their most basic rights and plan their futures.”

And the burden will fall hardest on the people with the fewest resources, disproportionately people of color, immigrants, and others who have historically been marginalized.
