CNN's Chris Cillizza argues with John Bolton about the definition of a coup...

What John Bolton gets wrong about coup attempts -- and Donald Trump

Tapper: "One doesn't have to be brilliant to attempt a coup."
Bolton: "I disagree with that. As somebody who has helped plan coups d'etat -- not here, but, you know, other places -- it takes a lot of work. And that's not what he did. It was just stumbling around from one idea to another. "

Cillizza: 

But also, to my mind, wrong. And proven wrong by several things that we know Trump contemplated doing during the period between when he lost the 2020 presidential election and when Joe Biden was inaugurated as the 46th president on January 20, 2021.
So these two have one thing in common. They both loath Donald Trump with the white hot passion of a thousand burning suns. But they have way different "real world" experiences with the world stage and how Governments work.

Bolton doesn't see this as a coup for obvious reasons. He has been involved with real coups in the past. Coups are generally "overthrowing of a Government" by a third party power. They are pretty much 100% armed takeovers as well. Our 2020 election was 90% legal battle and 10% bluster.  Trump was not an out of power party trying to overthrow a Government. He was the Government leader attempting to stay in charge. 

Cillizza sees things differently either because he actually does believe that the most powerful superpower in the history of the planet can be taken down by a few hundred unarmed people and a few dozen armed with bear spray and flagpoles... or he simply wants to believe media spin. Either way, it is not based on reality.

With all the threats facing our democracy, does it really matter that Joe Biden is old?



Our story so far...

The Extreme Court just gutted reproductive rights, shredded a New York law that helped keep guns out of public spaces for more than a century and crippled the Environmental Protection Agency in the face of a global climate crisis.

Georgia may soon send to the Senate former football star Herschel Walker, last seen claiming the Green New Deal would make America’s “good air decide to float over to China’s bad air.” Amazingly, he would not be the dumbest Republican in Congress.

Many observers fear, as election deniers run to become election officials all over the country, that 2024 could be the last time Americans cast a meaningful ballot. Fascism is on our doorstep.

So does it matter that Joe Biden is old?

The realization seems to have struck Democrats all at once that the president, born Nov. 20, 1942, is no spring chicken. If elected to a second term, which he seems intent on seeking, he would be 86 years old when he left office. The famously ancient Ronald Reagan, by comparison, was a mere child of 77 when his White House years came to an end.

In recent days, the president’s age — and concern over his subterranean poll numbers — have fueled debate among the party faithful on the feasibility and desirability of another term.

The New York Times has not been laggard in reporting on it. “Should Biden Run in 2024?” asked one headline. “At 79, Biden is Testing the Boundaries of Age and the Presidency,” declared another. A Monday story was headlined, “Most Democrats Don’t Want Biden in 2024, New Poll Shows.” A Tuesday opinion column by Michelle Goldberg made it explicit: “Joe Biden Is Too Old To Be President Again.”

It is worth noting that Biden was elected for one reason above all: to not be Donald Trump. In that, he has succeeded. Decency, predictability, stability and maturity have all returned to the White House after a four-year exile.

None of which, unfortunately, puts gas in your tank or baby formula on your shelves. And Biden has had the profound misfo35222rtune of reaching office only to find, hemmed in by the usual Republican obstructionism and kneecapped by the mulish intransigence of putative Democrats Joe Manchin and Kyrsten Sinema, that there is little he can do with it. Nor is it at all clear that things would be different if he were 40 years younger.

Not to deny Biden’s failings or to dismiss concern over his advanced years. Certainly there would be, in normal times, plenty of room to argue both.

But the point is, these are not normal times. And if, as the saying goes, you don’t change horses in the middle of a stream, you sure as heck shouldn’t do it in the middle of a tsunami.

On Monday, Stuart Stevens, a veteran Republican operative, took to Twitter begging Democrats to understand this. “As a former R. consultant,” he wrote, “I bear responsibility for the democracy eating monster the party became, so I get Dems don’t want to hear this from me. But I’d plead with Dems to rally around (President Biden). He’s your guy. You’re going to win with him or lose with him. Make the choice to win.”

It is advice Republicans would never need to hear and Democrats can’t hear often enough. If we are lucky, there will again come a time when we can afford to argue whether a president is too old or his poll numbers too low. But this is not it. Democracy is under mortal threat.

And you don’t hold a debate in a burning house.

The letter, which was originally sent to the House and Senate Homeland Security Committees by the Department of Homeland Security Inspector General, says the messages were erased from the system as part of a device-replacement program after the watchdog asked the agency for records related to its electronic communications.

"First, the Department notified us that many US Secret Service text messages from January 5 and 6, 2021, were erased as part of a device-replacement program. The USSS erased those text messages after OIG requested records of electronic communications from the USSS, as part of our evaluation of events at the Capitol on January 6," the letter from DHS IG Joseph Cuffari stated.

The Secret Service has been in the spotlight since witnesses have described how former President Donald Trump angrily demanded that his detail take him to the Capitol following his speech at the White House Ellipse – shortly before rioters breached the building.

A former adviser to then-Vice President Mike Pence also referenced the Secret Service in his testimony. Greg Jacob, Pence’s former counsel, told the panel that Pence refused to get into the vice presidential vehicle after being evacuated from the Capitol, raising concerns that the driver would have taken him to a secure location and thus prevent him from certifying the electoral results.

A few weeks before Cobb left, Trump tweeted: “I have full confidence in Ty Cobb, my Special Counsel, and have been fully advised throughout each phase of this process.”

A lot happened after Cobb’s departure. Mueller ended his probe without charging Trump with any crime. Trump lost the election, refused to concede, and presided over a rally on Jan. 6, 2021 that ended with a mob of his supporters ransacking the Capitol as lawmakers met to certify Joe Biden’s victory.

The United States Secret Service is in yet another scandal over its performance during the Jan. 6 attack on the U.S. Capitol.

"The Secret Service erased text messages from January 5 and January 6, 2021, according to a letter given to the January 6 committee and reviewed by The Intercept. The letter was originally sent by the Department of Homeland Security Office of Inspector General to the House and Senate homeland security committees. Though the Secret Service maintains that the text messages were lost as a result of a 'device-replacement program,' the letter says the erasure took place shortly after oversight officials requested the agency’s electronic communications," The Intercept reported Thursday.

Former White House aide Cassidy Hutchinson testified that Trump scuffled with Secret Service agents as he sought to join his MAGA crowd's riot.

"The Department of Homeland Security — Secret Service’s parent agency — is subject to oversight of the DHS Office of Inspector General, which had requested records of electronic communications from the Secret Service between January 5 and 6 of 2021, before being informed that they had been erased. It is unclear from the letter whether all of the messages were deleted, or just some. DHS officials have also pushed back on the OIG’s records request by arguing that the records must first undergo review by DHS attorneys, which has delayed the process and left unclear if the Secret Service records would ever be produced, according to the letter," The Intercept reported.



The established timeline shows the messages were deleted after the request to produce documents.

"A top Secret Service official allegedly involved in the attempt to spirit away Pence on January 6 remains in a leadership position at the agency. Tony Ornato, a Secret Service agent whom Trump made the unprecedented decision to appoint as his deputy White House Chief of Staff, reportedly informed Pence’s national security advisor, Keith Kellogg, on January 6 that agents would relocate the Vice President to Joint Base Andrews," The Intercept reported. "Today, Ornato serves as Assistant Director at the Secret Service’s Office of Training."

CNN confirmed the report.

Then how come Roger states now that his score was 2100?

The SAT used a 2400 point scale till 2016 when it was redesigned to be 1600. You can look that up almost anywhere.

Roger's 1590 would have been the equivalent to 1050 - not exactly MIT or Harvard material!

My score that was right at 2000 (1999) - put me in the 92 percentile. But I took my test as a Jr (as a practice or pretest) but since the score was high enough to get me anywhere I wanted to go... I never retook it as a Sr. Didn't need to.

No doubt I would have scored higher with another year of college prep education under my belt. But I had no real thoughts about Ivy League or MIT. I went to school locally so retaking the test just to get a higher score was moot.

The chair of the Jan. 6 select committee on Thursday said the panel will try to ”reconstruct" deleted U.S. Secret Service text messages flagged by an agency watchdog.

Why it matters:
The text messages were from Jan. 5 and 6 and may have contained evidence about key events related to the Capitol attack — the focus of the panel’s hearing next Thursday.

They could shed light on reported efforts to remove former Vice President Mike Pence from the Capitol, and former President Trump's alleged attempts to travel to the Capitol to join his supporters on that day.

The agency — and in particular Anthony Ornato, an agent who also served as White House deputy chief of staff — was a central subject of former White House aide Cassidy Hutchinson's testimony to the panel last month.

Driving the news:
The inspector general for the Department of Homeland Security, which parents the Secret Service, offered a briefing on the subject in a letter to Jan. 6 Committee Chair Bennie Thompson first reported by The Intercept and obtained by Axios.

Inspector General Joseph Cuffari wrote that DHS said the texts were "erased as part of a device-replacement program."
But, he added, they were erased "after OIG requested records of electronic communications from the USSS, as part of our evaluation of events at the Capitol on Jan. 6." AFTER?

Cuffari also wrote that DHS claimed all records had to be reviewed by the department's attorneys, leading to "weeks-long delays" in obtaining the records and creating "confusion over whether all records had been produced."

What they're saying:
"It's concerning, obviously. If there's a way we can reconstruct the texts or what have you, we will," Thompson, who also chairs the House Homeland Security Committee, told Axios at the Capitol on Thursday.

Thompson said the inspector general "was not clear as to how" the texts were deleted, adding that the committee "asked them some time ago to look at it."

Asked if the committee would bring in Secret Service agents to try to reconstruct the texts, he said, "I think it's important for us to get as much information as much as how this discrepancy occurred."

Thompson said the Jan. 6 panel has not yet interviewed Ornato and Robert Engel, another agent mentioned in Hutchinson's testimony, but said, "We've been talking to them."

Spokespersons for the Secret Service and Department of Homeland Security did not immediately respond to requests for comment.

Trump and his allies lost nearly all the more than 60 cases they brought challenging the 2020 election results, the report noted. Twenty were dismissed before a hearing on the merits, 14 were dropped by Trump and his supporters, and 30 included a hearing on the merits, it found.

The group of conservatives argued that Trump and his supporters had “an obligation to recognize that the election debate was over.”

“Questions of election legality must be resolved dispassionately in courts of law, not through rallies and demonstrations—and most emphatically, not by applying political pressure and threats to induce Congress to ignore its constitutional duty and the electoral outcome for which the people voted, and which the legal processes of the affected states had examined and confirmed,” the report says.

The group urged “fellow conservatives to cease obsessing over the results of the 2020 election, and to focus instead on presenting candidates and ideas that offer a positive vision for overcoming our current difficulties and bringing greater peace, prosperity, and liberty to our nation.”

The January 6 committee has held seven public hearings so far, presenting witness testimony from Trump campaign and administration staffers that there was no evidence of election fraud and that Trump disregarded warnings that his plan to overturn the election was illegal. The hearings have also detailed Trump’s pressure campaign at different levels of government and his attempts to enlist the Department of Justice in his efforts.

Hemphill, a former drug and alcohol counselor, flew to Washington, D.C. from Idaho on Jan. 5 hoping to see the results of the 2020 presidential election overturned. She was arrested in August of 2021.

At her sentencing hearing Tuesday, Senior U.S. District Judge Royce Lamberth, a Reagan appointee, flatly told Hemphill that she will be serving time behind bars.

In addition to the 60 days in jail, Hemphill will spend three years on supervised release. Pursuant to her plea agreement, she will also have to pay $500 in restitution toward the estimated $2.7 million in damages to the Capitol.

“I’m heading to the prison! Just know your prayers and support is keeping me going emotionally and spiritually! Love you guys dearly!” she tweeted on Tuesday.

She reported to the FCI Dublin, a low security correctional facility near San Francisco on Wednesday.

In an interview with Newsmax host Greg Kelly Tuesday night, Hemphill said she was “really frightened” and “scared.”

“I’ve never been to jail—ever,” Hemphill said. “I’m really frightened—I’m scared.”

She said she was pushed into the building, and never picketed or paraded.

“But if that’s what they wanted me to plead guilty to, so I thought okay, my lawyer advised me,” Hemphill told Kelly.

It wasn’t until sometime in February 2021 that Cuffari’s office requested that the Secret Service produce records that centered on Jan. 6 and the days leading up to the attack on the Capitol, seeking internal agency communications, memorandums, emails and telephonic records such as text messages.

By the time of the request, the people said, as many as a third of Secret Service personnel had been given new cellphones.

Most of the replacement program began with staff in Washington offices, and if they did not back up their old text messages, the people said, the information from Jan. 6 and the days before that is lost. That could conceivably include the texts sent and received by former White House deputy chief of staff Tony Ornato and former Trump security detail leader Bobby Engel and other senior leaders in the Secret Service.

This device replacement program, and resulting failure to back-up texts, does not appear to affect emails.

The Secret Service has a policy requiring employees to back up and store government communications when they retire old electronic or telephonic devices, but in practice, staff do not consistently back up texts from phones.

A similar issue came up in 2018, when the Justice Department inspector general said he used “forensic tools” to recover missing text messages from two senior FBI officials who had investigated Hillary Clinton and Trump and exchanged notes critical of the president. The missing messages generated criticism when GOP leaders and the president questioned how the FBI failed to preserve them.

Sen. Gary Peters (D-Mich.), chairman of the Senate Homeland Security and Governmental Affairs Committee, said lawmakers “need to get to the bottom of whether the Secret Service destroyed federal records or the Department of Homeland Security obstructed oversight.”

“The DHS Inspector General needs these records to do its independent oversight and the public deserves to have a full picture of what occurred on January 6th,” he said in a statement. “I will be learning more from the DHS Inspector General about these concerning allegations.”

Ms. Hutchinson said she had been told by Anthony M. Ornato, a deputy White House chief of staff, that Mr. Trump tried to grab the wheel of his vehicle when he was told he could not go to the Capitol to join his supporters, some of whom he had been told were armed. He wrote to the House and Senate committees with jurisdiction over the department on Wednesday, saying that many Secret Service text messages from Jan. 5 and Jan. 6, 2021, “were erased as part of a device replacement program.”

Mr. Cuffari wrote that the texts were erased after the inspector general’s office started an investigation into Jan. 6 and requested electronic communications from the agency. He also reported that Secret Service personnel were declining to provide records to his office without first having department lawyers review them, a process that he said was causing “weekslong delays” and “confusion.”

WASHINGTON (AP) — Secret Service agents deleted text messages sent and received around the Jan. 6, 2021, attack on the U.S. Capitol even after an inspector general requested them as part of an investigation into the insurrection, the government watchdog has found.

The Department of Homeland Security Office of Inspector General, in a letter obtained by The Associated Press, said the messages between Jan. 5 and Jan. 6, 2021, were erased “as part of a device-replacement program.” The erasure came after th5 minutes ago e watchdog office requested records of electronic communications between the agents as part of its probe into events surrounding the Jan. 6 attack, the letter said.

Additionally, Homeland Security personnel were told they couldn't provide records to the inspector general and any such records would first have to be reviewed by DHS attorneys.

“This review led to a weeks-long delays in OIG obtaining records and created confusion over whether all records had been produced,” states the letter, which was dated Wednesday and sent to leaders of the House and Senate Homeland Security committees.

Secret Service spokesman Anthony Guglielmi objected to the letter Thursday night, saying: “The insinuation that the Secret Service maliciously deleted text messages following a request is false. In fact, the Secret Service has been fully cooperating with the OIG in every respect — whether it be interviews, documents, emails, or texts.”

WASHINGTON—Members of the House select committee investigating the Jan. 6, 2021, attack on the Capitol are discussing the next steps in their investigation, including whether to seek an interview with former Vice President Mike Pence and potentially ex-President Donald Trump, according to one of the Republican members of the panel.

Rep. Adam Kinzinger (R., Ill.), the panel member who will be leading some of the questioning at next Thursday’s prime-time hearing, said in an interview ahead of a meeting Thursday that the panel could decide to request a written interview with Mr. Pence. The committee could also discuss whether to issue a subpoena to the former vice president to try to compel him to testify, he said.

The committee is also weighing whether it will ask Mr. Trump to testify, Mr. Kinzinger said. Earlier this year, Chairman Bennie Thompson (D., Miss.) had signaled it was unlikely that the panel would call Mr. Trump but other members indicated it was still under consideration.

Mr. Thompson told reporters Tuesday that the question of whether to interview Mr. Pence would be part of the discussion at Thursday’s meeting. Mr. Kinzinger in his speech warned that the former president’s continuing claims that the election was stolen present a threat to American democracy. “When you start to convince half of the country that their vote was stolen, because of some momentary desire for power, you will destroy a democracy,” he said.

Mr. Kinzinger said the committee is likely to have additional hearings around the time it issues a final report, expected in the fall, with the possibility of other hearings in between.

A group of prominent conservatives released a new report Thursday outlining their investigation into the 2020 election and have concluded former President Trump's claims of a stolen election are unfounded. 

The report, "LOST NOT STOLEN: The Conservative Case that Trump Lost and Biden Won the 2020 Presidential Election," was put together by three former federal judges and eight conservative leaders who investigated Trump's claims. 

Over the course of a year, the group looked at all 64 cases of the Trump campaign's fraudulent claims in six key states and concluded that there were no substantial instances of fraud that would have changed the election results. The report goes state by state and claim by claim, taking time to investigate each legal case. 

Fears of further damage to the electoral process drove the report, as allegations of fraud continue. Investigators said they fear that Trump supporters' unwillingness to see the election as lost could come back to haunt them if they flip the majority in the House and Senate this cycle.

Ginsberg, along with former senators John Danforth and Gordon H. Smith and longtime Republican congressional chief of staff David Hoppe, as well as former Solicitor General Ted Olson and former federal appeals court judges Michael Luttig, Michael McConnell and Thomas Griffith concluded that there were no substantial claims of fraud to change the election.

Griffith told Fox he felt it was important a group of conservatives do an investigation rather than rely on outside sources to investigate. 

"I contacted Ben and a number of other longtime political conservatives to say, 'Let's look at this ourselves. Let's not rely on what The New York Times is telling us or our other outlets are telling us. Let's look at this ourselves. Let's spend the time. Let's do a deep dive into each of the contested states,'" Griffith said.

The report acknowledges that changes in voting due to the COVID-19 pandemic could have created opportunity for more fraud but found that was not the case.

"The performance of the system in 2020 was all the more remarkable because of the extraordinary circumstances caused by the COVID-19 pandemic, which precipitated changes on an unprecedented scope and timeline," according to the report. 

"Some of those changes may have created possibilities for fraud, but there is no evidence that those risks materialized in reality; nor did they result in dampening voter participation. Quite the opposite. Nonetheless, moving forward, the states should redouble their efforts to strengthen the integrity of our voting systems and make it as easy to vote and as hard to cheat as possible for persons of every circumstance."

Claims of the 2020 election being stolen continue to come up on the campaign trail both from Trump and from potential voters.  At a rally in Alaska recently, Trump said ballot counting needs to be watched. 

"Democrats have proven, unfortunately, that the vote counter is far more important than the candidate is," Trump said.


This is exactly the kind of rhetoric Ginsberg, Griffith and their fellow authors insist is harmful to both the country and the Republican Party.

"One of the effects that the charges of fraudulent elections has is that it's going to depress Republican turnout — that if voters come to think their votes don't matter because the results are rigged, they'll stay home," Ginsberg said.

A briefing memo produced by the agency for a leadership meeting with the DHS Office of Inspector General on July 7 instructs participants on how to push back against what it calls the inspector general’s “persistent” request for “direct, unfettered access to CBP systems,” as part of its “high number of OIG audits covering a variety of CBP program areas.” In a section titled “Watch Out For/ If Asked,” the memo describes a number of exemptions Customs and Border Protection can rely on to evade records requests from the inspector general’s office — including national security exemptions.
