How stupid are Democrats?

Some apparently believe that this is how the FBI "found" the documents???


Seriously? There are people literally arguing that Donald Trump left documents with classifications laying semi-organized on the floor? I guess he even put up little helpful signs (like 2A) to make sure that people would know what was there. Apparently never occurred to them that the agents might have organized this and spread it out this way in order to take a picture? 

I mean... there is stupid... and then there is TDS stupid.

Current presidents can classify documents as long as they can “make a plausible argument that it is related to national security.” On the other hand, the president “doesn’t have to give any reason for declassifying” information, according to McClanahan.

“He can just say, ‘I decide that this should be declassified,’ and it’s declassified,” McClanahan said.

A 2009 executive order directs the head of a government agency that originally deemed information classified to oversee its declassification, and sets some rules for that process. But those protocols outlined in the executive order don’t apply to the president, McClanahan said.

However, presidents generally follow an informal protocol when declassifying documents, Richard Immerman, a historian and professor at Temple University, told VERIFY.



In fact the 2009 Obama EO explicitly exempts both the President and Vice President from having to to through any formal process to declassify something.



If the President said he declassified those documents when he was President... then those documents are declassified and the FBI cannot state differently.

The FBI has zero authority over a President when it comes to classifications.



That is the argument that Garland will ignore in the court of public opinion and the single most important reason that he will "not" press charges.

I've actually read Navy v Egan (rather than Egan v Navy) and it explicitly states that the President has this authority...

In fact the court almost "mocks" the idea that a President answers to other people in the government on classifications:

The President, after all, is the "Commander in Chief of the Army and Navy of the United States." U.S.Const., Art. II, § 2. His authority to classify and control access to information bearing on national security and to determine whether an individual is sufficiently trustworthy to occupy a position in the Executive Branch that will give that person access to such information flows primarily from this constitutional investment of power in the President, and exists quite apart from any explicit congressional grant.


This was a case where this person Egan felt he had a "right" to a certain classification level and felt he was being treated unfairly. But the ultimate authority was granted to the Executive branch through the President.

The ruling further refers to Presidents writing Executive Orders as it pertains to how classifications work. The ruling (again) explicitly provides that those orders are valid and come from the President's constitutional powers as CIC.


So if the President is the one who decides how classifications work and if the President says that you have to stand on your head before viewing classified documents, every member of the DOJ and FBI would have to do so... who is the FBI to tell a President that he was not handling classified documents correctly?


And of course... Obama's own Executive order not only exempted himself from having to go through "any" process at all to declassify something, it also excepted the Vice President.



This is why this case will never go to a court... they might be able to fool the liberal public with all of this. But if this gets into the legal and constitutional arguments about classifications and the President's ability to control it... and gets into Federal appeals courts (who will have to abide by their own precedents)....

Well they will lose.

In fact, they literally stand no chance.

Democrats are entering the homestretch before November’s election in better shape than earlier this year, boosted by gains among independent voters, improved views of President Biden and higher voting enthusiasm among abortion-rights supporters, a Wall Street Journal poll shows.

Republicans have electoral fuel to tap into if they can keep the debate focused on the economy and what has been the highest inflation in four decades. Nearly two-thirds of registered voters say the economy isn’t good or poor—a larger share than in the last Journal survey, in March—and close to two-thirds say the pain of higher costs makes them more likely to cast a ballot.

Democrats hold a slight edge over Republicans, 47% to 44%, when voters are asked which party they would support in their congressional district if the election were held today, a lead that is within the poll’s margin of error of plus or minus 2.7 percentage points. Republicans had a five-point advantage in March.

The Democratic gains come from increased support among independents, women and younger voters. Black and Hispanic voters, who have traditionally favored Democrats heavily, are also more solidly supportive of the party than they were earlier this year.

Among political independents, typically the key to victory in close elections, more voters now favor a Democratic candidate for Congress than a Republican, 38% to 35%. In March, Republicans led among independents by 12 percentage points.

OPINION:

It gives me no joy to write this piece.

Even a cursory review of the redacted version of the affidavit submitted in support of the government’s application for a search warrant at the home of former President Donald Trump reveals that he will soon be indicted by a federal grand jury for three crimes: Removing and concealing national defense information (NDI), giving NDI to those not legally entitled to possess it, and obstruction of justice by failing to return NDI to those who are legally entitled to retrieve it.




When he learned from a phone call that 30 FBI agents were at the front door of his Florida residence with a search warrant and he decided to reveal this publicly, Mr. Trump assumed that the agents were looking for classified top-secret materials that they’d allege he criminally possessed. His assumptions were apparently based on his gut instinct and not on a sophisticated analysis of the law. Hence, his public boast that he declassified all the formerly classified documents he took with him.

Unbeknownst to him, the feds had anticipated such a defense and are not preparing to indict him for possessing classified materials, even though he did possess hundreds of voluntarily surrendered materials marked “top secret.” It is irrelevant if the documents were declassified, as the feds will charge crimes that do not require proof of classification. They told the federal judge who signed the search warrant that Mr. Trump still had NDI in his home. It appears they were correct.

Under the law, it doesn’t matter if the documents on which NDI is contained are classified or not, as it is simply and always criminal to have NDI in a non-federal facility, to have those without security clearances move it from one place to another, and to keep it from the feds when they are seeking it. Stated differently, the absence of classification — for whatever reason — is not a defense to the charges that are likely to be filed against Mr. Trump.

Yet, misreading and underestimating the feds, Mr. Trump actually did them a favor. One of the elements that they must prove for any of the three crimes is that Mr. Trump knew that he had the documents. The favor he did was admit to that when he boasted that they were no longer classified. He committed a mortal sin in the criminal defense world by denying something for which he had not been accused.

The second element that the feds must prove is that the documents actually do contain national defense information. And the third element they must prove is that Mr. Trump put these documents into the hands of those not authorized to hold them and stored them in a non-federally secured place. Intelligence community experts have already examined the documents taken from Mr. Trump’s home and are prepared to tell a jury that they contain the names of foreign agents secretly working for the U.S. This is the crown jewel of government secrets. Moreover, Mr. Trump’s Florida home is not a secure federal facility designated for the deposit of NDI.

The newest aspect of the case against Mr. Trump that we learned from the redacted affidavit is the obstruction allegation. This is not the obstruction that Robert Mueller claimed he found Mr. Trump committed during the Russia investigation. This is a newer obstruction statute, signed by President George W. Bush in 2002, that places far fewer burdens on the feds to prove. The older statute is the one Mr. Mueller alleged. It characterizes any material interference with a judicial function as criminal. Thus, one who lies to a grand jury or prevents a witness from testifying commits this variant of obstruction.

Face it numbnuts - if there was clearly a crime(s) committed here, Trump would be charged by now. To not charge him in that case would be a crime in and of itself.

The fact that they're waiting until AFTER the mid terms to charge Trump is a crystal clear indication that this entire thing IS highly partisan political.
