FBI investigates alleged Trump/Russian ties, but not Clinton Foundation ties?

Investigating Donald Trump, F.B.I. Sees No Clear Link to Russia
For much of the summer, the F.B.I. pursued a widening investigation into a Russian role in the American presidential campaign. Agents scrutinized advisers close to Donald J. Trump, looked for financial connections with Russian financial figures, searched for those involved in hacking the computers of Democrats, and even chased a lead — which they ultimately came to doubt — about a possible secret channel of email communication from the Trump Organization to a Russian bank.
Law enforcement officials say that none of the investigations so far have found any conclusive or direct link between Mr. Trump and the Russian government. And even the hacking into Democratic emails, F.B.I. and intelligence officials now believe, was aimed at disrupting the presidential election rather than electing Mr. Trump.

Can someone please explain to me why the Justice Department would recommend moving forward with a silly conspiracy theory that the Russians and Donald Trump are in cahoots, but did not feel that there was any reasons what-so-ever to warrant a look at known ties between the Clinton Foundation and many international interests who were said to have gotten access to the State department after donations?

What did I do to warrant an FBI investigation?

News this week that Loretta Lynch and gang ordered the FBI to stand down from the Clinton Foundation probe that agents wanted to pursue would be evidence enough of a politicized DOJ. But to find out that they would then make an opposite recommendation to move forward with investigations into Donald Trump being tied to Russia (without any realistic cause) just makes the case of politicization all the stronger.

More to the point, business ties between someone serving as Secretary of State and international interest would actually have the possibility of being seen as criminal activity, if there was proof of conflict of interest. However, what laws would be broken even if Donald Trump had business ties to Russia?  Private business people are allowed all the business ties they want. There is nothing illegal about it. The results of such an investigation would have no meaning (other than a blatant political one).

Ex-Spy Told FBI that Russia Tried to Help Trump

Nov 1 -- “A former senior intelligence officer for a Western country who specialized in Russian counterintelligence tells Mother Jones that in recent months he provided the bureau with memos, based on his recent interactions with Russian sources, contending the Russian government has for years tried to co-opt and assist Trump—and that the FBI requested more information from him.”

Computer Scientists Uncovered a Digital Hotline between Trump Servers and Moscow

In July, a cybersecurity researcher who goes by the pseudonym "Tea Leaves" noticed a strange pattern of communication between Donald Trump's servers and the Alfa Bank in Moscow. He became curious about it and collected some traces on this connection. He tried pinging the Trump server and his pings were rejected, meaning the server was configured in a way to communicate only with a specific set of other servers, including those of the Alfa Bank.

He and his colleagues contacted Paul Vixie, who wrote much of the DNS code that makes the Internet work. Their conclusion: There was a secret digital hotline between Trump's servers and those in Russia.

What they also discovered is that this hotline was only active during business hours in New York or business hours in Moscow, strongly suggesting it was being used for human communication, not for serving webpages or something automated like that. Also odd was that very large and powerful servers were set up to handle a tiny bit of traffic. Technical experts who have seen the logs have sworn that they are genuine because there are items in them that would be very hard to falsify in a way to fool experts, such as interpacket timing.

What is also interesting is that traffic on the digital hotline between Trump and Russia seemed to correlate with political news. When there was a lot of political news, there was more traffic than when there was little news.

On Sept. 21, the New York Times began investigating this matter, and the Trump server was suddenly shut down. Four days later a new DNS entry was created that pointed to the now-restarted Trump server.

Alfa Bank is owned by people close to Vladimir Putin. This isn't the first piece of evidence that Trump has some connection with Russia and Ukraine. His first campaign manager, Paul Manafort, regularly did business with those countries. Trump praises Vladimir Putin all the time. Then there was the DNC hack by the Russians, clearly with the intent of helping Trump. But the nature of the relationship between Trump and Russia is still not clear. (Tannenbaum)

Speaking of non wikileaks bombshells.

Trump evaded paying taxes using a dubious exception.

Donald J. Trump proudly acknowledges he did not pay a dime in federal income taxes for years on end. He insists he merely exploited tax loopholes legally available to any billionaire — loopholes he says Hillary Clinton failed to close during her years in the United States Senate. “Why didn’t she ever try to change those laws so I couldn’t use them?” Mr. Trump asked during a campaign rally last month.

But newly obtained documents show that in the early 1990s, as he scrambled to stave off financial ruin, Mr. Trump avoided reporting hundreds of millions of dollars in taxable income by using a tax avoidance maneuver so legally dubious his own lawyers advised him that the Internal Revenue Service would most likely declare it improper if he were audited.

Thanks to this one maneuver, which was later outlawed by Congress, Mr. Trump potentially escaped paying tens of millions of dollars in federal personal income taxes. It is impossible to know for sure because Mr. Trump has declined to release his tax returns, or even a summary of his returns, breaking a practice followed by every Republican and Democratic presidential candidate for more than four decades.

Tax experts who reviewed the newly obtained documents for The New York Times said Mr. Trump’s tax avoidance maneuver, conjured from ambiguous provisions of highly technical tax court rulings, clearly pushed the edge of the envelope of what tax laws permitted at the time. “Whatever loophole existed was not ‘exploited’ here, but stretched beyond any recognition,” said Steven M. Rosenthal, a senior fellow at the nonpartisan Tax Policy Center who helped draft tax legislation in the early 1990s.

More to come.

Coldheartedtruth Teller said...

As that empire floundered in the early 1990s, Mr. Trump pressured his financial backers to forgive hundreds of millions of dollars in debt he could not repay. While the cancellation of so much debt gave new life to Mr. Trump’s casinos, it created a potentially crippling problem with the Internal Revenue Service. In the eyes of the I.R.S., a dollar of canceled debt is the same as a dollar of taxable income. This meant Mr. Trump faced the painful prospect of having to report the hundreds of millions of dollars of canceled debt as if it were hundreds of millions of dollars of taxable income.

But Mr. Trump’s audacious tax-avoidance maneuver gave him a way to simply avoid reporting any of that canceled debt to the I.R.S. “He’s getting something for absolutely nothing,” John L. Buckley, who served as the chief of staff for Congress’s Joint Committee on Taxation in 1993 and 1994, said in an interview.

The new documents, which include correspondence from Mr. Trump’s tax lawyers and bond offering disclosure statements, might also help explain how Mr. Trump reported a staggering loss of $916 million in his 1995 tax returns, portions of which were first published by The Times last month.
Photo

United States tax laws allowed Mr. Trump to use that $916 million loss to cancel out an equivalent amount of taxable income. But tax experts have been debating how Mr. Trump could have legally declared a deduction of that magnitude at all. Among other things, they have noted that Mr. Trump’s huge casino losses should have been offset by the hundreds of millions of dollars in taxable income he surely must have reported to the I.R.S. in the form of canceled casino debt.

By avoiding reporting his canceled casino debt in the first place, however, Mr. Trump’s $916 million deduction would not have been reduced by hundreds of millions of dollars. He could have preserved the deduction and used it instead to avoid paying income taxes he might otherwise have owed on books, TV shows or branding deals. Under the rules in effect in 1995, the $916 million loss could have been used to wipe out more than $50 million a year in taxable income for 18 years.

Mr. Trump declined to comment for this article.

wphamilton said...

It had to be something like that - I couldn't imagine how anyone, even Trump, could manage to lose almost a billion real dollars in one year.

Translating the losses of his backers into shares of his business interests is sleazy to say the least. Yet, how can you be unimpressed by the fact that he could pull something like that off? Think about it, would YOU accept something like that, or just laugh at the sheer gall of it? As much as I deplore the whole concept, even to the detestable business of casinos in the first place, there is a something to be said about falling in manure and coming up roses ...

“Democrats are already strongly confident of victory in three of them — Colorado, Nevada and Virginia — and believe that a fourth, North Carolina, is likely to break their way as well. Added to the party’s daunting advantage in the Electoral College, these states have impeded Mr. Trump’s path to amassing the 270 electoral votes needed to win, limiting his ability to exploit Mrs. Clinton’s late vulnerabilities and forcing him to scrounge for unlikely support in solidly Democratic places like Michigan and New Mexico.”

FBI Kept Cases Involving Trump and Clinton Quiet

November 1, 2016By Taegan Goddard201 Comments
“The F.B.I. and Justice Department faced a hard decision in two investigations this past summer that had the potential to rock the presidential election. The first case involved Donald J. Trump’s campaign chairman, Paul Manafort, and secretive business dealings in Ukraine. The second focused on Hillary Clinton’s relationships with donors to her family foundation,” the New York Times reports.

“At the urging of the Justice Department, the F.B.I. agreed not to actively pursue either case so close to the election.”

“Against this backdrop, the decision of the F.B.I. director, James Comey, to send a letter to Congress last week about a renewed inquiry concerning Mrs. Clinton’s emails is not just a departure from longstanding policy; it has plunged the F.B.I. and the Justice Department directly into the election, precisely what Justice officials were trying to avoid.”

NOV 2 2016, 8:58 AM ET
Analysis: Hillary Clinton's Path to 270 Appears Unchanged

There's plenty of hand wringing and stomach churning in Democratic households this week as polls show the presidential race tightening in its final days — and the Hillary Clinton campaign is making a series of moves that some see as panicked desperation.

A week out from the election, the campaign has started running ads in Colorado and Virginia, states it long ago felt comfortable leaving, and went on air for the first time in other, bluer states like New Mexico.

Meanwhile, campaign officials have seemed unusually agitated in a series of press calls and statements responding to FBI Director James Comey's bombshell on Clinton's email server. And after pledging to close the race on a positive note, the campaign rolled out a tough new ad highlighting women who claim Trump sexually assaulted them, while reintroduced former beauty queen Alicia Machado.

"Make no mistake, they are in panic," Rush Limbaugh said on his radio show Monday.

But the reality is that Clinton's chances of winning 270 electoral votes have hardly changed from last week. While Democrats' agitation is palpable, it's driven more by anger than panic at what they see as unprecedented and appalling meddling by outside forces in the election.

FiveThirtyEight's election forecast still gives Clinton a 71 percent chance of winning, while the New York Times' Upshot model gives her an 88 percent chance, and Princeton University's model pegs her likelihood at 97 percent.

Those numbers could fall, of course, as the impact of Comey's move is only just now being revealed in polls and early vote data. But so far, the effect has been marginal at most and muddled at least.

A panicking campaign would be moving money from one state to another, or pulling out of states entirely, but campaign officials say the blue state ads are more a product of surplus cash and a desire to help Democrats down-ballot.

Clinton has not changed her travel schedule and will still head Wednesday to Arizona, a red state aides believe they have an even shot of winning.

In the last 72 hours, the campaign raised $11.3 million in online donations, according to an aide, the most at any point since the Democratic National Convention.

Their confidence is rooted in the fact that while Clinton has multiple paths to 270 and a wide margin of error, Trump needs almost everything to go perfectly for him Tuesday in order to run the table of almost all of the key tossup states.

"If Hillary wins Florida, she'll be next president of the United States," Bill Clinton said while campaigning Tuesday in the state, which is essentially tied. The same is likely true for Ohio and North Carolina. And Clinton could still make it to the White House by losing both and instead winning Pennsylvania and one other state, like New Hampshire, two places where she has lead in every single poll since July.

Clinton Still Leads By 6 Points Nationally

A new Reuters/Ipsos poll finds Hillary Clinton leads Donald Trump by 6 percentage points among likely voters, 45% to 39%, the same advantage the Democratic presidential nominee held before an FBI announcement that reignited the controversy about her email practices.

For comparison, the HuffPost Pollster average shows Clinton ahead by six points, 48% to 42%.
