A look at Impeachment from the Powerline Blog

So let's start with the argument coming from the left that there are no real rules of impeachment. The argument that Pelosi and gang are not obligated to treat this the same way that Clinton or Nixon was treated.

The Constitution empowers the House of Representatives to impeach the President, but doesn’t say what procedures the House must use. This leaves the House free to use whatever procedures it chooses.
The Constitution also does not say whether, or to what extent, the President must cooperate with the House when it considers impeaching him. This leaves the President free to cooperate as much or as little as he chooses.

As pointed out here, what is good for the goose is good for the gander. If the Constitution doesn't tell Congress how to act, then it also doesn't compel the President to do anything either. The President has stated that he would participate, as long as the impeachment inquiry was made official in the manner that previous impeachment probes were done. Otherwise, the same logic the Democrats are using applies to him. There are no rules to follow.

The procedures approved by the Judiciary Committee for the Nixon and Clinton impeachments stated “[t]he President’s counsel may question any witness called before the Committee.” President Clinton’s attorney questioned Ken Starr when he appeared before the Judiciary Committee and President Nixon’s attorney questioned each of the nine witnesses that appeared before the Judiciary Committee.
The procedures approved by the Judiciary Committee for the Nixon and Clinton impeachments stated “[t]he President and his counsel shall be invited to attend all hearings, including any held in executive session.” President Clinton’s attorneys were allowed to call and question 14 expert witnesses before the Judiciary Committee.
Finally, it’s my understanding that in every prior presidential impeachment inquiry in American history, the full House voted to authorize the inquiry.

So  this is how the past two impeachment inquiries went. Like everything else political these days, the Democrats have decided to "change the rules" because of the "bad orange man" and likely because they understand that public hearings that allowed the President's attorneys to ask questions would smash their allegation to pieces.

Democrats have also offered that impeachment is like an Grand Jury indictment. Therefor no due process is necessary, or something like that.

Common sense tells us that the grand jury model should not apply to the impeachment of a president. Grand juries consist of citizens pulled in at random. They routinely indict whomever the prosecutor wants them to. The saying is that the prosecution can indict a ham sandwich.
Nothing about this model makes sense in the impeachment context. Congressmen aren’t pulled in randomly off the street. They are the elected representatives of the American people. In an impeachment proceeding, all members of the House should be able to vote on the basis of the fullest, most fairly developed record.
This entails a proceeding in which the president receives due process — one in which his lawyers can attend all hearings, question all witnesses, and call witnesses of their own.
The president, moreover, is not an ordinary criminal defendant. He is the chief executive officer of the U.S. government and commander-in-chief of the U.S. armed forces. He typically, and in this case, was elected president by the American people. He should not be indicted as if he were a ham sandwich.

Obviously the Democrats want to just "change the rules" because the law doesn't specifically prohibit them from doing so. This is much like the excuse given by the Office of the Inspector General to lower the standards for what they conclude is a legitimate "whistleblower" complaint. You know where we saw that the longstanding policy to require information be "first hand" was removed because there was no specific mention of such withing the legal statute. Reality is that there are a lot of internal rules and procedures within our Government that requires them to be not just within the law, but well above it. Honestly, I have never seen so many people applaud our leaders doing the "bare minimum required".

But it seems that if Democrats really want a "serious" impeachment hearing, that they should at the very least take it as seriously as past impeachment hearings. If they refuse to take it as seriously as the previous impeachment inquiries, then they have no business complaining when others (like the President) doesn't take them seriously either.

So there you have it. Either call for a full vote of the House to approve the impeachment inquiry and then provide the President with his due process... or shut the hell up and accept that people are only going to take you as seriously as you take yourself.

Trump, an ongoing eruption of self-refuting statements (“I’m a very stable genius” with “a very good brain”), is adding self-impeachment to his repertoire. Spiraling downward in a tightening gyre, his increasingly unhinged public performances (Google the one with Finland’s dumbfounded president looking on) are as alarming as they are embarrassing. His decision regarding Syria and the Kurds was made so flippantly that it has stirred faint flickers of thinking among Congress’s vegetative Republicans.

Aside from some rhetorical bleats, Republicans are acquiescing as Trump makes foreign policy by and for his viscera. This might, and should, complete what the Iraq War began in 2003 — the destruction of the GOP’s advantage regarding foreign policy.


Democrats were present at the creation of Cold War strategy. From President Harry S. Truman and Secretary of State Dean Acheson through Sen. Henry Jackson and advisers such as Max Kampelman and Jeane Kirkpatrick, they built the diplomatic architecture (e.g., NATO) and helped to maintain the military muscle that won the war. But the party fractured over Vietnam, veering into dyspeptic interpretations of America’s history at home and abroad, and a portion of the party pioneered a revised isolationism. Conservative isolationism had said America was too virtuous for involvement in the fallen world. Progressive isolationism said America was too fallen to improve the less-fallen world.

Hence Republicans acquired a durable advantage concerning the core presidential responsibility, national security. Durable but not indestructible, if Democrats will take the nation’s security as seriously as Trump injures it casually.

Trump’s gross and comprehensive incompetence now increasingly impinges upon the core presidential responsibility. This should, but will not, cause congressional Republicans to value their own and their institution’s dignity and exercise its powers more vigorously than they profess fealty to Trump. He has issued a categorical refusal to supply witnesses and documents pertinent to the House investigation of whether he committed an impeachable offense regarding Ukraine. This refusal, which is analogous to an invocation of the Fifth Amendment protection against self-incrimination, justifies an inference of guilt. Worse, this refusal attacks our constitutional regime. So, the refusal is itself an impeachable offense.


As comparable behavior was in 1974. Then, the House articles of impeachment against President Richard M. Nixon indicted him for failing “without lawful cause or excuse to produce papers and things as directed by duly authorized subpoenas issued by” a House committee, and for having “interposed the powers of the presidency against the lawful subpoenas” of the House.

Trump is not just aggressively but lawlessly exercising the interests of his place, counting on Congress, after decades of lassitude regarding its interests, being an ineffective combatant. Trump’s argument, injected into him by subordinates who understand that absurdity is his vocation, is essentially that the Constitution’s impeachment provisions are unconstitutional.

The canine loyalty of Senate Republicans will keep Trump in office. But until he complies with House committee subpoenas, the House must not limply hope federal judges will enforce their oversight powers. Instead, the House should wield its fundamental power, that of the purse, to impose excruciating costs on executive branch noncompliance. This can be done.

In 13 months, all congressional Republicans who have not defended Congress by exercising “the constitutional rights of the place” should be defeated. If congressional Republicans continue their genuflections at Trump’s altar, the appropriate 2020 outcome will be a Republican thrashing so severe — losing the House, the Senate and the electoral votes of, say, Georgia, Arizona, North Carolina and even Texas — that even this party of slow-learning careerists might notice the hazards of tethering their careers to a downward-spiraling scofflaw.

But that is how the CONSTITUTION WORKS!

If you do not get 2/3 support for impeachment in the Senate (which requires bi-partisan support) - then you don't get to remove a President.

Any hope Democrats had were crushed, dashed, and smashed when they decided to not follow the previous precedents for impeachment, and rather decided to run a partisan inquiry behind the scenes where they would provide the "bad orange man" no rights.

This effectively guarantees that the Senate will not vote to convict, and it's unlikely that Democrats will get many if any Republicans in either chamber to join them.



But that is how it is "SUPPOSED TO WORK". This isn't Great Britain where we hold elections ever time the wind blows in a different direction. We only remove our elected leaders under extreme conditions were the "High Crime or Misdemeanor" is not a partisan disagreement, but an actual crime that can be agreed upon and proven.

The trial in the Senate had people from both sides to testify under oath, from both sides of the defendant, Richard Nixon.

High Crime or Misdemeanor" is not a partisan disagreement, but an actual crime that can be agreed upon and proven.

The house of Representatives shall impeach him for high crimes and misdemeanors.

They decide, this is not a criminal investigation, it is impeachment, as they decide. The Supreme Court ruled the the Nixon tapes were not protected by executive privilege.

Trump is attempting to circumvent this situation, and if he succeeds future presidents, will be effectively repealed, and future presidential corruption will be largely immunized against punishment.

If Pelosi gets the votes to hold impeachment hearings, your argument will be nullified. I am not always correct, but I fear the executive branch will not be subject to control.

Trump is playing a game. We don't know if the Democrats will impeachment hearings, but you are playing games, in an attempt to protect the President from being impeached and/ or convicted.

Ya think? Right now the courts are going to look at the Houses impeach inquiry and will find it arbitrary and capricious. Not following establish procedures for impeachment inquiries raises a big red flag for violation of due process.

The house has the power to impeach but it must follow the establish and fair procedures required by due process.

And a hidden star chamber hearing with secret testimony and evidence is the antithesis of due process.

The nature and timing of the previously undisclosed discussions with National Security Council legal adviser John Eisenberg indicate that officials were delivering warnings through official White House channels earlier than previously understood — including before the call that precipitated a whistleblower complaint and the impeachment inquiry of the president.

At the time, the officials were unnerved by the removal in May of the U.S. ambassador to Ukraine; subsequent efforts by Trump’s lawyer Rudolph W. Giuliani to promote Ukraine-related conspiracies; as well as signals in meetings at the White House that Trump wanted the new government in Kiev to deliver material that might be politically damaging to Democratic presidential candidate Joe Biden.


The 25th Of July phone call will result in the impeachment of President Donald Trump.

The 2020 Democratic candidate with whom the CIA whistleblower had a "professional" tie is Joe Biden, according to intelligence officers and former White House officials.

Lawyers for the whistleblower said he had worked only "in the executive branch." The Washington Examiner has established that he is a career CIA analyst who was detailed to the National Security Council at the White House and has since left. On Sept. 26, the New York Times reported that he was a CIA officer. On Oct. 4, the newspaper added that he "was detailed to the National Security Council at one point."

Michael Atkinson, the Intelligence Community's inspector general, told members of Congress that the whistleblower had a "professional tie" to a 2020 Democratic candidate. He had written earlier that while the whistleblower's complaint was credible, he had shown "some indicia of an arguable political bias ... in favor of a rival political candidate."

A retired CIA officer told the Washington Examiner, “From everything we know about the whistleblower and his work in the executive branch then, there is absolutely no doubt he would have been working with Biden when he was vice president."

As an experienced CIA official on the NSC with the deep knowledge of Ukraine that he demonstrated in his complaint, it is probable that the whistleblower briefed Biden and likely that he accompanied him on Air Force Two during at least one of the six visits the 2020 candidate made to the country.

But her early recall from her post in Ukraine has raised questions she's due to answer before Congress.

KYIV — In the eyes of Donald Trump, the ambassador to Ukraine was disloyal, badmouthed him behind his back, and obstructed his efforts to dig up dirt on Joe Biden. Or at least that’s what a lawyer working for Trump, Rudy Giuliani, and his allies were telling him. The ambassador was standing in the way, they said.

So when Trump recalled Marie Yovanovitch from Kyiv in May, it raised questions about whether political pressure had been brought to bear against a career diplomat who had a reputation for honesty among those who worked with her.

Yovanovitch and the circumstances surrounding her ouster could be key to the House Democrats’ formal impeachment inquiry against Trump, which was prompted by a whistleblower alleging the president abused his power when he pressured his Ukrainian counterpart, Volodymyr Zelensky, in a July 25 phone call to pursue investigations into the activities of Biden and his son Hunter. The whistleblower cited the recall of Yovanovitch as one of a number of worrying events leading up to Trump’s call with Zelensky.

Several current and former State Department officials who worked for years with Yovanovitch told BuzzFeed News they believed her removal from the post — two months ahead of her scheduled departure — was directly connected to pressure from the White House. But they said the allegations leveled by Giuliani and other Trump allies were unfounded, and instead described a three-time ambassador who remained professional and loyal — even as some colleagues hoped she would take a stance against an administration they feared would alter longstanding US policy toward Ukraine.

“I never heard her say anything pejorative or derogatory about the president,” said one current US diplomat who worked closely with Yovanovitch in Kyiv and spoke on condition of anonymity out of fear of professional retaliation.

“She was very careful to remain as apolitical as is possible,” said another current US diplomat who worked with Yovanovitch in Kyiv and didn’t want to be named for similar reasons. Recounting an embassy meeting Yovanovitch called hours after Trump’s 2016 election win, the diplomat said some colleagues “felt the sky was falling and [were] wondering, ‘What are we going to do?’”

“She said, ‘Look, we are professionals, institutions are there for a reason, and we will carry on.’ And some people actually left that meeting disappointed because they felt she was too even keel,” said the diplomat.

Yovanovitch is one of five current or former State Department officials summoned to testify in front of investigators from the House Committees on Intelligence, Oversight, and Foreign Affairs. By late 2018, the campaign against Yovanovitch by Trump allies was heating up. Pete Sessions, a former Texas Republican member of the House who lost his reelection bid, wrote a letter in November to Secretary of State Mike Pompeo calling for the firing of the ambassador for allegedly criticizing the Trump administration in private conversations with colleagues. Reporting by BuzzFeed News and other outlets show his efforts may have been backed by two Soviet-born American businessmen, Lev Parnas and Igor Fruman, who are close with Giuliani and were already working behind the scenes to dig up dirt on the Bidens when they met Sessions in May 2018. According to the Daily Beast, Parnas and Fruman, through their company, Global Energy Producers LLC, donated $325,000 to a pro-Trump PAC called America First Action, which supported Sessions’ reelection bid with more than $3 million. The two men were arrested on Thursday on accusations of violating campaign finance rules.

As those Trump allies pressed on, tensions with Ukrainian officials flared in March, when Yovanovitch publicly chastised their lackluster efforts to root out corruption and called for the country’s special anti-corruption prosecutor, Nazar Kholodnytsky, to be fired after he was caught coaching suspects on how to avoid corruption charges. Reached by phone, Kholodnytsky declined to comment, saying only that Yovanovitch was “a professional diplomat.”

Lutsenko quickly hit back at Yovanovitch over the criticism, claiming, without evidence, that she had passed him a list of people his office should not prosecute during their first meeting two years earlier. The State Department said his claim was an “outright fabrication” and Lutsenko retracted it a month later after saying there was never a physical list.

“I don’t see her as thinking, ‘Oh, here’s my chance to get back at the administration,” said one diplomat. “I also think she is diligent enough of a civil servant that she has records, she’s kept files…[and] she has a good recall. And she will have prepared diligently for this briefing.

“She’s never going to be one to shape the truth, so she’ll be very straight forward."
