Did IG ignore the language on first hand information?

Statement from Inspector General office regarding Whistle blower complaint

So here are the facts:
  • The form has always included the requirement for first hand information
  • The form filled out by the whistle blower also had this requirement
  • As of 2019, the requirement changed and is no longer being enforced

So, yes, the Office of the Inspector General is admitting that the form requires first hand information, but that they are no longer following the form in those regards. The logic behind this is that the (first hand information) requirement  should not be enforced, because the statute itself doesn't specifically require it. In other words, the OIG did (as argued) decide in 2019 to loosen their own internal standards for what constitutes a valid whistle blower complaint.



Now the statement from the OIG obviously defends the actions of the IG. The argument is that even though the complainant did not witness the call or see any of the transcripts of the call, that he/she did have what the IG determined to be some peripheral information that was considered "first hand". Apparently that was enough to allow the IG to determine that the complaint was credible and urgent.

Obviously the complaint itself has been released to the public, and obviously the criticism will continue to be that nothing in the actual complaint provides any of the "first hand" information as generally defined by reasonable people. Whatever "first hand" information must have been something relayed from the complainant to the IG outside of what is in the actual complaint (which obviously complicates this from a PR standpoint).

What we do know is that all of the silly arguments from the left about how this has never been a requirement, and that somehow the "right wing" media had been photo shopping or lying about this has once again blown up in their faces. The requirement has always existed as skeptics argued. The requirement was changed as skeptics argued, and the changes were so recent that the form used by the complainant actually still shows that requirement.

Moreover, it begs the question as to how the actual complainant would have been privy to the idea that his complaint did not have to follow the form? It sounds like much of this was an internal discussion within the Inspector Generals office, rather than something that would have been relayed to the intelligence community as a whole. The whole things still reeks of more anti-Trump "resistance".

Of course first-hand information was always required. Both forms made that clear. The whistleblower listed people who had given him first-hand information about how upset they were over what the President had said, and that listing was found to be "credible."

However, the whistleblower was not aware that POMPEIO was one of those who listened in on the conversation, and we apparently now have first-hand information from someone else or from others that makes THAT clear.

Secretary of State Mike Pompeo admitted Wednesday that he was on the July 25 phone call in which President Trump asked Ukrainian President Volodymyr Zelensky to investigate Joe Biden, CNN reports.

Said Pompeo: “I was on the phone call.”

Pompeo had previously been coy about his role in the call, giving an evasive answer to ABC News when asked directly about the call last week.

NOW WHY WOULD HE DO THAT? He could easily have said, I myself heard the call and I heard nothing wrong. But he didn't say that.

The Office of the IG statement from YESTERDAY - which is embedded in this post for your convenience - states that there is no longer a requirement to have first hand information. The office states that this change took place in 2019, just as critics of all of this argued.


THAT is the issue here James. Why (in 2019) did the OIG decide to lower the standards of a Whistle Blower complaint? The reason why people are questioning all of this... is because THE COMPLAINT WAS MADE PUBLIC.

We can all read the complaint and see that there was no "first hand information" provided in the complaint.

Now Atkinson (and his office) can argue that other first hand material was provided outside of the complaint, but nobody has been made aware of that.


Now Atkinson admits that he:

Received a complaint about a phone call
That the complaint was second hand regarding the call
The transcripts of the call were available to him
He decided against reading the transcripts to verify the complaint

That takes a special kind of incompetence or malfeasance.

So the IG never actually bothered to read the transcripts of the call between the two Presidents before making a determination if the allegations regarding that specific call was "credible". That seems like an inconceivable slip up of the highest magnitude. Literally no reason in the world not to review the call to see if it matches your allegations. Not sure if this is just pure incompetence at an extreme level or that Atkinson was just more intent on getting this complaint to Congress (right or wrong) than doing his job.

The fact that the Office of Inspector General is actually defending this nonsense to the public tells me that they either were not really paying attention and are now playing a massive game of CYA, or that there were people in the IG office all the way up to the top that were bound and determined to get this rogue complaint to Congress.

Not one bit. Because I read the transcript and the complaint myself.

And I completely ignore the pearl clutching, fake feinting, screaming, and hollering from the usual suspects on the left. You know, the ones who think for you!



The GOP raised $115 million dollars last quarter, absolutely dwarfing the money raised by the Democrats... Trump himself raised 15 million in one day which is more than most of the Democrats running for President will raise in a quarter. Moreover, most of the money raised by the Democrats these days are from the candidates are being used to defeat each other. Meanwhile the President continues to build his war chest.


What I would be worried about James... isn't what you "think" you have on Trump. We can already assume that Trump will be "impeached" in the House and subsequently "acquitted" in the Senate by mostly a Party line vote. We can assume that it will be over by New Years...

In many ways it would be the best thing to have happen for Trump. Simply pull of the band aid in a quick jerk, rather than let the Democrats continue to play it out for months and months leading into the election.

Because what will Nadler and Schiff do once impeachment has been voted on and is over? Impeachment II? The public will have none of it!

Well, Ch, I guess you and I read different statements, because what I read indicated that the "change" in wording was only for clarification, and no real change in the substance of what was required had been made. Well, Ch, I guess you and I read different statements, because what I read indicated that the "change" in wording was only for clarification, and no real change in the substance of what was required had been made.

I think we are obviously seeing a difference of semantic argument.

They admittedly hired a new "Hotline Program Manager" who apparently spearheaded the change. This manager believed that the forms read as a suggestion that the whistle blower must possess first hand information. But she believed that was an incorrect suggestion (based on the fact that the statute doesn't state as much).

That makes what appears to be a rather far-fetched allegation that the "First hand information" portion of form that had been in use for all those years was just some sort of mistake or misprint. I find that more than just a little bit dubious.

It appears to most people who view this objectively (or even subjectively) that the entire paragraph that stated right up was explaining an internal OIG policy or internal OIG regulation that required it to be first hand information.


So you can choose to believe either of the possibilities.

- That putting the First hand information up front on the form was always just some sort of mistake that didn't "really" mean what it stated and not a single person in the OIG caught this mistake until 2019.

- that it was actually done on purpose because that was the OIG policy.

You can choose to believe what you want. But these are exactly the sort of hard to swallow arguments put forward that make people really really really distrust this sort of thing.

If you at least do not understand why people are distrustful of such a dubious suggestion... then I think you need to go back and read it all yourself (with a slight degree of skepticism).

In July 2016, the exact month that former FBI Director James Comey officially opened a case against the Trump campaign, Atkinson was named senior counsel to John Carlin, the head of the National Security Division. Carlin was Robert Mueller’s chief of staff when he ran the FBI and was appointed NSD chief by President Obama in 2013.

Carlin’s name has surfaced numerous times in the congressional inquiry into the Trump-Russia collusion hoax. According to closed-door testimony by former FBI lawyer Lisa Page, Carlin regularly was briefed by former deputy FBI Director Andy McCabe on the Trump-Russia collusion probe.

Under questioning by Rep. James Jordan (R-Ohio) last year, one of Carlin’s top aides confirmed that Carlin notified him in August 2016 that the FBI had opened an investigation into the Trump campaign and that a team of NSD officials worked with the FBI on the case.

In his testimony, George Toscas, former deputy attorney general for the NSD, referred to unnamed lawyers who attended various briefings with the FBI in 2016. He did not mention Atkinson’s name—although several names in the transcript are redacted—but it stretches credulity to think that the senior counsel to the division’s chief would have been unaware of such an explosive and unprecedented investigation.

Carlin was replaced by Mary McCord: Atkinson stayed on as her senior counsel. A few days after Trump was sworn-in, McCord accompanied Sally Yates to a meeting with White House counsel Don McGahn. The purpose of the meeting was to warn the White House that Mike Flynn may have violated an arcane federal law and was at risk of being “blackmailed” by the Russians.

Coincidentally, both Carlin and McCord have been effusive in their praise of their former counsel. “As soon as I saw that [Atkinson] had recommended it be sent to Congress, that’s all I needed to know it was legit,” McCord told CNN last week. “The mere fact he was not on anyone’s radar is points to the fact that his sense of urgency is credible.”

Atkinson is “someone who is very deliberate, thoughtful and tries to carefully review facts … not someone who seeks attention,” Carlin said in the same article. (Carlin now is a CNBC contributor.)

The transcript lacks a critical element needed for impeachment, which is evidence of a quid pro quo. Trump never connects the investigation with the roughly $400 million in military aid. While he discusses the aid, he never suggests he will not send it. That does not mean a case for impeachment or criminal prosecution cannot be made. Unlike the prior impeachable offenses suggested by Democrats, this allegation of self-dealing could be both an impeachable offense and a federal crime, though neither would be easy to prove.

Everyone who claims that the condition shown on the form requiring first hand information has been writing about it this morning, claiming vindication from the fact that the Office of the Inspector General was forced to put out an explanation as to why it has changed.

If the OIG hadn't done anything differently or hadn't changed anything. There would be no need to have a multi-page explanation as to what happened, how it happened, and why it happened. They are circling the wagons and coming up with explanations.


Considering the argument had been whether or not the form had actually been changed... what is embarrassing (or should be) are "yeah but" arguments coming out from those who claimed it hadn't been changed, but now are like "yeah" so it was changed "but".


It's just like those people who argued that the President had pressured to withhold Aid in exchange for help investigating Biden, who then turned around when the transcript showed differently and changed their story. Everyone effectively then moved the goal posts closer by claiming that the issue wasn't quid pro quo, but just that he asked.

Which of course is perfectly legal and with Ukraine is actually part of a treaty we have with them in regards to assisting with investigations. As if we are supposed to believe that we created a Treaty in order to agree to how our two Government go about conspiring to break the law.

The idea that this form has been wrong for literally decades and that nobody really caught it until just a few months ago is a perfectly good explanation if all you need is a semi-plausible reason to continue to believe what it is that you want to believe.

From any sort of legal or logical standpoint, the idea of implicating people in wrongdoing by using second hand sources is not part of our American legal system. Hearsay is not an acceptable method of proving something in court and quite literally anything that is considered hearsay is not even allowed to be considered by a Judge or a Jury. No reasonable court would allow it and I promise you that if there is a Senate Trial overseen by Chief Justice Roberts that the use of "hearsay" information from an unidentified witness will not be allowed to even be considered.

Sometimes a Statute is not going to cover every single contingency. The idea in this case as to whether or not the OIG would consider something a valid and urgent control would not be "bound" by a lack of language in the statute is not a very good argument at all. (lots of things are not specifically covered).

But it's obvious that the OIG at least "once did" want all complaints to be first hand complaints, if for no other reason than to provide the proper amount of protection from people misusing it and from possible legal repercussions if someone felt that they were unfairly or illegally targeted for wrong doing from a dubious complaint.

If I was sitting on the jury of a civil trial and an employer was trying to justify using hearsay to discipline or fire an employee, I would very likely stick it to that employer and stick it to them pretty hard!

Impeachment is what the House does as a means to determine whether a Trial will be held in the Senate to determine guilt or innocence of the chargers. It's no different than an indictment.

The Senate will hold a legitimate trial (as this is constitutionally a legal process). The Chief Justice will oversee the trial and will rule as any Judge would rule on motions, etc.



Roberts will use legal precedents and treat it like a legal trial. There are no legal precedents for a "political trial" as some on the left would have you believe impeachment is. The idea that impeachment is political is nonsense and an excuse by Democrats to once again "change the rules".

So does anyone actually believe that Roberts (as the trial judge) will allow hearsay evidence from an unidentified witness that will not make himself available to be cross-examined?

I have no doubt that Adam Schiff will see to it that this guy stays totally hidden from view. The only reason is that we all know he is a Democratic operative and would be seen as a complete and total fraud if his identity was revealed.

You have to realize that Democrats do not control the Senate and will not control the Senate trial process. That trial will be run by Chief Justice Roberts and Mitch McConnell.

It will be run however they want to run it. I promise you that no Republican Senator will vote in favor of removal of the President based on second hand information.



You keep saying that this guy will lead us to people with real first hand experience, but so far there isn't even a hint of anyone. The only named source provided by the complaint has already stated that he was not himself privy to anything first hand.

There are only a handful of people who have first hand access. Most of those are Trump associates (like Pompeo) who will offer no more support for this than Pompeo has offered.

The others (who would have listened in on the conversation) would be facing criminal charges for leaking this information to people not authorized. They would also have to seek whistle blower status and attempt to remain anonymous just to save themselves from indictment.


Let's also not forget James... that the Whistle blower description of events does not match the description of the call by other members who were there (Pompeo, Zelensky) or the transcript of the call. So it's likely that he got this from a friend of a friend of a friend, and that anyone with an actual first hand account will be unwilling (for a variety of reasons) to step forward.

In fact, while the URL at the bottom of the document screenshat by @BradMossEsq has apparently been defunct since 2017, here's what it used to say. It quoted the statute saying IC whistleblowers had to go through the ICIG before going to Congress.

This process is specific to the intelligence community, as the other congressional oversight committees crafted their laws to allow whistleblowers to go directly to Congress, rather than be filtered through or obstructed by the agency they're blowing the whistle on.

So if a CIA agent illegally leaks executive branch information to congress, before ever filing a whistleblower complaint, can we stop referring to them as a whistleblower and start calling them what they are? A spy!

In the press is today he called himself "stable genius".

His tweets were filled with allegations of treason and bullshit.

I wasn't able to watch the fake news today. But I saw the press conference today and I saw a man who is feeling under pressure and it's apparent. He called the whistleblower a traitor. As well as any one who is critical of the President.

He's acting like a mod boss, who is intimidating potential opponents and reporters!

He's losing control of his temper.
