Fat lady warming up or is this just the beginning?

 McConnell is said to have the votes to confirm a new Justice... 

With Chuck Grassley reversing his previous position and Cory Gardner declaring himself on board, short of some other defection, the Republicans have at least 50 votes to confirm a new Justice prior to the election. 

Current frontrunner to be the most hated person in the minds of liberals

So far Susan Collins and Lisa Murkowski are the only Republicans who are on record as being against the President nominating anyone or against the confirmation hearings. Mitt Romney has remained mum, but Mitt Romney being Mitt Romney, he will probably want to buck rather than back the President.

That being said, when push comes to shove and if a vote can actually be held before the election Collins, and Murkowski will be put to the test of voting "against" a qualified woman as the next Supreme Court Justice as some matter of principle, which would probably seal the fate of Susan Collins (who needs every conservative vote she can get a state that is increasingly becoming purple). 

Now the main question becomes what can Schumer and Democrats in the Senate do to prevent this vote? Ironically, if they prove that a 47 member minority can prevent a vote like this, then they are simply providing a blue-print for how a potential Republican minority could put the same sort of wrench in the Democratic plans to overturn the filibuster and jam through a huge agenda if they win a majority.  

Meanwhile Amy Coney Barrett has emerged as the odds on favorite to be the pick with Barbara Lagoa a "distant second". The question at this point isn't whether she is confirmed, but whether Democrats can find a way to prevent a vote.

If Ginsburg is replaced by someone like Gorsuch or Kavanaugh—and that is exactly what President Trump wants to do to energize his base going into the upcoming election—the median justice ideologically would be Brett Kavanaugh. It would mean not just six conservative justices, but five who are clearly much further to the right than the American people. Were Roberts to join the three more-liberal justices in forthcoming cases, it wouldn’t matter.

History shows that a Court well to the right of the populace is a recipe for disaster. When this occurred in the 20th century, the Court struck down the first child labor law passed by Congress and invalidated countless laws to protect workers and consumers. Facing the prospect of having the entire New Deal struck down, in 1937 President Franklin Roosevelt proposed to increase the size of the Supreme Court. Although that proposal was not enacted, it likely played a role in propelling one justice, Owen Roberts, to switch his vote to upholding New Deal programs. Retirements and deaths then let Roosevelt fill the Court with justices who upheld the laws that previously had been struck down.

I hope that four Republican senators will join the Democrats to keep this seat on the Supreme Court open until after the winner of the November 3 election is inaugurated on January 20, 2021. But if the Republicans, in an exercise of astounding hypocrisy, approve a Trump nominee before then, Democrats must be prepared to act. They must consider expanding the size of the Supreme Court to overcome how the Republicans manipulated the process to block Garland and confirm Trump’s nominee to succeed Ginsburg.

As I read Sen. Mitch McConnell’s statements immediately after Justice Ginsburg’s death that he would push the Senate to approve President Trump’s nominee to succeed her, I kept thinking of the words of Joseph Welch to Sen. Joseph McCarthy: “Have you no sense of decency, sir?”

I think we know the answer to that when it comes to Mitch McConnell. We only can hope that there are four Republicans who do have a sense of decency and will not let this vacancy on the Supreme Court be filled before the inauguration.

Then both Republicans and Democrats should be on board with actively making sure that this election goes entirely 100% by the books, all of the relevant laws are followed by all involved, and that we ALL SHUT DOWN any attempts by anyone in EITHER PARTY who attempt to use a myriad of excuses to bypass or ignore or undercut the current laws.

If everyone follows their laws, then there is no need for arguments, for lawsuits, or for anyone to undermine, challenge, or otherwise reject the election results.



But I am pretty sure that this is not what Bernie is advocating. He is likely advocating using Covid as an excuse to undermine every law, ignore them, attempt to go to court to eliminate them, and then demand that the other side is to blame when things don't go their way.

What many people are forgetting about is that while the Republicans hold a 53-47 Senate advantage right now, they also have another pick up that is not considered a "battleground" in Alabama where Tommy Tuberville is leading incumbent Doug Jones by a wide margin.

So if the GOP were to pick up another seat... anywhere... then it becomes very difficult for the Democrats to regain the majority. They would have to "run the table" so to speak in every close race just to get to 50, much less 51.

If you or someone you care about are among the more than 50 million Americans suffering from pre-existing medical conditions, you should be aware that the stakes in this year’s election go beyond abstract things like, say, the survival of American democracy. They’re also personal. If Donald Trump is re-elected, you will lose the protection you’ve had since the Affordable Care Act went into effect almost seven years ago.

The death of Ruth Bader Ginsburg has made this even more obvious. In fact, it’s now possible that coverage of pre-existing conditions will be stripped away even if Trump loses to Joe Biden, unless Democrats also take the Senate and are prepared to play serious hardball. But health care was always on the line.

Now, Trump denies this; like almost every other politician in his party, he keeps insisting that he has a plan to protect Americans with pre-existing conditions. But he and they are lying. And no, that’s not too strong a term.

On Trump: In early August he promised that he would soon release a great health care plan to replace Obamacare, probably by the end of the month. We’ve heard nothing since, which isn’t surprising, since he has made and broken similar promises many times.


It’s safe to assume that there was never any basis for these promises; there is not now and has never been a secret skunk works in the executive branch devising a brilliant new health plan.


Among other things, Trump administration officials have been too busy botching their response to the coronavirus. Did I mention that, as we pass the 200,000 deaths mark, cases appear to be rising again?

But we would know that Republicans are lying about pre-existing conditions even if Trump hadn’t established such a remarkable record of serial dishonesty. For the fundamental logic of health policy says that if you want to protect pre-existing conditions, you either have to have the government provide health insurance directly, as it does with Medicare and Medicaid, or use a combination of strict regulation and subsidies to induce private insurers.

And if you do try to rely on private insurers, the necessary system of regulation and subsidies will, inevitably, look a lot like Obamacare.

To protect people with pre-existing conditions, you must prevent insurers from discriminating based on medical history — which includes imposing minimum standards, so that they can’t offer cheap, minimalist plans that appeal only to the healthy while charging exorbitant premiums on plans that help those who really need care.

You also need to induce healthy people to sign up for coverage, which means providing financial incentives to do so — especially generous subsidies to working-class adults.

In other words, you need a system very similar to the one America has had since 2014, when the Affordable Care Act went fully into effect. That system can and should be made better, but this would require spending more, not less — which is, in fact, what Biden is proposing.

None of this is news. The G.O.P.’s inability to come up with a superior alternative to Obamacare was put on stark display in 2017, when Republicans came very close to enacting their own health care plan.

At the time, the Congressional Budget Office estimated that the legislation would cause 32 million Americans to lose health insurance — and even that number understated the likely damage, because those still buying insurance would have faced sharply higher premiums.

How does Ginsburg’s death affect the health care outlook? The Trump administration is backing a lawsuit, now before the Supreme Court, claiming that a fairly minor provision in the 2017 tax cut somehow rendered the whole Affordable Care Act unconstitutional. It’s a ludicrous argument — but Republican judges in lower courts have backed it anyway, and a court without Ginsburg is more likely to let partisanship override any pretense of respect for logic.

The odds that the court will destroy Obamacare, and with it protection for pre-existing conditions, will obviously go up if Trump is able to install a right-wing partisan to replace Ginsburg. And even if this particular attempt to take away health insurance from millions falls short, it’s a safe bet that a court with a 6-3 conservative majority will find some excuse to undermine the protections Americans have come to count on.


Indeed, such a court might well try to strike down Obamacare even if Trump loses.

So are Americans with pre-existing conditions doomed? Not if Democrats take the Senate as well as the White House. If they do that, they’ll be in a position to quickly reinstate an improved version of Obamacare soon after Biden is sworn in.

And yes, adding seats to the court will have to be on the table. Spare me talk about norms. Between Trump’s lawlessness and Mitch McConnell’s naked power plays, Republicans have forfeited any right to complain if Democrats legally act to protect the well-being of millions of Americans.

So once again, if you or someone you care about has a pre-existing condition, be aware that your fate is very much on the ballot this year.

Ninth Circuit Court Overturns Death Of Ruth Bader Ginsburg

SAN FRANCISCO, CA—In a landmark ruling, the Ninth Circuit Court of Appeals has overturned the death of Supreme Court Justice Ruth Bader Ginsburg. In a close decision, the judges on the court have ruled RBG's death unconstitutional and will block Trump from nominating a replacement.

Kim McLane Wardlaw, the judge who issued the ruling, said in a statement: "Justice Ginsburg's death was an affront to the constitution as well as our God-given right to abort as many babies as possible and sell their body parts for research. Death, at its core, is a construct designed to subvert the rule of law by taking pro-choice liberal judges away from us too soon. We cannot allow Ruth Bader Ginsburg's death to stand. By law, she will now be considered to be still alive."

Trump slammed the ruling as "idiotic" and called the court judges "a bunch of morons." Republicans pounced on this ruling like tigers that pounce on their prey before ruthlessly tearing it to pieces with their razor-sharp claws. "This is a terrible ruling because we're racist and we hate women," said a bunch of Republicans, according to anonymous sources.

Judge Wardlaw followed up on her ruling, saying: "We hereby rule any attempt by President Trump to appoint a replacement to be unconstitutional. We will block any attempt until we figure out a way to resurrect her or maybe clone her and restore her to her already 'legally alive' state. We're still figuring that part out."

Trafalgar Group polls: outliers with uncanny knack for accurately sampling Trump vote

Maverick pollster Robert Cahaly has honed techniques for finding Trump voters veiled by "social-desirability bias."


The Trafalgar Group, a Georgia-based polling firm known for its ability to correctly sample hard-to-reach, conservative Trump voters, shows President Trump with leads in the key battleground states of North Carolina, Florida and Michigan.

During the 2016 presidential race — widely predicted wrong by the mainstream polling establishment —the Trafalgar Group was the only pollster within the RealClearPolitics polling aggregator to show candidate Donald Trump defeating rival Hillary Clinton in Michigan. Their polls in 2016 also showed Donald Trump winning Pennsylvania — again, they were nearly alone in projecting Trump's narrow victory there — and thus taking the White House.

RealClearPolitics founder and president Tom Bevan recently praised the accuracy of Trafalgar's chief pollster Robert Cahaly's prognosticating abilities.

"Cahaly's success continued in 2018, most conspicuously in Florida," Bevan wrote. "He was one of the few pollsters whose data showed Ron DeSantis beating Andrew Gillum in the Florida gubernatorial race and Rick Scott besting incumbent Democrat Bill Nelson in the Senate race. Cahaly's firm, the Trafalgar Group, has emerged from the last two political cycles as one of the most accurate polling operations in America."

Cahaly last week posted a North Carolina poll showing Trump with a slight lead over Biden, though most other pollsters in the RCP average had Biden ahead:

Incumbent Sen. Susan Collins (R-Maine) is trailing her challenge, Maine House Speaker Sara Gideon (D), by 5 points, according to a new Boston Globe-Suffolk University poll.

The poll, released on Monday, found that 46 percent of likely Maine voters said they favored Gideon, while 41 percent said they same about Collins. Additionally, only 45 percent of respondents said they had a favorable view of Collins, while another 45 percent viewed her unfavorably. Gideon, on the other hand, had a favorable rating of 56 percent and a 37 percent unfavorable rating.

The survey comes as a number of polls show an uphill battle for Collins, who has served in the upper chamber for more than 20 years. She was easily reelected in 2014, scoring almost 70 percent of the vote in Maine.

This year, the RealClearPolitics polling average shows Gideon leading Collins by 6 points. The nonpartisan Cook Political Report rates the race as a toss-up. And on Monday, Sabato's Crystal Ball, the election handicapper at the University of Virginia's Center for Politics, shifted the race from from "toss-up" to "lean Democratic."

We have an impeached president who lost the popular vote and will lose the popular vote a second time in 2020. This will be the third time that has happened in the past six elections.

We have a House of Representatives districted and gerrymandered in such a way that even a large, 6-point victory by Democrats in the popular vote in November wouldn’t give them a majority of seats.

We have a Senate elected by a skewed, unusually white cross-section of America, where the median Senate seat is substantially more conservative than the median American voter.

We have a Supreme Court that is dismantling one party’s political economic base and helping preserve, even strengthen, the other party’s anti-majoritarian hold on power.

We have a political base in the GOP that has willingly fallen prey to outlandish conspiracy theory with full-on religious zealotry. Tribalism and a cult of personality has replaced any political platform. The GOP stands for “Owning the Libs” and little less.

(Reuters) - Some have likened People of Praise, a self-described charismatic Christian community, to the totalitarian, male-dominated society of Margaret Atwood’s novel “The Handmaid’s Tale.”

Others call it an ultraconservative group with an unusual mix of Roman Catholic and Pentecostal traditions.

In any case there has been renewed interest in the group since U.S. President Donald Trump put one of its purported members, Judge Amy Coney Barrett of the Seventh District Court of Appeals, on his short list of candidates for elevation to the Supreme Court.

The group has declined to confirm or deny whether Barrett was a member since a New York Times article in 2017 said she was in the group, citing unnamed current and former members.

The group’s spokesman declined initial requests from Reuters for comment and said Overall Coordinator Craig Lent was unavailable for an interview. The spokesman later agreed to take questions by email but did not immediately respond.

Barrett did not immediately respond on Tuesday to requests for comment made through a clerk at the Seventh Circuit.

People of Praise has about 1,700 members in 22 cities in the United States, Canada and the Caribbean, according to its website, and was founded in 1971 in South Bend, Indiana, also the home of the Catholic-led University of Notre Dame.

“We admire the first Christians who were led by the Holy Spirit to form a community,” the website says, tracing its origins to the late 1960s when students and faculty at Notre Dame experienced “a renewal of Christian enthusiasm and fervor, together with charismatic gifts such as speaking in tongues and physical healing.”

Its most devoted members make a lifelong commitment to the group, known as a covenant.

From 1970 until recently, women with leadership roles in the organization were called handmaids,
but the popularity of the 2017-to-present Hulu television series “The Handmaid’s Tale,” based on Atwood’s 1985 book, appears to have led to a change.

“Recognizing that the meaning of this term has shifted dramatically in our culture in recent years, we no longer use the term handmaid,” the group said after the 2018 media interest.

Coral Anika Theill, a former People of Praise member from decades ago, has described the group as an abusive cult in which women are completely obedient to men and independent thinkers are humiliated, interrogated, shamed and shunned.

Theill, who self-published a book about how her ex-husband dragged her through a number of religious groups, said she was campaigning to stop Barrett from being nominated.


Theill left People of Praise in 1984 but said she has remained in contact with others associated with the group, believing little had changed. Last year she wrote a blog post entitled “I lived the Handmaid’s Tale.”

“A lot of us suffered Stockholm syndrome and many of the women were on anti-depressants and tranquilizers,” Theill said. “If you were super submissive, maybe you wouldn’t be dragged in the middle of the night to an interrogation meeting.”

Thomas Csordas, a scholar of comparative religion at the University of California, San Diego, said he would not consider People of Praise a cult, instead saying it was “very conservative.”
